of the country and the economic facing the president and the battleground map showing the razor tight race in 2012. and this. horrific story out of texas. a man says he was beaten, stabbed, and burned all because he is gay. this is what his body looks like. we're going show you his face when we talk to him life. is this going to be labeled a hate crime? hope you had a greet weekend. i'm thomas roberts. we get right to it. more trouble for herman cain's campaign this morning. reports a new woman is accusing him of sexual harassment and she will come forward later today with her attorney gloery all red. nbc news has not independently confirmed these new allegations. meanwhile, a watchdog group called the center for media for democracy is asking the irs to investigate allegations that cain's chief of staff, mark block, improperly used $40,000 of funds from a tax-exempt

non-profit to pay for private jets, travel, and computers for the campaign. despite these allegations, cain is still raking in the campaign cash. $2 million raised since the harassment scandal broke. cain himself says he's not answering any more questions. >> don't even go there. >> can i ask my question? >> no. >> can i ask a good question? >> where's my chief of staff sfl. >> i'm right here. >> please send him the journalistic code of ethics. >> will do. >> who else? do you want to ask another good question? >> all right. so that sound from a weekend debate with newt gingrich who told nbc's matt lauer this scandal will play out, play out all on its own. >> i think it is probably surprised most professionals that herman has done as well as he has over the last week. but we'll see if this has legs or not. i think he's got to handle it his own way. >> joining me is the national political reporter for politico,

alex burns. alex, let's start with this new person who may have allegations to substantiate coming forward. we, again, nbc news not independently verifyi ining the accusations. however, she has already lawyered up. >> when you see gloria allred step forward you know it's about to get a bad or at least pretty problematic for rherman cain. what we're going see this afternoon is that for the first time one of cain's accusers will have a name and a face. cain has gotten away for the last week saying he's not going to address anonymous accusers. that might get harder going forward. >> alex, the new article you have out before this fourth potentially -- fourth person to put these allegations forth came forward, on politico, fa. you say no, one is willing to flat out say it, but the republican and democratic party

establishments have already written off herman cain. alex, how can you be sure they have done that since the scandal has broken, $2 million has come in to support his campaign? >> thomas, i think what's really striking is that over the last week you've had a republican presidential candidate who is in the polls tied for first place in his party's prime just engulfed in a scandal and none of his primary opponents have attacked him over it and none of the democrats who would be opposing him in a general election had attacked him over it. what that tells you is these are folks who either aren't taking cain particularly seriously to begin with or think it's only a matter of time before the house of cards comes tumbling down and they don't have to help it out. >> interesting though, pointing out here though that rival candidate jon huntsman appeared on "meet the press" this weekend and did attack him. listen. >> do you think he can't say end of discussion until he gets more information out? >> all the information comes out, it's got to come out in total. legitimate questions have been raised and that information has to come forward. >> you write in your piece it's

impossible to imagine other presidential candidates polling as well as cain and getting such light treatment over the reports of personal misconduct. why is that? >> well, i think the clip that you put from jon huntsman is lust stra tive on that point. he's not saying these reports are troubling and herman cain may not be qualified for the presidency. he's saying herman has some questions to answer. that's a very sort of, at best, passive aggressive way of going after him. it's just sort of saying this is a problem for him to deal with. let it play out on its own. >>al election, great to see you this morning. thanks for your time. the 2012 election now less than a year away and president obama's re-election machine is in high gear. the president's campaign held more than 2,000 events across the country this weekend to recruit volunteers. meanwhile, a new poll showing the president is facing frustrated americans. "the washington post" poll abc news poll shows a record 31% of voters is angry at the way the federal government is working

and overall 80% have a negative view of the job that washington is doing. nbc's kristen welker is at the white house for us this morning. the president is going to be speaking in less than an hour. give us a briefing about what he's going to talk about today. >> reporter: good morning, thomas. he's going to do a couple of things. first he's going to call on congress to pass the portion of his american jobs act that will provide tax breaks for companies who hire veterans. and the second part of what he's going to be doing is basically to announce two new presidential actions. as you know he's been rolling out he's presidential actions basically saying that if congress is not going to act on his american jobs act he is going to act to try to put americans back to work. as you know, republicans basically have been accusing him of playing politics for this. but today's actions are twofold. first he's going to announce a veteran gold card, which will essentially give veterans the ability to have six months of training, career, counseling at a career center to basically

help them get back to the workfor workforce. the second part of this will basically to give veterans -- he's going to announce a new website actually that will give veterans more access to job openings. >> when we talk about the specifics in the "washington post"/abc news poll showing 61% of americans disapproving of president obama's handling of the economy, how concerned is the white house when they look at those hard numbers? >> well, there's no doubt that there's concern. the unemployment rate still at 9% and when you look at the electoral map there are currently 11 states that are toss-up states, including states like pennsylvania, ohio, michigan, states that president obama won back in 2008. so any way you look at it, this is going to be a close race. so the strategy right now seems to be for the approximately to run against what he is painting as a do nothing congress. that's why you see him rolling out these presidential actions on a weekly basis at this point. we'll have to see if it actually works. this is something that did work for president clinton back in

