elections. with just 24 days to go, the president is working to hone his economic message. >> now it's true that when it comes to our budget, we have real challenges to meet. and if we're serious about getting our fiscal house in order, we'll need to make some tough choices. i'm prepared to make those choices. >> that of course comes on the heels of tough new numbers from the labor department. mike, good morning, what's the latest? >> reporter: another month, another dismal jobs report. the economy is growing too slowly to bring the unemployment rate down, and now with elections less than a month away, voter frustration is growing. even as he toured a thriving maryland small business, the president acknowledged the jobs picture around much of the country remains bleak. >> the only piece of economic news that folks still looking for work want to hear is you're hired. and everything we do is dedic e dedicated to making that happen. >> reporter: the unemployment

rate stuck at 9.6%, unchanged from september. with almost 15 million americans still looking for work, the jobs lost leader government, including 76,000 positions in cities and counties, most of them teachers. and even with private employers adding jobs for a ninth straight month, mr. obama says he's still working to dig out of a deep economic hole years in the making. >> i'm not interested in trends or figures as much as i am interested in the people behind them, the millions of hard working americans swept up in the most devastating recession of our lifetimes. >> the dismal report was the last before the midterm elections next month. and john boehner, the republican that many believe will become the next house speaker was quick the pounce. >> your government is out of control. do you have to accept it? >> no. >> do you have to take it? >> no.

>> hell, no, you don't! >> reporter: people who want full-time work are now forced to take part-time positions. >> everybody in jacksonville is concerned about jobs. nobody is getting any, nobody's offering any. >> reporter: another sobering figure, october was the 14th month in a row that the jobless rate has been above 9.5%. that's the longest stretch since the great aggressidepression. >> it's pretty obvious we're going to have a lot of people who just don't fit in anymore. >> reporter: and the political stakes only get higher from here on out from october 2 to election day. >> okay, mike, more from you later. before the recession, the jobless rate was at 6% or less.

today i spoke with the head of greenwich wealth management and i ask him when we would see the unemployment rate drop down to prerecession levels? >> considering that the gdp grows at 3% to 4% per year, and i'm not sure that's going to happen any time soon, but if it did, it's going to take us 12 years to get back to prerecession levels. >> the unemployment rate is 15.4%, people with no high school degree. for high school grads it's 10%. people with a bit of college education, 9.1%, college grads, 4.4%. so what does that tell me about the jobs that are out there. >> the jobs that are out there are primarily high education jobs. you have to have a good education in order to get a good job. and what we're finding out is that people who don't have the skills are the ones that are having the most difficult time and that's typically the case.

so for example a lot of the jobs we have lost have been in the construction and as a result those are jobs that don't really require that many skills or skills that are easy to pick up. the skills that come with a good education are the jobs that will keep you employed during difficult times. >> well, the data from the labor department shows it is not just the jobless who are still struggling. nearly 27 million americans are under employed. meaning they have been forced to settle for part-time work or they stopped looking for work all together. developing now pakistan says it will now reopen a keyboarder crossing to afghanistan with, quote, immediate affect after a new attack on nato tanker this is morning. the government attacked and torched three vehicles. the attack comes two days after the u.s. apologized to pakistan for an accidental airway that killed two pakistani soldiers on september 30.

tom, with the word now from the pakistani government, they're going to open up the border, how soon does immediate affect mean? >> i think it means right away. there's a terrific backlog of tankers parked at various points on the border particularly through western pakistan and kabul. nato has always said that it doesn't have much of an impact on the -- and much of fuel they say is being kept on the pakistani border, they have others -- but by everything the border with immediate affect as you mentioned, the pakistanis will get rid of the tanker parks where many of those trucks were sitting ducks for insurgents really. >> tom aspell, i want to thank

you for you from kabul, that important news coming from kabul. apparently the breaking news that drill has now broken through to the area in that mine where those men have been trapped now for some 60-plus days. let's go right now to angie san doe value who's live for us in chile. angie, let's get the very latest. let's get the confirmation, what was it like when you heard? >> it was amazing, it was an exciting moment. we can hear the horn signaling that the miners have been reached. there's a lot of commotion here outside the mine, families are running with flags, now they're climbing up the hill where the flags, there were flags for each one of the miners, people are singing, they're hugging each other. so this is very, very exciting. >> i can imagine how exciting that is. but it is certainly not the end, it is the beginning of the end

