a confidential agreement depends on the contract itself. from what i get, there was a nondisparaging clause in that settlement agreement. >> if he violated the settlement agreement, does that negate the entire agreement? would that allow the women to come forward and spim the beans so to speak? >> the answer is it might. there are to ways in my opinion to do it. a, you come out and speak and let him take you to court and say you violated it. and really what kind of judge will say under these circumstances that you shouldn't have spoken out and stuck up for yourself after he did? or you go to court on an emergency application and ask permission to speak out on your own behalf. >> if they don't do that and at the they were to violate the agreement, what could the potential penalty be? >> most of the time the penalty is in the agreement themselves, they might have to pay back money or attorneys fees or penalties. it would depend on what the agreement is. >> how air tight are these

agreements traditionally? >> the court usually will enforce an agreement unless it is clearly against public policy. depending on whether or not she had an attorney when she signed he's talking about things she said didn't -- that she'll be successful and try to violate herself. wouldn't be a violation at that point. >> one of the accusers saying through her attorney, one of the reasons she doesn't want to, she quote, does not want to become another anita hill. are her concerned valid do you think? >> in this media sensation, they could be valid but the bottom line is it seems like she's already become that. they are talking about her and saying she's lying. she needs to come forward and protect her reputation. >> rosemary arnold. thanks so much for the insight into a lot of questions we've been having. we appreciate your time. political correspondent jim

rutenburg has been covering the story for "the new york times" for days now. jim, where is the campaign getting this information that rick perry's campaign is responsible for leaking this story? >> really they are making a circumstantial case. what we know is some people now working for the perry campaign have worked for mr. cain back when he was running for the senate a few years ago. it's circumstantial. >> i understand one of the women who lodged a formal complaint said she didn't want to become another anita hill. there are two women who filed official complaints. what's the latest on the other woman? >> all we know is that there's at least a third woman who thought about filing a complaint and didn't was very upset. we'll see if she steps forward even more. right now mr. cain does not have anyone stepping in front of a camera on the other side of this, any of these women who made the accusations, to publicly take him on face to face. >> do we think at this point there were other women out there?

>> you know, i don't feel comfortable speculating on that but i'm sure his campaign is hoping this will be the end of it and it won't be. if this keeps dripping, i don't know if he can hold his position of not talking about it more. >> jim, in your article, do you also -- you guys revealed some stuff about cain's lifestyle while he was working at the restaurant association back in the '90s. what did you find? >> everything we're being told from people at the time it was -- especially he was in the d.c. area doing his job away from his family. at night if he didn't have a business plan, he had time on his hands. some younger staffers who were single had time on their hands. it was a lot of going out and that's what they did. they were at the restaurant association, hospitality industry. >> chris wilson is the name of a man who worked at the restaurant association as a pollster during the same time as herman cain. he's a new character in this ongoing story.

what did chris wilson tell you guys? >> chris wilson actually is also affiliated with a super pack supporting mr. perry. he says he witnessed an interaction in which he says a young woman was made to feel uncomfortable. >> where is the coverage for the paper go from here? >> i don't know, depends on do more things pop up? does pressure continue to stay on mr. cain where he's going to have to support and talk more about this? does the restaurant association have to clear the air? if this story keeps going with this kind of velocity, it's going to force mr. cain to address this in much more detail. >> jim ruternberg, thanks so much. >> the president is in cannes france and while they'll be discussing a range of topics, one ranks above them all as the most urgent. greece, protests against aus teri measures continued across

greece but leaders have canceled the planned referendum on the bailout after europe's leaders threatened to suspend aid. the g-20 leaders will try to hammer out a plan to avert a full blown crisis in europe. >> the most important aspect of our task over the next two days is to resolve the financial crisis here in new york. here at the g-20, we'll have to flesh out the details about how the plan will be fully and decisively implemented. >> chuck todd is nbc's chief white house correspondent and host of "the daily rundown." he's in the south of france with the president. >> day one of the g-20 summit, his fifth since taking office and all had the united states playing a essential role before but this one the united states and president obama is more on the sidelines because of the developing situation in greece and this issue with the euro

zone. he is playing the role on cheerleader on one hand, therapist, trying to thicken the spine of the french and germans to stick with this plan of creating their own version of t.a.r.p. they call it a fire wall. it's a trillion dollar fund to stabilize both financial institutions and governments. the u.s. t.a.r.p. was only for financial institutions. this one though would be there for governments as well. and they thought they had struck a deal with greece. obviously it's unpopular inside of greece and the uncertainty of who's running the government causing the question whether this bailout fund will work, this is also about italy and portugal and spain. they are trying to set up a way to work in greece and see if italy and spain and portugal and even ireland can also use this as a guide to do this. as for the president's role, he wants to say, look, this is how we did it with t.a.r.p.

