right now. so, we got a bombshell today during what is usually one of the quietest weeks in washington all year. the committee released the final report on matt gaetz and the break out maga star that trump wanted as his attorney general. we knew from multiple reports he paid women for sex. we knew that one of those women was alleged to have been underage and we knew gaetz did not face federal charges for his conduct. but the committee's findings in the 42-page report was eye popping. asserted that he did likely break the law. overall they concluded there was evidence that representative gaetz violated house rules, state federal laws and other standards of conduct prohibits prostitution, rape,

and accepting of world gifts and privileges and obstruction of congress. this is part of it. and gaetz creepy conduct. it says quote from 2017-2020 he made lots of payments to women. according to the investigators he paid 12 women, almost $100,000 during that time frame. among those women was victim a, a minor. at the time of her encounter with gaetz in 2017 had just completed her junior year of high school. let that sit with you for just a second. >> the testimony for the committee she recalls received money. >> he denied engaging with sexual encounter with minor but he refused to answer questions

relating to the interactions with victim a. in the end, the committee was, not at all ambiguous about it at all. the way he pressured the women into sex. as the committee writes he took advantage of the economic vulnerability of women to lure them into sexual activity for which they received an average of a few hundred after each encounter and saying one woman felt that the use of drugs at the parties and events they attended may of impaired their ability to really know what was going on or fully consent. one woman said, quote, he would make me feel bad about not having sex with him. another said the relationship changed over time and came to feel like a task. another said, when i look back i feel violated. a lot of news in this report, a

lot of disturbing details. here is the thing. it really confirms with more details what we long suspected. given the abundance of reporting. and yet through all of this over the last few years, all of the reporting, all of the details, gaetz only become more of a fixture in the maga world somehow. trump nominated him to be the top law enforcement official in the country. the rights most prominent billionaire maker, elon musk endorsed gaetz for attorney general as our hammer was justice. and called the accusations against him worth less than nothing. even after his resignation from congress he was rewarded with a platform on the right wing cable news network. oam. he spoke for turning point usa, news of running for rubio's open senate seat. that is in the future. just a few hours after he spoke on that stage trump spoke about

him in glowing terms. >> a friend of mine who i have not seen in a little while, matt gaetz is here. where is matt, he is around here some place. matt gaetz. he has a big career set up. >> that guy, i just described in that report, that is trump, yesterday, calling him a friend of mine. saying he has a big career set up. and here is prominent maga mouthpiece steve bannon. >> take the ethic's report and shove it up your ass. that is what i think. gaetz must return, like trump returned. don't back down. double down. >> double down. i don't even know literally what he means in this context which is disturbing. but, i mean in normal times here is the thing. lesser scandals were career enders. driving politicians out of public life with a cloud of

shame hanging over their heads, they would have to return donations, just google mark foley and learn more. there is no note from republicans, so, trump's party clearly lives by what seems to be a different standard. a lower one. it is clear, at least for now. that somehow matt gaetz still represents the future of that party. joining me now is mrs. crockett and katie fang. she is a long time attorney and prosecutor in the state of florida. thank you both for being here on christmas eve eve and hanukkah eve eve as well. a lot of what is in this report is not necessarily a surprise, you know, the premise of what he did. there are new details, gulling details, disturbing details and many has the receipts, so to

speak. my question is, you know the florida legal system better than almost anyone what do you think may be jumping out to the state prosecutor and what is next that you are watching for here? >> reporter: are the concern that i have is the statue of limitation that would apply for any crime. my frustration, the genesis of it is, how much information share was happening behind-the- scenes between the department of justice and the state of florida. as we know, the known associate of matt gaetz who is serving 11 years in prison right now for his own offenses. you know, greenberg provided cooperation as a part of his plea agreement to law enforcement. so, i would hazard to say and i want to manage people's expectations, jen, if there was evidence that was provided by greenberg that corroborated

that way. law enforcement received it. there is nothing new. we keep emphasizing the size of the report. i keep showing this on the air because i want people to understand this is not just 42 pages of a report. there is actual documentation and evidence that was considered by this ethic's committee. i think that law enforcement -- i don't know if they were asleep at the switch. i think there was more than enough probable cause for a number of state felonies that were violated by matt gaetz. i am stunned that there is not more activity by law enforcement. i would footnote that they did not find the federal trafficking offenses committed by matt gaetz when he went to the bahamas and flying young girls over to see him allegedly, right, in the state of new york. i have a concern that the department of justice did not cooperate with the house ethic's committee when it was conducting this investigation and did not provide some of the evidence that it could have

