2:00 pm
send him home. we heard today from one alleged victim's mother who said her son lived in fear of sandusky. all of this comes with the candlelight vigil for the plan at penn state tonight and as the school gears up for the final home game tomorrow. it is the first game without joe paterno. jay gray joins us and it's tamron here. let me ask you here about the climate. tomorrow when or if we see penn straight score a touch down, it will be eerie to see the group of people cheering knowing there families producing more allegations at this point. >> yeah, tamron, i think you are absolutely right. the game here tomorrow and i don't think this is overstating it will be something like never before. it's a different atmosphere, especially in an arena like this one. penn state and the people of central pennsylvania live for
2:01 pm
and love football. this is the way they spend their weeks and weekends and gagger with allegations in place. it will be difficult for many of them to cheer for the team. they feel like they need to be here to support for the university. it will be a very interesting and very different type of reaction tomorrow. i know that a lot of former players plan to be here to show their support for joe paterno and not the idea that maybe he didn't relate everything he should have to the right people, but for what he has done over six decades. i know a lot of students say it's important that they be a part of what happens here tomorrow as well. they feel like that's the only way they can move forward. as we have talked about, they canceled the pep rally that they hold every friday evening. that replaced tonight with a candlelight vigil for the victims. they are starting to make a transition here, but after what
2:02 pm
we saw was a week of anger with students poring into the streets and at times rioting, it seems to be they are moving to a stance of let's remember what this is all about and think about the victims here. let's think about what the school as gone through and preparing to go through and try to move forward. >> we also heard from the new president of the university. let's play what he said earlier today. >> my heartaches for the vehicles and their families and mind searches for answers like millions of others across the nation. this is a tragedy for many lives. it will take all of us sometime to come to grips with the full magnitude of the damage done. >> and i think one of the things that everybody here at penn state is talking about is it's going to take time. we sl seen them get rid of the school president and the legendary coach, joe paterno and long time observers say that's
2:03 pm
only the beginning. this entire coaching staff at some point is going to have to be swept out. most of them had been around for 20 or 30 years. they have been a part of this paterno administration and there aren't many people who believe if he knew what was going on, they didn't as well. they are going to try to work through the game. they have two more and probably a bowl game they will have to get through. this is just a process that is going to continue. tomorrow is the next big measure. >> jay gray live for us in front of state. thank you very much. let's bring in michael smerconish who is an attorney and msnbc contributor. we have criminal defense attorney joey jackson. i will start off with you. one sponsor pulling out of the game tomorrow. cars.com said it only wants to feature reputable universities and at this point they do not obviously see penn state as reputable. they will sponsor a game, but
2:04 pm
not penn state. what do you make of that move and others could follow. >> all afternoon i have been having a robust afternoon and canceled and toured nebraska and said we understand what's going on. this is what we are prepared to do. i don't think that's the right move. you have 85 young men on the squad who were not wrong doers and it would be in error if they were to say the season comes to a halt right now. >> you are right to make that point. some were students or athletes there who have done nothing wrong, but they are associated with the university. let me bring in joey. we have the mother of one of the allege victims now speaking out. she said her son felt he did not have any power to say no to the former state coach. she told abc news he didn't know what to do. you just can't tell jerry no. that is what the mother is
2:05 pm
saying. you have people wondering about the statute of limitations and civil lawsuits. what do you believe would be the next logical move for the families as they seek justice if the allegations are true. >> it's horrific. you have a situation where people are abused to the highest degree. who could expect and imagine where you have a vulnerable child. adults couldn't sayy in to these people and now you can imagine a child not having a clue what to do. what happens next? what has to happen is full cooperation with the authorities as it relates to the criminal aspects of the case. they will investigate this from beginning to end. >> which are they are doing now. >> the board of trustees even a pointed a committee to look into it themselves. there is an internal and external investigation. i can assure you this. after the criminal proceeding, there will be civil litigation because the families deserve redress. they deserve to have this matter resolved in a criminal aspect
2:06 pm
and those involved should be accountable. not only sandusky who was the abuser, but those who failed to report. the civil liability relates to money. if there is money for the families, they should be entitled to it and get it. >> i talked to the victim of abuse by a priest as a child and he said if they behaved like an organized unit, throw that in the situation if these allegations are true. >> it's a stretch. what happens is from a federal standpoint, we have racketeering act and states who followed suit and state statutes that are similar. to establish that you have to prove a experience not only that there was a main participant, but providing the children to him and know being it and exploiting the children and getting more children to come forward and maybe it amounts to that at a future point, but all we know is mr. sandusky is the
2:07 pm
main offender. >> politico has the article and they consume pa politics and talks about rick santorum who may feel the fallout. he sponsored jerry sandusky to get a congressional angels and adoption award. governor tom corbett came out who was the da at the time this investigation started, he is on the board of trustees and the governor. he spoke out yesterday. we know that the senators from that state also withdrew the nomination for paterno to get the presidential medal of freedom. the biggest names in politics and nationally have some connection to penn state. >> you would be hard pressed to find an elected official in the common wealth of pennsylvania that doesn't have a connection whether they attended or have a son or daughter or parent who attended as well. one other footnote and something
2:08 pm
else that needs to be looked at in this conversation is the reporting requirement in pennsylvania. i maintain it's got to be strengthened and if you are a witness to a form of child abuse that went on in this case, you ought to have a statutory obligation to pick up the phone and call law enforcement, not just your supervisor in the workplace. >> amazing that that's not the law already. stunning in itself. you will stick around and be a part of the panel. we will talk about a penn state alum who is joining to raise moan for the victims of sexual abuse. now to the race for 2012, analysts have been predicting an opening for newt gingrich and it appears for now they are right. several candidates are in south carolina getting ready for the second debate this week and going into it as two new polls show gingrich pibing up support in light of herman and rick perry dealing with different issues, but issues that are affecting their numbers.
