certain buzzword from donald trump and many of his cabinet nominees. >> we will forge a society that is colorblind and merit based. >> ensuring readiness and meritocracy is front and center. >> return our country to the merit system. you know. >> we must. >> be the. >> ultimate meritocracy. >> yes. three white men talking about the importance of merit in roles they're all unqualified for. donald trump and his nominee for defense secretary, pete hegseth, and nominee for cia director john ratcliffe. it's an especially dubious concept for trump in particular, since this self-made man in scare quotes reaped about $413 million from his father fred's real estate empire at birth, and then dodged taxes all along the way of his career. that donald trump has some feelings about merit and diversity, which,

according to trump and maga world, counts as inherently qualified white men who deserve every job, losing out to people who are not white men and therefore inherently unqualified diversity hires. and with those grievances in mind, trump repealed lyndon johnson's 1965 executive order 11246, which forbade federal contractors from discriminating on the basis of race, color, religion, national origin, sex, sexual orientation, or gender identity. it granted the labor department the power to enforce its provisions through a contracting standards office, and has for decades been used by presidents of both parties to improve workplace standards across the country. the executive order, which johnson signed a year after the civil rights act of 1964, required that employers who accept federal contract money take affirmative action not to discriminate against job applicants or workers. and as of

this week, it is no more. and tonight, as of about two hours ago, all federal diversity, equity and inclusion employees have been have been placed on paid leave following the replacement executive order trump signed tuesday night, claiming to restore merit based opportunity. now, again, merit is a curious thing to focus on, since many of trump's own cabinet picks have been deemed the least meritorious and least qualified individuals to ever be nominated for their posts. there is political nepo baby robert f kennedy jr to run the department of health and human services, despite having no health care expertise, and south dakota governor kristi noem for homeland security secretary, who so qualified she's banned from tribal lands, making up 12% of her state because of how flagrantly she's offended indigenous tribes. there's trump's pick for director of

national intelligence tulsi gabbard. where to begin on her merit. the wall street journal reported last week that in tulsi's meeting with republican senator james lankford, she couldn't clearly articulate what the role of director of national intelligence entails. and when she met with republican senator mike rounds, she seemed confused about a key u.s. national security surveillance power that she would be charged with overseeing. and who could forget trump's choice for fbi director kash patel? like gabbard, he hasn't had a confirmation hearing yet, but he submitted a background questionnaire for senators on the judiciary committee. the new york times notes one of the most intriguing lines in his reference to participating is his reference to participating in the american bar association's judicial intern opportunity program, a diversity initiative. while a student at pace university's law school in 2003. i guess

diversity isn't such a dirty word. if your sole and total allegiance is to donald trump. meanwhile, perhaps his least qualified cabinet pick could get a vote before the full senate as soon as tomorrow. aforementioned defense secretary choice and former fox weekend host pete hegseth, as senators will have to weigh a new allegation involving the content of his character. in a signed affidavit to senators on the armed services committee obtained by nbc news. headset's former sister in law, danielle hegseth, claims that he engaged in volatile and threatening conduct that caused his second wife, samantha, to fear for her safety. according to the affidavit, samantha hegseth developed and executed plans with members of hegseth family and mutual friends to help her escape if she felt she needed to get away from hegseth. noting

that the plans included what danielle hegseth refers to as a safe word, a code word that samantha could text to her to let friends and family know, or to text her friends and family to let them know that she needed help. through his lawyer, hegseth denied that he was abusive to his ex-wife samantha and his ex-wife samantha, and said there is there was no physical abuse in my marriage. that is what samantha said during their divorce, and both parties signed a court document saying that neither parent claimed to be a victim of domestic abuse. the affidavit was provided in response to a request by armed services committee ranking member senator jack reed. after learning that danielle hegseth was interviewed for an fbi background check, but that details of her testimony were not included in the final briefing provided to senators. joining me now is senator chris murphy of connecticut. he's a member of the senate foreign relations committee. senator, thank you for being here. let's go through this. the meritocracy

that donald trump wants to build includes mr. hegseth, who in addition, the wall street journal has reported, was repeatedly passed out from alcohol abuse, according to witnesses. pete hegseth regularly abused alcohol to the point that he passed out at family gatherings and once needed to be dragged out of a strip club while in uniform, according to an relatives account of his behavior that was given to u.s. lawmakers and reviewed by the wall street journal. he has denied the allegations, calling them part of a smear campaign. is it a smear campaign by everyone that he used to work with at various places like fox and these charities and his apparently former relatives? or is he just not a guy that has, you know, a lot of merit? >> well, i mean, according to donald trump, the only merit is that he watched you on tv. right. >> if you're. >> a tv. >> personality, you are qualified for donald trump's cabinet. and i don't know, i mean, maybe in some, you know,

