jobs showing an economy stuck in neutral. unemployment stands at a lofty 9.6%. in september another 95,000 jobs lost. almost 15 million people who wanted to work couldn't find a job. even though the recession ended 15 months ago. >> it's not a great story, because we continue to see unemployment at a major issue for businesses and for the economy. i think we are in a new normal. >> president obama and democrats are struggling to find a way to jump-start hiring while republicans are ready to pounce in november. a new cbs poll among voters show republicans hold advantage over democrats in a generic ballot 45% to 37%. candidates like christine o'donnell hope to capitalize on voter frustration to get letter to washington. get her to washington. >> i'm you. i know how tough it is to make and keep a dollar. when some tried to push me from this race they saw what i was made of.

>> and president obama is pledging to do more to help states keep and hire local government workers. >> the only piece of economic news that folks still looking for work want to hear is, you're hired. and everything we do is dedicated to making that happen. >> nbc's mike is at the white house. how would you describe the move today? >> putting it on wall street, the friend is your trend, making a positive here. the president and others pointing out the ninth straight month of private sector growth. notwithstanding all the te temporary census jobs lost. not nearly enough to bring down the unemployment rate. this is the last unemployment report, official government statistics before november 2nd. november 2nd obviously being midterm elections.

republicans pressed this time and time again. the good news for the administration and the democrats, the last time the public will officially be reminded the fact unemployment remains high. only two points higher than when president obama took office but republicans reminding everyone over and over again it is still at 9.6%. that is a problem. austan goolsbee basically saying, don't read too much into any particular particular month. move along, folk, nothing to see here. it obviously remain as political problem not to mention as the president mentioned for the 15 million people out of work. >> interesting, because the republicans want to blame the democrats for the loss of jobs, and yet they keep insisting on spending cuts and smaller government. so now we know local governments cut 76,000 jobs last month. most in education. this is a place where smaller government means more people on the unemployment rolls. >> obviously republicans dispute that saying small business, the president spoke to this earlier,

the small business bill that passed the senate before they took off for an early recess, saying tax cuts are the way to go. plenty of economists say there's not good jobs bang for the buck through tax cuts. look, this is a winning strategy for them so far, if the polls are to be believed, the recent polishes the generic backup to a winding margin, nbc last month had it at 3%. so it's fluctuated, but republicans obviously still have the upper hand as a bleak political landscape for democrats with just, what, four weeks to go. >> good to talk to you today. analysts say companies are re reticent to bring more on. health care obligation, numbers show companies are sitting on record piles of cash. "the washington post" reports they're using it to buy back their own stock instead of, say, hire more workers. in fact, this year firms announced $273 billion in buy back, five times more than last year. my big question today. what will it take to convince

companies to hire? i'd like to hear your thoughts. we're having a great online conversation. it's happening on twitter, on facebook. i want your e-mails. contessa@msnbc.com. the big question to cnbc's trish regan. talking to the ceo's of these companies what will ta toik to convince them to hire on more people? that that's the best use of the cash on hand? >> contessa good to see you. they say they need more clarity out of washington. that they're very concerned about their tax situation in the near future. very concerned about health care issues in the near future, and what all of that means for taking on additional workers, and the implications of all of that to their bottom line and they're not budging. yes. you're seeing them sit on so much money right now. instead of going out and hiring and planning for the future that way, they're buying back stock, trying to merge with other companies, and part of this is resulting in really less workers being in the workplace. it's having, really, the

opposite effect of what you know most would hope. >> so when we're looking at the fact that there are jobs being added. that only somewhat counterbalance the jobs that we're losing, where are people gaining jobs? >> well, there is some gain with the health care sector. but, you know, overall we're just not seeing a tremendous push here in -- on the job front. i mean, we're still holding steady near 10%. there's a little disappointment in the number of hours worked this past month. a little disappointment in terms of the wages. not really coming in where people thought. health care tends to be the one bright spot, but you know, contessa, it means a lot more than we're seeing to really get that unemployment rate down to levels that we saw just several years ago. keep in mind, you've got to add about 100, 150,000 workers to the workforce or jobs, i should say, every single month just to keep up with the population itself. >> and, you know, interesting,

