the scramble to stop a cholera outbreak. hundreds dead. thousands infected. and now reported of cholera in the capitol city of port-au-prince. is the aid money sent after january's earthquake from around the world helping? and nature's power on camera. amazing video of a twister touchdown, and what it left behind. plus, wild celebration. why police in india are now investigatining katy perry's ov the top weekend wedding. good day to you. i'm tamron hall. the news nation is counting down just eight days to go until the 2010 midterm elections. in just 45 minutes president obama heads to rhode island to try to fire up democrats there. back in 2008 president obama won 83% of the vote in that state. this year the president has his work cut out for him. it is a fierce battle for the senate in at least four states. nevada, pennsylvania, illinois and colorado where candidates are running neck and neck. and a new poll from politico

shows independents are siding with the gop. right now is richard wolffe at the white house. good to have you on. let's start with independent voters. what is -- why are they in so many numbers, in such large numbers appearing aside with republicans? why do they feel will be different if this we see this republican takeover so many predicted? >> well, there are a couple working theorys out of the white house and folk who is advise obama. first of all, independent a big growing group. a lot of them grew before 2008 as disillusions republicaned. a number of these may be returning to the fold. independent voters as a block have defined where elections go. the other sides, the main parties so equally balanced and independents especially have been concerned about the economy of course, but also the deficit. you'll hear both sides talking, especially intensively in these last if days. >> we've seen the president focus on women, minority voters,

the youth vote. he's talking with jon stewart on the daily show. another example of how he's courting the young people. what he with see in the next eight days targeted as independents or is there a strategy that can be focus that had way, richard? >> at this point it isn't just about getting the groups that haven't been paying attention. it's about turning out the base. you look at a couple places that he's turning to in the last weekend. illinois, his home state where there's a tight race there, and pennsylvania, which is normally traditionally a battleground state but trends democratic. the polls are so influx. it's a two or three point race either way. so right now a couple of points comes down to your turnout. can you get st people to vote? that's not independents. that's the core democrats. the ones who tune in to the daily show or the women voters who backed him in 2008. >> richard wolffe live for us at the white house. thank you very much, richard. from independents to members of the gay and lesbian community, they're expecting a lot out of the obama

administration on don't ask, don't tell and gay marriage. many democrats say they let them don and they're taking their votes elsewhere. one woman said she's now voting for the green party. joining me now live is fred sans from the human rights campaign. one was a member of the gay and lesbian community and said at this point she doesn't know what the administration is doing. there's lethargy. >> well the movement has been in the wilderness for the last 40 years. equality will never come soon enough for those denied fundamental rights and fairness as a community in these 40 years. we have made enormous progress, but our community is rightly anxious to make significantly more. what i would offer is that the -- it's clear from representative boehner's document, the pledge to america, that the republican agenda is certainly not one that is good for lbgt people. so while we have to push the

president and certainly the democrats in congress for more, we also need to be very mindful that the republican agenda for equality is nonkpexistennonexis >> does it boil down to these people saying, listen, maybe the obama administration has not lived up to expectations, but the other people are worse. is that the argument there? >> no, no. i think this administration and this president have done more for lbgt people than any president in history. can he and should he do more? absolutely. but when you look at it as a matter of pure substance, this administration and democrats in congress has compared to the alternatives, republicans and what represent boehner and his crew will bring, there's absolutely no comparison. we are certain gays and lesbians and transgender individuals in tb country will probably go backwards under a republican

controlled congress. from my perspective, there's certainly no comparison in between the two. we must and can and push this president and this congress to do more. but there's no comparison in between what republicans would do for lbgt people. >> the headline in this article. gay voters angry at democrats could sway elections. one says it's all talk and nothing is happening and i'm just over it. when you hear members of the gay and lesbian community say that, what is your specific response to how the folks feel at this moment and they are ready to take action november 2nd? >> well the frustration is p palpable. i don't want to feed into the narrative. i do believe the frustration is palpable. the amount of change will never come quick enough for those of us that have been denied our fundamental equality for so

long. but certainly in the states across this country and with this administration we have made a significant amount of progress. is it enough? absolutely not. when we're denied job employment and when we're denied the federal ability to love and be loved. certainly that change can't come quickly enough. but we are making progress in very fundamental ways across this country every single day. so it's a balancing act in between change coming quickly enough for some and not quickly enough for others. >> we'll see what people say with their votes november 2nd. it is a pleasure having you on. thank you for your time. >> absolutely. >> stay with msnbc for continuing coverage of the midterms. coming up, a look at what the gop's priorities would or could be if they take control of congress. and it is a race against time as health officials are desperately trying to control an outbreak of

cholera that has already killed more than 250 people. u our own dr. nancy snyderman is on the phone from haiti. before i came in there was an alertd that perhaps we were seeing an improvement in the number of cases. what are you seeing on the ground? >> we're still seeing bodies being wrapped up on gurneys. we're also hearing from doctors there was a definite slowdown today. so it raises the question, have we seen the peak of the epidemic or is this one point in the spectrum? i couldn't get any position to say one way or the other. but they are really i think b y buoyed by the fact that there's been a huge multinational response to this. and so far, except for five cases in port-au-prince, it has been contained to the rural areas. so what is the next step? this is a drinking water issue.

