democrats question out loud, who is the real incoming president, trump or the richest man in the world? luigi mangione in a brooklyn jail this morning. and later, first amazon and now starbucks. baristas join teamsters on the picket line. what it means with christmas days away? good friday morning. it's a busy friday morning at 10:00 eastern, 7:00 a.m. pacific. i'm ana cabrera reporting from new york. we begin with capitol hill this morning. house speaker mike johnson says republicans have a new plan to pass a spending package today. >> we're expecting to vote this morning. we have a plan. >> you reached an agreement?

>> we'll see. >> it didn't have to come down to the wire. spending package number one was unveiled earlier this week. it never saw a vote after elon musk and donald trump took to social media to rail against the bill. yesterday, spending package number two got the backing of trump and musk but three dozen republicans voted against it. lawmakers have 14 hours to cobble together a bill that will win over house republicans, senate democrats, president-elect trump, president biden and for some reason elon musk. ali vitali joins us from capitol hill. what do we know? >> reporter: you likened it to the nightmare before christmas. happens to be my favorite movie. at the end of that movie they pull off christmas, but maybe there's a little bit of that

energy. right now they need it. the speaker is saying we'll see, maybe we have a plan. in the last hour or so as our team has been standing outside the speaker's office, the members seem to disagree whether or not they're at a fully baked plan that's ready to be voted on or if they need time to haggle and put it together. that's the open question. they can't move on to the floor. they don't have anything to vote on yet. that's where the speaker stands. there's an unclear picture of what the other options could be. we know that plan b was a paired down version of plan a. you just ticked through the differences. plan c, it's unclear that gop leadership has the ability to take things out like the debt ceiling negotiation which is a sticking point for democrats, but it's also the thing that trump and musk very much want in the plan. it's not clear they have the flexibility to do that. >> president-elect trump s been posting all over social

media. it sounded like he's calling for a shutdown. will republicans give him what he wants? >> reporter: we can read a little bit of the statement, if there's going to be a shutdown of the government let it be under the biden administration under, quote, unquote, trump. this is a biden problem to solve, but if republicans can help solve it, they will. the reality is republicans and democrats came to the table in good faith. negotiated that plan a package and then musk with the help of trump tanked the deal. that's why they're back at the drawing board in this 11th hour position where it looks like the government is going to shut down. that's not the posture that lawmakers want to be in. when you throw in other things like the debt ceiling in addition to government funding and disaster funding, you're starting to trip wires that exist within the house republican conference and many of these folks are aye vowed to

their fiscal responsibility. they're not going to abandon them because of trump. that's what we saw in the 38 republican no votes yesterday. just because trump blessed it doesn't mean everyone is going along. >> ali vitali, keep us posted. joining us now chair of the professional congressional congress of washington. congresswoman, thank you for taking the time with us. we heard the speaker say there will be a vote this morning. what are you hearing? what are your expectations? >> i don't know how they get out of the pickle they're in because they're listening to two outside puppeteers when mike johnson knows damn well that what he needs to do is craft a package, as he did with democrats, because he can't get anything through his very fractured republican conference, even though they're in the majority. it was an embarrassing vote for

him, for trump, for the gop yesterday. to be in the majority and not even be able to get a majority of votes on the floor when we had a negotiated agreement that had the speaker put it on the floor it would have passed with republican and democratic votes today and the government would not be shutting down. this is squarely on the republicans and they have to figure out a way. >> you're heading into a democratic caucus meeting this morning. what's the goal of that meeting? >> we want to discuss with our leader hakeem jeffries who has been strong in saying, hell, no, you can't negotiate a deal with us, walk away and say we need your votes but we're not going to give you anything. that's not the way this place works. not to mention as ali vitali said we have a democratic senate and white house.

