i'm chris jansen. we begin with breaking news. the president will announce two more executive orders to try to help the sagging economy. the first will help speed up the federal research from the lab to the marketplace. the other will create a website called business usa. it's designed to be a one stop resource to help businesses cut through the bureaucracy for exports. the obama administration will announce the initiatives on a conference call one hour from now. it's all part of that white house strategy dubbed we can't wait. since congress has not passed the jobs bill in its entirety, we'll get reaction to the latest executive actions from one ever the gop leaders. don't faint, but there's some evidence that bipartisanship is not completely dead in washington. two bills actually passed in the house yesterday. one of them won wide support from both democrats and

republicans. nbc's luke russert joins us from washington. luke, that bill wasn't a blockbuster job creating bill, but maybe it's a start. >> that's right. that's what a lot of republicans are saying, chris. this is a bill about an interesting sort of tax. it was a tax that would essentially say the government would have to hold back 3% of whatever they would pay government contractors because over time, they felt government contractors were not taxing themselves properly. this is a tax that a lot of small businesses do not like. it was in the president obama's jobs plan bill to repeal this tax, specifically republicans jumped on it. yesterday it passed the house by a wide margin, 405-16. that being said, it was essentially repealed a law that had never been enacted. never been enacted because a lot of people on both sides felt it was a law with a lot of faults to it. therefore, it won't have an immediate economic impact for a big stimulus package, chris. >> let's talk about the debt reduction super committee. they're far from a deal.

what's it say? >> it's interesting, chris. the last few days, we've seen where both sides have drawn the line in terms of the fight over the super committee. john boehner had an interesting memo he sent to republican members of the committee saying two things. number one, "tax increases match president obama's budget request which no democrat voted for in the senate so that does not present a compromise" he also said the proposal includes $200 billion in defense cuts below those in the control act. secretary panetta says the cuts are not achievable. those are two big areas where republicans have a problem with the democratic offer on the super committee. the first one which you saw there, is about $1.3 trillion in new revenue. republicans see that as a tax hike. on top of that, there's a lot of consternation amongst republicans in term of defense cuts. if the committee are to fail,

you would see huge defense cuts across the board. in the democrats proposal, republicans say, look, we already gave you the defense cuts. we were trying to figure out the debt limit agreement. if we have to go through this again, we'll have a real problem in terms of keeping the country safe. that's something they feel they can hammer into voters' head. secretary panetta, a democrat gave him the leverage by saying that a few days ago, chris. >> luke russert, always good to see you. >> be well. he's a flipflopper. it stuck jop kerry when he ran for president. now it's pinned on mitt romney. he did fan the flames when he went back and forth on a union issue in ohio. let's bring in steve core knack i and msnbc contributor, jeff johnson. gentlemen, good morning. >> hi. >> good morning. >> there's a list that people will show you about supposedly how mitt romney is a

flipflopper. the ohio anti-union bill, healthcare abortion for starters. steve, is it just that he is maybe a realist, times change so his opinions change or could flipflopper stick? >> i'm always open to the argument that politicians can change and a lot of times they should change. the one constant when you go back and look at romney's record in 17 years in politics that i see is whenever he flipflops, there's a very clear and specific sort of electoral political motive. >> tunism at work perhaps? >> this week is a perfect example in ohio. now it's looking like he has a good chance of winning the republican no, ma'am nag. ohio is a crucial swing state. this union bill that he flipflopped to not take a position on was unpopular. you can see this is what the conservatives have been suspecting about romney all along. once he gets the nomination, he'll flipflop back to being the moderate pragmatic guy that he

presented in massachusetts to win the election in the faux. he puts it in a bad situation where you confirm that suspicion and you risk a backlash or keep playing along with the republican base and give ammunition to the democrats in the fall. so he's put himself in a really weird situation. >> you can see he put himself in that situation but i wonder if it is just the conundrum now, especially with the tea party if you're running for the republican nomination. it's very hard to run the kind of campaign that will allow you to win over a lot of independents and moderates in the fall campaign. >> but i think independent and moderate still want you to have charact character. the challenge with romney, it's not just flipflopping, it's flipping and flopping again. as an ohio an, i was offended not because he was initially in support of bad legislation, i was offended because he said he was in support of it, then he said he didn't have grounds or information to talk about it. then he said a day later, he was in support of it again.