the '90s. but there is certainly a lot of gridlock here in terms of getting any jobs bill passed and these presidential actions by all accounts are really operating on a small level. so as we approach election day, thomas, the main indicator that people are going to be looking at really is the unemployment rate, which, as i said, is at 9%. not expected to drop that much lower when voters head to the polls. thomas? >> nbc's kristen welker at the white house for us. as we did mention, president obama will layout his plan for getting war vets back to work in aen hour. stay with us for live coverage beginning at 12:00 p.m. eastern for that talk. as kristen just pension men released is the 2012 battleground map. the map suggests the map will be decided by less than a dozen swing states. take a look at whether where this tally stands. democrats have 196 votes among states that are leaning or will likely vote for president obama.

the gop has 195 expected votes. and all eyes are on 11s to-up states where 147s to-up votes are up for grabs. joining me now is the education director. doug hi is the former communications director of the republican national committee. it's nice to see you. brad, i'll start with you. in '08 they took traditional republican states like virginia and north carolina. how tough of a fight will those toss-up states be this year? >> thomas, no one suggested from us or the obama campaign or the white house this won't be a very hard-fought election. it will be very close. i got to tell you though, if you -- you know, if you told me that if republicans were going to take over the house, that they would be hell-bent on hamstringing the economy, so that the president can't get any political gains before the next election, and that we would see polls that show the president ahead of all of his rivals as he saw in quilast week and in coloo

and ohio, they had the president ahead, i would tell you that i feel, you know, that we're in pretty good shape though it's going to be a very, very tough election. >> let's go ahead and keep these battleground map state itself. as we look at this, doug, which states do you think the swing states, that is, the republicans really have the best chance, where republicans should be focusing the efforts? >> first and foremost is my home state, brad's home state of north carolina. look at what we saw in the republican elections and also the state house -- state senate elections. we not only won an important house seat but took over the state house, took over the state senate. independent voters are hemorrhaging away from barack obama in north carolina and the only real messaging we're seeing with the democrats with the convention in charlotte is how they're trying to coerce companies from hiring union employees. it's something the north carolina republican party down in raleigh is taking advantage of. >> brad, when we talk about the unemployment rate among teensnd

adults under the age of 24, it's 16.7 %. it's been over 16% now for 32 months. young voters were a big part of the president's campaign in '08 and sweeping him into office. is president obama going to have trouble galvanizing support among youth voters now, especially if that number remains where it is? >> look, first of all, thomas, we're working hard to get the unemployment rate down among all sectorses and among all demographics in the economy. but if you look at what this president has done, what he's done on student loans, the executive action that he took on student loans recently, if you look at what he did with health care allowing children up to 26 to stay on their parent's policies, there's a tremendous amount for young people to get excited about in terms of this president and his leadership. >> but that's not going to get them jobs though. that's just deferring their loans and allowing them to sit with their parents for insurance a little bit longer because there's no work to be had. >> we're doing everything we can. look, thomas, this economy was beginning to turn the corner

until the republicans took over the house. they have clamped down on any measure that would help create jobs. they've either obstructed in the senate, refused to bring it to the floor in the house, and that's why this election is going to be a choice. it's going to be a choice about republicans that don't really seem interested in creating jobs, that want to go back to the same policies that failed us in 2008 during the bush years or whether or not they want to follow president obama's vision for job creation and winning the future and investing in new technologies and inveszing in research and development, education. >> doug, brad makes that great point that the fact that the congress has been obstructionists but they stand in front of him at every turn. >> eric cantor and john boehner have been so clear and consistent on their messaging that there are parts of the jobs bill they want to pass but it's not eric cantor's responsibility or john boehner's responsibility for harry reid to pass a budget. 900 days have passed by and harry reid, despite having one party control for quite a while,

wasn't able to pass a budget. you talked about young voters. let's look at north carolina. colleges and universities throughout the stay state like my alma mater of chapel hill, i'll even say duke though, i don't like their basketball program, and even the hbcus, historically black colleges and universities were turnout machines for the obama campaign. these voters now are depressed, they don't like -- you may say they're bitter if you're barack obama, and they don't have the enthu enthusiasm to knock on the doors and call. >> there's nothing in our campaign and the outreach that we've done and the number of volunteers we have created and nothing in the polls to suggest that anything that doug is saying is true. young people will be with the president again. they will volunteer first campaign if they will help turnout the vote. when they see what the republicans are offering. you know, we haven't even had a chance to have our say yet. the entire campaign of ours have been fought out on the republican side, anti-obama. wait until we get a chance to see some messages on air.

