selection win. just as congress marks the four- year anniversary. president-elect donald trump trying to block his sentencing in the hush money case set to happen just days before his inauguration. his new arguments and the possibility of yet another delay. justin trudeau set to address his political future this hour after weeks of speculation that he's about to step down. is 10:00 eastern, thanks for joining us. i'm ana cabrera reporting from new york. there is intense security around the capital and the biggest snowstorm in the region in years. lawmakers prepare to gather for a joint session of congress.

today they will officially certify president-elect donald trump's election victory. president biden vowing to give trump the january 6th he was denied when maga loyalists storm the capital. he's urging americans to not forget what happened in 2021. the president warning in a new washington post opinion piece of a quote unrelenting effort to rewrite, even a race the history of that day. to tell us what we all saw with our own eyes. let's go to washington with ryan nobles tracking the latest on capitol hill. gary grumbach has more on security and storm impacts, also with us, new senior congressional correspondent and msnbc political contributor. walk us through what we are about to see this afternoon. >> reporter: what will be most remarkable about what takes place and capitol hill is how unremarkable it will be. four years ago, the attempt to certify the election results of

then joe biden's electoral victory were interrupted by a mass group of donald trump supporters trying to intervene and stop the peaceful transfer of power. none is expected today. it'll probably be a very drama free event that begins at 1:00 today where speaker micah johnson will gather. it'll be a short session of congress where they will certify the election results and presiding over that activity will be the vice president kamala harris who lost that election in november and this morning she talked about how important she views her role and how important she views the peaceful transfer of power. take a listen. >> today the united states capital i will perform my constitutional duty as vice president of the united states to certify the results of the 2024 election. as we have seen, our democracy can be fragile and it is up to then each one of us to stand up

for our most cherished principles. >> everything that'll take place today couldn't be more different than it was four years ago. the security is at an all-time high. there is fencing all around the capital complex. there is a massive law enforcement presence of police here from different jurisdictions as well as new york city police department officials here. as i was walking through the capital this morning there's also no sort of protest or any organized gathering outside the capital this morning. it's a much different situation, perhaps the biggest reason as a result of the election. donald trump one this time and there's no effort to draw to washington to stand in the way of the pet -- peaceful transfer of power. >> tell us how this snow could affect things. >> reporter: the federal government is closed, schools

around the region are close but congress is going to be in session. michael johnson made it clear he wanted them to state in d.c. in case they couldn't get back here to certify the election. what a difference four years makes. i want to show what this looks like. there's members of the nypd right here outside of the capital. there is not only bikes fencing but that non-scalable fencing that surrounds the capitol building itself and also the senate and house office buildings where so many staff and the 435 members of congress are going to be today. this is a national special security event for the first time ever. what that means is agencies across local state and federal governments are working together to make sure this is as safe as possible. normally you hear from capitol police chief about what he said about security preparations for today. >> united states capital police are better staffed, better

trained, better equipped than ever before to protect our capital and protect our congress. four years ago, the office of the inspector general issued after action reports containing 103 recommendations. we have completed every single one of those recommendations. >> some of those included increasing staffing. they have more than 2200 members of the capitol police, they did a full exercise back in december where they played out what could happen in different scenarios, so they have the real life experience and it'll be a big month for washington. this is one of three national security events that will take place. we have jimmy carter's funeral and the inauguration on january 20th. >> just a couple weeks away. melanie, you were at the capital on january 6th. how are you feeling on this day? >> it's a little surreal.