so i think what that says is it lacks character. there's one thing to flipflop in the midst of governing when you realize that perhaps there may be a more expedient way to go. fdr didn't want to go to war, but then after pearl harbor said we're going to war. that's not flipflopping. that's in the midst of governing realizing a different approach is necessary. what we see romney doing is lacking character, lacking a backbone, lacking focus and being willing to blow in any direction that the political wind say is expedient for him at the time. >> it seems like the white house is bent on this strategy too. take a listen. >> he takes a position one day and wait a couple days and he'll probably -- >> you think he'll have a field day against mitt romney? >> i think romney will have a tough timex planing what he was for in the past and what he's for now. >> how does he do it, steve? >> it's tough to see. when you think of that january kerry example and the line.

you think of well romney is the nominee, what's going to be one of the biggest issues this fall. it will be healthcare reform. it will be romney saying we need to repeal it and obama saying you were for it before you were against it. that impression that jeff was talking about really takes hold. a swing voters in this country, there's a chance that would happen with romney. that's how romney, who want this to be a referendum on obama and the economy, that's how the swing voters stay with obama. >> i'm not sure if you've seen it, but the perry team started this twitter campaign asking people to use the hash tag flipflop mitt. do you think this sort of label is the kiss of death as it was for john kerry. >> there is a mitt romney flipfloping website as well that if you keep clicking it will show you where he said one thing and where he said something different. it's already stuck. >> let me show you. i think we have the first dnc web ad and i'll ask you your

long with the driver of the tractor-trailer were all taken to the hospital. witnesses say the minivan may have hit a deer and then slowed or stopped before it was hit from behind by the truck. major new developments this morning in the occupy wall street movement. first nashville where police arrested about 30 people overnight and using a newly enacted state policy that sets a curfew for the grounds near the state capitol. in oakland, california, about a thousand demonstrators held a vigil for an iraq war veteran who was seriously hurt earlier this week. scott olson suffered a fractured skull. doctors upgraded his condition now to fair. in london, a senior priest resigned from st. paul's cathedral over the protests there. reverend frazier says he believed that church leadership was ready to back a plan that could lead to the violent eviction of peaceful protesters who have been camped out on the church's doorstep. it's being called one of the greatest games in world series

to go around the congress is just -- it's almost laughable. so we're keeping a very close eye on the administration to make sure that they are following the law and following the cons tuesday. >> joining me is marcia blackburn. thanks for coming in. good to see you. are you going to be questioning the president and whether he can constitutionally do this today, for example? he put out a presidential memoranda to speed up the transfer of federal research to the laboratory and he's created business usa a central web page for small businesses can go to help them get exports on to the market. do you have a problem with that or should we be focusing on job creation? >> what we should be doing is creating the right environment for jobs growth to take place. we all know there is no single deal, no stroke of the pen on an executive order that is going to fix, if you will, the jobs situation. what it is going to take a change in the way we do business. i like to say it's an equation.

less regulation plus less litigation plus less tax pags, equals job creation. >> that means usually some austerity, doesn't it? >> not necessarily. what it means is getting the federal government under control, working through in an orderly process. we're a nation of laws. the rule of law, we have the order of process for congress for the house and the senate and chris, that is what people are wanting to see. lay it out. let's talk about what we're going do. >> the president did lay out his plan. didn't get very far. >> no, it didn't. >> because what he wants to do is increase the burden on taxpayers on job creators and the american people have said time and again, we don't want any more taxes. we don't the regulations. >> let's be fair about this. the american people and you've seen it in poll after poll after poll, they want people who make a million dollars and more a year to be taxed more. they want them to pay more. if you look at the statistics shall at the number of people who don't pay any taxes at all, frankly, it's worrisome to

people out there just getting up every day hoping to be able to pay their bills. >> hard working taxpayers continue to tell us that what they do not want is more regulatory, more taxation, more litigation burden. what they want is the federal government to get out of their way. >> do you think those polls that show the american people want people who make a million dollars or more to be taxed, do you think the polls are wrong in. >> when individuals are asked, if this is your employer, do you think your employer should pay more in taxes, should he pay in more taxes and hire fewer people they come back and say no. what they want to see is growth and job opportunities and as long as that litigation, regulation taxation is increase, you're not going to see that. and repeatedly people are saying, wait a minute, you know, we used to be the leader when it kams to innovation and job creation. take a look right now at the technology sector part of our economy.

