>> we begin with the latest on preparations that are already underway for monday's presidential inauguration. >> at this hour, we are awaiting president elect trump's departure from florida and route to washington, d.c, where tonight he will kick off the inaugural festivities with a fireworks show at his virginia golf course. also at this hour, vice president elect jd vance is expected at an event with trump cabinet nominees. >> we're also following tens of thousands of protesters who are gathering for the people's march in the nation's capital. >> the marchers have been making their way through the streets of washington, d.c, to rally in opposition to the incoming administration. >> their rally will culminate at the lincoln memorial and is being billed as a continuation of the 2017 women's march. march organizers say that they are speaking out on behalf of women's and reproductive rights, lgbtq plus rights, immigration, climate and democracy. the president elect is already making big news today on the

future of tiktok. in an exclusive phone interview, donald trump told nbc's kristen welker that he will most likely give the social media app a 90 day extension after he takes office on monday. although tiktok says that it may still be forced to go dark on sunday due to the ban that the supreme court unanimously upheld yesterday. nbc news white house correspondent vaughn hillyard joins me now. vaughn, president elect trump has mentioned that he is inclined to grant a 90 day extension before the tiktok ban goes into effect. but meaningfully, that extension is contingent upon the president elect certifying to congress that there has been significant progress toward ending chinese ownership of tiktok. are you hearing anything about how the president elect plans to reassure congress that there has been significant progress toward new ownership of the platform? >> right, melissa? you're absolutely right in that distinction. that was a part of, let's be clear, the bipartisan law that was passed by congress

and signed by president biden last year. and yet, what is significant progress mean toward finding an american investor? and, well, there's few details. there's nobody that is publicly coming out there and saying that they would seek to acquire and purchase tiktok. and so it's not clear what the president elect is suggesting or whether the other part of this is anybody will actually challenge the idea that there is significant progress if his doj does not step in, unless somebody working in the acting ag capacity were to try to counter that effort. there's a lot of questions, but i think at the forefront of this is the parent chinese company of tiktok has not suggested either at this point in time that they have any intention to sell tiktok, which is another part of that bipartisan legislation that would be needed to be shown by the president in order to get to

that one time, 90 day authorization. and so there's a lot of questions, because it's supposed to go dark tomorrow, but donald trump is not supposed to be sworn in until monday at noon. so it could go dark tomorrow. could he attempt to put that 90 day authorization into full force? and is there anybody who is going to try to legally challenge that effort, understanding that the law says one thing, yet donald trump may seek to do another. >> on the other end of the spectrum, vaughn, there's also much talk about president elect's plans for immigration. what are you hearing now about the planned enforcement operation that's supposed to take place in chicago just days after the inauguration? >> exactly. chicago, to our understanding, could be the first city that is targeted by ice officials. tom homan, who is the border czar for donald trump. this is not a confirmed position, is said that he intends to carry out the mass deportation program that donald trump promised during the campaign to impose in cities across the country. and our julia ainsley, our colleague, is reporting that chicago is

expected to be that first city and that these operations could begin as soon as tuesday, and that they are seeking ice officers to work in volunteer capacity. again, this is at the crux of so many of the complications is not only an unwillingness among some local law enforcement jurisdictions to put the resources in towards working with federal immigration officials, understanding their budgets are very short as they are, but also understanding that the federal resources are limited. and that is where you see the expected focus on one city, potentially at a time. this being chicago, over the course of several days, the idea of having a mass deportation system, it is not an easy one. despite donald trump and tom homan pledging to go forward, he has said that he's going to target criminals and drug dealers. it is not clear exactly where that focus point is going to be. there's a lot of outstanding questions for these first days of this trump administration. melissa. >> well, thank you for trying to fill in some of those answers.

