and in the fight over health care reform that passed congress last night, opponents are already lining up with fresh road blocks that they will try to throw in the way of reform. senator jim demint, republican of south carolina, is introducing a bill this week to repeal the bill, calling it unconstitutional. demint issued this statement, quote, this arrogant power grab proves that the president and his party care more about government control than the will of the american people. americans told washington to keep its hands off their health care in opinion polls, at public protests, and at the ballot box, but their pleas were ignored. meanwhile, virginia's attorney general plans to sue the federal government, claiming congress lacks the authority to force americans to buy health insurance. nbc's luke russert is live on capitol hill. luke, as the various legal challenges start take us through what's going to happen over the next couple of days. >> reporter: david, here's what's going to happen. the senate is most likely going to start debate tomorrow, 20 hours of debate on the reconciliation bill. president obama will sign the senate bill tomorrow. and for over those 20 hours the

gop, using one of 19 points of order, is going to attempt to take down a certain piece of the reconciliation bill, which means it would have to be sent back to the house. now, there are two ways to do this. we're getting very wonky and washington right now. the gop can take a scaffold and say you know what? this area does not deal with the federal budget because anything that is passed with reconciliation has to be passed using the budget and they would have to cut it out, go back to the house, and redo the bill. however, if there is something in the reconciliation bill that pertains to social security, david, then the gop and the senate parliamentarian can take what we call not the scaffold but the hatchet and strike down the entire reconciliation fix-it bill democrats are counting on right now. so you better believe that every rnc gop lawyer there is is actively looking at this legislation right now trying to find that magic part that they will be able to take the hatchet

to. if that happens the legislative process has to start all over again and most likely we'll end up with the senate health care bill. that is the process of the next few days. democrats are on the edge of their seats trying to see exactly what is going to happen. david? >> i've got some information on that incident last night on the house floor, a congressman who called bart stupak democrat of michigan a baby killer. what's the latest? >> reporter: yes. a congressman from texas, three-term congressman named randy neugebauer, he said last night on the house of the -- on the floor of the house that he said, it's a baby killer referring to the bill and not mr. stupak himself. he has issued an apology about an hour ago. he is of fame for cosponsoring a bill last june, david, that would have required folks running for the presidency of the united states to display their birth certificate from the beginning of the presidential campaign. >> oh, great. >> he most likely will become a

the woman and her car he was able to stop on the shoulder and incredibly nobody was seriously hurt. up in smoke. an historic river boat in st. louis, missouri has been destroyed by a fire. today investigators are trying to find out how the robert e. lee river boat caught fire yesterday while docked on the mississippi river. nobody was hurt. now to a new situation on the jersey shore. the mayor of seaside park was arrested this weekend in a bar room brawl. thomas conners was at a night club saturday evening whith his 23-year-old son and 22-year-old daughter. something happened inside and the family was being escorted out by a police officer when the son and daughter allegedly tried to hit the officer. the mayor tried to intervene and was also arrested for disorderly conduct. he says he'll be exonerated when all the facts are out. one news report suggested it all started because someone was coming on to the mayor's daughter. people for the ethical treatment of animals is fighting mike tyson the former boxing

[ crowd noise ] >> reverend jesse jackson confronting a crowd of angry tea party protesters on capitol hill on sunday. jackson was one of the targets of opposition to the health care bill, but he also heard some bizarre shouts about not being with martin luther king the day he was shot. that, however, was mild compared to the racial epithets hurled at african-american lawmakers like john lewis and james clyburn. emanuel cleaver was even spat upon. antigay slurs were shouted at congressman barney frank as he made his way through the halls of congress. in their determination to intimidate democrats did the tea party do more to scare off republicans who have tried to co-opt their anger? nancy skinner is a progressive radio talk show host and armstrong is a conservative talk show host. armstrong, what did you make of