potentially. what are the obstacles that they face in rescuing these miners? i mean are they 100% sure they've got that shaft capable of bringing up these special capsules or do they have to still test that? >> exactly. now what's going to happen is they're going to lower this camera and they're going to be able to watch and inspect the walls of the rescue shaft. if the shaft is not strong enough, they need to put casing, this steel tube so the capsule can slide, can pull up the miners. right now we can hear some sirens, probably also signaling that they have reached the miners, so there's still some critical moments they need to go through, the shaft for the plan b is not a straight line down, there is some curves and some little turns so they need to secure the walls of the shaft, because everything could happen. that's why families are very

happy, but also they are very nervous. >> as you can imagine. angie, with this larger shaft, does that mean more things can also be brought down to the miners? i mean they have had to do things with such restrictions on this space, things like clean clothes, different types of foods, are they hoping to use the shaft for that as well in the interim before pulling them up? >> i can't hear you very well, but what the miners have been doing is they have been sending up their belongings, their memories, their t-shirts and their shoes and families have been receiving that. is that what you were asking me? i'm sorry i couldn't hear. >> do you think that families will now be able to send clean clothes for example back down, greater quantities of food to these miners as well through this shaft? >> no, no, actually, in 48

hours, if it's decided that they need to put the casing in some parts of the shaft, the miners will, you know, the miners will start being pulled up in 48 hours. when that happens, you know, the miners will not be able to eat six hours before, you know, they have to have an empty stomach to go up. so families will not be able to send anything. throughout the wait, for the past two months or less, the government has been sending them food and clean clothes. >> okay, angie, is there any estimation as to how long it will take to pull each single miner up through that shaft? >> officials say that it might take no more than an hour to bring each one up. >> it is an extraordinary thing. so this might begin pulling the minute meres up through the shaft may begin as soon as

monday? it might only take 48 hours now? >> monday or tuesday. that's the date they need to put the casing in the rescue shaft. >> angie, it is all very exciting, thank you for being there onscene for us. mexico opened up a federal probe into the killing of an american, david hartley on a border lake. no arrests have been made, his body is still missing as well. in hartley's home state of colorado, friends and family held a rally outside the mexican consulate in denver. david's sister says his family wants hiss body returned. >> we know he's in a better place, but i think the thoughts that go through your mind as to what could have happened is

police in new jersey are looking for a man who may have used children to help him steal from a car. police release this video from last month which shows a man hold two toddlers while directing two children to take

items from a garage. the 11-year-old girl and the 9-year-old boy in the video are his stepchildren. a car has been recovered six months after it disappeared. the car's owner says the vehicle vanished last april after heavy rains, the honda was found 35 feet down in that hole nose first. the crews were trying to build new drainage in time for the rains when they made that discovery. trump said his country needed better leadership. trump was in the uk to receive an honorary-degree from a scottish university. from spending to health care, there's no shortage of hot button issues that play in these midterm elections, but judging from the senate race in nevada, the battle lines are not restricted to the economy. >> but here's the kicker, reid actually voted to use taxpayer dollars to pay for viagra for convicted child molesters and sex offenders.

what else could you ever need to know about harry reid. >> thank you for joining me there. so let's get to the polling which shows this race in nevada, this is a dead heat, you have angle who's up two, but it's within that whole margin of error. and nevada inform is one of the highest rates of foreclosures and rate of unemployment across the nation. but these two candidates are talking about, really, sex offenders? is this approach going to backfire and who do you think is more at risk if it does? >> you're right, on the foreclosure rates, nevada actually has the highest foreclosure rate in the country and the highest unemployment rate in the country. a lot of people want to talk about the upper midwest, and certainly they have high unemployment as well. but nevada has the highest of both. so the economy sets the highest -- harry reid has to

make sharon angle unelectable for him to be able to be re-elected. the environment is so bad in nevada for reid is that his only hope is to make her as extreme as possible. in fact you showed one of the response ads from reid on this viagra ad that she put up. on his website, he even has this web video selling sharon angle crazy juice, literally. so this is what this race has come down to. elections are choices and that's what reid is trying to set up. and one thing that does benefit reid is that none of the above is on the ballot in nevada. this could be a real hold your nose election where reid could win by a couple points, doesn't need to break the 50% threshold to win. on that viagra ad, it's taken way out of context. reid did not vote for viagra funding in that health care bill. it was put out by tom coburn who

