course we will make adjustments or changes when called upon. >> mike taibbi joins us live from laguardia airport in new york city. mike, no changes as of yet, but what are you hearing from people at the airport today? >> well, what we're hearing here in new york is what people are hearing around the country, that travelers are frustrated with the idea that at the peak of the holiday travel season starting today that there may be additional delays because of these enhanced security measures. i talked to a lot of people who said they were frustrated by it, although they didn't object to the point they'd refuse to do anything. one guy came from am pa yesterday and said he was secretaried out for the enhanced pat down and said it was a groping. it was humiliating, it was horrible. his word. now, he, too, understands that this is what the tsa had determined is necessary to make sure that flights are secure. he wouldn't join any protest. but there's a lot of talk these days about protest. in san diego, for example, which was made famous when john tiner a bid man said if it you touch

my junk, i'd have you arrested, another protest today, a man named sam stripped down and refused to let the tsa pat him down. he, too, was arrested. so a lot of anger, a lot of planned protests for wednesday afternoon. second napolitano said for everybody's sake, don't do that. >> we hope people will appreciate and understand the goal, the purpose and the need for what is being country. be partners in this. >> there were calls on the internet for these planned protests, insisting on being pat down to slow everything down, slow the travel down for everybody. a lot of people calling for that on wednesday night. the tsa is saying, number one, these are as you said evolving procedures and, number two, the rhetorical question, if you had a choice of getting on two aircraft, one so which everyone had either been patted down or gop througop through a full bod

skraner and one where no one had, which one would you want to get on? the answer seems to be pretty obvious which is why about 80% of people polled accept the techniques. >> joining me now is michael boyd. i'll ask you at the top, is the tsa mishandling this situation when you think about and you hear the comments that poll that mike taibbi cited and janet pa po napolitano saying only a few have gotten the invasive pat downs? >> absolutely it's been mishandled. napolitano is right. . everybody is not going through it. but the reality is that that last comment made would you rather be on an airplane where everybody has been patted down or one where every has not been patted down, it's a nonseqitur because the problem is not just passenger screen, it's ramp screening it's screening of the entire process at the airport. and that's where they're falling

down. you can pat everybody down. we won't be any safer because the back door is still wide open. >> when you say the book door is still open, what does that mean, more screening then for employees? we saw the situation also the hoop holes with cargo, travel cargo packages, as well. >> oh, you bet. right now people working on the taxi ways at laguardia airport, how closely have they been checked over the years? people in the maintenance facility and fume farm, people doing the cleaning, a terrorist is not going to go through this theater that we've passed off as screening. a terrorist has other ways of doing it. 9/11 was not passenger screening failure. it was a total security failure because these guys had things on the airplane, they had friends working with them. to a professional terrorist, what we're doing today could really hurt them, they could die laughing. >> michael, i got to ask you, we hear from the tsa chief that this is evolving. what can they evolve to? >> well, when he says it's evolving, it's he doesn't know

what to do, he's in a mess. he's saying we might change it we're not really sure. the fact of the matter is we had a bomber a year ago who supposedly strapped something to his leg and now we want to make sure we can find out whether people have something strapped to their legs rather than getting on airplanes. >> as we saw with the shoe bomber and we had to take our shoes off over the internet, people are saying why can't we do what's done in israel even though they handle about 30,000 passengers a day, los angeles international airport on a daily basis handles over 150,000. is it possible to replicate or duplicate what happens in israel or is that not a fair comparison? >> well, you can't do a barbara walters interview with every passenger going to omaha from chicago. but you can have security awareness doby professional security people. we don't have that. the people at the top of the tsa were not professional security

people. the guy before pistole, he was a railroad guy. he shouldn't have been there. until we get professionals like ez real israel has, we won't be safe. but following their model which is to have professional security for the situation, we need to go in that direction. >> to your point, their screeners are university educated, well paid and thoroughly trained at probes questions to look for any potential threat. thank you very much, we appreciate your type. so whether you are against it or for it, all of these security measures, of course, are the result of terrorism and today al qaeda is boasting about its failed mail bomb plot saying it only cost $4200. it will launch a wave of small scale attacks like the one we saw with cargo. the group says it does not mind the bombs are intercepted because takit is a good bargain spread fear among the, quote, enemy. it was publish orded this weeke.

what do you think? when going through airport security, which would you choose? text one for the full body scanner, two for the tsa pat down, to the number 622639. message and data rates apply. we will read some of the responses we've been getting in later taoday. freezing rain has created deadly driving conditions. hundreds of crashes have been reported in minnesota since a cold snap just smacked that state. at least two people have been killed, dozens more injured. look at some of this video. joining me now from bloomington, illinois is janel klein. what's the latest on that storm? >> reporter: here in minnesota, the conditions are still bad. we're seeing sleet and freezing rain coming down periodically. and that's exactly what caused those problems in minnesota yesterday. almost 500 crashes throughout the say the. the state patrol calling the storm one for the ages. 75 people seriously injured and as you said, into killed. the driving conditions are still bad because that freezing rain

is still on the roads, it created a thick layer of ice on the freeways, on the highways, on the interstates. even on the sidewalks, the emergency rooms throughout the state are saying they saw a lot of people come in with braeakin and sprains because they fell. today not an effect in air travel. cancellations and delays are not been real apparent. they did shut down the run way for a short time, but that has not been affected. the issue really is the roads. and as the storm continues to get worse, we are expecting that we will see a difficult afternoon commute. so everybody who is not needed to be on the roads urged to stay inside. >> thank you very much. and president obama still hoping for a break through with senate republicans on the nuclear arms treaty with russia. the president hinted during his summit with european leaders in lisbon over the weekend that politics is the only thing standing in the way of ratification of the new s.t.a.r.t. treaty.