done so. i understand internal policies for doj is not to turn over evidence if they don't charge someone with a crime. i feel like a folsom investigation should have been and hopefully was done but when you look at all of this, jen, you are left with more than a sour taste in your mouth. >> yeah. this is, this is a horrifying report to read. i don't know how else to describe it. this is why i asked you the question, katie. when you hear the conclusion that he did violate laws it feels like oh, what will happen next? and that is why talking to a lawyer like yourself it is helpful to set expectations. let me ask you congresswoman, part of it was he delayed the process by not participating, of course, by declining to even respond to the subpoena. i mean i want to ask you first if you share katie's frustration. i watched her talk about on the last hour with the department of justice and other authorities that did not act or information share when they could. and congress, democrats could

be back in control in two years. is this a case where you think there could be something done if democrats regain control. that is a two parter, i guess. >> yeah, so i am with her in the frustration. you know, one of the things typically happens like statutory rain there is a longer statue of limitations. when you start to talk about statutory you are talking about children. usually most state legislature afford children an opportunity to grow up and really, then, talk about it especially since a lot of time perpetrators are close to them. i would imagine that florida still has time. i don't know as it relates to the doj. trump's doj is coming in. the same doj he wanted platte gaetz to sit and reign over. definitely not optimistic that anything would have enough on the federal level. i think that this was a matter in which the public should be enlighted on if he was in

congress or not. i know there are a lot of people talking about setting a terrible precedence. i think when you decide something rises to the level of literally statutory rape, that is the most egregious thing. i do. especially with someone who is out there that absolutely could get, say, another appoint. in this administration that does not require the consent of the senate or someone who is out there saying they are going to run for u.s. sin at. whether or not the general public in florida decides to elect him at least we know they have the information. they are okay with the sexual abuser ascending to the precedency. who knows? i really agree with what you said in your opening. it seems like there is no low for maga. they will go out and they will be offended if you are a person of color and talking about race. you are race baiting or whatever the case may say.

they can say lock uphillary clinton because they are talking about a server she used and the conversations about trump and the server they are using as it relates to his transition back in power. it is amazing they want to make up laws to lock up anyone who does not see the world through the orange-flavored glasses that they do. i just think that america really needs to have a reckoning and decide. are we going to be a country that is okay with the lack of morality? okay with the lack of family values? okay with the lawlessness or are we not? there is no middle ground. we are or we aren't. >> orange-flavored glasses. you come with the best ringers. that is -- i like it. let me ask you, katie. you are a lawyer but politically savvy person. he floated that he may run for rubio's seat. i don't know go it is a real thing or not. is there anything in florida law? anything that prevents someone like him from becoming the next

senator from florida? i don't think there is but i wanted to ask you the question? >> reporter: the answer is no. he is not a convicted felon, right? he is able to run for office. he being platte gaetz. speaking on sane floridians we don't want him, there is no such thing as a shame spiral for matt gaetz. there is nowhere left to go. i appreciate representative crocketts point, the offenses from drug offenses not just marijuana it is cocaine and ecstasy that is alleged but then you also have the statutory rape offense which i think when you look at the facts that are set forth in this report it is just profoundly revolting to think that matt gaetz is trying to say he did not know she was 17. oh, no, six months later when

she was not 17 any more. he had sex with her again and he paid her. the problem that peels away from all of this is whatever office he tries to hold in whatever capacity, he was accused of -- it is established in this report that he exploited an imbalance of power and i talked about that the last hour. it bothers me so much. they feared retaliation, jen. they feared something would happen to them. they would be retraumatized. that is something that should not be reflective in a politician that we have regardless of party >> no, one of them just finished her junior year in high school. representative crockett, katie fang thank you for joining me. i appreciate it. >> we have a quick break. we have much more to get to around the investigation into matt gaetz and many other things. it is all happening ahead of the vote for house speaker.

himself on pretty shaky ground. ahead of another vote for speaker in just 11 days. a former senior advisory to house speaker baner and carney, a -- sorry about your last name. they both join me now. i want to get into the house speaker race because i am so interested in this and it is soon. i want to ask you, matt gaetz floated the idea for running for rubios seat. is it a real thing? could it happen? i know you are not all of the spokesperson for the republican. >> i don't know you can not rule out he will not get re- elected. all of it was hanging out there and he was re-elected in his district by, was not even close. republicans in this era embraced the idea you are always a victim, always someone out to get you and easy to point the finger to someone else. >> you give him a couple years and you let it blow by. it would be -- short sided to

assume that his career is over with >> it is insane to say. >> it is crazy to say. >> yes. i don't know if you can say this these days. could it be as soon as rubio's seat? assuming he gets confirmed to the secretary of state position in a couple of months? >> i doubt he will be named the replacement. >> he will be named, he can run. >> challenge whoever the sitting person is. i would not put it passed him for trying. >> he said he always wanted to be florida governor. it would seem like it would make him dead in the water but truly this, the released report gave us a lot of details. the brood outlines, mccarthy gave them to us last spring and he was still nominated to be attorney general in the trump administration so . >> yes. >> i mean we have known the brood strokes of the allegations against him. just because d.o.j. did not bring charges does not mean he was exonerated. so, he has not, it is not good.