it was around this time exactly 4 years ago i was getting ready to go in and i recall sending a text to my friends and family saying i feel like something bad is going to happen because we had been reporting on threats of violence, i had seen the crowds starting to descend on the capital. i remember some republican leadership aides were specifically instructed by their bosses to stay home because we knew what could've happened and sure enough there was the storming of the capital. i was in the house chamber with a group that were locked down inside the chamber. i heard the gunshot that went off that killed one of the riders. i witnessed some breaking the glass trying to get in. i saw police officers barricading the door. it was a scary moment and it shook my confidence in the security of the united states capital, but my hope and expectation is it will go back to what it's always been which is a ceremonial certification of the election. there is really tight security. i think the capital is more

prepared and there's not the expectation there will even be any sort of demonstrations or lawmakers on the floor trying to overturn this. >> this is one of the first orders of business for the 119th congress. we just saw speaker michael johnson walk a tight rope to keep the gavel on friday. what type of congress or the president have once he begins his term? >> a tenuous one. what we saw really shows us that governing is going to be difficult and interestingly enough the people that will probably give the most problems for the agenda are the house freedom caucus and hardliners who theoretically are the most trump of the entire conference. they are trying to stand up for things like fiscal responsibility and spending cuts, that will come to a head as they are trying to enact this massive bill which is a fast track process they will try to use as a vehicle. i will also point out republicans are about to lose two more members when they

leave for the trump administration. it'll be in incredibly tight rope they are laying out, an ambitious timeline to get this done. i'm skeptical they will deliver but we will have to wait and see. >> thank you all for your reporting. joining us now is democratic congresswoman of california. she served on the house january 6th committee. congresswoman, thank you for joining us. talk to us about what this day means to you given what we saw four years ago. >> you can't help but think of the violence and threat that they brought to our country. i always call some of the police officers, one of the officers mother lost so much. there officers who were injured so severely they could go back to work.

all to defend our democracy and to save the congress. you know, thinking on that day and the trauma that so many people went through, the staff and some of the republicans are trying to say it didn't happen is pretty shocking turn of events. today will be different. democrats are not election deniers. i have no respect for donald trump, but i do have respect for the process and for american voters. he was elected president and we will certify that election today. >> house minority leader hakeem jeffries had this to say on friday. let's listen. >> two months ago the american people elected donald trump as the 47th president of the united states of america. thank you for that very generous applause. it's okay. there are no

election deniers on our side of the aisle. >> as a reminder 147 republicans voted to overturn the results of the 2020 election . over 100 are still members of congress. it seems things are working out well for election deniers. what do you say to people who are having a hard time with that? >> we just have to stand up for the truth. their efforts to rewrite history ultimately will fail. all you need to do is go to the government office website, you can find the entire report we wrote and the facts. the funny thing is some members the day after henry 64 years ago were condemning trump and decrying the violence now as if it did happen. it is sort of a lesson and propaganda if you will, but

ultimately it will not succeed. i have faith in america. i believe our best days will still be ahead of us and we need to stand up for truth and for the rule of law and i intend to do that. >> president-elect trump said he plans to pardon january 6 the rioters. former police officers who help protect lawmakers told me this about today, this former sergeant seriously injured that day required surgery for those injuries saying pardons or not, republicans in name only, a.k.a. maga, cannot erase history. they've turned their backs on police officers who defend them from trumps mob. this from former officer harry dunn. the thing top of mine is that i feel american voters let us down adding trump being re-elected feels like a gut punch. how do you think history will remember january 6th and donald trump? >> i think history will remember donald trump for what

he did. he was engaged in trying to overturn the constitution of the united states, without an armed mob and sent them to do that task. officers protected the congress and the democracy and we did survive. i'm sorry that the american voters chose donald trump again for the white house, but that is up to voters to decide, not the congress. as i say i have no respect at all for him but i do have respect for our democracy and i intend to uphold it today when we certify the vote. >> looking ahead to the next administration we have seen trump ignore norms or push limits of what's allowed. now that he's gearing up for his second term after winning both popular vote in addition to the electoral college what do you expect him to attempt in the next four years? >> we will see. has project 2025 lays out the agenda. really some very

radical proposals to damage social security, medicare, to violate the constitution, trying to deport people born in the united states, a whole round of really wild things. we are in the minority. the democrats and the house, but we will stand firm for the rule of law and for the constitution. we are also willing to go to the third branch of government, the judiciary, who by and large have so far held when posed the question of whether the rule of law should be upheld. all the election challenges from 2020, all the judges including the trump appointed judges rule that the objections were nonsense and without any evidence. we will endure, we will persevere and in the end i believe our american democracy will survive. >> thank you so much, zoe

ask your doctor today. millions of americans are waking up to a dangerous mix of sleet, snow and freezing cold temperatures today. this monster winter storm is moving east to the mid-atlantic after pummeling parts of the plains. kansas was hit particularly hard. up to 18 inches of snow in some parts of kansas, something they haven't seen in decades. in nearby kansas city, missouri we already know they've seen the fourth largest single calendar date of snowfall record. eight states now from kansas to new jersey have already declared states of emergency.