take a look at what's happening in the energy sector of our energy, whether it's the fcc imposing new regulations in technology or the epa with regulations on the energy sector, it's difficult to hire those individuals. >> so it sounds like you would support what the president did today, which is taking steps to speed up the transfer of federal research and development from the laboratory to the marketplace. sounds good to you? >> those are the type things that need to take place. but congress needs to be leading the way there. what we need do is -- >> are you suggesting, as the speaker did, that there is something unconstitutional about that? >> chris, that needs to come through congress. when there are laws on the books, when there are statutes that these rules and regulations are based on, what we need to do is get those statutes off the books. that way you're going to see a permanent systemic orderly process change. that's what people want to see. they want some certainty. what america needs to have a is a certainty in growth agenda. if you were out with me in my

district, what you would hear from employers is that uncertain fwi what's going to happen at the federal level and this constantly changing what the rules are is hampering them. i visited with the hospital in rural west tennessee last week that had gotten 37 rule changes that week from hhs. that's the kind of uncertainty people don't like. >> congressman marcia blackburn, safe travels. i know you're going back to your district and the weather around here is -- the forecast isn't great. thanks for coming in. >> thank you. a whale of a tale to tell for this kayaker. look at this amazing picture. the photographer took this lucky shot off the california coast. he was doing actually promotional shots for the santa cruz visitors council. look, two humpback whales coming right out there and perfectly timed and we're going in. but what you can't see on the right side, what we should be seeing on the right side is the kayaker who said he had to duck so their tails didn't hit him. unbelievable.

doctors havelong touted the positive effects of aspirin. the so-called wonder drug can reduce the risk of cancer. let's get the details from dr. ian smith. author of the four-day diet. always good to see you. tell us about this study. what kinds of cap certificate are we talking about here? >> this is colorectal cancer. we've known there's relationship with aspirin and preventing someone's colon cancer. the issue with this study, it's the first time we've had a randomized control study that's looking at patients specifically to see if it can prevent colon cancer. this particular study looked at people with something called lynch syndrome, a genetic disorder. it found it can reduce their risk by up to 60% by taking daily aspirin. >> it's 60% for those with that

increased hereditary risk. that's a huge number. is aspirin good for everybody in. >> this is the key. you know, aspirin is typically used to prevent heart disease consequences and so we typically use it in patients who are heart patients and so this study does not say everyone should go out and take an aspirin to prevent heart disease. aspirin can be dangerous and increase your risk for gastrointestinal bleeding and it can be fatal. always consult your physician. the other question, chris, is that this was a high dose aspirin. they want to know whether or not you can have this protective affect against colon cancer at the lower dose. >> there's so many things that we hear about that aspirin can help. i do know people who as a matter of course take a couple of aspirins a day. sort of as a preventative. is that a good idea? >> well, it's a good idea only if you are doing it under the supervision of a doctor. aspirin can increase your bleeding time which means that

oh, are you kidding? we're a little less than two months away from the official start of winter and already snow coming down here. we have another snowstorm on the way on the 95 company. i'm carl parker. we're watching a quiet day right now. that's going to change. notice the rain here across the tennessee valley and down into florida as well.

that's the developing storm. wet weather in some areas that need it across the south. a little bit of stormy weather in florida. that will increase in the carolinas tonight. then the storm moves up the coast. snow develops in interior parts of the northeast and then late saturday the storm is going to bomb out, which is to say it's going to get a lot more intense. a lot of wind, very heavy snow through interior parts of the northeast. it's a tricky call for the 95 corridor. a few inches in boston, new york city, 5 to 8 in hartford. 3 to 5 in philly. 6 to 12, farther west, allentown bo poughkeepsie and the litchfield hills. with a lot of leaves on trees and heavy wet snow and wind 30 to 40 miles per hour, that could be enough to cause widespread power outages. that's a big worry going into this weeken. in the meantime, very quiet for the country. looks beautiful in los angeles. p 7 today. rina is just about no more. chris, just a little bit too

early for all this winter weather. >> we're not ready. >> absolutely not. carl parker, thank you for the update. in ohio, the six exotic animals are staying put at the columbus zoo for now. the agriculture department put the surviving animals in quarantine instead of transferring back to the woman whose husband set the exotic animals free before he committed suicide. john yang is live in ohio. do we know, john, what the future is for these animals? >> reporter: chris, they are going to remain here at the columbus zoo under indefinite quarantine. miriam thompson, the widow of the owner was on her way here to pick them up yesterday when state officials issued that quarantine order. the sort of last minute intervention was coordinated by the governor's office and the state attorney general's office. it is an indefinite order. thompson has 30 days to appeal it and request a hearing.