lower level departments that wouldn't be a threat to the country, but it is a threat to the country. if the post is the department of defense protecting america. the director of national intelligence in charge of hunting down information about terrorists. i mean, listen, this guy is not qualified. i mean, not even remotely qualified. and at his hearing, he tried to pretend not only that this was a witch hunt, but that it was an anonymous witch hunt. well, increasingly, we have people going on the record putting. their names to very specific stories about. gross sexual misconduct, public drunkenness, and financial mismanagement. i had hoped that this last report was the straw that would break the camel's back, that there would be just a handful of republicans who would press trump to appoint somebody a little bit more qualified. there's still hope. but the. >> you know, impact. >> of hegseth taking the reins of a department that oversees the moral development. of

teenagers and men and women in their early 20s, just incredibly, incredibly disastrous for the morale and development of our armed forces, young men and women who are looking for, for, for not just strategic leadership at the top of the department of defense, but moral leadership as well. >> but what i mean, what does it say about, you know, the republican party and your colleagues on the other side of the aisle who are going to confirm him? let's just be clear that, you know, joni ernst would actually be well qualified to be secretary of defense, but she's a woman. the current secretary of defense is a four star general, but maga people regularly refer to him as a quote unquote die hire. he's a literal combat veteran, four star general, but he's black, so therefore he can't. i mean, the way that they're determining merit does appear to have something to do with the color of one's skin, one's gender, and whether or not they're on television. so what is meritocracy? what does it even mean in the trump era? >> well, i think all it means to donald trump is first and

foremost that you will be blindly loyal to him. right. that that's his assessment of merit. will you be loyal to me? will you violate the law and the constitution, if that is what is necessary to help me politically or keep me in power? >> b did. >> i see on tv? and do i think that you look like somebody who, in my mind should occupy that post? but you. >> know, we. >> saw this on display over the last four years. i watched my republican senate colleagues target women nominees, especially for the judiciary and nominees of color. they were subject routinely to a totally different set of scrutiny than white nominees or white male nominees were. so this isn't new to donald trump's nomination process. when joe biden was putting up nominees, his women nominees and his black and hispanic nominees would always.

get a different level of attention, a higher bar that magically had to be crossed by many senate republicans. >> let's talk about some of the pragmatic impacts of this. there's a federal hiring freeze that a lot of there's a concern among military veterans that the va could be understaffed as a result of it. they frozen hiring. there were nurses who were preparing to accept jobs as early as february who will now not be there. and there's already a shortage of care in the military. are you concerned that the hiring freeze there will harm veterans? >> well, it. absolutely will harm veterans. what we already know is that we have unjustifiably long waiting times for care throughout the va, especially in the mental health system. so you have to constantly be filling vacancies just to make sure that veterans who are at risk of suicide don't go into an interminable waiting period. but remember what their

agenda is. their agenda is to destroy people's faith in government so that they can sell government off to the billionaire class. and so that's partially their agenda in the va. it's to underfund the va, the core va, where you have government doctors and therapists doing work so that some private equity firm can come in and buy up the veterans clinic and make profit off of it. so their agenda here is not to save you money. it's not to run a better system. it's to make government look bad so that they can hand it off to their billionaire friends. >> yeah. one quick thing. you made some news yesterday in questioning elise stefanik, who is donald trump's choice to be our un ambassador. and you talked about the spread of glee among far right wing groups over elon musk and his behavior. can you say more about that? what threats are you seeing out there? what kind of reactions are you seeing to him?

>> so listen. what you saw is what you think you saw. elon musk did the heil hitler salute. he did. and of course he did, because he's been, you know, constantly trading in anti-semitic conspiracy theorie. on twitter. he endorsed the far right neo-nazi party in germany. but you don't have to believe me. just look at what happened that night on far right telegram channels, neo-nazi groups and white supremacist groups here in the united states said, that's our guy. that's our signal. donald trump's with us. he's with our white supremacy agenda. you pair that together with the 1500 pardons, which is a signal to those fringe violent groups that if they engage in violence in donald trump's name, that they'll get away with it. and what you're talking about is maybe the most dangerous moment in modern american political history, where there is a sense of endorsement from elon musk and a sense of entitlement and

experienced career staffers across several divisions to post. considered to be less influential or focus more on immigration enforcement. one of these officials includes a senior counterintelligence attorney who played a key role in deciding to search trump's mar-a-lago residence to retrieve the classified documents he illegally took home. as part of that now shuttered federal investigation. joining me now is everett kelly, national president of the american federation of government employees, which is the largest union representing federal and dc government employees. thank you so much for being here, mr. kelly. thank you. this is the order i'm showing. i'm holding it in my hand. this memo, we can put it up on screen. and it went to all heads and acting heads of departments and agencies, shuttering dea offices and other things. what is the union's response going to be? >> well, first. >> of all, i think that. >> we have an. >> obligation to educate the public. >> as to what dei really is.