because the president says that a lot of the economy recovery is going to happen on the backs of small businesses. that they're the ones who are going to power this through. i have a couple guys joining me making real business on adult pajamas. i'm talking to them. >> great. >> incredible story. real innovators. we'll talk to them and see what they make of this business of hiring. >> one of the silver linings in this, you tend to see a lot of creativity come out of these recessions like this. hopefully we will see more and more small businesses that really take off. >> necessity, the mother of invention in all of that. trish, thanks. a check now on the stock market. dow jones at this hour -- is it moving? there it is. up 48 points and the s&p has risen almost 5 on the day. and the nasdaq is up 7.5 on the day. by the way, the dow jones hit 11,000 briefly a little bit ago. the california governor's race takes another ugly turn with one campaign apologizing for salty

language that the other side called an unforgivable smear. it stems from a conversation caught on tape between democrat jerry brown and an aide who can be heard calling the opponents republican meg whitman a nasty slur for a prostitute. >> do we want to put an ad out? that i have been warned if i crack down on pensions, i will be -- that they'll go whitman, and that's where they'll go because they know whitman will cut them a deal that i won't [ bleep ] released it yet and the whp, what about saying she's a [ bleep ]. well i'm going to use that. it proves you've cut a secret deal to protect the pensions. >> well it didn't make it in an ad but caught on tape saying it seems almost as bad. >> right. well, you know, the brown campaign now says that, look, it's clear that this was not jerry brown who made the comment nap it was an unidentified

staffer. unidentified here is the operative word. because the campaign told me that they have not been able to identify the person, and i'm not certain that they're trying that hardnessly, because they said that, you know, there are a lot of people that it could be. everybody has different ideas as to who it could be. will i asked whether or not this person would be fired if they found out about that, they said, well, you know, we don't even know if we'd be able to identify the person anyway. so very non-committal there and certainly a question that could come up later. certainly from opponents, and this is three days before the nbc debate in california that is going to be moderated by nbc's own tom brokaw. so the bigger picture here, though is that this phone call took place about a month ago. what's the national media been talking about this past week or so has been the undocumented worker meg whitman. the big picture is that the police union that had leaked

this to the "los angeles times" endorsed whitman as a month ago, because of pension reform and said they would not -- that they would not -- that whitman would not cut the police pensions. so brown refused to do that, and they're saying that this is a dirty trick from the other side. back to you. >> dough mink oh, thank you very much. and the nobel peace prize winner away from beijing and to a prison where her husband is being held. the nobel committee just today awarded the peace price toly ow to liu xiaobo. the chinese government is denouncing the nobel peace prize award and president obama is in and kim jong-il will turn over his rule to kim jong un.

the third generation of family to lead north korea with its population of 24 million. that nation is preparing for the 65th anniversary of north korea's workers' party. private guards liared to protect american military bases reportedly have tied to taliban militants. senate report raises concerns over security for u.s. troops and lack of any oversight for the private guards. nbc senior pentagon correspondent jim miklaszewski joins me from the pentagon. i'm imagining if i'm a mother or father with smurn serving overseas this report has me worried. >> reporter: u.s. officials aware of this problem some time. sounds worse when you compile it in this one report. it's important to remember those private guards are afghans, and in any counterinsurgency as the u.s. military found in iraq, you have to work very closely with the local population, and that includes hiring people to work for you to support you in some cases prct you. but it's impossible to know if each and every one of those is

entirely on your side if they're working both sides, or they're the enemy. that's the dilemma here, but in this case, the taliban was also using afghans to put money in their pockets. u.s. military and these private contractors will to pay bribes essentially, protection money, for convoys that go through the area, and then taliban was taking half of the money paid to local warlords to protect those convoys. nevertheless, this is a problem. defense secretary gates has ordered a couple of instigations to look into at least how to minimize any potential danger or threat to american troops from any possible infiltrators working for the private security guards. >> thank you. searching for a body in a texas lake. the response from the governor ahead. two candidates.

[ william ] three years ago, i started my first real job as a part time sales associate with walmart. when william came in i knew he had everything he needed to be a leader in this company. mexican authorities say they are ramping up the search for a missing american tourist. david hartley's wife says they were jet skiing on a lake at the borders of texas and mexico last month when mexican pirates ambushed them. he was shot and killed. she escaped. his body, his jet ski, have not been recovered. u.s. officials say a search of the lake had to be suspended over threats of another ambush by drug gangs.