this is how it works. we know it's politically unpopular and that's what the europeans are finding out. all politics is local here as well. you have to do it if you're going to stabilize the world economy. for president obama there's a political aspect to this because if the european economy doesn't stabilize, the american economy isn't going to stabilize and that will hurt him going into 2012. from cannes, france, this is chuck todd reporting. back to you. >> chuck, thank you. appreciate that. the greek crisis also a u.s. crisis as well, fear of course can move markets and the fear today is that u.s. banks and repeat of 2008 are once again exposed to too much bad debt and that a default by greece could have huge implications in this country. joining me now senior analyst ron insana. monday there was going to be a referendum in greece and today it's off again. what does all of this do to the

markets in the country? >> the fact that it's off again has allowed the markets to snap back for a second day. if the greek people decided to opt out of the euro zone it would mean they would have to readopt their old currency. it's likely they would default on their debt and the hair cuts being taken by the banks that have lent greece money would be larger than the 50% agreed to. what people worry about, that would trigger a broader crisis in europe where the sovereign debt would come under pressure and lead to a further systemic issue in europe, which o could then affect our markets. with that referendum off, it's possible the bailout fund will be utilized properly and this situation might be contained. >> live look at you're speaking at the prime minister of greece there speak gs there on the other side of the screen. you mentioned the banks in greece and how they are tied to the mess there. what about banks in this country? how exposed are banks in this

country or do we even know how exposed they are to debt in greece? >> from what we've understood, the direct exposure to the debt of greece or the other troubled european nations is relatively small. given that u.s. banks during our crisis were very heavily recap talized, they don't have much direct exposure. whether or not they own a lot of derivatives or other types of complex instruments that could go sour if the european situation gets worse has not been fully calculated. it seems u.s. banks can weather that storm. but like you said, i'm not sure we're entirely certain of. >> what are we entirely certain of? >> we're entirely certain if greece -- if europe does not handle this well and the european central bank should point out cut interest rates by a quarter point from 1.5 to 1 1/4%. the u.s. by comparison, despite

the problems we have, looks good. our markets may go off and continue to rebound. if the whole thing collapses, there's a risk of a double dip recession and that's what everybody fears the most. >> is there concern over inflation as a result of that? >> europe is facing what we faced in 2008 right now it is a deflationary condition where recession could come and prices could fall. they need to cut rates to zero like the fed did and need to engage what a lot of economists call qe, buying up bonds in order to obtain low interest rates so the american economy can recover. >> ron, thank you. a quick look how the markets are doing. dow up 121 and s&p and nasdaq also up. we'll continue to update you. the texas judge in the videotape of him disciplining his daughter that triggered a public outcry. we'll show you that video and also tell you what lots of folks

closing arguments are set to get under way in the trial of dr. conrad murray. right now the judge is giving jurors their detailed instructions, very detailed instructions before the prosecution and the defense make their final cases. all of that expected to get started here. the final case is expect -- closing arguments expected to happen within the next hour or so. kristen dahlgren is live at the courthouse. good afternoon. what kind of instructions is the

judge giving? >> reporter: what we've been looking at i judge pastor reading 26 pages of instruction to the jury, essentially what they can and can't consider in the case, how they handle things like objections and anything stricken from the record, they can't consider that when making their decision. we then expect to hear the closing arguments and the prosecution goes first. they will try to make their case that dr. conrad murray was a careless and greedy physician who gave michael jackson propofol. that powerful sedative outside a hospital setting without the proper emergency equipment and left the room for 45 minutes to make phone calls. the defense gets its say. they'll try to argue that michael jackson was an addict who took the fatal dose himself. the prosecution gets one last shot, the final say. expect them to argue that whatever happened inside that room dr. murray should have had control of that sedative at all

times. the judge hasn't set any type of time limit on the closing argument although he has advised both sides to stay focused. >> timetable on when the jurors will start deliberating. are we expecting this early this afternoon or more than likely tomorrow? >> reporter: you know, it's a good question. it could happen later on today. two days ago the judge was saying he expected both sides to take three hours in their closing arguments. there's no time limit. they could go longer. if they take that planned three hours, the jury could get this case later on today. the judge will give them a few mour instructions before they go into the deliberations otherwise we could see them begin deliberations. after six weeks, i'm sure the jury is anxious to get started on making their decision. >> kristen dahlgren in los angeles. thank you. a day of peaceful protests aimed at showing the reach of the occupy wall street movement turned ugly. we'll take you there.

