good morning. i'm richard lui in today for chris jansing. good day to you. president obama is where we start. he is engaging his 2012 rivals me says herman cain and michele bachmann are just plain wrong for saying they would be willing to use the controversial interrogation technique used as waterboarding. joining us live from honolulu, hawaii, where the president spent the weekend. first off, aloha to you. now, the president has said in the past -- >> aloha. >> aloha. -- said in the past that he wasn't going to make a comment on the gop field until everyone is voted off the island. seems as though he is engaging. why not? >> reporter: rich chart, it's impossible to know exactly what the president was think when he decided to engage his republican rivals last night. remember, this is a policy that

he banned in 2009. it's possible that for the president, this issue is a case closed and he wanted to put the fine point on it. it certainly remains a political lightning rod though. that's for sure. let's just listen to what the president had to say. >> waterboarding is torture. it's contrary to america's traditions. it's contrary to our ideals. that's not who we are. that's not how we operate. we don't need it in order to prosecute the war on terrorism. we did the right thing by ending that practice. >> reporter: it's also interesting, richard, just a few minutes laters he was asked about republicans hammering him on his iran policies. mitt romney has accused him of not being tough enough on iran. in that instance we saw the president say, i'm not going to engage, which is, as you pointed out, something we've been hearing a lot lately. so it's possible that because

iran is something that is still being negotiated, that he didn't want to jump into the fray in that instance. in fact, there was some news on that front this weekend. president obama meeting with the presidents of russia and china. both of them affirming their commitment to working with the u.s. to prevent iran from getting a nuclear weapon. it's also worth noting, richard, that the election arm of president obama's re-election team has been engaging the republican candidates, specifically mitt romney. so they are really in full campaign mode. it seems like they are think that mitt romney is going to be the likely nominee. richard? >> kristen welker live there in honolulu, what wh honolulu, hawaii, with the president. we're just getting this in. just learned the supreme court will be taking up the issue of the health care reform wall from the obama administration, discussing whether or not it is constitutional or not. we'll have more on this very topic. again, the supreme court deciding to take and hear this case. we'll have that in about 30 minutes for you.

also want to bring in our special guest on the topic that kristen welker was talking about, waterboarding and the debate over the weekend. bring in "new york times" columnist nick chrisoff and ezra klein. good morning to you both. nick, i heard the president in his comments about water boarding being torture. let's listen to how they belt with that first. >> i would return to that policy. i don't see it as torture. i see it as an enhanced interrogation technique. >> if i were president i would be willing to use waterboarding. i think it was very effective. it gained information for our country. >> all right. and then after that, nick, on "meet the press" david gregory said to michele bachmann, you understand that many of the generals are say nothing to this as well as mccain is against this as well. how do you think this is going to play out? >> i'm not sure. there's no question but that it's torture and tokyo war

crimes tribunal we prosecuted japanese officers for waterboarding americans, manifestly clear it was torture then. i just came back from cambodia and in the genocide museum, you have images of the waterboarding people. if it's clear that -- >> pictures. >> pictures. well, they're paintings. after the fact by people who underwent it. if it's clear when they do it, it's torture, japanese officers do it, it's torture. it's torture when we do it. >> ezra, you've done a let of writing on this, as well as nick for that matter. this is in regard to the announcement, the supreme court taking up the issue of the obama health care reform law and they will be hearing this. what do you think? >> i think that's to be expected. we've had a number of appeals court cases go through on this. they disagreed. pretty much the supreme court has to jump in. it is important to note that what they are not doing in general is looking at the entire case. what we expect them to do is look at the individual mandate, the provision in the law that says that individuals must purchase health care. and if they decide that the s.

not constitutional, which seems not the impossible two years a, go seems like one now, they could do a couple of things. either overturn the whole law. what they would be more likely to do is call it severable. you can take that provision out and the law is fine. it it would be easy enough to preplace the provision, but they would not want to do that, and it's possible the supreme court could say the whole law is constitutional and the way the mandate has not gone into effect yet, no one is standing for this case and we should come back and ask them in two or three years. >> what do you think, nick, on this issue? guy with ezra. it's unlikely the whole lieu would be overturned. i also think as time goes on and people get more used to the law being in place and the benefits of it it becomes politically more of a problem to simply remove any kind of health care safety net nationally. >> that decision could come out in june 2012, right before the election. so we'll see how that does pan out. of course, we'll have more on that later.