case now, serious federal case, over being refused access to video of a republican candidate being stopped for driving under the influence. he's suing, because the department of public safety did release dash cam video of a democrat running for office. randy jillenhaul of nbc's burlington afill kwlat details. >> reporter: when democrat peter was pulled over for speeding, the dash cam video hit the airwaves with a week seemingly no problems releasing it to the public. but what about republican tom? >> guilty. >> pulled oesh and arrested last year. >> i understand that i made a mistake. >> now running for re-election at state auditor. when several news organizations including our partners at seven days and a burlington lawyer tried to get salmons dash cam video released the answer was, no, rejected. >> a picture's worth 1,000 is words. >> reporter: now a lawsuit is being filed saying it's a double

we're keeping our eye on that rescue. police are desperately searches for two boys right now snatched from behind their anaheim, california home. two men grabbed 4-year-old jacob and 2-year-old justin and took off with them. the boy were with their mom while she took out the garbage. two men jumped out of a van, probably a silver dodge caravan with tinted windows. police suspect the boy's dad is behind the kidnapping. an amber aalert been issued. and convicted a man of terror rising a family during a home invasion. steven hayes to face the death penalty for charges including murder and rape. he is accused of attacking the family in 2007. jennifer hawke petit was raped and strangled. her two young daughtered died of smoke inhalation after their house was caught on fire, and the husband, drft petit, the sole survivor.

now, the american economy shed 95,000 jobs last month keeping unemployment at 9.6%. general james jones is stepping down at president barack obama's national security adviser. more from the president in the next hour. former president george w. bush's memoir e will hit book stores next month, and" i love boobies" bracelets set to raise awareness for breast cancer. after raising half a million dollars in 2008, that organization gave just $6,700 to breast cancer-related grants. there is light at the end of the tunnel for the chilean miners. rescue crews are getting very close as they punch through the final few feet of rock to reach the 33 people trapped underground more than two months. nbc's kerry sanders in copiapo, chile. they've made a list of who comes out first, kerry? >> reporter: yes. they haven't revealed that yet.

the only way the list would change is when the medical teams get down there, they may decide somebody has to get out first. very democratic down below. juan has tubes here that perhaps tells us most about the confidence these 33 miners will come out soon, because inside these tubes are things that are being sent up from the miners to the family here. so juan is the uncle of one of the miners down below. he hasn't opened this up. the landscape changed in the last 24 hours. you see that big, what looks like an oil drill, to the right you see red cranes. those cranes went up today. that's what they're going to use to lower down the capsule. it's an escaped capsule that will ge down this hole, this shaft that has been built, and it will go down, pick up one miner, come up. go back down, pick up another miner, come up. it's unclear how long that jurnsy going to take. some have suggested it might be as quick as 15 minutes. others said it could take two hours. that capsule has radios, has lights, has compressed air so they can breathe. there's a lot of attention being put on the safety, because they are so close to get that final push all the way down and they don't want flig to go wrong at this point, contessa. >> kerry thank you to you and to your cameraman for a great look around there at the scene in

cope yaup copiapo. before midterm elections showing unemployment rate holding steady at 9.6%. senate minoritiy leader mitch mcconnell says the stimulus isn't living up to the promises made by the obama administration and the growth of the federal government along with the health care mandates, taxes all have a negative impact on the economy. cnbc's chief washington correspondent john harwood is in columbus, ohio. as we speak, two senate candidates debating now for the job. ohio is a state here, john, that, where jobs truly matter. it's been a hard-hit state. what's their take on these numbers and what the president is doing? >> reporter: well, the exact same arguments that you just mentioned with the obama and mitch mcconnell are playing out here in ohio. last night a debate for governor between the incumbent ted strickland and john kasich, the republican, mounting a strong challenge to him. you see that in the senate race, portman has a solid lead and the house raid, 15th district of

ohio where i'm covering, kilroy, democratic incumbent is on the defensive and her response to these high unemployment numbers is to say, steve stivers, the republican, would take us back to the wall street casino days and what stiver's response is as he reflected in the forum a few minutes ago was, look, she's doing anything she can to distract from jobs and spending. those are the issues. it's not getting better. the stimulus hasn't worked. we freed a new approach and need to cut spending. that's where the argument is playing out and right now works in the republicans' favor. >> thank you. president obama, of course, pointing out how important small businesses and entrepreneurs are in creating jobs. the president spoke less than an hour ago as a factory in maryland. >> small businesses like this one are the bricks and blocks of our entire economy. and over the past two years my administration has been doing everything we can to help encourage more success stories like this.