was against the entire bill and it was designed to sort of stop the health care bill and democrats voted 53-47 to not stop the entire bill. so, you know, if they want to stop something like this, they can revote on it later on. but, boy, some things don't pass the smell test and i think a lot of voters in nevada are going to say, whoa, what? and it doesn't exactly work. >> and to all those voters there, we had a bit of a technical issue, but we had a few more seconds to play of that tape which showed more of senator reid's advertisement there. so we will do so the next time we discuss this this morning. polling gives richard blumen thal a 13% lead over linda mcmahon. was there any sort of projections that linda mchas be been -- mcmahon had any shot of

winning? >> when you talk to democrats, they don't think this is a 13 point race, they think it's maybe high single digits. when you talk to the mcmahon folks, they think it's closer. linda mcmahon has got a ton of money, she's vowed $50 million to spend on this race, and money is a big thing in connecticut because it's that new york media market, you've got to spend a lot of money to be able to win. they came one a really tough ad against blumenthal last week about his misstatements on having said several times that he had served in vietnam, but he never did. so, you know, look, the backdrop of this race, the fact of the matter is that blumenthal still favored, because it's connecticut, he has a long history and she's also very flawed. so that's where the race stands at this point. >> how about the battle on three fronts for that senate seat in florida. meek is denying any reports he

may drop out of the race. i saw one article that said he may be doing that again, he is denying that, but short of the democrat bowing out, is marco rubio a lock in this race? >> it's hard to say he's a lock, he's a heavy favorite at this point, it's a really tough path for an independent in a race like this because you have take some republicans, hold independents and take some democrats. and what's happened is that the republican base has solidified around marco rubio and charlie crist, it's very difficult for him to make the argument that he's totally affiliated with the republican party when he was a republican just a few months ago and only switched parties because he knew he was going the lose that race. and we saw it happen with arlen specter and mitt romney and when you think about him switching positions. crist still enjoys the

favorability ratings. rubio is definitely the favorite and as far as kendrick meek, if you saw that last debate, it's really hard to think that kendrick meek is going to drop out. and to be honest with you, it's going to be very hard for democrats to have kendrick meek get out of the race because he's got a base of african-american voters that they need to get out to the polls so that in the governor's race, the democrat can win and democrats see that governor's race as much more important actually, structurally, in 2012, the redistricting and in senate race. >> that "wall street journal" bomb of a rumor there, there's just no way meek is not dropping out. so there you have it. here's a programming note, keep it on msnbc as tomorrow i'm going to be talking about political commentator and author arianna huffington and howard

24 past the hour, with breaking news, if you're just joining us, it's a happy time in chile, some 66 agonizing days after the 33 miners were trapped there way down in that mine. the drill has broken through to that chamber in which those 33 miners have been trapped. reports of them being very anxious as they could hear the drilling in these last couple of hours, but it has happened, they have broken through. now they have been checking to see if the shaft that was created is of a technical structure that they can bring these miners up starting as early as monday or tuesday. they're going to do all those checks. they also say it's going to take about an hour to bring each miner up. but really happy times right now. we have some big news on the financial front this morning,

bank of america says it's halting foreclosures on homes in every state. mortgage lenders have been evicted homeowners despite flawed court papers. joining me live is a business reporter for "the washington post." good morning. does this turn around and help the housing market? let's look at the big picture here and the fallout from bank of america's plan? >> it's really troubling for the housing market, the most recent report shows one in four foreclosures are sold in the country. so if you put a stop to the foreclosures, you're putting a stop to 25% of homes being sold in this country. things are just going to be in limbo for a while. bank of america saying it's going to look into all the paper work and until it's done with its review, it's just going to stop foreclosure sales. if the foreclosure sale has

already been complete, then the eviction goes through, otherwise everything's just on hold for now. >> what about people who have gone out and bought these foreclosed homes in these fire sales, what happens to them? >> short sales are going to be okay, so if you're in a situation where the bank has agreed to sell a home for less than the mortgage is worth, you're going to be okay. but if the bank has taken ownership of the home, you're in the middle of trying to buy the home from the bank, that's on hold. >> besides bank of america, you have pnc financial services, gmac has done it as well. jpmorgan chase. is now four and more banks will follow suit? >> probably. one of the big lenders we have yet to hear anything from is wells fargo, they're saying their paper work is all in order. so they're holding out. they're perhaps the second biggest lender in the country so they haven't done anything yet. but things are moving inevitably

live with a smile on his face. what can you tell us, kerry? >> it's so thrilling, the families were told first, they started to cheer, clap, cry, and then a few minutes later a siren sounded saying that they had made it completely down to the men. we can see that the police are now standing at attention, and you see many of the miners with their helmets here, when they began to walk down into a large group of -- the family that was held back burst through the gates, throwing their arms around them, hugging, kissing celebrating, thrilled because they are now so close to a final rescue as we pull back from this picture here, and you see the continued efforts that are going on, i want to take you far up on to a hill on the side here, high on the hill overlooking the mine area, where the families had planted 33 flags for the miners down below. some of the family members ran up the hill to start screaming