mike johnson to his credit recognized that, but he's bending to the will of the puppeteers elon musk and donald trump. trump has to think about the chaos he's sending the country into and the republican conference into if we're not able to do the work we need to do to get him into office, what the republicans have to do to get him into office as the next president with decent ratings. the american people will suffer with a shut down. it never goes well for the party that initiates it. that's clearly the republicans. >> everybody loses with a shut down. after plan b failed last night, j.d. vance came out, elon musk was on social media again, steve scalise, prominent republicans said a shutdown will be your party's vote because all democrats voted against the bill.

what's your response? >> i tweeted back at elon musk and said let me explain to you how government works. you're the majority party. if you can deliver the votes, you can put any damn bill through you want. if you want our votes, you have to negotiate. that's what the negotiated bill was. they can try to blame us, but we have a negotiated bill that if today they put it on the floor we would vote for it and pass it. it's clearly a republican shut down. they know it, ana, that's why they're trying to frame it as a democratic issue. all americans understand when their social security checks disappear, when they have delays at the airports because the faa isn't able to work, when they can't get their paychecks because all the federal workforce is furloughed, they'll blame mike johnson, the republicans, elon musk, donald trump. they're trying to frame it, but

it's not going to work. >> "politico" reports when yesterday's bill was rerevealed leader jeffries said i'm not a no, i'm a hell no. if a bill emerges today, if it's not a totality of bill a, the bill that was negotiated, what would have to be in this now plan c in order to soften the hell no stance? >> well, we're going to go into caucus and discuss what the options are. again, i would say the things that -- there were two problems with the bill yesterday. one was the debt ceiling. the other was the things that were taken out, things that lower prices of drugs for americans across this country, community health centers that provide health care to people, cancer care for children. i mean, these were the things that the republicans took out

that democrats have negotiated to put in the bill in exchange for our votes. so it's very difficult to imagine why republicans would want to be on the record saying we took out all these things that would lower prices and help struggling americans across the country. after all, they ran on being able to lower prices. now donald trump is saying, i don't even know if i can lower prices for you. they'll raise prices by taking these things out of there. let's see what they come up with. it's hard to talk about a hypothetical. we had a negotiated deal and they blew it up because of a tweet from a billionaire saying, i don't like this. >> you just said it. sounded like you took issue with the debt ceiling piece part of the new deal. last year you were in support of eliminating the debt ceiling. you no longer support that? >> well, what i've always said the debt ceiling should be

reformed. we have a number of reforms for it. what you don't do -- listen, it was never a negotiating tactic until republicans made it a negotiating tactic. if you remember going back six, eight years, it was something republicans and democrats did together, raise the debt ceiling. it wasn't a problem. republicans now have turned it into a negotiating tactic. if you're going to make it a negotiating tactic, we have to negotiate it. it will come up next spring. it can't be thrown into a budget deal to keep the government open at the 11th hour. if you want to talk about that, that's going to be down the line, but you can't throw it in now. >> congresswoman, thank you for taking the time. let's bring in david jolly of florida and max rose of new york. congressman jolly, what's your reaction as you're observing

everything that's playing out in your old stomping grounds? >> i don't know if it's the evil christmas or groundhog day. you see this with republican politics. there's a lot of dynamics to keep in mind. donald trump presided over the longest government shutdown in u.s. history. he's not scared of that. it was 35 days in 2018 and 2019. he's not worried about a government shutdown. his tell was that he wants the debt ceiling lifted through 2029. this is a president who during his first term added 25% of our entire national debt in the first term of donald trump. he wants the freedom to bust through the debt caps when he's president. that's the dynamics informing this decision. he doesn't care about a shutdown. he wants to spend freely and explode the debt. the other dynamic, the only way the government stays open is for mike johnson to work with democrats.