we've asked her attorney and we tried to reach out to her to find out what her plans were. but we got no response. the order says that they want this time, this quarantine to assess the health situation of these animals. particularly of concern are the prime mates. we're talking about three leopards, two primates and a small grizzly bear. the primates are typically carriers of the herpes b virus. it doesn't affect them. but if they bite a human, it could be fatal. the zoo officials here also, the veterinarians here at the zoo also talked about the horrific conditions, their terms, horrific conditions in which these animals were kept in zanesville and zoo director emeritus jack hanna says they will go back there over his dead body. >> john yang. let's check on other stories. jurors in the manslaughter case against michael jackson's doctor will hear another version of

what may have happened in the singer's bedroom prior to his death after a defense witness did a computer analysis based on samples taken during jackson's autopsy. all this is delaying the trial and the frustrated judge who long ago prommed jurors they'd be done by today is now worried that some of them may not be able to continue. a former ohio high school gym teacher has been sentenced to four years in prison after a judge rejected her insanity plea and convicted her on 16 counts of sexual battery for sleeping with former students. five former students testified that 33-year-old stacy schuler provided them with marijuana and alcohol during sexual encounters that took place at her home. the parents of missing missouri baby lisa irwin called off an interview between their two other young children and police. the parents have not allowed their two sons to be interviewed since october 4th. meantime, kansas city police wrapped up a brief search at a small lake near the family's home. a rescue in turkey.

a 13-year-old boy pulled alive from the rubble of a collapsed apartment building nearly five days after the earthquake. the boy's uncle says the teen used a rock to try to dig a hole. the death toll stands at 570 and 2300 hurt and thousands more are still homeless. breaking news. detectives are now on board this cruise ship in the harbor in boston after two separate deaths. the ship docked this morning after two passengers on board died. one was a 67-year-old woman, apparently that was natural causes. not suspicious. but they don't know how a 23-year-old man died. norwegian cruise line has not rurpd the ap's calls for comment yet. when you have a 23-year-old, they always will investigate it as if it's possible it could be a suspicious death. we'll keep you posted as we learn more. consumer groups are getting with phone companies some static

over another fee that will be tacked on to your monthly phone bill. cnbc's brian schactman is here with what's moving your money. another fee, are you kidding me? >> we never really know what they are and we ignorantly pay them anyway, chris. basically the federal government has been subsidizing land lines for a long time and then want to stop doing that, allocate money and resources to broadband. the phone companies are going to have to charge more to make up that or at least they feel they have to. it is small. it's 50 cents a month. in five years it can ko go up to $2.50 a month. the businesses don't have to but they will because they can. they don't want to lose the extra income that they've been getting from the land line subsidy. it's only people who use and pay for land lines. so that's the one caveat for you. >> better news when it comes to j.p. morgan chase. they will not charge a monthly fee for debit card purchases.

>> at $5 a month do you use -- 23% of the u.s. market in debit cards. chase, which has about 15%. they're not following suit. it's like the issue with airfare hikes. right? if everyone follows suit, it's good for the companies. if not everyone, there's tension. we'll see what bank of america does. i will tell you the banks on board, bank of america has the debit fee, so does sun trust and regions. on the other side, citigroup, u.s. bank or pnc and key corp. decided not to follow suit. all eyes will be on bank of america to see if they pull back because of the consumer backlash. cnbc's brian schactman. thank you. filing paperwork in new hampshire. rick perry and ron paul have stops there. time for our periodic check in what's happening on those early states crucial to winning the presidency. nbc's political reporter is here. let's start with the state with the first primary. new hampshire, what's going on? >> since you mentioned new