>> nbc's vaughn hillyard reporting live. >> let's bring in our political panel to hear more about this. joining us now are jeff mason, the white house correspondent for reuters, as well as former republican congressman from florida, david jolly, who is also an msnbc political analyst, and fernand amandi, a democratic pollster and an msnbc political analyst as well. >> jeff, let me start with you. as vaughn suggested, the idea that there will be a 90 day extension for tiktok as president elect trump said to kristen welker this morning, is not as simple as perhaps it sounds. what do you think is the likelihood that this republican controlled congress would go along with the president elect on this, especially if there isn't evidence that there's been significant progress toward finding a us buyer for tiktok. >> well, a couple of things. >> i think, number one, to the question of what will the republican controlled congress do? so far, the republican controlled congress has shown a willingness to do pretty much whatever president trump president elect trump still wants. so if that is something that he's signaling by saying he

wants to give them a 90 day, give the company a 90 day reprieve, i think the evidence would suggest that congress would probably back him. that said, to offer a counter point to my own point, what vaughn raised was spot on. the legislation about tiktok was bipartisan. there are concerns on both sides about chinese ownership of the company, and it's going to be pretty hard to prove or to show that there's been any progress on that within the next 24 to 48 hours in terms of changing ownership of the of the us part of tiktok. so tbd. but i think the other kind of political aspect of all of this is president elect trump knows that tiktok is still a popular program in the us, and it's a popular app for a lot of young people. these are voters who were important to him and would continue to be important to his party. so he's aware of the political aspect of this as well. and that's probably also one piece of why he's saying he'll give them a reprieve. >> all right. >> we'll look for that reprieve. >> david, to you, msnbc news is

also reporting that isis is planning a major enforcement operation in chicago the day after the inauguration on tuesday, donald trump told kristen welker this morning, quote, we have to get the criminals out of our country. >> and i think you would agree with that. i don't know how anyone could not agree how much of this planned operation is likely to be about meaningfully addressing immigration policy, and how much is really just a show of strength to his base and everyone else about what this new administration is capable of doing. >> i think it is to feed the base. >> i think it's for tv very quickly. >> on tiktok, donald trump does not have the authority for the 90 day reprieve, and i don't think we should approach it as though he does. >> i think vaughn's right. you're right. jeff's right on it. >> he doesn't have the authority. >> so we're going to enter day one with him, possibly saying, i'll let china keep mining the personal data of individuals. >> and, oh, by the way, i'm going to pursue essentially family separation. >> he'll be it feels and looks different than family separation

at the border. >> but he's going to target people for removal. and this will be all about the tv images. >> it would not surprise me, melissa, if this is occurring concurrently with the inaugural celebrations, because donald trump intends to have a tv moment, he intends to have a tv presidency. >> it's what he understands. and so they have fed the republican base so long with with fear mongering and xenophobia, and he is going to deliver on that. >> and tom homan certainly intends to deliver on that. >> so will it in practice it be a more traditional ice raid? they do this often. >> it could be where they target, for instance, just those with outstanding warrants. >> perhaps that's it. but they make sure that the images are across everybody's cell phone and tv. maybe that's it. >> or maybe this is the more aggressive deportation plan that he's promised. >> i think there's a big question, you know, could he actually pull off the greatest deportation in history? >> probably not. >> will he even try to deliver it? >> i think he will. and at this point, we should take him at his word. certainly with somebody

like tom homan, they have said they want to do this. it starts on tuesday. and i think the cruelty is the point, and the evidence will be right in front of our eyes. >> all right. >> fernand, pete hegseth and pam bondi were on the hill this week for their confirmation. hearings on pam bondi seem to escape relatively unscathed. >> hegseth got a little bit of battering from the panel, but i want to get your thoughts about all of the hearings that we've seen so far. >> what's going on here? what's the likelihood of confirmation? >> well, melissa, based on what we've seen this week, at least despite the many legitimate and i think fair questions about not only the capabilities, the experience, the conflict of interest of the two nominees we saw this week outside of perhaps, maybe marco rubio. >> i think elections have consequences. >> donald trump is likely to get hegseth and pam bondi through. i also think marco rubio will sail through as well. >> he's probably the least controversial of these picks, where i think it is going to get difficult, however, is with the next round, especially those having to do with tulsi gabbard,

the potential director of national intelligence. >> given all of the compromising information. >> her very soft on putin approach, her support really, of the former assad regime, which now has been vanquished in syria, and then the big one, as well as our robert f kennedy jr, with the potential leading of the health and human services committee. >> i think we've also got to look to the noncommittal attitude of some republican senators, including the likes of lisa murkowski and mitch mcconnell, who have kind of signaled they may not be on board, especially with the gabbard pick. that's where i think you're going to see some of that turbulence. but look, trump is going to get most of these through the popular vote win that he had, which i think was the big shock for democrats and i think for republicans as well, gives him the highest political capital he's ever had. >> even when you consider the first term, donald trump is coming in with more political capital behind him than at any point. >> so i think you're going to see that reflected in the republican response to these cabinet hearings, which is going to be less resistance than you might have seen before. >> well, david, let's push