we've seen that three times on ukraine funding, on another government shutdown and raising the debt ceiling. it was the republican speaker working with hakeem jeffries and democrats. he doesn't have the votes to pass something through the house that senate democrats will approve. here's the nuclear problem. mike johnson is standing for re-election as speaker on january 3rd. this is really important. mike johnson might decide to save his speakership he shuts down the government as well through january 3rd. he gets re-elected as speaker because republicans see him as having a backbone and spine and negotiates how to re-open the government. if he fixes this with hakeem jeffries now, he's likely not speaker in the next congress. the only vote that confirms him is the internal republican congress. if he strikes a deal with hakeem jeffries, he possibly loses the

speakership january 3rd. >> you pointed out there are internal and personal motivations for different key plays in this. of course, it's the american people whose lives are hanging in the balance. >> that's true. >> something like somebody's job ambitions. congressman rose, democrats have power in the senate, they have the white house. trump isn't in office. what is the democrats' best move in this moment? >> congress is largely built on trust and relationships. with the republican party and the republican leadership have completely broken those relationships. they earned every right to take a step back and say if those negotiations meant nothing, you solve this yourself. what is shocking is that the republican party is patently ununified.

13 republicans just voiced their opposition to the incoming president-elect donald trump. those are representative of the republican base. are they now treating donald trump like a lame duck president or do they care about something? irrespective of what the answer to that is they're not unified and are incapable of addressing this themselves. >> trump said the pressure is on whoever is currently president. is he wrong? >> he should shut up then. he should shut up. if this is not his issue, if this is not representative of his agenda, don't talk until january 20th. the second he got involved this entire thing got wrecked. now he realizes, shocker, that causing a government shutdown during peak holiday season is not good politics so he's trying to step away from it. the number one person that he should be unifying his message

with is elon musk. that's the person who started this, along with vivek ramaswamy, and, you know, he's the one that empowered them. this is his problem. >> speaking of musk, just a couple days ago mike johnson was bragging about being on a text chain with elon musk. now you have major republicans who are actually calling for musk to replace johnson as speaker. what does that tell you about the gop sentiment toward speaker johnson? >> republicans are in disarray. speaker johnson got the job because nobody else wanted it. that's a problem they face if they get rid of johnson. who could follow him? with elon musk there's an asymmetry between money and policy. you're also seeing raw ignorance prevail. they thought that because november happened all of a

sudden the numbers in the house and senate changed. the math is the same as it was the day before the election until january 20th. the interesting thing here will come down to there is a bill that will pass. mike johnson leaked it out this morning. it includes keeping the government open through march, a farm bill extension for one year and disaster relief for the hurricanes. not all the things democrats wanted, but democratic support. the votes you lose there are republicans. the republicans don't lose that. we're right back there. the outside influence of elon musk is real. it dictates a lot for the next four years, dictates injuries to our democracy. >> if there isn't a total combustion that happens between musk and trump. >> right. hakeem jeffries has decisions to make, but mike johnson does. if mike johnson wants to keep the speakership, he has to shut

essentially encouraging republicans to read every word of whatever bill is put on the table. the reaction from the president-elect has been a spin on these events. he posted on truth social this morning, quote, if there's going to be a shutdown of government, let it begin now under the biden administration. this is a biden problem to solve. if republicans can help solve it, they will. ana, what's making this job more difficult for republicans is what the president-elect called for in another post on truth social, calling for the debt ceiling to be extended through his presidency or eliminated altogether and that is an idea that's very popular among democrats, but that is opposed by republicans. the big question now is what role the president-elect has incoming to a solution. it's unlikely he'll head to capitol hill as we see j.d. vance meet with lawmakers. you can be sure he's working the

phones behind the scenes trying to twist arms of republicans and get to an agreement. >> allie raffa, thank you. annie, you write in "the new york times" that house republicans are deeply frustrated by mr. musk's involvement in spending negotiations and are concerned about his threat to find primary challenges to take on lawmakers who vote for a spending bill he doesn't like. can you tell us more about the republican frustration with musk? >> yeah, there was really palpable frustration on the floor on thursday. some of these lawmakers saying last time i checked elon musk doesn't have a voting card. this is our job. we vote. he doesn't. they're taking seriously the threat of being primaried. the hard right members like marjorie taylor greene are loving this and floating the idea he could be the next speaker of the house. more moderate members feel the

