that we are accustomed to in the last two years. leadership put something on the floor of the house that they knew was going to fail and failed to the tune of dozens of republican lawmakers voting against their own leadership's bill that they negotiated only among themselves. the reason these funding deals have been negotiated in bipartisan in the past because most republicans, that same cluster of about 40 people who never vote for continuing government resolutions to basically just keep the lights on, they never vote for them. they need to reach out to democrats in they are going to have a deal f they are going to keep the lights on. the goal has always been do not shutdown the government but the chaos is the point for many members that don't like to vote for government funding deals but don't want their leadership to e tend a hand to democrats. what we just saw on the floor it failed, no one has now refer

today to the rules committee. i was talking to congressman chip roy, one of those no vote republicans, there was an open question about if they were going to try a different method to try the whole deal again and most likely see it fail there. it is not clear that is the next move. and so they really are left sort of throwing their hands up. i do think on the musk-of it all there is a lesson to be told. not just my gosh it is going to be chaotic it is also that leadership needs to take the cue n. this case it was the speaker who got slimmed but on the other side of the building it is senator thuid who watched the way republicans negotiated, they thought they had a plan and then donald trump came in from the wings and utterly tanked it on his own team. so, yes, there say musk factor here, but this only really fell apart here when trump came in over the top and said i want to

january 6th ceremonial meeting. >> reporter: that is correct. congress has to certify the election. the only way to certify an e selection to have a speaker that is gaveling us as a congress. trump also knows he needs to ensure the speaker is in place so elections can be certified and he can be inaugurated on inauguration day. that can turn into a mess if they don't figure it out. but want to go back to one other thing that you said. why does musk want congress not to do anything? a government shutdown for musk means he can then focus on insuring that debt ceiling is all he cares about is not in place, he can continue to make money and wealth from middle class and working class people, give it to himself and his companies, and at the same time he can care less about the millions of americans impacted by government shutdown.

i think people need to understand a government shutdown actually means our tsa agents at the airports, folks that are in air traffic control at our airports as l millions of people are not going to get paid during the holidays. what republicans want is to ensure working class people don't get a paycheck and transfer their wealth to musk. that is what it is all about >> that was going to be my next question. go through some of the other things. last time we had a shutdown for a few days, national parks closing, all of the museums get closed. security guards don't get paid. people that clean the capitol. we are talking about low wedge federal workers going without during the christmas holidays. >> reporter: that is right. that is what is the most cruel about this salute moment. while elon musk is arguing and advocating for a complete shutdown he can care less about all of those tsa agents, folks cleaning our buildings.

threats. deploys a lot of trump's tactics. the thing is, he bought twitter to do it. he has a larger platform, a deeper wallet. when he says he will pay for you to be primary he can back it up. same as 2024. >> and trump can't. trump has long talked -- he lived under stronger men. if it is his father or if it is roy cohen. or putin who, you know, his son claims helped bail them out when he went $900 million debt. he got the money from some strong person and now it is musk. he can bankroll and write checks. trump can't. what elon musk wants is clear and what the other billionaires want is clear. the trump tax cuts. the corporate rate went to 14% as high as 39% depending on taxable income to a flat 21% that was in 2017. if you now extend that the trump 2025 tax cuts would increase taxes on anyone making

interact with one another. how might we expect donald trump now that he has got this oligarch on his back, essentially, musk, how do we expect him to operate to still project power domestically and not lose face? >> reporter: that is a great question. we are now passed the reality show. that is the election and into something that is more like reality that will be trump's next time in office. in reality trump does not have money and musk does. in reality, trump can issue threats and musk can enforce them. in reality, musk is the person to whom trump owes debts. it will be clearer as time goes on. so, i think we are in a moment where trump's prestige but the nature of what the precedency is really in question.. >> it is interesting, it reminds me of what ukraine was, right, before it was liberated in its present form. it was a dutchy of the kremlin. it was a separate country technically but answered to another country.

despite the scrutiny over her romantic relationship with a special prosecutor on the case. the appellate court said the lower court decision did not prevent the appearance of improprity. if willis is not able to win her appeal the case would have to be reassigned to a different county prosecutor which may prove difficult given the complicated political and novel nature of the case. joining me now is trial attorney and host of the katie fang show. let me put up a list of those indicted. there, some pled guilty already. but, is it possible that the case could go forward with just fani willis on case. why would her whole office have to be removed? >> well, i mean, this decision was just bad and wrong on the law and i want to make sure it is clear it is a 2-1 decision, joy, i invite everyone to read it because it lays out the law

in this case. fani willis'office, the entirety was disqualified. she, being willis, can not proceed in the case. it gets kicked back to a prosecuting association with somebody can decide whether or not if a, if the case gets prosecuted at all, and b, if it goes to another prosecutor. joy, this decision was a hammer in search of a nail. it is an outcomed determined thing. the reason why it is outrageous is as happens with the trump first term now about to be second trump and everything trump adjacent the law does not mean anything. this is wrongish. the reason why is the descent makes it clear. the judge after 2-1/2 days we all lived that hearing for 2- 1/2 days. judge made it clear there was no actual conflict of interest. so, in georgia the law says no

conflict of interest you do not disqualify or up to the trial judge that is why it is so important. as lawyers when we do evidentiary hearing you do it in front of a trial judge who gets to be the finder of fact, the person who applies the law. he sat there, watched them, listened to the testimony, determined their credibility. now these two judges that sit on an appellate court think they do a better job. it is absurd and i am grateful for the descent but look, the descent was just in the minor in this incidence >> do we know if the judges are trump appointees? >> reporter: you know, they -- all three of them are republicans thank god one of them knew what justice looks like. there are 9 justices on the georgia supreme court, so, willis filed immediately a petition for rite of cert. it is discretionary, though, so you got to have them agree to take it. like the supreme court of the

term, as stupid and ridiculous as it sounds that would be the right thing to do. if trump makes it to the end of the four year term who knows, that would be the right thing to do. or, i am not going to sentence him until after it. you can blame the supreme court. any of the immunity nonsentence created legal obstacles. but, he is the only who how has given the other side, as in trump side, the opportunity to make arguments. he considered them and he rejected them so far and he also said that, you know, nonofficial conduct does not give you presidential immunity. let's be practical, joy, why do we manage expectations. the criminal case was going to go on the back burner during his term, so it was not like he