those other european leaders also unanimously urged the senate to ratify the treaty. john kyle continues to argue for more time to debate. senator kyle said last week there is, quote, no chance it will get passed in the lame duck session of congress. and the u.s. and north korea's neighbors scramble today to deal with this weekend's revelation of a main advancement in north korea's nuclear program. it was revealed that north korea recently showed a visiting american scientist, a highly sophisticated secretly built new uranium enrichment facility. after meeting with a special envoy for north core re, a south korea's defense minister said his country would consider deploying u.s. nuclear weapons for the first time since 1991. jim miklaszewski joins us from the pentagon with the latest on the back and forth and where this stands. >> reporter: well, on the claim from the south koreans that they may consider deploying u.s. nuclear with that weapon, that's

pretty much out of the question. that is entirely up to the united states. they had act ctactical nuclear weapons but they were removed long ago and there is no likely hood they will be reintroduced. u.s. officials are saying we knew they were pursuing enrichment process procedure, but i think they were taken by surprise by the scope and sophisticated of that centrifuge operation as described by that professor. so the question then is why would the north koreans reveal this now publicly to this american scientist? and officials here at the pentagon and in the intelligence communities have come up with two possible answers. one, that the north koreans are looking for some kind of bargaining chip when perhaps at some point negotiations, those so-called six party talks, are resumed, or because kim jung il is about to hand over the reigns to his hand, kim junk un,

sometimes soon. kim jung il's health is failing by all accounts, that it gives the son a little bit more authority because he has that nuclear card in his hands. so it that seems to be the scenario now, but nobody's panicking. they say even if north korea were to enrich uranium right now, it would still take several years if not longer before they could actually put it into the shape of a weapon. >> all right, thank you very much. and developing now, a juror has found a salvadorean immigrant guilty of murdering chandra levy. that jury convicted him on two counts of first-degree murder after four days of deliberations. chandra levy was 24 years old when she disappeared. her remains were found in a park more than a year later. levy was romantically linked to congressman condit.

welcome back. a vatican insider says the pope wants to, quote, kickstart a debate on condom use.

the pontiff certainly has people talking now that he said that condom use could be acceptable in some situations. the pope made that statement ahead of a release of a new book tomorrow. kerry sanders has more from miami. >> reporter: the book is simply questions and answers. pope benedict xvi sat with a journalist in an open forum to ask any questions and it's there on page 118, a question about aids in africa. should condoms be used to prevent the spread of that disease? in one of the longest answers in the book, the pope says in part there may be a basis in the case of some individuals as perhaps when a male prostitute uses a condom. the church, of course, does not regard it as a real or moral solution, but in this or that case, there can be nonetheless in the intention of reducing the risk of infection a first step in a movement towards a different way, a more human way, of living sexuality. >> was that the pope encoresing the use of condoms?

>> no it's not. but it sounds dangerously close. >> reporter: the publisher of the new book is also a long time friend. when you hear already the word is out that the pope is endorsing the use of condoms in limited situations -- >> he's saying it's immoral, but he's saying someone could do it in a particular case having an intention of causing less harm and that could be a first little step towards a more moral life. but that does not say, okay, go ahead and use condoms. >> that was kerry sanders. and the pope's comment not the only one making headlines. pope benedict said he'd consider resigning if he became incapacitat incapacitated. the last time the poen pe resig was more than 700 years ago. still no word on will and kate setting a date or even a location. in the meantime british people

welcome back. federal safety experts are trying to figure out what caused engine failures on three different delta flights. one of which was actually carrying leo dicaprio. all three made emergency landings and practice for tense midair moments. the mosts dramatic, a moscow bound jet lost power and had to return to jfk. thankfully no one was hurt. afterwards, though, the grateful leo dicaprio was seen signing autographs for the crew and passengers. and whether it's holiday pictures or those school pictures that just keep coming back, photography companies across the country say more and more parents want their children's pictures retouched. could be something like covering a zit or as complicated or making long hair shorter.

starting them out at an early age where we teach the beauty of something they don't have. >> so help me understand this because you talk on probably more parents than i do when you encounter them with your children. but more and more parents are asking for it. so if the argument is so clear that these are about the memories that make us who we are, why are more parents signing on for this to retouch their kids' pictures? >> i can't understand it. i really -- i draw a distinction. i remember in my senior year having acne, so they cleared up my face a bit. that was that iconic senior year picture that for the rest of your life is going to symbolize high school. an akey condition acne, okay, i get it. but removing braces, a bad haircut? that's the picture you want to own. we had a son who went away to camp. he came back with a mohawk.