deputies searched the wooded area near the home of a missing mother of four. karen swift was last seen after a halloween party. her suv was then found abandoned with a flat tire. the sheriff's office says there's no obvious sign of foul play. her husband reported her missing. the two are divorcing but so far no suspects have been named. a texas judge under fire for how he punished his daughter. next, the videotaped beating that has many saying that judge crossed the line and then some. plus, will go after wall street bring back blue collar votings to democrats? we'll talk about that in just a few moments. that measure is not expected to pass. new claims for unemployment benefits fell below 400,000 last week, for first time in five weeks. also, more than a million people still do not have power across the northeast. in connecticut alone, about 540,000 customers are still in the dark and the governor says the lights won't come back on for everyone until sunday. a new study out of canada shows a link between prolonged periods of sitting and cancer exist. researchers found regular physical activity reduced the risk of breast, colon and in end meet treeal cancer by 33%. herman cain doing his best to keep out of the media spotlight. the scandal continues and now cain is lobbing accusations of a smear campaign against one of his republican rivals. cain reportedly phoned supporters telling him that the perry campaign, quote, stirmed

this up. a spokesman called the suggestion quote reckless and false. joining us today, what's the atmosphere in the campaign like right now? good afternoon, craig, we're seeing a defiance from the cain campaign. late yesterday we heard the accusations leveled by the perry campaign, there's this guy curt anderson who helped advise cain during his run for the senate in georgia in 2004 had been privy to this information about these suits, that these women leveled with the nation restaurant association and now he's a perry supporter and that's where they say that rick perry got this information, somehow leaked to the press. even if the story holds true, it does not answer the questions that everyone is asking, what exactly happened? saying it's rival campaign, putting out this information, this doesn't hold a lot of water with people who want to know exactly what it is that happened

with mr. cain and whether or not he's ever sexually harassed thiz women. >> we've been talking about this for several days. the candidate seems to be using all of this to rake in a boatload of cash, fundraising over the past few days for the cain campaign has been historic. >> that's the other part about this, craig. according to the campaign, they've raised nearly a million dollars over the past 48 hours. just this morning they started an iowa fund where it is money that they want to put towards the caucus to doing well there. i'm told that since 6:00 a.m., they've already raked in $100,000. the goal is to make $900,000 by november 9th. of course the clever 9-9-9 puns out of him right there. they are taking advantage of this in fund dz raising standpoint, according to the campaign these are their numbers. >> he also did an interview this morning with someone else who is fairly controversial in her own right, i understand.

who's that? >> right, he spoke to clarence thomas's wife for the daily collar. there was one quick question about the actual scandal or the alleged allegations against him. and we heard the same narrative that this is false, it's a smear campaign and this is just the media being biased and other campaigns fearing him now that he's a top tier candidate and trying to bring him down. he has those arrows on his back as he's like to have said on the campaign trail. >> thank you, andrew. >> rick perry, meanwhile in iowa trying to get his support back in the double digits among registered voters. carrie, what's been the perry camp's reaction to herman cain's charge that it was perhaps his folks who leaked the allegations? >> last night we saw a swift response from the perry campaign. they said two responses, the

candidate himself was on tv and curt anderson who my colleague andrew mentioned, the perry backer who cain accused of leaking this information has been doing the tv rounds as well. he is not only in those interviews denying the fact he had anything to do with this, the word he's been using are interesting as well, how it would be unethical to make a leak. invoked the bible talking about the idea of bearing false witness. they have been very careful not to attack herman cain personally, to push back the charge they were involved with the leak but not to call cain or anybody from the camp is a liar. cain is still very popular. it's unclear how voters are going to react to these allegations so they don't want to be overly negative about cain himself but do want to distance themselves from the story quickly. >> let's talk about rick perry, the giddy speech he made over the weekend, still making the rounds all over the internet.

any more out of camp perry about that speech? >> governor perry addressed this earlier and said the speech was fairly typical for him. i felt great, everything was fine and that sort of doubles down on the message we've been hearing all week from him, that the speech on friday, he was just feeding off the crowd having a good time. we heard that from the candidate himself now. his backers in new hampshire say the same thing, there was nothing going on there except for a lot of excitement. i think the perry that we saw on friday had enthusiasm, was one that the texas press corps and those that have been following perry for a while have seen before, the very enthusiastic, very interactive candidate. and the campaign said that night in new hampshire that the crowd seemed to like it and wanted to see a candidate with that much energy in the future. >> such a sharp contrast from that rick perry and the rick perry we have seen in so many debates now. thank you. we appreciate that. thanks for your time.