what happened saturday and what it says about the tea party movement? >> listen, i think overall the tea party is representative of most americans' angst against the policies and agenda of the obama administration and disenchantment with congress republicans and democrats. i think the chance of tts of th word is so outrageous and shocking, even those hearing that should have condemned this and expressed outrage immediately. i don't think anyone has a monopoly on bigots and ignorance. you can have an organization and you have no idea what can come to the top after the organization emerges. it shouldn't happen. i saw the earlier interview with congressman lewis and clyburn and i felt bad for them that in 2010 we're having to discuss this kind of ignorance. but i don't want to demonize and condemn the entire tea party. they're not for republicans. they're not for democrats. they're advocating what works for this country and they just feel that most people elected to

congress today and especially the white house is out of line with what most americans want and the direction they want this country to go. >> nancy skinner, we spoke over the weekend with the executive director of the tea party and he denied that this happened. he said there was no evidence of it and thought this somehow may have been a figurement of somebody's imagination. does that sound like leadership to you in terms of condemning this? >> i don't think that will dig the hole a little deeper here. david, atta boy for such great coverage late into the night and then this morning. really enjoyed it. the question is, does this, is it toxic for the political cause at hand? you don't have to be from madison avenue to see the democratic pictures which were people who have lost their lives because of health care, sad stories, which rush limbaugh and others are calling sob stories, and their pictures were these angry protesters hurling expletives. even those folks who may or may not have been the slurs, the vast majority of people had signs like communism, socialism. they were talking to speaker pelosi and shouting down her.

people in peoria feel that. those pictures have meaning. and they want progress. now, one quick thing. going forward, and david from said this, a bush speechwriter, the republican party should distance themselves from these people. it was their waterloo to be associated like this. instead of trying to when you're scored on in football instead of trying to score your own touchdown you try and take seven points off the board. that's what they're trying to do and it ain't going to work. >> in fact, here's part of david from's quote. armstrong, we'll get your reaction. he said we followed the most radical voices in the party and the movement and they led us to abject and irreversible defeat. >> listen, i've got to tell you, if you follow what has happened from new jersey to virginia, and massachusetts, i got to tell you, these are not democrats and republicans. these are people who are just outraged with where this country is going. in all fairness, there are people including columnists like myself who have used the word

"socialism" and "communism" as associated with this administration. am i antiobama? no. i voted for him. but i, like many mernls, are very disappointed in his policies. we assumed that when massachusetts, they lost massachusetts, that the president got the message and he was going to do the will of the people. it makes it seem as though -- >> scott brown supported some of the health care, what happened in massachusetts, and he distanced himself as much as possible from the tea party crowd in massachusetts so i'm not sure that is quite a great analogy. >> i don't want to say the tea party has, the republican party has ownership of the tea party because they have no control over them. that is unfair also. >> i don't know about that. armstrong i keep hearing time and time again the will of the people that the tea party are the people and all of these conservative talkers, we are the people. wait a minute. we won an election. democrats did. and these polls, because this was so demonized for so long, still "the washington post"/nbc poll was one point in favor of the plan. you've got to stop talking for all of the american people because i think people resent

five-minute interviews cannot possibly get the job done. but i do think in contrast to some other people that he is sincere. he just is trying to find his waythis. the i think -- i heard a sincerity that i have not heard -- not in that scripted appearance last month. i do think that he is aware that the public has lost total respect. i think he's trying to gain that back. people are going to want these details about what exactly happened that night and all that and they are privy to the texts and that stuff, that aspect of it, some people want every last thing they can wring out of that they won't get that from him. they should accept that. i think he was believable and that he truly understands the scope of what he did and wants to somehow become in the good graces the american sporting public. >> fascinating interview last

and today's top stories, president obama will sign the health care reform bill tomorrow. the signing ceremony will take place at the department of the interior and the president will hit the road convinces americans the benefits of the legislation. he travels to iowa on thursday. netanyahu is in washington to talk to the obama administration. secretary of state hillary clinton met with netanyahu today. his visit comes at a tense time for u.s./israeli relations.