president obama's chances for another turn in 2012. a new national poll says 49% say he does not deserve a special term. just 27% of democrats want to replace him as the nominee in 2012 compared to 64% who say she run again. this poll also did some head to head contests, starting out with sarah palin. what does it show? >> reporter: we see sarah palin is actually -- does worst of all of the republicans who could run in 2012. she's down 48 brs to 40% against president obama. he gets closest to 50% against her. other candidates, the best republican who fairs against president obama is mitt romney who actually edges the president with a 45% 44% lead. and then mike huckabee also fairs fairly well. he's about two points down on

the president, 46%-44%. but this is really early to be talking about 2012. a lot is going to change and certainly the economy is the big issue. and we'll see how that winds up moving as we start getting over 2010 and start thinking about 2012. >> and to your point, it is early, but we know the last presidential campaign went on for two years. so with that said, we're at the mark and then when you combine the results of the midterm elections, you have republicans obviously really eyeing who they would like or could they potentially have as their leader. >> reporter: that's true, but a lot of republicans have said so far this they're not really going to decide many of them until a little bit later in 2012. so we're not probably going to see as long of a drawn out process as we saw in 2007, but some of the folks have said maybe april, maybe may. we may see some people like tim pawlenty who needs to get his

name i.d. up a little bit, people like john thune perhaps. but the big elephant in the room as we mentioneded, sarah palin, people like john thune and other republicans who need to get some of that energy are going to stay out of this race until they see what's happening with palin because she sucks up so much oxygen. >> all right, thank you very much. and two of the potential presidential hopefuls, they seem to be fans of each other. mitt romney is sending out a shout out, if you will, to sarah palin on the eve of her second book debut. he wrote, quote, thanks for the kind words in your new book about the role of faith in public life. hope it's a best sell person the book he's referring to, america by heart, comes out tomorrow. and that is also the day "dancing with the stars" winner gets announced. big week for the palin women. nora o'donnell joins me live. it's interesting, with her daughter on this reality show

more than 500 people attended her funeral. chasen was driving home from the premiere of the new movie about your about your lesk when she was shot to death. at one point we heard a lot of point about surveillance video that might help in this investigation. where does that stand and what is the latest there? >> reporter: police are certainly still trying to piece together this investigation. there is no late developments, but they are following some leadses. as you mentioned, ronni chasen was laid to rest yesterday. it was an emotional funeral and memorial service attended by several hundred people including many well-known actor, producers and directors who were chasen's close friends. the service was a tribute to the long time hollywood publicist's life, many reflecting on how she touched their lives and her impact on the movie business. although chasen was laid to rest sunday, the mystery surrounding her murder is anything but over. she attended a hollywood

premiere party almost week ago today when believered to be driving home, she was gunned down in her mercedes benz. the shooting in ht well to do neighborhood has shocked area residents as chasen's murder has rocked hollywood. there is no motive. police have no suspects and at least publicly there appears to be few leads. it's unclear if this was a case of road rage or possibly even a targeted hit. so at her memorial, certainly a moving tribute yesterdays as there are many questions surrounding her murder. >> all right, thank you, miguel. and in new zealand, authorities are preparing the families of 29 trapped coal miners for the worst. rescue teams still have not been able to enter the mine since friday's explosion. there is buildup of poisonous gases and a small fire. a robot is going into examine the mine. in the meantime a happy ending at a coal mine in china. 29 were pulmonariey pulled out e

we're following breaks news out of cambodia where the prime minister says 3 339 people were killed in a stampede. the crowd tried to flee over a bridge and many fell over into the water. apparently after a concert followed by boat race, a hugely popular festival, the stampede resulted in the deaths of 339

people. we're just getting these horrible images in to us of the scene. you see the chaos as emergency workers are trying to assist the injured. but 339 people have died in the stampede at a popular festival. we'll continue to follow the developments on this story. back here while millions are planning to travel over the thanksgiving holiday, millions more are certainly planning to do some shopping. the national retail federation predicts 138 million americans will hit stores over the weekend. that's up actually about 3% from last year. the group also predicted americans will spend more than $447 billion on holiday shopping this year. that would be moderate 2% to 3% increase over last year. got to tell you, i'm curious how these stores will make money because i've already seen 40% off sales and it's not even

thanksgiving. and this is from high end stores to more moderate retailers. >> certainly retailers are pulling out all the stops. this is the big week for the retail industry as they get ready for black friday and the days after thanksgiving. retailers are started doing sales as early as halloween, but the important thing to remember is that these sales were planned. these are discounts that they had planned in advance, they're investing in price as they put it in order to get customers in the doors and they're hoping that with enough sales, enough people will come in the doors and it that will make a very happy holiday season. >> but it does make you wonder when you start off at 40% and 60% off, where do you go from there. basically free in some cases. but i'm interested in this new movement to bring attention to small businesses. i believe it's american express and some others who have really said give local businesses the mom and pop stores in your area a chance. >> small businesses have long