hampshire and we talked about their primary deadline. let talk about ron paul today. he's dismissed sometimes because of his libertarian views. this is the live free or die state. ron paul has done a pretty good job fundraising and blanketed the granite state and last time in 2008 he finished fifth. this time around he's been second or third in most polls. that's probably where he's going to finish. mitt romney has huge leads, he's the overwhelming favorite, chris. >> he does have that vacation house there. let's talk about iowa. rick perry has a new ad there? >> yes. rick perry is on the air in iowa. he's the first time he's done so. he has about $15 million in the bank. he trails in the polls. he's got to be able to make his move. if he's going to become the romney alternate. he's got to win in a place like iowa. it lines up perfectly for him. he has to do well there. he talked about yesterday his campaign had talked about yesterday that they may forgo some of the debates.

that's because he really likes the hand to hand retail campaigning and no place is better to do that than iowa. >> mitt romney in south carolina and it is going to be interesting to see whether his religion plays a role there. >> no question about it. mitt romney, it's interesting he's actually first or second in most polls in south carolina. but his campaign is not playing there. why? because 60% of republican primary voters in south carolina say that they're either born again or evangelical christians and many have problems with mormons and don't believe it's christianity. it is a flash point. it's a tough thing for mitt romney to overcome and it remains to see if they'll play there. indications are they won't because they think they can do well in new hampshire and that fla and win in a longer delegate race, chris. thanks, have a great weekend. big stars hitting the big screen this weekend.

probably the only plan put fort as a presidential candidate that people can recall or remember. inside the beltway we debate the economics of it. at least it's a plan that someone can remember. >> is that what the bar is now? that something you can remember? >> i think at this stage it probably is until we actually get people heading into voting booths. all the presidential candidates have put out some sort of plan, mitt romney has the 59-point plan. governor perry tried this week to put his plan out. although, he sort of self-bracketed himself with talk of bertherism on the front and skipping debates on the back end. >> he admits he's a terrible debater. what his campaign is trying to say is that he wants to skip some more because he want to spend more time with voters. are we buying that? >> not really. you got to do both. you'll have every other presidential candidate standing up there taking questions and exchanging views with each other.

that's what republicans voters really want to see. you cannot skip the debates. it was kind of silly to raise it. because it confused the character of the candidate. i'm not really sure why the campaign did that except that they seem to have a habit of getting their skis crossed. >> we always come back to this question, governor, is it really all talk, except about the economy. i hate to bring this up. we've known each other a long time. it's on the front page of the wall street journal. harrisburg, which people may or may not know is the capital is having a yard sale two weeks after they filed for bankruptcy. they put it in -- i've got to read the first paragraph. it's too good. stowed in a warehouse, a u.s. cavalry horse's hoof purr porptedly found on the battlefield of little big horn. how did it come to this, governor? >> it's really a local issue. it's symptomatic of the fact that municipalities are hurting because of the recession. no question about that. harrisburg made bad investment

decision to put a lot of money into an incinerator. it caused them to have an incredible debt to carry. >> if you're somewhere like that and i'm trying to make this in the big picture. if you're somewhere like that and you see what's happening to your city and you see what the unemployment rate is and we know how important pennsylvania is a battleground state. extrapolate that across america, ultimately is that where your vote goes, you want to throw out whoever is in there right now? >> to some extent. let me finish quickly chris on harrisburg. i testified before the city council there. i kept them alive with short run grants or up fronting some of the money due them. i said they had to sell their assets. they have parking garages that should be in private hands in my judgment and by selling those assets, they could have avoided going into bankruptcy. they still might. that's the prescription for harrisburg. sure, the economy is difficult. and it's the biggest burden for barack obama. but unless the public hears

something else from someone running against barack obama that makes sense, i think e. going to be the most credible candidate on the economy. the jobs bill that he's put forward is understandable. people like the components of it. republicans have supported it in the past. he is doing very well. remember, he's at 46. and you can see that's not so great. but the republican congress is at 9. >> if the republican congress isn't running for president, governor, it won't -- >> ask around for tom dewey. >> they're going to try to do that. you hit on something, chris. that is that you start doing the electoral math in in race and you look really hard at states like pennsylvania and governor rendell and i both spent lots of time in pennsylvania, he as governor. it's a wonderful town and we want to see it get back. but there is this sense of real angst and concern in pennsylvania. the jobs picture is not great. state finance rs not great.