and cheering and they started chanting a popular chant here, chile, chile, rah, rah, rah. they really feel this is the last step to rescue the miners down below. now an erie question that needs to be answered. there's room for the 26-inch capsule to go down, but they don't know if they want to re-enforce a portion of the shaft by putting in a half-inch thick pipe, that would be like a sleeve going down to prevent rocks from perhaps collapsing from the highest portions where it's a little more unstable as the escape capsule goes up and down. if they have to do that, that will slow the process. if they don't have to do that,

we could be seeing rescues very soon, alex. >> that is so exciting. kerry, do you know how they're going to decide who comes up first? >> yes, 33 miners, men down below who have developed this incredibly tight knit society of support thought they were going to decide. but the folks up here on the surface working with expert psychologists, engineers as well as the influence of nasa at the u.s. space agency decided that the first 11 coming up should be those who have, a, the best health, and they have been monitoring their heart rates, they have been monitoring all types of aspects of their physical health and they want somebody who has the most experience as a miner. the reason why they want the first 11 to be the most experienced and the healthiest, because as that capsule comes up, if they encounter a problem, they want somebody who is calm and collected in the process, who can reach over to the

two-way radio, who can turn the live camera that they'll have things that are going on, explain and suggest potential solutions should there be problems. after they take those first most experienced and healthiest 11 up, then they're going to bring up those who have health problems. one of the miners has diabetes, another has a skin condition where we don't know the specifics of it. but it's apparently quite uncomfortable and needs immediate attention. and there are some of the miners in that group of 11 who in those first 17 days when nobody was quite sure when they were alive or not, and they had thono toothbrush or toothpaste, and the last 11 will be those who have the least amount of experience. somebody like, there's a miner down there jimmy, he's 19 years old, only working in the mine four months, he'll probably be in that last group that comes

up. so it's been worked out. when they come to the surface, then in groups they'll be flown from a helicopter over to the hospital where they'll get some immediate medical attention. >> it can't come soon enough for everyone involved, and for all of us watching. fingers crossed that it happens monday. kerry sanders, many thanks. bank of america now tez it is halting home foreclosure sales in all 50 states as it widens it's investigation of foreclosures of homes. concern grows that a number of mortgage lenders evicted people without the proper paper work. okay so, let's talk about first of all people who have been evicted. is this going to do anything to change thing for them. >> first of all, it's a complete and total mess, but if you're facing foreclosure, you're going

to essentially be rent free until the banks sort this out. this could take up to a year. if you have tried to purchase a foreclosed home, you're in deep trouble, you thought you were going to get in, you thought you were getting a steal, suddenly you're in a hotel. it's going to throw the housing market into total disarray. >> but foreclosed homes are those going to be okay? >> can you imagine you're -- a lot of these things were done on automated systems. and there's moms, dads, kids. >> and the sad part is, we all vienne need housing to recover, how does that happen? by getting fresh flood, fresh buyer into the market. that comes from people who said this is too good of a deal, we have to buy this home, that wall has now been erected in front of that. so the recovery we're looking

for could be a year away or more. >> unemployment, not a good report for september having lost 95,000 jobs cut by the government, unemployment rate remains 9.6%, way back when, it was 6% for the recession. what's going to turn this thing around, and what does this mean for the economy overall? >> it's a stalemate is what it is. why would we hire until we know consumers are going to spend, if we're consumers, why would we spend until we know the job market is going to come back. that's why the recovery is going to take a very long time. add to that the idea that you get a job in minneapolis, you get a job in texas, selling your home is going to be very difficult. that's added maybe a couple of percentage points to unemployment. >> i understand that in regard to mom and pop shops, the small businesses, what about the large corporations, in addition to the banks who are sitting on piles of cash right now. the end of year bonuses are

going to be huge, reportedly. >> companies have been through a lot and so they are girding for battle, they're worried about a second downleg, they're worried about another big shot. are they building up cash balances? yes if they're hiring, a lot of it is overseas because there is a world where consumers are spending, the emerging markets. >> isn't that one of those things if they would just turn things around and focus back domestically and invest it would come to fruition. is a mindset thing? >> i think two things. a, we don't have a lot of business on the order books. but we hear from a lot of ceo who is say we don't know what's going to happen to taxes and we don't know what regulations are going to mean, health care, financial reform are going to mean for our business down the road. so let's just take it easy for now, let's hold back, i they's

that 1969 album cover. there's been people crossing the crossing all morning. right now they're listening to a beatles tribute band, they have just finished a walking tour of sites that were famous here in london. it's being celebrated all around the world, the 70th birthday is being marked in liverpool with a birthday party at the tavern, that's the club where the beatles and john lennon were actually discovered. they played there 293 times before their careers took off. and this morning, a sculpture has been unveiled, a sculpture of -- unveiled by john lennon's first wife cynthia and his eldest son julian and it's supposed to be britain's answer to the memorial.