pressure, don't like it and don't appreciate him getting involved. they are worried about people that represent rural areas worried about subsidies for farmers he just killed. they don't really have any relationship with him. vivek ramaswamy is the one that has been more actually communicating with lawmakers directly. these congress people are just looking at their x accounts and looking at his twitter feed. that's all they have. they don't -- he doesn't pick up the phone and talk to them. they feel very uncomfortable. they said they've never seen a donor play such a public role trying to influence policy directly after an election that he thinks he won. we're seeing to the point the clips you played of democrats trying to message this is president musk. that's a clear attempt to get --

to start a rift between trump and musk. so far our reporting shows that isn't happening yet. trump has not yet tired of him. >> tell me more about that because, as you know, everybody knows, it's no secret, trump isn't known to share the spotlight. he seems to be giving musk a wide berth. i thought what was interesting in your piece is the dynamics revealed in terms of what's happening be hind the scenes an their relationship. can you share more about that and how that bond is strong or not? >> yeah, i think that -- you know, the conventional wisdom is that trump doesn't like to be overshadowed. if you're an aid or adviser who claims too much power, that will backfire on you. we saw that happen with steve bannon in the first administration. elon musk is the richest man in the world. that goes a long way with trump who equates money with smarts and money with power.

so he's got a longer leash just for the fact that he's so rich and so much richer than trump. that gives him standing in trump's eyes. so far he's still inviting him to meals at mar-a-lago. he was not -- our reporting shows that he kind of was -- wanted musk to be tweeting the way he was. there was no issue there that musk creating a problem he didn't want there. i mean, it's still early. trump actually -- the trump administration hasn't started yet. a rift could happen, but we don't have signs it's happening. >> so interesting. you men shund tioned the meals mar-a-lago and i caught your reporting that musk dropped in on trump's meeting with jeff bezos. annie, thank you so much. let's go back to capitol hill. congresswoman barbara lee of

california is joining us. thanks for taking the time. are you aware of any upcoming votes or plans to stave off a shutdown? >> not at this point. let me tell you, ana, we had a bipartisan agreement. the public wants to see us work in a bipartisan way. they don't want to see a nonelected billionaire serving as president and president-elect or a vice president. this is outrageous. wreaking havoc on the public that will happen if, in fact, we shut down. democrats are working very hard to make sure the government stays open. people will be furloughed. services will be cut. there are huge impacts on people who live paycheck to paycheck, services they rely on. there's no way that elon musk should be directing the republicans and then threatening them to primary them if they vote a different way than what he's ordered. this is dangerous for our

democracy also. >> let's listen to what republican congresswoman ana paulina luna had to say about the deal making process. >> we're very close to a deal. we'll be negotiating here. there will be no deals with the democrats. to lie to the american people and pretend otherwise is not going to happen. i wanted to update you. we're not cutting deals with democrats. i don't believe the government will be shutting down. you'll see great stuff similar to president trump's plan. >> what's your response to that saying they're not cutting deals with democrats? >> i believe that's what elon musk wants and also i assume donald trump has co-signed that. democrats negotiated a bipartisan deal. what they care about is making sure their tax breaks for billionaires rather than cancer research for children and they don't care if the government shuts down. the public wants to see us

working in a bipartisan way. we've done that. i'm telling you elon musk, a billionaire, nonelected running the republican party is a danger and it's a danger to the american people. so who knows where this goes, but you heard her say they don't have any interest in negotiating with democrats, even though we have been doing this day and night. i don't know where the speaker takes this, but i can tell you one thing, elon musk is running the show. >> how did democrats get back to the bargaining table then? >> we've been talking about that. we've been asking. i'm asking here on your show, please get back to the bargaining table. speaker johnson, i know that our leader hakeem jeffries has been waiting and has been negotiating with us to talk about a path forward. we know exactly where we stand in terms of wanting a bipartisan deal. we had one. there was an agreement. so we're waiting, ready, willing

