george pataki, editor of the "reed report" joann reed former tsa nominee and attorney susan filan. good wednesday morning, i'm chris jansing. this is "jansing & company." and it was the democratic dream team that never was in 2008. i'm talking about barack obama and hillary clinton, but this morning bob woodward has touched off a firestorm after saying it really is being considered for 2012. woodward, of course, fresh off all that white house access for his new book says the idea is now officially on the table. confirming it on "andrea mitchell reports." >> if obama seeks re-election as people expect him to, he could be in trouble, like he is now. and need the support of the groups that hillary clinton did very well in the primary elections. bring her on the ticket and make

biden secretary of state. they would all go out there and be delighted and happy and it might help obama politically. >> let's bring in our company, governor george pataki and karen finny who served as democratic press secretary to former first lady hillary clinton. so, karen, i have to start with you. does she want it? will she do it? will barack obama go for it? >> i think that this is fodder for the media and kind of inside the beltway musings, but it's silly, no. i don't think, she has a great job, she's doing a fantastic job. you know, again, i think maybe bob woodward. >> she is doing a fantastic job, but she also said, she told tavis smily, i'm not going to take a second term as secretary of state, it's too much traveling, i'm tired. i don't know if in 2012 she's going to be secretary of state.

has been a failure and all of a sudden get excited and say, hey, maybe there's hope. i don't know if there's any subsentence to it post-election but a way of talking about the failure that has been the democratic congress and administration. >> i understand the republican, former governor george pataki said the democrats are doing something smart here. >> politically, not governmentally. they are trying to distract the american people from the record the pelosi, reid, obama. >> i think it was three years ago i had this conversation with sally quinn. washington has been buzzing about this for a while. this is the first time they were talking about inside the white house and, again, the white house is denying it. let me play for you what sally quinn said back in the summer. >> i do think that she would be in place very effective as vice president, if they made the move after the midterm elections, hillary could go right into campaign mode and start taking on the tea party crowd.

>> joann, tea party crowd. a lot of people said she would help with minority vote and the youth vote. are there areas in which politically it would make sense if barack obama is in trouble, does she help him? >> well, i think, first of all, that assumes that things are static. where we are today where barack obama stays where he is going to be two years from now. >> a big window of opportunity here. if they make the switch, they have to make that decision. >> that is not something i can so them doing midstream. i know that there was a certain point at which biden wanted to be secretary of state, that was the job he actually wanted. you sortcolonkernel of something that was true in the past. in 2012, we'll look at a different situation. we don't know where we'll be politically. the idea that you would suddenly panic in the obama admin strigz and switch out your vice president. >> you don't think it's time to pan snk. >> no. i think if you did it now, it would be incredibly disruptive.

>> she does make a good point, governor, doesn't she? the republican ads saying, obviously, this team didn't work. >> joy-ann makes a very good point. it's wonderful to distract the ways before an election, but post-november, i doubt very much if it is going to happen. >> karen, we got to go. >> the republicans who have been pushing this story. >> oh, all right. >> oh, well, all right, maybe we will talk more about this. so, if it's only possibly obama/clinton in 2012, another signal that sarah palin may be interested in heading up the republican ticket and it's coming out in an angry e-mail from her husband. he defended his wife sending an e-mail to joe miller and his staff when miller ducked a chance to give palin an endorsement, just as palin has done for him. sarah put her bleep on the line for joe and yet he can't answer a simple question.

is sarah palin qualified to be president? i don't know if she is. joe, please explain how this endorsement stuff works, is it to be completely one-sided? actually what miller answered is that there were "a number of great candidates out there." so, i would say definitely not an endorsement. joining, shashana. how do you read this? is this endorsement stuff to be completely one-sided, is that an indication she might be thinking about running for president? >> i think they are thinking about it. i think she will run in 2012. i think what's more interesting to take out of this is how, is the palin's reaction. yes, it was todd palin's reaction on behalf of his wife, but safe to say they're talking together. this is both of their opinions. the way he over, as totally overblown what joe miller said, as you said, it is really taking his words out of context.