>> how many people are stopping traffic to cross the street, stop, take that pose, the iconic pose in the middle of the abby road crosswalk? >> well, there are literally a steady stream of them, as you can see a few just doing it right now, and what you can't see, i can look down the road and there is such a long queue of traffic here. as far as the eye can see. people are taking it in good spir spirits, but a few people are tooting their horns. so move over old spice guy, you're getting some competition from the "sesame street" set. you know the commercials i'm talking about, right? the ones that feature a shirtless man promoting old spice body wash by telling customers to smell like a man and sometimes he's in the shower, sometimes he's on a horse. here's grovers version, urging viewers to smell like a monster. >> anything is popular when you smell like a monster.

positive sales, i'm smiling, you're smiling, is this a sign of life for the economy? >> there's no doubt that the back to school shopping season went particularly well for retailers. but if you unpack that number a lint. you find the 2.8% increase that you're talking about is still less than the increases we saw over the summer. so what you're finding is that some of the momentum we saw in retail sales is declining. the other thing to point out is reports among retailers is uneven. many consumers are still feeling very stressed and they're going to be holding on to a lot of their sort of recession shopping ways. >> why is it important that we see retailers doing well? common sense will give you the answer to that from an economic perspective. >> consumer spending accounts for about 70% of the gross domestic product, so it's very important for retailers to be

so a fight is bubbling in new york over a proposed ban on the purchase of sugary sodas with food stamps. but are they overstepping their bounds? we have got discussion coming now. i'm joined by karen hunter, and also adam berg. i'm going to ask you from a reporter's standpoint. where did this get started? >> it's a long -- it's a huge -- the new york city life expectancy has gone up by more than a year and a half since he took office. they have banned transfats in foods. restaurants have to put up how many calories in the foods they sell. smoking bans anywhere. and this is a logical

progression. this is becoming a nanny state, this is too much, people still have the right to choose what they want. i'm not saying you don't have the right to smoke or eat fatty things or whatever else, but the government's not going to pay for you to do this. >> and what this is targeting is so that it reduces the obesity rates in poorer neighborhoods, which then reduces problems with diabetes, problems with teeth and sugar and cavities and there's a lot of benefits to not eating this kind of stuff. what do you think is the government going to stop? >> we're in america, and u live it being free, but as my mother said when i'm under her roof, you're going to follow my rules. when you're taking government money there's a consequence to that. and if you don't like that, get off the dole. this saves the taxpayer, we're putting our money into this, so 60% of kids are more likely to be obese by drinking soda. we lead the nation in diabetes,

high blood pressure, i like it fundamentally, but yeah, we do live in a free country. >> is this a slippery slope? >> of course it's a slippery slope. you couldn't propose a soda -- there was another proposal in new york state to put an extra tax on soda and drinks that have extra sugar in them. >> which has been successful, though. you can't smoke in restaurants, everyone's kind of like, we got it, it's fine. >> you can't letting morality, but maybe we should for our own good. people left to their own devices don't seem to be doing too well. we are the fattest nation in the world. i'm working on it myself, i know, i battle with it every day, and to have it that you can't get it, you're protecting people from their own bad habits. >> adam, what about the prospects of saying only so much, we're going to limit the

amount that you can buy. is that kind of a middle ground that has been discussed at all? >> i haven't heard that. it would be fairly easy to circumvent and go to the next store over and buy up to your limit if you wanted to. new york city is a place that has a reputation where you can do anything you want. they don't want to be told which side of the street to walk on. >> it's the city that never sleeps, but i don't think that it should be the city that eats too much and drinks too many sodas too. >> do you think that other cities will follow suit? >> i hope that other cities will noll suit. it's america, we should be free to do whatever we would like, but if you're taking government money, this is the one area where we can dictate what people can do with their lives, if you don't like it, you have a choice. >> you could use your own money to buy sugar y sodas. >> adam, do you think this is going to play out the same way