michelle grossman is tracking the storm but let's start with maggie vespa and hard-hit kansas city missouri. we are talking some of the most snow they've ever seen. how is that city and the surrounding area handling all of this? >> it's basically a ghost town. look at the amount of snow that came down, but you can tell my mouth isn't moving that well because it is painfully cold, like a wind chill of zero. it was negative for when we woke up this morning. check out this car behind us. that hasn't moved all weekend. the big problem here, this was an especially extreme storm. it's snow on top of sheets of ice on these roads. it'll take a long time to plow all the snow and even under it because it's so cold out, these treacherous conditions remain. highways across the midwest were just such a mess over the weekend. dozens and dozens of crashes, a

lot of authorities say with injuries. here in the city they treat the roads a lot leading up to this and during the storm it's a little better manage. we wrote and apply with the kansas city city manager yesterday and talked to him about even with the pretreating how massive the system was. here's part of that. >> this is going to be one of the most historic significant storms the city has ever seen. we haven't seen more than 10 inches in 32 years. we started pretreating friday, 36 hours in advance of any snowfall or ice to make sure we were as prepared. we are being very aggressive. >> he said this will take days to clean up. a couple layers to this you mentioned well over a quarter of 1 million people basically from missouri up to virginia at this point without power. obviously it's very dangerous. travel disruptions, yesterday was the unofficial end of the holiday travel period. a lot of

kids trying to get back to campus, a lot of people getting home if they spent time with family. thousands of flights delayed and canceled. 1300 canceled yesterday, a similar story today. that mess could also take days to clean up. >> doing a great job even with a frozen mouth. thank you to you and your crew. go warm-up. we see a little sunshine in the background there. the snow storm has passed there, but it's not over yet. fill us in. >> this is a large storm. from the midwest through portions of the ohio valley into the mid-atlantic and it's impacting a lot of places with different sorts of weather. we have snow, heavy rain that can also see some severe thunderstorms later and we have the ice in between. 62 million americans under winter alert with winter storm warnings, advisories. notice how long the stretches.

it's been large over the past few days. we are seeing where the snow is falling and where you're seeing that lighter blue, almost a white color is the heaviest snowfall. portions of the mid-atlantic, also portions of southern new jersey and really heavy rain where you see the bright returns. that's where we are seeing heavy rain falling. we could see severe thunderstorms in the southeast. pink and purple is freezing rain and that's where we see really tough travel. if you're in those areas you've been dealing with it all morning long. stay indoors. it is really cold outside. temperatures 30 degrees below normal so this is freezing on contact. we will see this move off the coast later this evening into the mid-atlantic areas. we had a tough morning commute, tough evening as well. the morning snow is heavy but sticking around for a bit and as we go throughout tomorrow we will see plain cold temperatures

with that wind blowing. we will see the lake effect really ramp up once again tomorrow as the wind goes over that relatively warmer lake water. it is coming down at a good clip in some spots. that creates reduced visibility and anything falling is sticking to these roadways because we have been cold for so many days and will continue to be called. ice accumulation is dangerous. we have seen power outages, we will see additional power outages and that will be dangerous with those really cold temperatures. light pink is the highest amount of ice accumulation so we are talking virginia into richmond. this is a big storm. your 13-year-old called this like a week ago. >> he was hoping for good ski conditions in new york. i don't know if the snow will make it that far. we got the blustery conditions here. not a great end of the deal.