forward to next week. as fernand has said, there are going to be some pretty controversial picks hitting the hill. robert f kennedy will be there to be heard as the potential hhs nominee. but also tulsi gabbard, who's been tapped for director of national intelligence. she hasn't yet been given a hearing date. is this a sign that there are likely to be potential issues with her nomination on both sides of the aisle? >> oh, i certainly think so. >> and i think we may see some party line votes for cabinet confirmations, which is actually historically somewhat anomalous, particularly if it comes to death. >> if we were to see a party line vote. >> i agree with ferdinand. >> i think because of the numbers and the fealty to trump, most of these sail through. >> i would suspect even rfk jr. >> tulsi gabbard, though, will face some of the hardest questioning and reservations from people like mcconnell here. look, there's a lot of armchair quarterbacking going on. >> this is very hard for democratic senators. >> here's the one thing that i would like to see more of that we haven't seen yet. instead of simply trying to disqualify these candidates, make them prove their qualifications.

>> this is not like a supreme court hearing where we're getting an appellate judge who we know is substantively qualified, and so they have to break down their opinions on constitutional law. >> we are seeing unqualified nominees. seth is not qualified to be secdef because he worked at fox news or with the koch brothers. and god bless him for his service. >> not not even because of his service in the national guard. >> there are questions about tulsi gabbard that could be disqualifying, but let's see how she qualifies herself to be dni, because i don't think she can actually stand up against that test. neither could rfk jr. >> i would suspect we see some hard questioning, even from republicans on those two. >> all odds right now, though, are in favor, as ferdinand said of trump getting his nominees. >> so, jeff, i want to talk a little bit about trump 2.0 and this president's relationship with the media. and i know this is not your first time at the trump rodeo. i want to play a little bit of a clip of an incident that you had with donald trump back in 2020. take a listen. >> i think it's a it's a possibility. they're trying to

look between you people. don't answer. don't talk to me that way. you're just you're just a lightweight. don't talk to me that way. don't talk to i'm the president of the united states. don't ever talk to the president that way. all right, i'm going to go with another question. >> okay, jeff, what are you expecting this time around? more name calling or maybe even worse treatment? >> well, i think for context, that clip that you just played, as i recall, i think that was on thanksgiving day, and it was after he had lost the election and i was asking him if he would respect the results of the electoral college. so i do think that's important to know what i was asking him in that case. and, you know, we had ups and downs over the four years. i would say that president trump was in office in terms of his relationship with the media, with reporters like me. he doesn't always like tough questions, but i think he does like having cameras around, and he likes the back and forth. it's hard to say if 1.0 and 2.0 will be the same in that sense.

point? >> so, melissa, we are just nine hours now from when this cease fire is due to go into effect, as you said, 8:30 a.m. local time tomorrow. and the latest we know from the israeli government is they are saying they have not received the names of those three female hostages who are due to come out in the morning, and they are saying that unless they get those names, this deal is not going ahead. now, we should be clear. prime minister netanyahu has a domestic political audience. it suits his political needs to show his right wing voter base that he is on high alert for any violations of this deal by hamas. we just came from hostage square, where thousands of israelis demanding the release of the hostages were gathering. i can tell you there was concern about this. there was not panic. this is the middle east. things go right down to the wire. it still seems highly possible that that list of hostages will come in time

for this ceasefire to go into effect. the other question, though, raised by netanyahu's remarks tonight and frankly, his public statements for months now is whether this cease fire is going to move beyond phase one, which is six week ceasefire, 33 hostages come out, several hundred palestinian prisoners and move to phase two, which would be a complete end to the war. full withdrawal of israeli forces from gaza and the release of all of the remaining hostages. and prime minister netanyahu is indicating that he resumes or he reserves the right to resume this war, potentially after the end of this first phase. and if that happens, there is a very real possibility that a month and a half from now, we could be back to fighting and there could be some 60 or so hostages alive and dead, still in gaza, with no clear path for them to come out. i'll also say israeli strikes are still continuing even with this deadline. so close. the