>> "businessweek" magazine calls them one of america's most promising entrepreneurs. what do they do? sell pajamas for grown-up. like the onesies had you as a kid. selling what they call unilazy fleece for adults and sales are taking off. joining me, co-founder of forever lazy. tyler and dave. good to see you guys. >> hi, thanks for having us. >> hi. >> here you are, you've had coverage in national media. you're heading into a crucial time period for retailers. are you bringing on more workers? >> you know, we're definitely trying to. it's been hard for us getting started. hard to get bank loans and funding needed to start this business. we tapped our entire personal savings. every dollar to our name are invested in this. my parents' money is invested in this. that's been hard for us to grow and build our business, but we're hoping that very soon we will be able to reach that point

where we can start bringing on more people. >> there's only -- >> go ahead. >> i was just going to say, being just, dave and i the sole honors, we wear all the hats. there's becoming a point, hopefully soon, we can't do all the processing, shipping, marketing all that stuff. right now we kind of do everything. but there will come a point we have to explore options to kind of more efficiently do all of those tasks. >> there's a lot of political battles over the environment for small businesses. are you guys optimistic that the small business law just signed into law by president obama will help you? do you feel like the environment for entrepreneurs and innovators is conducive to investing in your business and bringing on more people and growing your business? >> the biggest challenge that we have in growing a business is getting funding to properly grow the business. we have a product that's tried and tested but we want to be able to scale it and get in front of people's eye. our big obstacle, being able to

get bank loans, very difficult for us. we can't at this point to our liking buy the inventory and media to put it in people's lives. the biggest thing we need is money to grow the business. >> and to further answer your question, i do think we are headed in the right direction. i do think people are realizing the need for small businesses. i mean, this is what supports or economy and makes it grow. i'd love to be a part of that. i really wonchts last question for you here. given that you began the company about 600 of these adult pajamas in san francisco, why did you decide then to move the manufacturing to china? >> that's a touchy subject, and when we started we wanted to keep the production here in america, but the price point that we freeded to sell this at was about $70 to adequately grow our business and listened to customers who told us, i'm unemployed. can't pay this much. can you knock down the price? our big initiative. when people found out we moved

tell me a little bit about the conservative party and why it appeals to you as a latina woman? >> thank you for having me today. i have been a republican for over 20 years. it appeals to me, because actually primarily it is our culture, and the latino heritage, it's pro-family, pro-life. very strong on self-reliance, and no longer -- i used to be a democrat but no longer fit in that party. >> and i understand that there's this perception that the republicans lost a lot of latino voters especially because of their stand against illegal immigration. why did you feel like it still represented your personal views on the subject? >> well, i really believe that illegal immigration, chaps is, the republican party gets tagged as conservatives in general as being anti-immigration, but it's not anti-immigration.

i'm very pro-immigration, but anti-illegal immigration. the democratic party will talk about actually about equal justice because this is america, and in mexico, as i talked to other people before who are legally immigrating, the law doesn't mean anything in mexico, but in the united states it is. equal justice is a foremost important issue to me. >> when you're looking at latinas as a group, will they show up and bring their friends to the polls? >> i think absolutely. there was a study this week that said although most latinos are planning to stay home in november, the ones coming out are republicans. the issues important to them, education, jobs, health care, they feel the democratic party have completely ignored them. >> thank you, ladies, both. we're watching the white house right now where president obama is expected to speak in just a few minutes. expected to talk about the resignation about general james jones who is stepping down as president barack obama's national security adviser.

well, the brits are in an uproar over what some consider a tasteless, maybe even disturbing do docudrama. michelle co-zin kosinski is in . what's the story? >> there always seems to be some big controversy here. often times it involves the royal family. this hasn't even aired yet, but it's already sparked this big debate. there was a former army commander in one of the. lar morning news shows in brit an and he was railing against this saying this dramatization of prince harry being captured by the taliban while serving overseas in afghanistan is terrible. that we shouldn't be showing something like this, even though it's fiction, while soldiers are still in afghanistan. of course, harry did serve on the front lines in afghanistan in 2008, and there were a lot of concerns over his security

there. so much so that they had to rush him home when his position in afghanistan became public. but on the other side, you know, you even have royal watchers saying, well, this is something that's of interest to the country, and the documentary part of this, even though there's -- there seems to be a lot of emphasis on the drama part of this program, is to inform the country what would happen in this kind of situation. and they say that people have so much interest in that, that it could very well be a very informative program, but it is a little strange. can you imagine someone doing a documentary about your life as if something absolutely terrible happened to you? so you can imagine what it must be like for these princes who are always in the public eye to see something like this coming on tv. although right now buckingham palace is making no comment on it. >> thank you for that. before we go on this friday, baseball fans, i know. charlie crist threw out the first pitch at the tampa bay/texas game.