this is about contaminated water. what needs to happen next, nancy? >> wash the food, bathe and get their drinking water out of the area. there's no doubt cholera is here now. >> dr. nancy snyderman is back in haiti. more on the scope of the unfolding health crisis and what can be done to contain the damage. we have a program director for the relief program. i can't tell you how many people are wondering about the donations, to help provide adequate and clean drinking water to the people of haiti. what is the answer to that? is the money sent since january working and improving the situation there? >> the money has been here being put to use but mainly because

there aren't infrastructure systems that are can be depended upon. water supplied in nonsustainable ways. we haven't been able to do the work we want to do in combination with the government to improve drainage systems, improve water systems. so the funding is going to expensive mechanisms of ensuring that the people have water. >> are you at all hopeful that. if it seems it could only get worse. this could get worse. that is hard to believe. >> you know, it could absolutely get worse for the people here. prior to the earthquake people lived in overcrowded conditions. now they're in tent camps where there are no walls between them.

there are no proper drainage solutions. if this disease really gets to the tent camps, they will be under even more squalid conditions. the suffering will increase. and a developing story out of afghanistan, officials say four gunmen forced a dutch aide worker and his driver to get out of the car and took the two men hostage. apparently part of a group helping disabled people. police are informed local officials who are trying to track the gunman down. and the florida teenager who made headlines because she could not kick a bad case of the hiccups is back in the news. jennifer was arrested this weekend and charged with first-degree murder. police say she admitted to the crime. back in 2007 jennifer and her medical condition were featured

on "tthe "today show.." >> does it hurt? >> it hurts a lot. there's point where i will burst out and cry. right now it hurts so bad. >> nbc's mark potter joins us live from miami. what are police saying happened here, mark? >> well, tamron, police are saying 19-year-old jennifer and two young males were involved in an armed robbery in which a third young man was shot and killed. during that incident saturday night police say she lured the victim, a 22-year-old shannon griffin to a home where two men confronted him with a gun, tried to rob him, tried to take away items from him. there was a scuffle. police say the victim was shot several times and was killed. she and the two others are now charged with first-degree felon murder. very serious charge. police do confirm what you say, that they have confessed to the

incident. their involvement in the incident. just a short while ago she mee had a hearing before the judge. today her mother very distraught was on a radio show where she spoke by phone saying she was torn apart by this. she was shattered. couldn't believe this happened. described her daughter as a very good girl who would never hurt anyone. and she's just stunned by this and just cannot understand how this could have occurred. tamron? >> mark potter, live for us out of miami. thank you very much, mark. and now to housing where existing home sales rose last month after dismal summer. the numbers still remain well short of healthy levels. the national association of realtors said sales grew 10% in september. sales are down 19% from last september. also today, a warning from a leading bank regulator that already battered housing market could, if you can bloelieve thi take yet another hit.

fdic chair sheila bear said it could make potential buyers wary of purchasing homes. further damaging the already beat up market. and brett favre is reportedly admitting it has his voice left on a message for a former sideline reporter. he's heard inviting sterger to the hotel room. she also received graphic pictures from the waist down. he is not copping to those picturing being his body. joining me now, michael smerconish, also an msnbc contributor. good to see you. hope you had a great weekend. >> i did, tamron. >> so brett favre says it's him. the website that originally leaked the voicemail says those graphic pictures came from the exact same cell phone as the voicemails. what needs to happen here. >> well, as new york post could

only say, favre has confessed to the ringy but not the thingy. if the thingy becomes an issue, he has a real problem. that's a product of a twisted mind. the voicemails, he's a married guy. that's an issue for his wife. he's in the dog house at a minimum. but it's sort of night and day between the two. one of them is really, really a serious problem that's going to cause some issues. >> yeah, i would say that the thingy as you put it or the post put it is the issue. she was an employee for the jets at the time. and he was obviously an employee of the jets at the time. some people are turning the mic microscope on this young lady. her attorney says she may cooperate with the investigation. do you think it's fair to drag her into it and demand more detail. >> if he sent the worst of those two, meaning the pictures tlrks nothing that can or should save him. if it's an issue of him hitting on her, take a look at the way

she's dressed on the sideline doing the reporting. >> oh, michael -- a lot of women are going to hear you say that and say what does her dress have to do with anything. if brett favre was calling her asking her on a date. he's the one married. she is not. he's the person we should be pointing our finger out. if we're going to be judgmental. >> she has that torn jet t-shirt that goes right down between the cleavage. she doesn't dislike the attention is all i'm saying. so he showed her a bit too much, but -- >> but how do we know -- listen, she may -- in one of the e-mails apparently or voicemails, jennsterger reportly told this employee she didn't want to be with a high profile guy like brett favre because she would end up in the garbage can.