cities across the united states. according to a document reviewed by nbc news, the operation will last several days. while on the campaign trail, trump painstakingly laid out his plans for mass deportation while feeding his base disinformation and conspiracy theories about migrants. >> my first day back in the white house, i'll terminate every open borders policy of the biden administration and begin the largest deportation operation in american history. >> and i'll stop all of the migrant flights into our country. >> you k them in the numbers. i will rescue every city and town that has been invaded and conquered, and we will put these vicious and bloodthirsty criminals in jail and kick them the hell out of our country as fast as possible. >> according to estimates from the american immigration council, up to 4 million mixed

status families. >> those are families where some members are undocumented and others are u.s. citizens. risk being separated. during his first term, trump's zero tolerance immigration policy led to one of the cruelest family separation chapters in recent american history. more than 3000 children were forcibly taken from their parents at the border and transferred to more than 100 shelters nationwide. last year, the washington post reported that 4400 children still had not been reunited with their families. nbc news reports that the incoming administration is considering restarting family detention and potentially building more detention facilities. trump has also promised to recruit more state and local law enforcement to aid in this sweeping effort, and sources from the incoming administration have flagged its intention to roll back policies that protect sensitive locations like schools, churches and hospitals from immigration raids. joining us now to discuss all of this is journalist and

msnbc contributor paola ramos. paola, politico is reporting that donald trump plans a flood of immigration executive orders on day one. under these orders, the administration will move aggressively to close the southern border, but it may be slower in expanding the mass deportation effort beyond chicago. i want to get your reaction to what's expected on tuesday in chicago. and does the fact that the plans to expand this effort to other cities, the fact that those are less firm, does that suggest that maybe all of this is really performative, an initial show of force that's designed to inspire fear and perhaps placate an anti-immigrant base? >> perhaps. >> but i think the point is that they will try everything they absolutely can to make their point. >> and i think, unfortunately, in more than 40 hours, you will see a trump administration that will try and show force. >> and if you remember melissa, but in 2017. right. so just a couple of months into donald trump's first white house, what happened is that ice arrests spiked. they spiked by over 30%. >> and so the point during those

first months of that administration was to send a message. so i think what we're about to see next week is not just a donald trump that feels empowered. >> the danger is that they all feel emboldened. right. and when you embolden maga, when you embolden this movement, that's when it gets dangerous because it starts to defy the rule of law. what it means for this administration to be emboldened is that we're about to see local law enforcement act as ice agents. >> to your point, we're about to see ice believing that they can start entering safe spaces like schools, like hospitals, like churches. and we're about to see people like governor ron desantis that literally just a couple of days ago said and stated that he wants to bar undocumented immigrants in florida from attending public universities. >> and one of the things that scares me is that for them to be emboldened also means that vigilantes that are out there, some folks that i've spoken to directly, they will also feel emboldened to take matters into their own hands. and so, i think, to answer your question, until they get what they want, the point now in the next week and the next month and the next couple of months, is to instill

and create a lot of fear to terrorize so that all of the undocumented immigrants that have been talking to over the last year have two options, either to self-deport or to hide in the shadows. no, that's what they want. >> all right. just to be really clear, though, paola, it's not as though there hasn't been a lot of deportation activity under the biden administration in its annual 2024 report, ice said it carried out more than 271,000 deportations last year. that's 32% of the people in the country with criminal histories. and just to note, that was the highest number of deportations since 2014. that was the year when president obama was called the deporter in chief. how do you think the trump administration is preparing to carry out these mass removals? how will they prioritize those that they designate for deportation? and once they've handled the quote unquote, criminals, is that enough to declare victory on this? or, again, as you say, is there more to come simply to inspire fear and to ensure compliance? >> i think what you pointed out, those numbers are really important. now, it is true. it

is a good reminder for people to understand that it's right in. president barack obama was named deporter in chief for a reason. joe biden will go out and with a presidency that ended up deporting a lot of people. and i think precisely that is one of the reasons that i can only imagine someone like donald trump cannot wait to increase those numbers so that he can be called the actual deporter in chief. no, that's that's one thing i think they're looking at. but one of the things i think about also, melissa, is this idea of what they weren't able to do during the first administration. and if you remember, in 2019, donald trump suggested electrifying the wall, putting razors on the wall. he also even suggested in 2019 shooting migrants on the legs to deter them. right. so that is one of the things that i keep thinking about what they were not able to do then and what they will try and do now. and look, they have said that they will go after criminals and but we don't know. but we do know is that if they want to implement the largest mass deportation in american history, we do know that inevitably a lot of people