i don't think he will rise quickly now. but not ruling him out. >> right. >> and he could run in a couple of year that is the crazy thing. okay, let's talk about the house speaker race. that was not mike johnson's best week of his life, i assume. i talked to leader jeffries about this. he thinks he is in a bit of trouble what do you think? >> hard not to. probably not going to get it on the first round when you saw it two years ago when mccarthy did it. some ways it is of his own making. he botched the end of the year. his idea was i want to do something noncontroversial. three-month bill, it is easy before my vote. for whatever reason he had to open up the store and add things to it and it fell apart. the problem for mike johnson, the same problem for the next speaker. it is not about the speaker. he has a bunch of numbers that

refuse to accept anything achievable. anything that is they will not accept. as long as that is the problem he said it himself, good luck to who can get 218. it is not the speakers it is the numbers. sounds like enough people can if not kick him out get something for it. >> same thing? >> always the problem. >> there are republican members that control his fate. that do not vote for spending bills. therefore he has to go to democrats to pass anything. and therefore he has to make compromises and you end up with the kind of bill that is just to everybody in his party and that is how you end up here. this is the same thing that mccarthy did. having to dance between appeasing the hard right, going to democrats to get votes for must-pass legislation and it is impossible position for any speaker. i talked to johnson people earlier tonight and they, the best kind of version of his position they could come up with is that only one

republican member said i will not vote for mike johnson. i will not call out his name. that is tomas macy. so far only one is on the record saying i am not there. he can not lose more than two, i think, the math is bad for him and a lot of other ones waffling but they, they are taking it as a positive, despite everything one member is on record saying i will not vote for johnson. >> there has to be an alternative. >> not necessarily. >> they can put him through pain >> and not many that said they would vote against him. that was surprise how big the number got. this is not theoretical any more. we saw it two years ago. they run this play before. >> that is the other thing. i remember how many stories i wrote once in a century floor fight two years ago >> no more can you write that. >> now it is normal floor fight for speaker? i mean it seems like the idea that he would get it on the

. so, we still have almost a month before trump is sworn in. the republican meltdown over funding the government last week had a lot of democrats asking a good question, "who is really in charge here?" it seemed like most republicans were focused on pleasing musk as he cheered for a government shutdown. and that had many democrats calling him, well, i think you can take a guess. >> welcome to the elon musk

there is that. so, now, of course, a lot of speculation about when this relationship might implode. as it happens so many times over the years with trump's generals and his best people, all feels inevitable, right? the thing is, it will not be the same, though, as trump casting aside tillerson. musk is the richest man in the world. he owns a platform where he has 200 million followers. we saw the power that he wielded over the republican party. he has billions of dollars in government contracts. relying on spacex rockets to get astronauts to space and back. not an easy relationship to untangle. that is my point. so, yes, the break up could happen. if it does and it may take longer than we suspect, i think if it does it am be very, very messy. congressman jim himes joins me next very messy. congressman jim himes joins me next oh... stuffed up again? so congested!

the republican caucus. joining me now to talk about that and other things happening is jim himes. the ranking member of the house committee. i wanted to start off by asking you, elon musk threw the house in a tail spin. we all watched, as you watched being there. he has been called, clearly power over the republican caucus. he has got the ear of the president-elect of the united states. he also got a lot of government contracts. how concerned are you about how we can use this proximity to power and his influence to benefit himself financially? >> reporter: yeah, i mean, very concerned, right? a guy of his wealth, of course, will have not just, you know, certain amount of admiration in the white house, chiefly by the president-elect and the republican conference.

the president loves this guy. he spend $250 million. and by the way he owns x. he can light up a member or a group of members. so, a new sort of carnival of crazy in what is already a pretty crazy conference. you know, to your point about conflicts of interest. a guy of his wealth, he owns several companies, he got all kinds of business abroad. including in china, by the way, substantial interest in china. in the old world mattered in washington, d.c. this is a matter of at a minimum disclose what they were before he started, you know, i would not call him a president, exactly. but, sort of before he became a third house in the conference of the united states. >> that is another thing. we just gave him another job. i wanted to ask you, given your role as the ranking member of the house intelligence