we're waiting a news conference later today on the bombshell allegations of child sex abuse rocking penn state university. two top university officials have resigned and face charges that they lied to a grand jury and tried to kor up the accusations. the scandal centers around former coach jerry sandusky. nbc's kristen dahlgren has the details. >> reporter: penn state and college football's winningest coach joe paterno are facing serious questions. overnight word came the school's athletic director and vice president are stepping down after being indicted this weekend in an alleged cover-up involving former defensive coordinator jerry sandusky charged with child sex abuse. sandusky was an assistant coach under paterno for decades.

paterno is troubled that someone he thought he knew may have harmed young people. sandusky was well-known for his work with at-risk youth. nbc profiled his charity the second mile in 1987. but now sandusky is charged with sexually abusing eight boys. one of the alleged encountered happened in 2002 on the penn state campus and witnessed by a graduate assist about who went to paterno within days. paterno in turn reported it to the athletic direct whole prosecutors say failed to alert authorities. attorneys for sandusky and the school officials vow to fight the charges. prosecutors do not accuse paterno of wrong doing. in a statement, paterno said, i understand that people are upset and angry, but let's be fair and let the legal process unfold. kristen dahlgren, nbc news, los angeles. >> a new survey says sexual harassment among students in middle and high schools has become an epidemic in this country. dpurg last year's school year,

firms raked in more cash during the first 12 1/2 years of his presidency than all eight years of the bush presidency. over $85 billion in profits compared to that of $77 billion. the numbers come days after hundreds of americans go to the banks in response to jacked up debit card and checking fees. jeff is here to talk more about that. josh, when you look at this data and how the country's largest banks have increased the assets since '09 it makes you wonder if the banks are getting richer under president obama. how can it be out there effectively, genuinely harnessing the frustration that we're seeing on the streets? >> yeah, you know, i know, the banks are kind of in a tough spot because they have all the new fees they're having to pay because, i mean, they're trying to find fees, ways to charge fees to people because they can, because of the dodd frank act and restrictions on the debit card fees they used to impose. on the one hand they're looking for money, on the other hand you

have this really frustrated public that is just fed up with the fact that they're getting charge an arm and a leg at every turn and angry at the bigs for other things, too, like not injecting money back in the economy. >> josh, the occupy wall street movement being credited with the transfer day rebellion. you mentioned it in your article and you mentioned you tried to rew. draw your money from wells fargo. how successful was what you did as well as the campaign over snaul. >> it's hard to close your bank account. there are a lot of ways that the banks keep you captive. you have to transfer overall your bills, if you have automatic bill pay set-up, that's a pain to switch over. but it just kind of for me came to the point where, you know, i was a wells fargo customer for ten years and i was getting charged ridiculous fees. i was in new york and i had to pay $5 debit card fee to wells fargo in addition to what i got charged by the machine. i go to a credit union in san francisco, like, we refund you all debit card fees for any atm

in the world. and it just seems so attractive. i signed up for a new account. i haven't switched over fully yet because it's a process and you have to gradually switch things over because you don't want to get in trouble by all these bills not getting paid. >> when we talk about how the occupy wall street movement is going, do you think it's getting more organized, getting more on point with message? >> you know, i don't know. i mean, it's really -- it's like i heard it described as a monday know protest, the closer you get to it the harder it is to understand. i think it's really something that is going to take time. people are still trying to figure out how to occupy these spaces, how to deal with the problems that have popped up like homelessness and crime. i think once they get that in order, they're going to start having these more in-depth conversations. these conversations are happening but it's just a matter of so many desperate interests and how do you focus all those into something that sounds cohesive to people on the outside. >> monet, i like that, looks

primary battle in 1996, then state senator obama, you say, called clinton's campaign disturbing. explain what happened there. >> well, the differences between these two presidents are so f d fundament fundamental. and the things that bill clinton is amazing at barack obama is terrible at. and things that barack obama is really strong at are things that bill clinton is terrible at. and so it's sort of like these two men are having this long running argument that goes across the years and the latest machine fe manifestation is this book. >> jodi, there's certainly criticism of president obama in this book. bill clinton does support the jobs plan. where does their relationship stand modern day, today? >> that is what is so interesting about this book, because if you read the book it has this quality of president clinton saying, i really want to help you, i really want to help you. i don't think you're doing a good enough job, so i'm going to come in and sort of say all the things that you're not saying. and by the way, in the course of