>> because. >> number one, it's not affirmative action as some might think. dei is about. >> making sure. >> that, say. >> a veteran. >> may have a handicap or an injury from. >> the services. >> and come to work for the federal government. the i would make sure that that veteran has the, i guess i would say the opportunity to work in a job and they were placed in a position where they could accommodate that veteran and so that they can do their job. so dei is about that and about providing services for workers. it's not about the color of a person's skin. >> and it's not a quota program. let's just be clear. it means that you know not. and it also i think for a lot of conservatives, they believe dei just means black people getting jobs. and so when they see a black person in any job, they say, oh, that person's a d, or they said it about the literal elected vice president of the united states. she wasn't hired. she was hired by the american

people. 80 million americans voted and voted for her, but they can't see through her race and gender. so it isn't just about hiring black people and women, right? it's about disabled veterans being accommodated. it's veterans returning from wars are also under dei. >> absolutely. and i see that as a veteran myself. right. i see this initiative as a direct impact and attack on veterans of the 2.2 million federal workers, 642,000 of those are veterans. and so this is in my way of viewing this is a direct attack against veterans as well. you know, the misunderstanding of what dei really is. you know, it's on us to really educate the public as to what it really is all about. >> so taking down the websites is one thing to make sure it's gone. i mean, again, what is going to be the response because you said this is 2 million some odd employees. donald trump is trying to obviously purge people in the civil service, in the federal government, not the

political appointees, but the people who usually transition from administration to administration working in the civil service. he would like to purge them. the project 2025 plan was to purge up to 50,000 career civil servants, replace those positions with trump loyalists. do you see this as sort of the first step in trying to do that, to purge civil servants and replace them with trump fans? >> you know, thank you, because so many people miss that. that's exactly what i see, because, you know, this administration told us exactly what they was planning on doing, right? and they're doing it. this is an attempt to take apolitical civil servants and make them political appointees, make them, you know, loyal to the president of the united states and not necessarily the people of the united states, nor the constitution. >> yeah. let's see. i'm going to play a clip from jd vance, who's now the vice president of united states. he was on a show called jack murphy live in september of 2021. this was the advice he gave donald trump.

expert to get him out of the position because donald trump is mad at him. what is the union going to do? what is your organization going to do about all this? >> well, you know the thing about it. you know, we are expecting this administration to follow the law, to follow contracts. if there's a contract issue, you know, and if they don't, then we will litigate, you know, that's what we plan on doing. you know, this is about taking civil servants and making them political pawns. that's what this is all about. you know, and again, i've said from the beginning of this election right cycle, that this president that is now the president want to make sure that he has civil servants that's loyal only to him and not the constitution, not the american people. that's what this is all about. and i hope that the american people will realize that, you know, it's not about nothing less than the loyalty to donald trump. >> yeah. i will note that

soldiers after the civil war ended with the insurrectionists defeat in 1865. and how did that go? well, they soon took over state governments across the south, which led to a host of problems, including the violent end of reconstruction. therefore, in america, before and after the civil war, meritocracy meant that any white man was qualified for any job or opportunity, and any black person, brown person or woman was presumed not to be, even though most americans had little more than a grade school or high school education, whether they were black or white at the time, what was important was ensuring that white male workers suffered no competition. andrew johnson tried to do his part, vetoing the formation of historically black colleges since what the southern planter class wanted was field workers, not educated blacks, who might do inconvenient things like demand rights. his veto was overturned, but when it came to the pardons,

johnson at least had some standards requiring soldiers to swear a loyalty oath to the united states and free any slaves that they owned. and he included exceptions to the general pardon that included soldiers who had attended the us military and naval academies, who had to file a petition directly to the president to get a pardon. donald trump had no such standards, handing out pardons like oprah hands out gifts. you get a pardon and you get a pardon and you get a pardon with no exceptions or apparent thought process included. and yesterday, the 78 year old president seemed to have no idea who he even gave pardons to, or the violent criminal acts they committed. >> you would agree that it's never acceptable to assault a police officer. >> sure. >> so then if i can among those you pardoned dj rodriguez. he drove a stun gun into the neck of a dc police officer who was abducted by the mob that day. he later confessed on video to the fbi and pleaded guilty for his