know that are undocumented, that have been here for over 20 years, will be caught up in the middle of that. we also know that even some latinos. right. black and brown people will be inevitably racially profiled. one of the last things that you mentioned in this is no longer just an immigration issue. there's over 10 million us citizens that live in mixed status families, over 4 million us born children under the age of 18 that have at least one undocumented parent. so i think the difference between then and now is that americans will feel something. and so i think the question is, once we see these images happening, once we see the raids, once we see the family separations, the question is, how do americans react to that? are they mobilized or are they truly are we truly a country that has shifted so far right on this issue that we feel nothing? >> well, here's a question. trump's incoming borders are tom homan says that he's going to need from congress funding for 100,000 beds to detain more

backdrop to think about what's going to happen in just a few days. do you anticipate that with this new president, we're going to see a reenactment of the separation policies that we saw during his first term? and how are families who are likely to be affected by this new policy change, preparing for it? >> well, i can tell you, and even just last week, i spent some time with a venezuelan family in asylum seekers that got to this country that specifically got to new york city just two weeks before donald trump won the election. and the one thing that he and his family keep thinking about, and i can only imagine what they're thinking about right now as people are seeing these images. the one thing people keep thinking about is will we be separated? and i think that's the stain. that's what will always overshadow all of this story. will we be separated? these are families that are literally trying to think right now, who could have custody of my children if i am comes after me, you know, who takes care of our children? and so these are, you know, these are families that came here to work and they're asylum seekers. i always

president elect told welker that he will likely travel to california next week to examine the wildfire damage in that state, although he also revealed that he has not yet spoken to the state's governor, gavin newsom. the trip comes as firefighters continue to battle 40,000 acres of ongoing wildfires, which have killed at least 27 people and destroyed more than 12,000 structures. joining me now for an update on all of this is nbc's maggie vespa. maggie, what are what's the status of the recovery efforts in california right now? >> yeah, melissa, the status is that basically they're progressing, which is really welcome news, as you can imagine, for the tens of thousands who are still under evacuation orders. in fact, here in this neighborhood in altadena, you can see we have electric and gas crews, including crews up on a cherry picker by that electrical line. and then others have been jackhammering here over on the side, basically trying to undergo utility repairs, get these rolling and get these neighborhoods safe enough so that people can just drive through them and hopefully come see their homes or what's left

of their homes. in so many cases. we just got updates, actually, from the l.a. county sheriff that roughly 33,000 people between the areas burned by the palisades and the eaton fire remain under evacuation orders. that's down. get this from roughly 200,000 when it was at its peak. >> so down now to 33,000. >> so that's how much all of this is improving. you mentioned the death toll 27 people. that number is expected to rise with dozens still missing. and the search for those missing is really what's kept. a lot of these areas closed off, along with these safety concerns that crews still have to get through, and also 12,000 structures, a lot of them homes, businesses, schools completely destroyed. >> we do have kind of a reprieve right now from the winds. >> thankfully those might kick up again next week. but in the meantime, fire crews are getting a handle on containment of these fires. >> new numbers eaton fire, 73% contained the palisades fire, 43% contained. >> keep in mind a lot of those crews that you're seeing right now, they've been working 24 to 48 hour shifts without any sleep or longer to try to get those

numbers to rise. that exclusive announcement from president trump that you talked about. and again, he said he had not spoken with governor gavin newsom. we haven't yet gotten a comment from newsom's office, newsom's office, on that. it comes as the governor's office announces a lot of mortgage relief efforts to try and help people who either their homes were damaged or destroyed by this fire or the areas around their homes were damaged or destroyed, including a 90 day forbearance on mortgage payments without penalty or basically any kind of ding to their credit limit. this as a huge question among people like the ones that you're seeing, their homes are completely gone, is about insurance. so many people talking about that. and how long will it take them to get payments, whether it's to actually rebuild or just in the meantime, afford things like clothes, food, a short term place to stay. and it's a huge question for a number of reasons, including sort of chief among them, that a lot of commercial and private insurers in the last few years have been pulling out of the state of california or canceling policies