ezra, let's switch now to the issue of the super committee. big debate in washington, d.c. as to whether anything is going to happen on this. when we think about the super committee, president obama taukz about it last night. >> my hope is that over the next several days, the congressional leadership on the super committee go ahead and bite the bullet and do what needs to be done because the math won't change. there's no magic formula, there are no magic beans you can toss in the ground and suddenly a bunch of money grows on trees. >> all right. so, ezra, you've got your ear to the ground. any magic beans you've been listening to at all? >> i support the magic bean plan. >> well -- >> right now, we're about as of tomorrow, one week away from the deadline. they have to come up with a resolution by november 23rd or they have failed. it does not look likely but people tell me to not be so sure. these things can come together

more quickly or terrify for those of us who have to cover it it could stretch on past thanksgiving if they got an extension. but the folks to watch right now are john kerry. he's a democrat most likely to brank ranks. he wants to deal the most. if he and possible a other m thes on the commit tee could go over, you could see a deal. but right now the expectation is if there is a deal, six republicans and either one or four democrats. not six republicans and six democrats. >> nick, one of the magic beans that was talked about in the "new york times" was an escape hatch. basically pushing down some of the details. is that a possibility here? >> i think that it's always incredibly a peaing if you're a politician to deal with things like either cutting entitlements or tax increases than to agree in pins approximately if you have any details people can pen on you. i think that that may indeed be one way at the last min thaut the panel will come together to try to reach some kind of nominal agreement. whether that makes a real difference is, i think, pretty unclear. >> nick, great, as always.

thank you for your time. ezra klein, thank you. >> thank you. herman cain's wife is defending her husband, speaking out publicly about the sexual harassment allegations. gloria cain says the accusations does not match the man she's been married to for 43 years. kelly o'donnell joins us live now. the question might be here, kelly, who is gloria cain? >> well, she has been married to her husband for 43 years. unlike so many other spouses of candidates, we haven't had a chance to get to know her. in the modern political age, usually families campaign together so the country gets to know them. but the candidates made a decision long before the allegations surfaced that they weren't going to do it that way. that from time to time gloria cain and maybe the children, their grown children, would be visible. but after the allegations of sexual harassment became known, cain at first canceled his scheduled interview but now she has spoken to great a on fox news that will air later tonight. we've been able to get an

advanced clip of this interview. and she talks about the allegations of sexual harassment and says, it is not possible that the husband she knows could have done what those women allege. >> to hear such graphic allegations and know that that would have been something that was totally disrespectful of her as a woman, and i know that's not the person he is. he totally respects women. >> and so cain has denied any wrong doing many times through. but now to have his wife stand by his side and be in many ways a character witness for him could be helpful. it also answers the question of who is gloria cain. we had not had a chance to see her. also in the interview she was asked about the possibility of living in the white house. she said she really doesn't let

interviewed ex-coach jerry sandusky back in 1987 to talk about the charity he started for troubled youth. >> how did it all start in basically because i'm a frustrated playground director. i enjoy being around children. i enjoy their enthusiasm. i just have a good time with them. >> nbc news national investigative spoernt michael issakopm is live president as you looked at the tape, what did you find, if anything that might tell us about something about today's situation? >> well, certainly they're remarkable wourds words. it was back in 1987. it was focused on this charity, the second mile that sandusky set up to help troubled kids. it's exactly that charity that has been at the center of this investigation. all of the kids that sandusky is

alleged to have victimized and molested, he met through the second mile, through these charity programs. and here in this 1987 interview, which is all about the great work that the charity is doing, sandusky says, you know, talks about things like how he tries to develop trust with the kids. here's some of what he had to say. >> everybody needs people to care for them. sometimes they don't want it. sometimes they don't understand what you're trying to do, but they want to be disciplined. kids are growing up awfully fast today. >> look, clearly, those words take on a certain -- a very different meaning in the context of the charges this week. and i think you look back on it, people look back on it and, from the perspective of hindsight, they can see perhaps the seeds of what we've -- of what we've

candlelight vigil happening on campus to remember the victims. you tweeted, you said it was the most proud moment of your life. talk about that. >> yeah. i actually had the honor to address the students at the candlelight vigil and talk a little bit more about what has happened over the course of the past week or so. i stood up on old main, directly behind me here, and looked out over the lawn which is spilled anywhere from 20 to 1,000 students holding candles in unity and in support for the victims and their families. it was literally one of the most emotional experiences of my life. we started to sing the alma mater at one point. i'll be honest, i couldn't help but be breaking down. it was really, really a strong sense of community. i think that's what we needed. >> if the pictures that we're seeing here are any indication, certainly must have been quite an evening, quite a vigil. as you've been speaking to students throughout the week that has passed, what have they been telling you in terms of what they think should happen to sandusky, macquery, and paterno?