crimes. why does he deserve a pardon? >> well, i don't know. was it a pardon? because we're looking at commutes and we're looking at pardons. okay, well, we'll take a look at everything, but i can say this. murderers today are not even charged. you have murderers that aren't charged all over. >> yeah. where? and somehow, with a straight face. minutes later, trump claimed that he was more of a friend to the police than any president that's ever been in office. today, more of the criminally convicted trump supporters who assaulted those same police or conspired in the violent overturning of the election continued to be released from prison. enrique tarrio, the proud boys leader who was serving 22 years for seditious conspiracy, returned to miami in triumph. he, of course, went straight to san diego conspiracy theorist alex jones yesterday after being released from prison. >> well. >> now it's our turn. now it's our turn. i'm happy that the

of his planning of part of the insurrection, but he had also had guns on him, and he had previously been arrested for burning the black lives matter banner at a storied d.c. church. he is somebody who's been to the white house before. he actually was there in 2020 as the leader of latinos for trump. but what do you make of the comments that he made on alex jones calling for retribution, because he seems quite emboldened? >> i think. >> i think that's right. >> i mean, i think. >> he's emboldened. >> and i think the. >> problem is we have no. >> idea what he's capable of. >> i can tell you that in a place like miami. >> to your point. >> george. >> he is seen as a hero. >> he's seen as an anti-communist hero. and that's a problem here. >> and we. >> know and. >> you know. >> this. >> more than anyone, that. >> republicans have done a. very dangerous and brilliant. >> job at. >> of course, exploiting. >> the. >> very fear. >> and the political trauma that a lot. >> of cuban exiles have in a place like miami. they've cast the democratic party, of course, as the communist regime. and someone like enrique tarrio is sort of caught in the middle of

that. and that is why today, in a place like miami, you can see people wearing shirts that say, enrique tarrio did nothing wrong. here's the danger, though, to your point. and enrique tarrio is someone that has been seen in protests wearing patches that say right wing death squad no. those right wing death squad patches are a reference to chilean dictator pinochet. the dictator pinochet is someone that justified political violence and killings in the name of getting rid of communism. now pinochet is someone that enrique tarrio i know because i've seen sort of pinochet references in his own home. in 2018, enrique tarrio praises pinochet. and so the danger of enrique tarrio is that he is coming back to a united to a miami where that paranoia that he has is being validated. now, the weeks leading up to january 6th, enrique tarrio literally was believing that joe biden was equivalent to the bolshevik revolution, and he had to stop that at no cost. >> he believed that. >> and so what worries me is

what we don't know what they're capable of doing, and that it's a very dangerous thought. >> yeah. i mean, and, you know, george, he was involved. he's been politically adjacent before, you know, tarrio was the head of latinos for trump, the national version of it. and he's already he's the guy that donald trump said, stand back and stand by. and now the message that's been sent to him and stewart rhodes is whatever, anything goes. as long as trump is president, they can kind of do whatever they want. i mean, there's two ways that that could go. they could be the new tea party movement, and we could see a bunch of january 6th, former violent insurrectionists in congress or as governors or as mayors, and they could get elected or they could go the violent way. >> well, i mean, what have they been rewarded for? >> they have been rewarded for the violent way. they have been told. >> that they. >> were wrongly. >> prosecuted, that they were. >> hostages for. >> for standing. >> up for. >> their views by. >> committing this violence. >> so the message. >> is engage in violence. and if it's for. >> donald trump. >> he'll protect you. >> yeah. >> and, you know, this is the

problem of. >> electing a. convicted felon. >> and criminal. president of the united. >> states and who has nothing to lose. you know, to come back to you, paula, because i lived in south florida and have some familiarity with the politics in miami, this feels like the perfect storm. you know, it is rare that a black latino, a black cuban is, you know, rises to this kind of prominence. you know as well as i do that black cubans are tend to be somewhat marginalized in the cuban community. but this guy is a black cuban. i don't know if he acknowledges it, but he is literally. and now he's the former head of the proud boys. he's back in triumph in miami to a very red, ruby red right wing miami and increasingly, trump deeply trumpy miami. give me sort of the worst case scenarios of what that looks like. >> well, i mean, so i think the interesting thing about enrique is that i think there's two sides of the story. i think the story that we keep saying is sort of the story of the very powerful, dangerous enrique. i