here. and then, as we reported, there are a lot of questions about the state's so-called fair plan. the last resort for homeowners, for fire insurance here in that state, and a lot of mounting concerns that that plan is actually going to go bankrupt with all the need that's surrounding us here. melissa, i'll send it back to you. >> all right, a tragic situation. >> nbc's maggie vespa, thanks so much for that update. we have more now on president elect donald trump and his 11th hour comments about the fate of tiktok in the united states. in an exclusive interview with nbc's kristen welker this morning, trump said he will, quote, most likely give the popular social media platform a 90 day extension to avoid a ban that's set to take effect at midnight. tiktok says that it plans to go dark in the united states, unless it receives more information about the potential legal fallout. the biden administration has called tiktok's move a quote unquote stunt, while also saying that it is now up to trump and his team to implement the ban. joining me

now to discuss it all is ian millhiser, senior correspondent at vox. ian, what can we expect to happen tomorrow with tiktok? it's not that the app is actually going to go dark, it's that us platforms can't service it with updates. and over time, very quickly, it's going to become obsolete. is that the case or is there more to it than that? >> so my understanding is that it's a little unclear what is going to happen. >> so what the law actually says, it doesn't, you know, shut down tiktok altogether, but it forbids u.s. companies from providing services to tiktok. >> and so that means that the app stores that apple and google can no longer allow new people to download it. >> there's also some uncertainty about what happens with tiktok's web servers. >> so right now it is provided web service or internet service by oracle, i believe, which is an american company. there's some possibility that it could move that hosting overseas, but

tiktok says it's going dark tomorrow. i guess i'm inclined to believe them. >> and it's just it's really unclear. i think the only people who know the ins and outs of the tech side of it, and whether it's possible to move that, that internet hosting overseas are the people who work at tiktok themselves. >> i have to say, as the mother of teenagers who are addicted to tiktok, i would not be upset with any of that. but if donald were like, well, think about the bigger issues. if donald trump does act on monday as he says he will, with the 90 day extension, what's likely to happen during that period? what kinds of assurances will congress need in order to extend the deadline for the ban? >> so what the law says is that the president does have the power to extend, you know, or to delay the ban by 90 days. >> he's only supposed to use that power. and this is written into the statute if like a sale, so that the broader issue here is that tiktok is owned by a company called bytedance, which is a chinese based company. and

there are very, very serious concerns that tiktok just gathers so many, so much data on so many americans that we do not want a company that is potentially, you know, potentially could give all that data to the chinese government to have all of that information. the 90 day delay is only supposed to happen if bytedance is imminently going to sell tiktok to an american company. but realistically, i think that trump can delay it for 90 days. >> i don't think anyone has standing to sue in court in order to prevent that from happening. >> the bigger question is what happens after those 90 days? >> trump could say that he won't enforce the law, but the law has a five year statute of limitations, and trump's successor could still enforce it. >> so if i'm tiktok's lawyer, i'm going to tell them, look, you can't know what trump's successor is going to do. and, you know, any company that does business with tiktok is facing extraordinary legal danger. if

not under trump, then potentially four years from now when his successor is sworn in. >> all right, so the ban is really about divesting tiktok of its chinese ownership. and today, artificial intelligence search engine startup perplexity ai announced that it would be very happy to make a bid to merge with tiktok's parent company, bytedance. it's not an ownership, it's a merger, and bytedance has said that it would not sell. so again, this truly would be a merger. is that a nonstarter, given that the ban needs and requires the divestiture of chinese ownership from tiktok? >> so, i mean, i think the biggest question about the ban is, is bytedance willing to sell? >> like there have been a number of suitors, including, i think elon musk made at one point some noises suggesting that he might be interested. so there are several people who could potentially step forward who are americans, who could who who could buy the company. right now, bytedance has said that it will not or, you know, bytedance does not seem interested in selling the company. >> now, maybe that changes