back with breaking news. trump now seeking to block his sentencing in the hush money case which the judge has set for this friday. and scheduling the sentencing, judge juan merchan denied to dismiss the case but indicated he will not give trump jail time. crumbs lawyers say there's no legal basis to rush ahead with sentencing except that the d.a. wants to get it done before trump's inauguration. nbc is covering the trump transition from west palm beach, florida and here with me

is our legal correspondent lisa rubin. what more are we hearing from crumbs lawyers? >> their argument is because the supreme court's immunity decision over the summer says the president or former president is entitled to resolve their entitlement to immunity before a trial, by necessity, given the trial has already happened he must be entitled to a stay sentencing now. if the supreme court is willing to say you have to resolve whether someone is entitled to immunity before trial doesn't that necessarily mean that if the case is already progressed beyond trial and to appoint there could be sentenced it would also be unlawful to progress to sentencing before resulting immunity? the argument is a different one. he's arguing as a president- elect that transition period is so vital and integral to his service as the future president that the immunity bestowed upon him should also extend to this period right here. >> it seems like the judge

would have to move quickly to answer this given sentencing is on friday. >> that's why in the filing where they've asked judge juan merchan to grant the state they impose a deadline on him saying if you don't act by 2:00 p.m. tomorrow we will take additional steps. we should be prepared to see if there is no answer from judge merchan today the trump folks may indeed go to an appeals court in new york state and ask for the same, a stay of sentencing to prevent it from taking place this friday. >> we have seen trump lashing out on social media. tell us about reaction now to this new development and preparations if this hearing does go forward. >> there's a question of whether the president-elect would welcome judge merchan's ruling late friday night in which he wrote he did not intend to sentence him to any jail time also went as far as to suggest he would grant him

unconditional discharge which would amount to no probation, no substantive consequence. especially under the circumstances judge merchan would allow him to appear virtually instead of having to come down to the courthouse on january 10th and would donald trump allow this to go quietly? this weekend on social media he said the opposite of that continuing to blast judge merchan as being politically aligned and making the case he is protected from presidential immunity claims of courts which at this point in time judge merchan has dismissed and said the sentencing would move forward . it did not toss the indictment, it did not toss the verdict despite best efforts of donald trump's attorneys at this point in time. in a statement from the spokesman for the president- elect here in just the last half hour he wrote in part that the justice system the courts should put a stay on this for

the purpose of bringing americans together and uniting the country around donald trump as he is set to be sworn in on january 20th and that americans voted to end what he called political prosecutions. this has been the crux of trump and his team's argument at this point in time and is going to be a question this afternoon of whether judge merchan grants the stay or not and whether the sentencing on friday morning will proceed. >> thank you for that. lisa, i want to play what someone else said who was investigating donald trump regarding the sentencing that is expected on friday. this is a former impeachment manager, now senator. >> he should treat donald trump as he would any other criminal defendant charged with like offenses. i think new york has demonstrated how the justice system ought to operate. no one should be above the law. >> what are your thoughts on how the judges handled this case? >> i think he's balanced to

tween the fact that while he believes no one should be treated above the law this case presents special circumstances. former and future president trump has a variety of arguments here that no other person would be able to make. the judge is cognizant of that. it's why while scheduling the sentencing he has also indicated he doesn't believe incarceration is appropriate and he would likely impose unconditional discharge. that's not an option available to most criminal defendants. i think judge merchan has done a good job between the two and at the same time satisfying very few people, there are many viewers who would like to see a harsher penalty for donald trump and many partial to the former and future president who believe no sentence is appropriate. >> lisa rubin, thank you. new details on the bourbon street terror attack including what the attacker was doing in that city weeks earlier. the techie may have used to plan his assault. we will talk to a former dhs secretary next.