2:09 pm
according to a new york poll, herman cane is in the lead with 18% and in october that number was at 25%. the number two spot is tied with mitt romney at 15% down from 21%. newt gingrich is also at 15%, up from october by 5 points. a new poll puts romney at 23% and gingrich at 19% and herman cain at 17%. they call it newt-mentum. he commented on the number this is morning at a breakfast in new hampshire. >> when the front-runners at 18 and the next two are tied at 15 it is a wide open race. >> it is a wide open race and let's bring in our panel. back with us after seconds away, michael smerconish, an msnbc contributor. let me bring you in and take a
2:10 pm
look at the numbers. is it new ment um and the natural course here? >> i think it's a little of both. when you look at the polls, one of the things is 17% of the people who were poled and primary voters are undecided. i think certainly gingrich has a window to make a play for the folks. i talked with his people in new hampshire and they are excited there. he has been able to get a lot of tea party support and the top guys are tea party organizers. he has been able to really coalesce and have a tea party movement around him. one of the problems is he can be a very undisciplined campaigner. let's face it. the tea party likes anti-establishment folks and gingrich is a very establishment guy. >> let me ask you how we get to the point. you know as i do, it was weeks or months ago, people had britney him off. he was the butt of the jokes.
2:11 pm
he was glitter bombed, we had a book signing where a guy walks up and throws glitter in his face. in iowa he was yelled at verbally and attacked by a voter who said he was a disgrace at the time. how did we get back to this point? it's not as if he is a new face to the audience like rick perry or herman cain. they know the good and the bad that comes with him. >> i think it's two things. number one, i think the conservatives in the republican primary process are looking for a candidate. they moved around from michele bachmann to herman cain to rick perry and circled back to newt gingrich. they still don't feel that mitt romney, the raging moderate is the candidate they want to have represent them in november. they are looking for a new conservative voice. number two, romney has not put the guys away.
2:12 pm
he is not somebody that inspires a lot of passionate following and the establishment choice for the nomination and a lot of republicans don't want a repeat of 2008 with john mccain who was the inside air apparent and got the nomination. they top the get their energy and the grass roots support behind the candidate that they think can bridge the enthusiasm gap with president obama. >> our team and the political team wrote this. mitt romney's path to the presidential nomination is wide open. not since bob dole in 96 has a candidate been such a clear front-runner right before the primaries and caucuses began. is it so clear when you have newt-mentum on our trail? >> it is and it isn't. i think he performed well in every of the debates thus far. yet he hasn't popped. he is always in the high teens or low to mid 20s and as other
2:13 pm
candidates had imploded, the support does seem to migrate, but never towards mitt. i said to you all along he needs to survive this primary season. not necessarily to win it and survive he is. it's like the tortoise and the hare. in the end, he will be the tortious crossing the finish line. >> how will he survive? we know rick perry has a sizable amount of cash and if he throws it into ads presenting mitt romney as a flip flopper, he may survive, but it's like a bird with one feather. you can't fly with that. that's a texas thing. speaking of rick perry, i want to play it last night on david letterman whose ten excuses for the unforgettable moment. >> number six. >> listen, you try concentrating with mitt romney smiling at you. that is one handsome dude. >> number two. >> yeah. i wanted to help take the heat
2:14 pm
off my buddy herman cain. >> and the number one rick perry excuse. >> i just learned justin bieber is my father. >> it's yuck, yuck time there, but they have the debate. it's the last that perry agreed to attend. he cannot have another failure especially when we are talking about iran, israel, troops leaving iraq and this is a big moment for him. do-or-die and this is really it. >> every debate almost for rick perry is do-or-die at this moment. he had a yuck, yuck moment on letterman which was at the debate as well and he can't have another one. the strategists i talked to said he has to knock it out of the park on saturday. i think the problem is he is not that strong of a debater as he is made fun of. there is no sense so far that he knows foreign policy that well.
2:15 pm
his strong suit has been the economy and as we have seen, even in the debates he struggled mightily. >> peter, what are you looking for? serious marries ahead pertaining to iran and the report that the obama administration may sell the bunker buster bombs to the united emirates trying to shore up the safety in the region and none the less, this is serious business here. we can't just hear the candidates blame president obama. we need to hear what their solutions will be and it can't be we are a supporter of israel. >> unfortunately that's what you are going to hear. i think that the foreign policy answers and prescriptions by the candidates across the board have been a mile wide mainly because the obama policies have been very successful in libya and capturing bin laden. >> extraordinarily successful and no one is focused on that in this campaign and the focus obviously is on the economy and
2:16 pm
unemployment rate and getting people back to work and that kind of thing. i don't envision anything coming from this that will be a game changer. if mitt romney shows he has more knowledge than the rest, it will help, but earlier i said i think what you are find suggest there is a need within this process of finding a conservative that these tea party folks can get behind. romney is not the guy. he may survive it and probably will be the nominee, but i don't know where the enthusiasm comes from. >> me either. you have a great weekend and see you on monday. thank you. coming up -- >> we want to make it clear that this is not us. this is an outside force that came here with a bunch of people and did this. let's make that clear. this is not what we are standing up for. >> new details on a shooting outside of the occupy oakland site.