>> occupy wall street protesters gathering again today in oakland california. today is more peaceful after violent clashes with police last night landed some pro testers in jail and forced a closure of the port of oakland. we want to go live to oakland and miguel almaguer. what happened? >> reporter: craig, apparently there were 100 or so protesters in the downtown area. they were approached by police in riot gear because police officers say the protesters occupied an abandoned or foreclosed building downtown and setting dumpsters on fire. officers say for public safety they had to clear out the area they went in with riot gear and tear gas. several arrests were made. during that time, there were also some acts of vandalism that happened. this is a coffee shop in downtown oakland, that was near

the heart of where the encampment is taking place. over my right hand shoulder, this is the occupy oakland plaza where protesters have been gathering and this is kind of the main focus where protesters have been gathering. last night as that protest was breaking out, this was among one of several businesses that was actually vandalized. you'll see this downtown square here in oakland was actually the center of a lot of activity. across the street you can see there's a rite-aid pharmacy and workers trying to take off spray paint. there's a four-block radius with a lot of damage and it will take some time for police as well as volunteers to get this all cleaned up and under control. >> any idea when the port of oakland might reopen or has it already reopened? >> reporter: they've let us know that there are still some protesters there but there are several entrances to the port

that are reopened. of course, as you know, that was shut down last night around 10:00 or 11:00 permanently for at least several hours, pmany o them about 4500, marched to the port of oakland and shut that down. they were saying that the reason it was so important to shut that down because it's the capital source of commerce and they shut down the port. it was followed by acts of vandalism and small riot in downtown oakland. >> we appreciate that. take care of yourself out there. the occupy wall street moment seems to help democrats find their inner populist, calling on the top 1% to say what they say is their fair share in taxes. could that help them win back the majority in the house as well? josh, what are the chances of

them winning over blue collar workers by beating up on wall street? >> they are betting by appealing to working class voters and trying to connect themselves with some degree to the occupy wall street movement, that they are going to really win over the working class voters. it's not just the house. it's everyone from the president on down. president obama in the last couple of months has been talking about the wealthy paying their fair share in taxes. you have senate democrats, elizabeth warren running in massachusetts and closely associated herself with the occupy wall street movement. a lot of blue collar congressional districts that house democrats think they can take back by talking about populism. this is a message we're hearing across the board and democrats think it will be the tonic to help them across the board from the house on up in 2012. >> what's the danger? what's the danger for democrats as they continue to make this populist push? >> by making it about occupy

wall street and hearing the occupy wall street connection a lot, they are risking connecting themselves with the excesses and more unpopular things. what we saw in oakland and other sfis around the country. there was a poll that came out today that showed for first time a pluralty of voters looking at occupy wall street unfavorably and thinking maybe this isn't what we want to associate ourselves with. democrats are trying to walk a thin line between channelling the middle class angst and anxiety but not identifying themselves with the excesses and some of the violence that's taking place in recent days. >> have we seen any candidates specifically benefit from the occupy wall street movement or benefit from the new found populism of the democrats in general? >> this is a big bet and if you want to look at one state, one place where the message is really going to be heard loud and clear it's in massachusetts.

the senate race where elizabeth warren has been talking about the struggling of the middle class and running against the leading republican senator, very vulnerable in 2012, republican scott brown. she's been accusing him as being part and parcel and someone with wall street's interests first and foremost. >> you alluded to this as well. you have democrats who beat up on wall street often times and beat up on the top 1%. when it comes to campaign contributions, it's very difficult to finance major races on the backs of the 99%. >> that's absolutely right, craig. the president himself is finding that out today with the -- some of his biggest campaign donors who have been connected to wall street firms in trouble. it's a delicate line to walk because a lot of democratic donors as well as republican donors are from wall street or have close connections to

the issue of gender gap in pay. >> let's start with the size of the gap. how much of a gap are we talking about between men and women with a high school degree or less? >> what this report looked at is low paying jobs and unskilled workers, yet many of the women had college degrees and it showed a consistent pay gap anywhere between 79 cents to 86 cents to the male dollar. this low income group was defined as making less than $11 an hour. this is among a series of study that's initiated with the general accounting office on the gender gap so we can understand it and address it and hopefully correct it. >> to what do we attribute this gap? >> well, the researchers would factor in all kinds of conditions that may explain it, such as the birth of a child,

part-time work, taking time off to take care of an elderly parent, occupation, age and still there was always a consistent unexplained wage gap. but it did show that over the past three decades women are gaining an education. they are becoming better educated at a level of higher and faster than men, yet still, there is this unexplained wage gap. what was very troubling about it is what i'm calling the mom bomb and that is when women have children, they really take a hit. often times fathers get a pay rise but women lose or or lose ground in their professional careers and it hurts them. there was a huge gap between single men with children and unmarried single women with children. >> the under lying some of these numbers, is it just sexism? i mean, is it just