welcome back. breaking news on what sickened some students at a party on october 8th. an investigation determined it was a high alcohol caffeinated drink. a team has been looking at this on the internet. it has 12% alcohol content. it's not a date rape drug that caused these students to fall ill. nine students were hospitalized after the house party. many of them were young female students who were sickened at this party. it's been a mystery as to exactly what happened. now we're learning it's also called this for loco.

it's also called the blackout drug. moving on, though, schools are closed after a tornado tore through the town yesterday. the touchdown was caught on tape. look at this video. this is what they are trying to cleanup. the aftermath of this right now. those winds were so powerful they flipped an 18-wheeler driving on the interstate. jay gray is live in rice, texas, with more for us. jay, what do you see? >> reporter: hey, tamron. you see that unbelievable video. it's hard to believe nobody was seriously injured in all of this. that's the case. that's the good news here. still a lot of work to be done. look at the softball field behind the rice middle school. you can see dom of the damage. you can also see the rail cars back there. those were overturned and pushed

onto the ball field. the rail is actually working again today. another key point, about five homes really damaged severely here. a lot of power line problems. you can see the crews out working on the lines as well. there's a ton of work to be done here. a wide path of destruction. one stretched all the way to the north as well. this was a tough storm. it's now moving across the east. they don't care about that at this point here. what they're worried about is cleaning up. they have a lot of work to do, tamron. >> they certainly do. amazing to see. thank you for the live report out of rice, texas. as jay mentioned, that storm is headed east. still ahead, the democrat who told president obama to "shove it." he says he doesn't need the president's endorsement. why is he so angry at barack obama? plus, a california beach reopens days after a shark takes a young man's life. the news nation is back in three.

in california, officials have just reopened a beach north of santa barbara that was the site of a deadly shark attack. 19-year-old junior at santa barbara was body boarding at a surf beach on friday when a suspected great white shark mauled his leg. witnessed pulled him to shore, but it was too late. he was pronounced dead at the scene. he tried to laugh off the possible dangers of sharks in the water. >> every surfer has that in the back of your lead. it's in the very far back. you go out to enjoy life and celebrate. you don't really think about it. i know they joked about it. it's something you joke about. it never hits home until something like this happens. >> nbc's kristen welker joins us live. obviously this attack was a rare

event as the family described it. but still, i have to ask you, how are people reacting now that the beach is reopened? are they worried about going in the water? >> well, tamron, it's a great question. the entire community has been put on edge. in fact, some nearby stores have reported they've actually seen a decrease of people renting surfboards. the beach reopened at 8:00 a.m. this morning. we haven't seen any swimmers or surfers but beach officials spent the weekend scanning this coastline, looking for signs of the shark. they didn't see it, so they did reopen the beach. now just to re cap, this tragedy zid happen on friday. that's when 19-year-old lucas ranson went body boarding. he saw a shark flash out of the water, grab his leg, pull him underneath the water. amazingly that friend was able to pull his body back to shore, but he wasn't able to resuscitate him. it was too late.

happen after this so-called, if it happens to be, a wave election or a change election for the gop. what would this do to the obama administration? >> well, it would curtail his effort to really have big pieces of legislation. that took a filibuster proof number of democrats in the senate to be able to pass that, as well as having substantial majorities in congress. so in some respects the big change items are probably off the table come 2011, 2012 if republicans take back the house and senate. however t there are places that they could find agreement on deficit reduction, education, maybe an issue like immigration. so there's still some legislative items that they could work on. the bigger question is if it improves his chances on winning in 2012.

>> what does history say to us about voters and the desire to have, what some may see as a balance between congress and the president depending on the president's party affiliation at the time? >> we look back. since lbj, a party is held the white house, the senate and the house for four years at the most. that shows they like checks and balances. they don't want every party holding onto the branch of government. more than 60% say it's good for the parties to switch up control of the white house and congress. so as you've you've seen this desire for a very long time in the american history. >> a lot of insight, mark. thank you for joining me. greatly appreciate it. there's a lot at stake that the gop does take control of one or both chambers republicans will have their hands full with the economy, health care, the list goes on. so what will a republican congress mean for the country.

nbc news senate producer ken strickland is with me now. first i have to ask you about comments made by mitch mcconnell recently that the goal for the gop is to make barack obama a one-term president. this is something he just revealed in a new interview. >> here's the way we think the landscape will look that mark and chuck are working on. it seems like the republicans will take control of the house, but democrats may maintain control of the senate for democrats the good news is as long as the democrat controls the white house, they'll be able to veto anything the republicans could pass. the difference is republicans are now in a position of governing. they will actually be able to right their own. once the polls close, then a new cycle of elections begins, including the president's.