actually think enrique is a very insecure, dangerous person. he is a black cuban, ordinary person from miami, you know, a bubble of miami where white privileged cubans rain in this in this city. and i think, enrique, from what i gathered years ago, is someone that really never fit anywhere in miami. and in the proud boys. he went from being absolutely no one here, literally no one in the proud boys. he found belonging. he found community. suddenly he went from being nobody to being praised by roger stone, by donald trump. and in that little power that donald trump gave this black cuban person from miami, enrique tarrio, ran with that. i think to your point, joe, i think a lot of people are trying to make sense of how is it, you know, that this black cuban person, son of immigrants, ended up carrying the torch of white supremacy on january 6th, becoming this general that led soldiers to january 6th? and i think i keep thinking of how enrique tarrio introduces himself. sometimes he says, i am 40% african. and then he says,

directing the civil division to examine possible legal action against states or cities, with laws barring officials from cooperating with immigration enforcement officers. reuters noted earlier today that the u.s. military is also preparing to send an additional 1000 troops to join thousands of national guard troops already on the southern border. the associated press reports that trump will not prevent immigration enforcement at protected spaces like schools or churches. those actions follow his initial flurry of executive orders that included declaring immigration a national emergency, calling to reinstate the remain in mexico policy to end catch and release, and to end birthright citizenship. some of these policies, like redefining the 14th amendment, will clearly wind up in court. but make no mistake, all of them will produce images and headlines that will test our collective dignity, and we cannot hide from them. we need to face them head on. and joining me now to do just that is congressman robert garcia of california. congressman, let's talk about these. first of all the fires. we know the hughes

given every single disaster during. >> the biden presidency. >> yes, california is a donor state. let's talk about these threats. donald trump believes, apparently, that he wants that. he needs the visual of blue states of immigrants in blue states suffering, being dragged out of restaurants, dragged out of schools. he wants that in blue states. he wanted it in illinois. that was a no. he would love to have it in california. will california resist that even at the threat of prosecution? >> we have to. i mean, this is about our values as a people. i'm an immigrant myself. this idea that now, as an american that is. >> born in. >> the united states. >> is not an. >> american because a parent might be undocumented or undocumented, or a parent is on a on a visa. that is a legal visa. by the way, if you're born in this country, you're an american. if you've been here for ten, 20 years and you've worked hard, you're in the back of a favorite restaurant. you're working at a small business, you are part of our country. so this is, i think, a moment, like you said, that as a community and as a country, we have to look deep inside and think, who are we? are we going to be good people?

are we going to be humane people? are we going to be true patriots that believe that all of us are part of this country? we all helped build this country? i think what donald trump is doing is dangerous, but we've got to fight back. this is not a moment to work with donald trump, to work with the republicans on immigration solution. >> they're going. >> to steamroll us. we've got to fight like hell. >> yeah. i think people forget that when the third when the 14th amendment was passed, it was because a lot of the enslaved people, they were either born in africa or their parents parents were they were considered not american citizens because they were africans. right. and so they it was built around that. and so the idea is should be deeply offensive to everyone. what is the fight look like? are business owners going to stand up to this? because a lot of them are republican leaning. a lot of the big agriculture. who stands up to this? >> well, i think. >> you're going to have. >> to, because at the end of the day, america's. food supply is dependent on immigrant labor, not just in california but across the country. the folks that are picking our food, that are putting our food together and sending them essentially to american families, are immigrants, most of them not documented or have some type of work permit or residency or residency that's in progress.

and so if donald trump implements his plans, you're going to see an incredible disruption in the food supply and the people that are working at our restaurants and the economy is going to suffer, and it's going to actually make inflation dramatically worse. and so business people are going to have to do the right thing. but as we've seen, donald trump has this crazy ability to hold over his supporters and direct them to do, i think, horrible things and to seek the worst in us. so we've got to be very honest, i think as progressives, as good people, as democrats, and push back until the truth about the impacts of the american public. >> right. and do you think that people are missing the connection between the literal food they eat? and because i think people we say it on this show a lot, but i don't know that people are connecting that. that's why price that's how prices go way up. if you get rid of the people picking the food or working in the meatpacking plant, so people get that. >> or they. >> don't. >> or the people that are actually building our homes or. >> building our business. >> yeah. i mean, these people are majority immigrant labor. they're building our homes. they're in our agriculture, in our farms. and so this idea that we're going to attack them,