miles from here. he was handed new federal charges including murder that could result in the death penalty if that's convicted. this morning luigi mangione is back in new york city to face charges, landing in manhattan on an nypd helicopter thursday after being extradited from pennsylvania where he was arrested. the 26-year-old accused of murdering unitedhealthcare ceo brian thompson was handcuffed, shackled and escorted by heavily armed law enforcement. >> our warrant sent a clear and loud message that this act of terrorism is something that will not be tolerated in this city. >> reporter: mangione hit with four new federal charges including stalking and a murder charge that could carry the death penalty, on top of 11 state criminal charges in new york including murder in the first degree in the furtherance of terrorism. the complaint revealing new details in the investigation, saying mangione allegedly

undertook extensive efforts to identify, place under surveillance and track the victim. according to the prosecutors, on least one occasion prior to the murder the shooter was using a cell phone. it does not specify who he may have been talking to. the documents detail what was inside the notebook authorities say was recovered during mangione's arrest at a pennsylvania mcdonald's. according to the complaint, mangione in an entry dated, he wrote, the details are coming together, the target is insurance because it checks every box. mangione was taken into custody by new york law enforcement, driven to the airport where a plane was waiting. ultimately a helicopter bringing him to lower manhattan and his first appearance before a

federal judge. he's not entered a plea in either the state or federal case. >> we're going to respectfully decline to make any comment at this time. >> reporter: mangione will be detained until his next hearing in january. a a senior official telling nbc news he's behind bars in brooklyn where sean diddy combs is awaiting trial. back to you. joining us now a former federal prosecutor and former defense attorney who worked for the manhattan d.a.'s office. jeremy you feel strongly about two counts of stalking, use of a firearm, a separate firearms offense. what do you make of it? >> there's a term bigfooting and there's a turf war here, this whole charade of this perp walk was notorious of making a scene of something that didn't need to

be. the bottom line is you don't see the southern district for the most part grabbing people who commit interstate crimes and having the mayor come out and all this happen. let's deal with it in the state system. it's a murder two case. that's how it should proceed. >> do you agree? why do you think the federal prosecutors piled on charges? >> one thing that the federal prosecutors and the state prosecutors and luigi mangione all agree on is that this case is about more than just a murder. mangione has this concept, you know, health care, he has this admission. frankly the southern district agrees and that's why they're charging here. the life this case has taken on has brought federal interest because it's garnered so much interest and they're trying to send a message. i don't think the federal case will go forward. the state case will proceed first. i think he'll be convicted and

the federal case won't see the light of day. it sends a message that the federal system takes it seriously. >> mangione's lawyer claimed the federal and state theories are different. in fact, they y conflict with each other. she said the manhattan case talks about material, while the federal case is stalking and individual. how do prosecutors get around that and is that a preview of the defense? >> you can't have two different theories of your case. you can be stalking an individual while having this larger terroristic message. again, we can agree to disagree on that, but it seems to me a lot of the things he was doing, mangione, was internal. he vocalized some of it. you have his writings and what he said online.

they may be a little bit in conflict, but one may never proceed. it just may be a state case. >> speaking of those writings we have heard from the federal complaint specifically that it contains several pages in a notebook, expressing hostility towards the health insurance industry and wealthy executives. there was that august 15th entry that the details are finally coming together he allegedly writes. the target is insurance because it checks every box. another entry, one and a half months. this investor conference is a wind fall. how damning is that evidence? >> incredibly damning. this case in some ways is an open and shut case. what's interesting about the federal complaint, the stalking charge is not that common and, i

as thousands of workers forego assembly lines for the picket lines. shipping experts warn the walk-offs could cause delays for packages. troubles also brewing for your beloved cup of coffee. starbucks workers announce plans to strike. priya sridhar is at a picket line in georgia. what do we need to know? >> reporter: the teamsters are saying that thousands of amazon workers are walking off the job to the picket lines like the ones you're seeing behind me. amazon is saying these people aren't direct employees, they're third-party contractors and it's not impacting operations. from new york to georgia and california to illinois, teamster workers say drivers for amazon have walked off the job, demanding better pay and working conditions.