>> if the governing includes getting rid of the person in the white house, how much governing will we really see? as stated by mitch mcconnell on the goal list there. >> i think it's going to be hard to know how it plays out because a lot of it will depend on what happens with the economy. the first thing that everybody wants to deal with is the economy and jobs. in december the president of that commission will put out a report. everybody is talking about trying to fix the debt. new january or sooner democrats will have to sit down and decide whether or not they want to do that. unfortunately, as history has shown, political consequences do get in the way. maybe a lame duck. >> how much will be preoccupied with repealing health care reform k which we know is a part of the pledge that republicans have made if they are able to take over the house and possibly the senate. >> if john boehner becomes speaker of the house he's in

position to put his party in passing a bill or make fundamental changes to its. as long as democrats hold the senate, they'll be table stop it. if it were to get through the senate, barack obama as a democratic president can put the veto pen out and sign it away. >> it's great having you in studio. not in d.c. stay with msnbc, the place for politics for continuing coverage of 2010 midterms. in the next hour we look at whether the white house is effective in selling its strategy. moving on, opening statements were made in the chandra levy murder trial. prosecutors say they've made massive mistakes in their investigation because they were mistakenly focused onned on a former congressman. we have a "washington post" reporter and coauthor of this book "finding chandra: a true

washington murder mystery." thank you for joining me. you've got reports that the congressman will take the stand. what would he bring to the table? what would his testimony bring to the trial? >> trial opened today in washington in a packed courtroom. there's a lot of drama in this case. yes, he had a relationship with chandra levy but he didn't murder her. he was the main focus, as you can remember in the summer of 2001. the prosecutors focused on gary conditt. the strongest part of the prosecution's case, the strongest part is the fact that he confessed to attacking two other women in rock creek park that summer. >> how does this admission from the prosecutors that massive mistakes were made, how does that make it difficult to get a

conviction? will this affect the trial in some way? >> the point is the defense is going to argue a lot of mistakes were made in the case. critical mistakes were made in the case. we know that. the defense will say this is another mistake. he's not the man that did it. and the prosecutors are going to say there were mistakes made back in 2001, but make no mistake about it, now we have the right man. >> and back quickly to congressman gary condit. have we heard his feelings regarding testifying? >> his spokesman has said they expect that he may be called. the real drama today was one of the women attacked in rock creek park. she testified a a while ago. very chilling. have dramatic. talking about how he stalked her in the park, attacked her at knife point. they rolled down a ravine, and she had to fight for her life. >> it is chilling. the book is "finding chandra:

true washington murder mystery." thank you for your time. new information from secret war documents is raising concerns that iraq could dissolve into chaos if the u.s. removes more troops next summer. also disturbing new accounts of apparent military misconduct and prisoner abuse. jim miklaszewski is live at the pentagon. people are looking through the leaked documents and wondering what impact or effect it could have. what more could you tell us? >> u.s. military and pentagon officials are still sticking to their story here that many of those documents cover stories that we in the media had covered from a to z during the seven years of that war so far. what is particularly damning is the detail and morbid and in some cases gruesome detail in terms of what was going on inside iraq.

at the same time trying to ensure that everybody here in the united states that things were going well in iraq when that wasn't the case. primarily, though, to determine how this was leaked, they have a private first class in custody as a suspect in an earlier wikileaks case. one of the major problems facing the pentagon and the u.s. military is the fact that was all the result of a massive monumental security lapse on the part of the u.s. military. and the bigger longer question is, how do you fix that so it doesn't happen again, tamron? >> jim miklaszewski live at the pentagon. new criticism where a u.s. swimmer died in dubai. the winner of the open water race says the water and air

scary. the scary part prompted one town to ban teenagers from trick or treating. the law is on the books in the town of bellville, illinois. no one above eighth grade can go door-to-door asking for candy. teens aren't allowed to go out in public wearing masks on other days. the mayor says it's part of keeping the town safe. >> trick or treating is designed for the younger children. it's also designed not to be where it becomes a scary thing for our seniors or for single parents home alone with children when big kids come to the door. many of them came 10:30 or 11:00 at night. >> so teenagers who dare to break the law could face fines of $100 or jail time. the mayor says no one has ever gotten a ticket and there have been very few warnings. he says, hey, it's been effective. what does your gut tell you? definitely a teenager is too damn old to be trick or treating, i got a tweet already.