committee. talking about musk and space x has failed, this is what the reporting suggested. it was designed to protect state secrets, space x workers concerned about handling sensitive information and them talking to the reporters. is that something that concerns you? is there more information you have about that? is that something you are closely watching as the ranking member on the house intel committee? >> reporter: well, a real concern, right? our launch capability and, you know, elon musk is launching more cargo into space, payloads into space than the chinese are, right? or the russians are. it is an immense operation. as you know, jen, some of these things are confidential, a lot of the satellites we don't like talking publicly about. yes, we worry about that. he is impulsive. we saw him spread massive

amounts of information. love or hate the original continuing resolution. there are 50 or 60,000 raises for congress that is just crazy. he was saying there is $3 billion for an nfl city for the generals i guess it was. not true. the combination of spontaneous impulsive and perfectly willing to trade false information it is a scary conversation. not unfamiliar to those of us who worry about classified information. trump when he was president the first time. we got to, you know, expose classified information on then twitter. hold up the pictures, see the in-- intel people passing out as they disclosed that in public venues >> an interesting thing i think we will all watch. to be specific the report that anybody can read out there is according to people with knowledge of the company and also documents, internal documents as well. let me ask you before you go. it has been a weirdly busy day

of reports from the house. even though we are in holiday season. the release from the ethic's investigation into matt gaetz confirming, of course, serious allegations of sexual misconduct. i have been talking about this report throughout the course of the show. i really just wanted to ask you what do you make of the report and what your takeaway it is at this point in time. >> yeah. well, by the time we get to the report, of course, not a lot surprising with matt gaetz. i am a democrat but ask republicans that are in the mood to be honest. there is not a single defender of matt gaetz in the republican conference, maybe a handful. people knew what he was up to and, you know, so, again, he did not have much in the way of defenders. what i would suggest is important here.

as we get a new president on january 20th. read the report and contemplate the fact that the president nominated him to be the attorney general of the united states. just sit with that for a minute or two. and, and think about what that means for the seriousness with which the republican party and president-elect trump is taking the rather serious job of governing the most powerful country on the planet. >> very important point. also, they still seem to be applauding him or not being critical post report. that tells you a lot. a lot. thank you very much congressman himes. happy holiday. thank you for taking the time tonight. >> still ahead, donald trump promised to do a lot of things on his first day in office. a day that is rapidly approaching. more about the extent of his executive power more than anybody.

. okay. today marks four weeks until trump's inauguration, four weeks until the day he said he will pardon january 6th rioters, put tariffs on imported goods, dismantle the deep state, and be a dictator. as the clock ticks closer to that day many of you are wondering will he do all of though things? can he do all of those things? that second question is where my next guests come in. they are out with a news letter executive functions. they analyze the way trump is planning cast aside norms and push the limits of executive power. what, if any legal guardrails stand in the way. that is important to know. the first piece, trump's big plans to disrupt and reconceive the federal government.

how trump not through the normal process get the people he wants to the positions of power. >> he pointed out in his post, there is a complex statute that lends itself to things a president once a vacancy is established in office can fill it in an acting basis. it can last for a long time. two years. somebody can be in a position a confirmed official would of filled but being in it without confirmation for an extended period of time. donald trump said in the past he likes acting governments, that is to say governments where he points the officials without having to run the senate confirmation process and the federal vacancy act. it can be devoted to that purpose. i should add there was discussion at the beginning or soon after his election that some discussion of his to be

able to appoint the entire government on a recess basis with an active collusion and grievance to congress that did not come to paddle. but building a government. >> yes, the doge i think people know what it is a reference to. led by musk and ramaswamy. but you say that parts of it will quote, raise a hornets nest of legal issues." what does that mean? what kind of legal issues could it raise? >> reporter: the first and primary question is if the organization itself will be lawful. there is a law called the federal advisory committee act. another one of these complicated law that bob and i are going to try to explain in

accessible ways when the president gets outside advice from private officials he has to establish an organization and transparency rules and it is not clear how doge will comply with it, circumvent it. claim it is unconstitutional. this will be an issue from day one and a big issue. and, then even if they get over that it is not clear as many people pointed out how they are going to experience influence. they will not have any kind of coercive governmental authority. they can advise things that other branches of the government could implement. the main thing is if it will be legal. >> a big one. we only have a minute left but bob i want to ask about your new post about conflicts of interest. among the worst of all words might be one that we are facing. a president that declines the public salary and chooses to

operate under relaxed standards for the acceptance of personal gain. this is on a lot of people's minds. what are you watching for if that regard over the next couple of months? >> it is fairly clear, i think, that president-elect has not yet put out his ethic's policy. it it is apparently in the works. it would be different than it was in the proceeding administration, biden administration and different from the one in the first trump government. may according to press reports allow overseas business transactions that could directly benefit him just not direct dealings with foreign governments, business deals directed with foreign governments. so, that already raises a whole host of questions. then you have another layer of