>> isn't that the way the political game is played? sarah palin is not running around the country, you know, for her health, i'm sure. i mean, that's, you do that. you get your political chance and that was a pretty clear diss, don't you think? >> i don't. what's different, joe miller and other mama and papa grizzlies out there that she endorsed. they're friends. >> long-time friends. >> that is why he was angrier and also strange he would react that way. why not pick up the phone and say, hey, buddy, that's not cool. he sent it to his lawyer who is also joe miller's lawyer and i think that's classic palin to see something and completely blow it out of proportion instead of reacting with a quick phone call and, obviously, these e-mails are private and now they are leaked. no e-mails are private, though. >> a bad move on joe miller's part, do you think? >> i can understand todd palin feeling the way that he does.

and he wasn't asking miller to endorse her for president. no one knows, it was a simple question of is she qualified? out of respect for what sarah palin has done for him, i would have said yes. >> it's interesting, i was up in alaska and i covered the senate race and i asked joe miller this several times. how much do you think sarah palin has helped you, he wouldn't talk about it either. he didn't want the media focus off of him and on sarah palin. >> joe miller forwarded this e-mail around and wrote, quote, this is what we're dealing with. holy cow. is he hurting himself, joy-ann? >> this is the one part where joe miller is in the main stream. most republicans, including most republicans don't think that sarah palin is qualified to be president of the united states. the other issue is this

incredible sort of hubris on the part of the palin. they feel they made all these tea party candidates. sarah palin came in at the tail end of the races and sees who is going to win and jumps in and endorses. >> i think some of these were real surprises, weren't they? >> chris, i think that's right. a number of these cases is it was really a toss-up and she did have an impact and she did have a real influence on the final decision. >> maybe not the only factor, but certainly -- >> clearly not the only factor, but no question when she gets involved in a race, it has an impact in republican primaries. >> we have to end it there, governor, karen, thank you, all, we'll see you all again shortly. now, putting together a presidential event is always a big deal and probably a bigger deal when things don't go quite as planned, like this. >> the science and technology and engineering and math. we cannot sustain -- oops.

we may finally get some answers in the case of david hartley. divers expected to search the waters today after his wife said he was shot by mexican pirates while the couple jet skied on that lake that straddles mexico and texas. now, because his body hasn't been found, no jet ski found, mexican officials, in particular, had questioned tiffany's story. but today the sheriff told "today" show a new witness backs up her version of events. >> did you have anything to do

are going to send some divers down in that lake today, right? >> that is correct. we have heard from the sheriff in zapata county that there is going to be a main effort search by the mexican government over there today. so, hopefully, we will get some results in this search. >> i understand that your wife also made an appeal to president obama yesterday and this is, obviously, something because it does involve mexico that the feds could get involved with. have you heard back from them? are you hopeful at all that there may be several other avenues that might be followed to figure out what happened here? >> we have not heard back from that level yet. we are hoping to, you know, get some information on that or hear something on that. but at this point, we have not heard anything. >> dennis, tell me a little bit

about how this all unfolded for you. did you get a phone call from tiffany? what happened? how did you find out? >> i was at work and received a call thursday afternoon from the sheriff of zapata county. >> and he called you and said, we're looking for your son? >> he called and said that there's been a terrible, terrible accident and that my son and his wife, tiffany, were jet skiing on the lake and david was shauot and fell off his jet ski and they do not know the statuses of david at that time. >> is there no doubt in your mind, whatsoever, that tiffany's version of events is true? >> oh, no doubt. you know, fully supportive of what tiffany has said and there's no doubt in our mind that that is what happened. >> well, let's hope they do find

brad, we hear these rants a lot but how serious should we take faisal shahzad? >> we should be taking seriously because they mean it. they are going to keep coming. they're not going to stop, chris. >> different than it was post-9/11? >> i would say we're looking at a very new normal now. i am concerned because as we saw with the '93 trade center bombing, when al qaeda picks a target, they keep coming back and i'm concerned that times square might see something else. >> a heightened state of alert in europe and he was talking specifically about times square that they're not going to let up and in some places around the united states they are heightening security, places like lax. how concerned are you? >> well, i'm very concerned and he represents a whole new breed of recruit and radicalization movement here in the united states. as brad mentioned, he came here and was naturalized much like