helping you, i'm also doing to say everything you did wrong. >> and as we have been noting all morning, year out now and bill clinton campaigned for democrats at 130 events in midterm elections. what kind of role do you think he's going to play in the president's rebekz campaign? >> this is why i think president obama and aides have to put up with bill clinton's critique. it is extremely annoying to them and they can't do anything about it because they really need bill clinton's help. bill clinton is still very popular. he's still one of the greatest campaigners this country has ever seen. and he's very popular in the places that the president is not. >> when we talk about what bill clinton did for jobs though because he writes about his own term in the white house, how his policies led to some 22 million j jobs. what specific advice does he have for job creation now? it's completely different than it was when he was in office, a completely different world, basically. >> completely different world, and that is i think part of what bothers the obama people is they

have been handed this terrible kind of long, lasting economic slump that is the worst since the great depression. and there's no doubt that there was an element of luck to clinton's economic success. he had some smart policies but he also came into office at the right time. so president clinton, you know, the book is such a classic kind of clinton conversation because he's got like 40 different ideas and some of them are really big and some of them are really small and some of them are about investment and some of them are about energy. you just get this impression of this guy whose head is exploding with ideas and sort of wants to -- wants to insert himself into the conversation so much that he's kind of coming out of retirement to say all of these things. >> jodi cantor from the "new york times." nice to see you. pass along a programming note for everybody, you can catch former president bill clon clinton tomorrow morning with "morning joe." here's some other stories

learning new details about the jury. it's made up of seven men and five women. one is african-american, four are white, seven are hispanic. they come from all different walks of life. there's a postal worker, parallel, school bus driver, tv technical director and film animator who actually almost was dismissed because he had met jackson on a disney lot at one point. joining me now is legal analyst and criminal defense attorney ricky clto talk more about this. day two of jury watch. nine of them as we talk about on the jury here have had previous experience serving one woman, has served five different times. so what are your thoughts, the makeup of this jury and also what does it say to you that we're on day two of deliberations? >> let me start with your last comment. day two of deliberations, i was in l.a., as you know, at the courthouse on friday. and i have to say it's a moral victory for conrad murray and his defense team to have even gotten to day two because so many people predicted a quick

verdict. we have to remember o.j. simpson's verdict was a mere four hours. if we look at the complexion of the jury, the composition of the jury, i would say that there are a couple of things. you mentioned prior jury service. that's significant to me. the more times someone has served on a jury the more expertise they may think they have. and people may turn to that person to look at, even if that person is not the foreperson or the forewoman of the jury, to look at them, to guide them in deliberations. very important to me on this jury, there is a woman who has a degree in biochemistry. this evidence, as you and i have talked about over the weeks of this trial, this is thick medical evidence. so people may turn to her and ask to see if she has a guiding way in terms of getting through the medicine. >> when we talk about some of the other jurors we've got a former pathologist, a paralegal, served on five juries, served as a foreperson that says to me as i'm looking at this that there

are some pretty intelligent individuals on the jury that are going to bring their different theorys from their walks of life into that conversation as they deliberate. i know they didn't ask for any readback. >> asked for highlighters. let me tell you, if i'm still here with you tomorrow, that is if there is no verdict, i'm going to bring out the jury instructions which have all my highlighter marks on them because they are really dense. and when you look at the two theories of manslaughter in those jury instructions this is not a simple case, thomas. >> as you talk about a moral victory for conrad murray, do you think not only are they in that room judging conrad murray, also judging michael jackson. >> of course. the defense theory in this case is that it wasn't conrad murray who did the final deed. it was michael jackson himself. the defense theory is he was an addict who would have done anything and found anyone to give him propofol. you have two different looks at two different persona. >> supposed to give us a two-hour heads up, correct? >> yes, indeed.

halloween weekend. he says they did it because he's gay. but despite the attack he is now speaking out about it. burke burnett joins me now to talk about this. appreciate you talking time to join us today. i want to start off though with -- you were at this halloween party. it's in reno, texas. you're there with friends. three men at this party find out that you're gay. explain how they found out and what hey did with that information. >> well, i'm openly gay. so i'm assuming -- i'm assume that they just knew i was gay from having lived in that small town themselves. their reaction to that was that that you just described. violent and hateful and horrible. >> what happened when this attack began? what happened with the other people at the party? how were you saved, as we say you were stabbed, as i understand it, with a broken beer bottle. obviously the men were beating and kicking you. they then threw you into a fire.

but on both my arms. on my rib cage right here, and then a few on my head, on my forehead. >> burke, beyond the fact that the three men are now charge with aggravated assault, arrested in this case. the police, the da haven't said too much about this. they're saying that it's going to be up to a grand jury to decide whether they prosecute this as hate crime. as i understand it, under texas law, hate crime enhancement could result in the charges being bumped up from the second degree felonies to first degree felonies, punishable by 5 to 99 years in prison. do you personally want to see them push for this to be considered a hate crime? >> it's -- it's not my job to decide whether or not what justice is exactly for these guys. i want to see justice served. i have every faith in the county district attorney's office that they will handle it properly. >> burke, how has suffering this attack, what you've gone through and the recovery, how do you