today, the president and first lady traveled to new orleans where they will meet with family members affected by the bourbon street terror attack that left 14 people dead and doesn't hospitalize. the visit comes as the city readies new security precautions ahead of next month super bowl. as investigators share new details about the planning behind that new year's day rampage, including the attackers

to recent visits to new orleans during which he apparently cased bourbon street on a bike wearing smart glasses that wrist recorded this footage. let's get you to jesse kirsch. as the city gets ready to host the president where do things stand on the investigation and security? >> reporter: beyond those revelations that investigators shared there's been a reporting coming out over the weekend about the security plans in place in the city and new orleans mayor is now admitting she cannot guarantee the city super bowl safety plan is good enough. this morning, mounting questions about new orleans is ability to safely host the super bowl next month. the company that makes the new bollards being installed tells nbc news they can only stop a car going a maximum of 10 miles per hour. some experts say the famous street should have barriers that can stop a car going three

times faster. >> i have full confidence the city of new orleans not only is safe, we will continue to be safe. >> new orleans is mayor now admits she cannot guarantee bourbon street's new barriers can effectively protect super bowl crowds and she's asking for a tactical expert to review the city safety plans. >> the assessment i'm asking for will determine if, in fact, they are strong enough. >> despite uncertainty, bourbon street is open to partygoers. last night, traffic was moving across at least some intersections. meanwhile, we learn more about the man behind the attack. the fbi releasing this edited video they say shamsud-din jabbar recorded on one of at least two trips to new orleans in the months before his deadly rampage. the fbi says he rode a bike through the city's french quarter wearing smart glasses and at one point even looked at himself in a mirror to test

barricades on the sidewalks as well as in the streets. >> these new bollards reportedly they are installing can only withstand a car going 10 miles per hour. you saw that truck moving much faster. >> i suspect that was more a matter of funding, a lack of funding which needs to be reassessed. as to the super bowl, the super bowl is a well-worn security event. it is a national special security event. between dhs, local law enforcement, state level law enforcement we know how to secure a super bowl whether it's in new orleans, metlife stadium or california. i have a lot of confidence in the security around that. more challenging is the immediate area. if history is a guide you tend not to see a terrorist attack

in the exact same place where one occurred, say, a month before. i used to tell my people at dhs plan for the next potential attack. don't plan for the last one. we always have to think ahead. we always have to imagine the unimaginable. there are lessons learned from new orleans without a doubt. it is a tragic, tragic loss of life. you hate to see an event like that shattered on new year's eve. i'm glad the president is going there today. he knows how to empathize. we move on and do the best we can. >> as we move forward in thinking about the potential threat that could still exist and i keep thinking about the possibility of isis in the u.s. and where things stand now. we know authorities are looking into the attackers travel.

he went to egypt and canada last year, whether that factored into the radicalization but we know with the internet you don't need to travel to be influenced by foreign terror groups. i wonder when this attacker makes video saying i'm now a member of isis, how official was that? >> that's a red flag without a doubt. the challenge for law enforcement and our national security community is to be able to see that red flag fast enough to intervene. as you alluded to, there are things called terrorist directed attack were a foreign terrorist organization will direct and operative to come to the united states and carry out a large scale attack like 911 and there are what we refer to as terrorist inspired attacks where a lone actor already here in the united states, even a united states citizen born in texas, will be inspired by a group like isis to carry out an attack like that.

those are particularly challenging because a lone actor can often radicalize in secret, in their basement, in their garage and carry out an attack on almost no notice. >> was asked about the isis threat and whether there had been any changes related to that since asad was ousted from syria. here he is on this weekend. >> we are very concerned about the instability that resulted from that and whether in fact it creates a space for the re- emergence of isis in syria and isis continues to seek to radicalize individuals outside of the middle east and throughout the world and that is something we are, of course, also very focused on. >> are we seeing a resurgence of isis and its ideology?

>> any time a regime like the assad regime collapses in syria you have to worry about the possibility that a terrorist organization like isis could re- establish a place to train, to recruit, to plan, organize where its leaders can hide, but we also have to be concerned as i said a moment ago about terrorist inspired attacks. you don't need a caliphate to inspire a lone actor in the united states to carry out a large-scale terrorist attack. i'm concerned we are in a new environment now where isis may feel emboldened to encourage people in the united states, europe, elsewhere to carry out attacks like this. our intelligence community, our law enforcement community, national security community really does need to double down. it's not business as usual. you have major security events coming up like the super bowl