ooomar hamari and these individuals are charismatic, they're english speaking and being used as a recruiting tool and we have to be concerned that this transnational threat continues to grow, especially as they target the recruitment. >> let me ask you about the recruitment and radicalization of americans. how effective are they and where are they operating? >> i'm sorry. they're actually operating here in the united states. they're now traveling abroad. we saw some 20 or 30 individuals from minneapolis leave and go to get trained in somalia. those folks are now going getting trained and our biggest concerns they're fighting

overseas and more importantly returned here. more than 20 or 30 germans being trained overseas and they, too, at least nine of them have come back. we're very concerned that they're making bombmaking training and tactical training and they can come back to their home countries and use that training in their own state. >> one thing we hear, brad, about these potential for mumbai-style attacks and after these warnings were issued we said, what do you do? do you just not go to eiffel tower or times square? the threat for places where there are big crowds of people, you can't cover everything, right? >> it's tough. he makes a good point in bringing up the germans in all this kind of stuff. we have seen arrests of french citizen and german citizens who came from other countries and became citizens of those nations to attack those host nations. we're seeing that with shahzad here. in my opinion, he should have been tried also for treason because he went and received training from the enemy of the united states and assault

americans. we have a big problem in this country because terrorist attacks are being planned based upon what kind of media coverage they're going to get. this is part of al qaeda's thinking. they want to get the longest and deepest run of media targets. not only soft targets, they want to make sure they get as many women and children as possible. we will cover that longer and deeper than if it was a group of ten men that were killed. that's scary. >> thanks very much. take a look at the traffic backup. just moments ago mission hills, california, big rig accident caused by the weather and we're going to keep our eye on that. wow, what a mess there. taped to the wall by his admittedly stoned parents. new information on what is being done to protect this 2-year-old. plus, growing outrage that trained firefighters let a man's house burn to the ground with three dogs and a cat inside because he didn't pay a $75 fee.

because the homeowners didn't pay a $75 fee. not the first time, apparently, and we wonder how common these subscription fees are across the country. so, richard lui has been investigating this for us. what did you find out, richard? >> as we look as thit this situation -- >> where is he? >> there he is. we're looking to see how common it is. it is fairly common and you can get on a plane flight and look out the window and you're probably flying over a town that uses something like a subscription fee. the reason pretty simple here. the fire departments across the country are trying to balance their books by using something like this, as i was showing before we went to the break. a subscription fee. i want to break it down so we can understand a little bit more about what these look like. generally speaking, when you go on to one of these online subscription fee sites or you have the form in front of you, you have to pay a fee.

in this case, $48. that covers from 2005 to 2006. what do you get for that year? let me zoom down and show you that area in terms of benefits. the benefits in this case is that what you have to pay is merely that $500 to the insurance company, no, all the way at the top of your screen at the moment and this would be when you take a look at the wording here, the most that you would be able to pay if you had insurance. now, if you don't have insurance, you'd still have to pay something. if you have paid a subscription fee whether you have insurance and whether it's $500 or $600 or $1,000, the fire departments are saying, you don't have to pay anything with that subscription fee. okay, but, what we're looking at there in tennessee is, well, they didn't pay the subscription fee, does that mean no pay, no service? will fire departments show up and then not fight the fire? that is part of the dynamic here. let me show ask you soyou some

that prescription fees. i already pay taxes, why do i always have to pay a subscription fee? firefighters say it's been very, very difficult throughout the recession. we have seen our revenues drop and they're trying to raise their revenue by doing these subscription fees. you know, chris, it can affect these fire departments a lot. some of them only have a $40,000 yearly budget. if you lose $10,000 in subscription fees here, chris, that's a huge chunk. >> what do they do? what is the alternative here? >> they're stuck in a very difficult situation and there is a dilemma. what i was able to find, a study put out in nashville and it was looking at the different ways that they could raise revenue. only over 20 different ways they're suggesting that fire departments start thinking like businesses. but that could be difficult for them. so, departments, you know, they're not built to be that way. that is one dynamic. the downside in all of this, chris, when they have a cut like