because i think we're in a bit of a game of chicken right now where the government is saying, hey, we're going to ban you. >> and bytedance isn't quite sure that the that threat is legitimate. and the fact that trump is hemming and hauling and also saying he's going to offer them a 90 day extension, i think diminishes the credibility of that threat. but if bytedance knows for sure that on a certain date, the government is going to start enforcing the law, the ban is going to go into effect and this whole thing is going to shut down. you know, maybe they decide that, look, we should make some money off of this. and so they'll go go forward with the sale. i don't think that's going to happen until they are convinced that the government is actually going to enforce this law. >> all right. >> ian millhiser, thank you so much for that update. let's go back to our political panel, jeff mason, david jolly and fernand amandi. jeff, the tiktok ceo, is going to be attending the inauguration, and he recently posted a video expressing confidence that president elect trump will find a resolution for the ban. we now

know from trump's interview with kristen welker that he is likely to issue this extension, but it's worth noting that this is pretty much an about face for donald trump, who, as president in august of 2020 issued an executive order dealing with what he called the threat posed by tiktok. what explains this stunning about face? >> yeah, well, let's be clear. >> president trump now, president elect trump had a relationship with china and chinese companies. >> and the chinese leader that that are full filled with contradictions. so having an about face or a contradiction on this is not necessarily inconsistent with how president trump has sometimes approached issues such as tiktok, such as, you know, other issues having to do with beijing. what he ends up doing is, as we were discussing at the top of the hour, still tbd, and to what extent he has the legal power to do that is something that you've been discussing on your show, i do

think excuse me, i think it's interesting that you noted that the head of tiktok is attending the inauguration. that does seem to suggest that his confidence is probably not ill placed when he says that he thinks that they will find a solution. >> all right, david, the president elect is not the only one who is rethinking his antipathy towards tiktok. already, some of the lawmakers who voted for this law, including democrats, are now backtracking. is there a political price to pay for lawmakers if this very popular app goes dark tomorrow? >> sure there is, but there's always a political price to leadership, and this is a moment where either lead the nation in a conversation about our own national security and the data privacy of tiktok users, or you fall to the political winds and look, this was an overwhelmingly bipartisan vote. i think it was 360 to 58 or something when it first passed. this wasn't close. >> it was republicans and democrats. it was joe biden and it was donald trump. and it is because of the security risks that tiktok users face with all

of their data in the hands of china. of course, we live in a digital generation where we know that our data is taken by a lot of people, but in the case of google and apple and others, it's domestic companies. in this case, it is china who is an adversary. they are not an ally. and so i think what you're seeing from a lot of politicians, but we're seeing it from trump right now, he's the president. let's focus on that. is someone who's willing to put his own personal and political interests ahead of the security of americans. this is kind of one of the first moments we're seeing this, where the security interest of americans is at risk, and donald trump is saying, don't worry about it, because i'll solve your problem for you. well, the way he's going to solve the problem is by triggering part of the statute that doesn't actually apply. he there are not negotiations going on. bytedance does not want to sell. and so donald trump does not have the authority on tuesday to say i'm going to postpone it for 90 days. but i suspect he will because as we discussed, there's really nobody to sue. it would be up to his own solicitor general, his own department of justice, perhaps even pam bondi, if she's

confirmed quickly to actually bring an action. and there's and apple's not going to do it and bytedance is not going to do it and google's not going to do it. so donald trump will probably get away with it. but it actually just reflects kind of on his unfitness for office. >> if he ultimately makes this quick decision. >> great. fernand. in addition to the tiktok ceo, we are also going to see the three richest people in the world elon musk, jeff bezos and mark zuckerberg prominently seated in the gallery at the inauguration. perhaps one of them will get the final rose and be permitted to purchase tiktok separately, though in his farewell interview with lawrence o'donnell, president biden warned about the developing oligarchy in the united states. let's take a listen. >> look. if the decision is made that the multi-billionaires, the super, super wealthy, the wealthiest people in the world began to control all the apparatuses from the media to

the economy, then who do i get to fight back for me? who do i get to? i mean, look, i think everybody deserves this a shot. that's not a guarantee. just a shot. >> right, fernand? are there risks for president elect trump in flouting his very close ties with these billionaires? >> melissa, there are only risks if there is a counterweight to that. i think what was so stark about president biden's warning with regard to these? >> i don't think their emerging oligarchs, i think they are oligarchs is the fact that it came so late in the process. one would have kind of wished the president would have been a little bit more robust in making the case against what these folks were doing, but i think i think it's correct to say that they do represent a threat, by the way, not just in the united states. you see individuals like elon musk wanting to use that unprecedented historic amount of wealth. we've never seen so much
