if they can't, the jury is going to punish them for having made that promise. >> on june 16th the third anniversary of the day that caylee anthony was last seen alive, the defense begins its case. >> in 2008 -- >> it's first order of business, attacking the holes in the state's forensic evidence. mainly, what wasn't found. no blood or dna in the trunk of casey's car. >> there was no dna profile generated from those items. >> no chloroform found in the anthony home. >> did you find any containers that at one time or another contained chloroform? >> no, not at all. >> in the only dna found on the duct tape that the prosecution claims covered caylee's nose and mouth was from an fbi analyst who handled it. >> did you later find out that it was your profile on the duct tape. >> i did and it was. >> i think folks have come to expect with csi and law & order that the dna is going to be
11:52 pm
there, and that's going to be the thing that says see, there's the evidence. it's not there. >> forensic pathologist dr. warner spitz testifies that the duct tape couldn't have played a role on caylee's death because it was placed on her skull after it had already decomposed. >> if duct tape were attached to the body on the face, there would have been dna on the face. >> no explanation as to why someone would locate a skeleton in the woods, get duct tape out, and then leave. that's a really curious question. >> the defense doesn't answer that question, but instead tries to raise suspicion about the utility worker who found caylee's remains, roy kraung. >> that was a horrific thing for me to find. >> the defense has long pinned its hope for reasonable doubts on what they believe is his dubious story. >> roy krnon notifies the authorities that he knows where
11:53 pm
caylee's remains are in august. they are not found. >> i originally called -- >> he then notifies the authorities. he knows where they are in november, an officer shows up, they aren't found. then in december he walks into the woods and he finds the remains again. >> the defense suggests could kronk have moved or tampered with caylee's remains? prosecution quickly brings the focus back to the hard facts. >> you have never had any access to casey anthony's pontiac sun fire, i take it? >> no, ma'am. >> you have never had any access to the computer in the anthony family residence, i take it? >> no, ma'am. >> and never had access to any of the duct tape in the anthony family home? >> yes, ma'am. >> but if there is a bombshell moment for the defense, it's this. >> if those computer entries were made, then i made them. i was --
11:54 pm
>> cindy anthony reveals that she was the one, not casey, who did searches for chloroform on the computer. it happened while she was looking up the word colorphil. >> both of the dogs would eelt the bamboo leaves and i started looking up chloroform. >> that was a moment in this entire trial. in one fell swoop, there goes first degree premeditated murder. >> but in the hard hitting cross-examination, prosecution put cindy's story to the test. >> were you on that website 84 times? >> i don't know. >> did you do 84 searches for the effects of colhloroform on your animals. >> i didn't do 84 searches of anything, but i don't know what my computer does while it's running. >> the prosecution points to her
11:55 pm
timecards from work that indicate she couldn't have been there at the date and time on those searchs. >> is it your testimony in front of the jury that you were home between 2:16 and 2:28 p.m. ? >> it's possible. i mean -- >> were you or weren't you? >> i think cindy anthony looked like a liar, and i think all of a sudden it became clear that this family is a family of liars. >> i did not search -- >> cindy was lying about the chloroform search. then maybe she was lying in earlier testimony and she goes from being one of the prosecution's star witnesses to one of their worst witnesses and the case is falling apart. >> the defense turns to its story of an accidental drowning. >> do you know what that photograph is of mrs. anthony? >> yes. >> a tearful cindy anthony describes how just a year prior to her death caylee barely needed help getting up the ladder into the pool. could she have climbed up that
11:56 pm
ladder on june 16th, 2008 to her death as the defense claims? and did george anthony confide to an alleged mistress about the drowning? >> he had said that it was an accident that snowballed out of control. >> george anthony denies the affair and says that conversation never took place. then the defense comes back to the story laid out in its opening statement that the anthony family has dark secrets. leave anthony, casey's older brother breaks down on the stand as he tells how casey's pregnancy was kept from him. >> i was very angry at my mom and i was also angry at my sister. they didn't want to include me. and didn't find it important enough to tell me. >> and then george anthony takes the stand denying the defense's
11:57 pm
claims that he sexually molested his daughter. >> my question is you would never admit to it, would you, sir? >> sir, i would never do anything to harm my daughter in that way. >> only in that way. >> the defense presses george about his suicide attempt six weeks after caylee's remains were found. diaz had claimed that the suicide attempt. >> george anthony carried around this guilt for many months. >> the prosecutor reads from the suicide note to make a different point. >> she was so close to home. why was she there? who placed her there? >> george's anguished words proof the prosecution says that george had no idea what happened to caylee and couldn't have taken part in a cover-up of an accidental drowning. asked about his granddaughter's death, george cannot contain his feelings. >> had you held out the hope that caylee would be found alive? >> absolutely, every day from
11:58 pm
july 15th until the day we were told it was caylee. >> then after sitting silently through weeks of emotional testimony, casey anthony speaks answering the question on so many minds, will she take the stand. >> and it is your decision not to testify? >> yes, sir. >> and with those words -- >> under, the defense rests. >> in closing arguments, the prosecution -- >> casey anthony is guilty of murder in the first degree. >> and then the defense. >> you have to rely on the evidence. you can't speculate. if you don't know what happened, it wasn't proven. >> one day into its deliberations, the jury announces it has reached a. >> as to the charge of first degree murder, we the jury find the defendant not guilty. as to the charge of aggravated child abuse, we the jury find the defendant not guilty. as to the charge of aggravated
11:59 pm
manslaughter of a child, we the jury find the defendant not guilty. as to the charge of providing false information to a law enforcement officer, we the jury find the defendant guilty of providing false information to a law enforcement officer as charged in the indictment. >> a stunned jaw dropping moment. there was a lot of expectation it would be either guilty of first degree premeditated murder or a lesser manslaughter charge. >> we are disappointed with the verdict today and surprised because we know the facts and we put in absolutely every piece of evidence that existed. >> i am very happy for casey and i want her to be able to grieve and somehow get her life back together.