10% in nashville they could lose over 100 firefighters. just got this in and i want to share this with you, as well, from the international association of firefighters released this to me today and they are saying that firefighters and their association are condemning what happened there. >> obviously, a clear ethical debate here, but might be some legal issues, as well, which is why we have our legal analyst susan. let's start with the insurance company. because in this case the homeowner said his insurance company is going to pay, but then could the insurance company go after the fire department? >> you bet. i mean, the fire department arrives on the scene, stands there and does absolutely nothing to extinguish this fire. i think there's a clear question of whether they had a duty to mitigate the damages. they allowed the absolute worse-case scenario to take place. the insurance company has to be out the entire bill? i think that's an absolute clear case of civil liability. >> let's say there was a person inside or a child inside, but in

this case, there was at least three dogs, a cat and in another case we heard there was a barn that burned down with horses inside. is there some law that would cover this animal cruelty or something? >> i was wondering that myself. is there some statute that protects these animals against cruelty to animals. i mean, does the firefighter have the duty to at least rescue life and limb? you bet you. what if there was a person, a child, elderly, somebody crippled who couldn't rescue themselves? now, these animals, they're helpless. isn't that cruelty to an animal to allow them to simply perish in the flames? i think they face some kind of liability for allowing these animals to die. these animals didn't even belong to the homeowner, they belonged to their grandchildren. >> we want to stand by because another story we are talking a lot about, that little boy duct taped to the wall by his own mother. look at these pictures, you can't do it without shaking your

head. the mom thought this was funny, she told police. her child is still in foster pair but the plan is try to give him back to his mom. she is 18 and her ex-boyfriend was 19. the mom got ten days in jail and two years probation and, susan, we were given incorrect information. the deputy said that she, that this child was actually back with the mom. in trukt, sheth, she's working him back but what is the legal custody issue here? >> the law on this is what is in the best interest of this child. the theory on this is always in the best interest of the child to be reunited with the parent and the parent has a constitutional right to parent that child. so, does always the last case scenario where the child is not reunited with the mother. >> do you only look at the mother? her boyfriend is an ex-con who got three to five years for child abuse and possession of --

>> he has no rights to this child. he's out of the picture. he's not the father of the child. it's really the mom. >> but if he was involved with her. will they look at who she is involved with or only just her? >> first thing she'll have to do is say he's out of the picture. let's assume she wants him back and she's agreeing that he's out of the picture. is she a fit mother? she has substance abuse problem and the first thing she will have to do is go into recovery for addiction. let's assume she does everything she needs to do which becomes a fit mom and visitation at first will be supervised and if she can rehabilitate herself of becoming a fit mom and it is not his best interest having his own personal mother as his mother. that is the best-case scenario and that is hopefully going to happen in this case because she is very young.

assuming she can learn to parent. if she can't, she's going to lose him. >> all right, susan, thank you so much. we talked about how this is the most expensive off-year election ever, by far. here's example one. billionaire republican meg whitman who spent $140 million on her run for california governor and the former ebay ceo said she's prepared to spend even more on salaries, tv ads and we should all be on her payroll. her top adviser is making $90,000 a month. a close aide, $36,000 a month. and her campaign manager 30 grand a month. it's already an ecological disaster in hungary, but growing concern that this toxic sludge could bring six-foot high waves as a dangerous mess to half a dozen more european countries. this lighting is awful.

a lack of exercise, obesity and an otherwise unhealthy lifestyle may affect job performance. a new study shows that employees that smoke, don't exercise and eat an unhealthy diet take more sick days than other workers. smokers were 30% more likely to take sick leave than nonsmokers. four people are dead, more than 120 injured and hundreds have been evacuated in hungary. after toxic sludge leaked from a metal refinery. it happened 100 miles southwest of budapest. this isn't a mudslide, this is sludge, a waste product from aluminum production. they declared a state of emergency calling this an eke ological disaster.