>> obviously the students are most frustrated and disgusted with sandusky. they're asking why are the media not seeking him out and chasing him around? his allegations and the grand jury report is absolutely disgusting. it churns my stomach when i read it. the students are asking why is there not more at stengs on that. fundamentally the students want justice to be found for victims and families. that's the most important thing to move forward. >> how do you think this will be remembered ten years from now, you as a student and as a student body president? >> that's -- it's a great question. i think obviously i hope that we will remember them for the way we recovered from this situation, the way that we were able to move forward and be stronger than we ever were as a university. obviously this is a critical and crucial point in our history. that being said, there's been 156 years of history before this and i hope there will be 156 years more after this.

two of the most important are energy security and economic growth. north america actually has one of the largest oil reserves in the world. a large part of that is oil sands. this resource has the ability to create hundreds of thousands of jobs. at our kearl project in canada, we'll be able to produce these oil sands with the same emissions as many other oils and that's a huge breakthrough. that's good for our country's energy security and our economy. breaking news now from the supreme court. the high court just announced it will hear a challenge to president obama's signature health care initiative. new york university constitution allow professor joins us right now for more on that. professor, we just heard the news. is that surprising to you at all that they are going to hear the case? >> no, not a surprise at all to people following the supreme court. no question. they were going to take the case. the government asked them to take the case.

the courts were divided on it. not unexpected at all. >> the big issue here, is the government overstepping the constitutional authority by requiring individuals across the country to take on health insurance? you signed a brief with the group of other law po pro fess professors that said it is constitution approximately. why? >> because the government has broad powers. we live in a nationally integrated marketplace. it's a huge part of the federal economy. 16%. and this supreme court for years has upheld various forms of insurance requirements, social security, form of old age insurance, driver's license requires insurance. >> consistent with that. one judge just upheld the law on a state level. quote, it is encroachment on individual liberty, but that it was in line with civil rights laws that require restaurants to serve all customers regardless of race. so if the government can force individuals to buy insurance,

where does it stop, is the question folks are asking. >> that is exactly the big question about this, because even though i believe the law is constitutional, no question it's a novel form of governmental power to encourage people who are not in the marketplace at all to actually buy insurance by penalizing them if they don't. >> where does it stop? >> i think the general view is most of the powers in the national government are not limited by constitution allow. the government has the power to tax. in theory the government could tax 100% of income. the government has the power to spend money. they can choose where to spend that money. basically most powers of the national government are limited by politics. they're not limited by constitution allow. >> by politics. how likely will they rule then -- because this is going to be 5 ya1/2 hours to set aside. >> exceptional for the supreme court to devote this much time to a case. they understand this is a hugely no mem us the case. lots of major issues. they have slotted an exceptional amount of time to address these

you've got your ear to the ground. both sides offering up compromises but we don't have a deal, why? >> it's the issue that has plagued this committee since the beginning and plagued this congress. entitlement and taxes. republicans do not want to see taxes raised at all. democrats do not want to see it intome intoment entitlements cut. we've heard the possibility of an escape hatch mean that this super committee could decide about how much new revenue would be generated from tax reform, meaning say, hey, perhaps it could be something like $500 billion in new revenue, $650 billion in new revenue from a new tax structure. delegate that responsibility to committees here on the capitol hill, house, house and means committee. the senate, the finance committee. number one is if you do that you open up the process of rewriting the tax code to lobbying, the

possibility that it could be filibustered in the senate. remember the reason why the super commuittee is so super because it's on expedited path on the united states senate. what they suggest cannot be filibustered. up or down vote. if 12 people couldn't figure out taxes and entitlements, richard, how do they expect an entire committee and bring in more meshmesh members of congress to figure it out, the gridlock is so bad here, why do you want to put more voices in the pot, if you will. only nine days out. maybe this works, but it's not looking very positive here on the hill. >> sounds simple, doesn't it, luke? thank you for all the details today. luke russert. tomorrow on "jansing and company" i'll be talking with congresswoman eman yeel cleaver about the super committee's upcoming dead line. italy's premier designate monti will put together a new government today to putting together reforms to keep them there.

touchdown football to a dallas cowboys cheerleader? we'll explain when we go down to the wire. that's happening about 20. there you go. banks got the message loud and clear over the plans to charge a monthly debit card fee. that hasn't stopped them for finding other ways to make some money. mandy, banks are quietly introducing fees for other services and they're also raising others. what's the net net, did we lose out? >> yeah, it looks like it. remember a couple weeks ago, richard, i did say they would find other way toss make up for that lost income. you've got, for example, bank of america and other u.s. banks backtracking from collecting that $5 monthly debit card fee because they didn't want backla backlash. but now bank of america is upping the charge for rush delivery of debit card replacements to $20 from $5. you've got u.s. bancorp increases the charge from depositing a check with a cell phone to 50 cents. td bank is going to begin charging by december $15 for

each incoming domestic payment. citi group basic checking account fee from $10 from $8. and chase, standard checking account hiked to $12 a month from no charge previously. so they've all got their ways and means. as i said, they are always going have to find a way to make up for that lost income. >> i'm going to need a macro to figure out what i should do with a bank account nowadays. let's move on to something else. the best credit cards out there. >> absolutely. so you've got, for example, credit.com with its annual ranking of best credit cards. why don't we start first of all with the best low interest credit card. the winner there was simmons first visa platinum. might have never heard of this particular bank. simmons is headquartered in arkansas. you can, how far, apply for it wherever you live. why you won the card, doesn't have awards. that's why the interest rate is so low. excellent benefits such as the $1 million travel insurance coverage and emergency cash and

on how their take is evolving over the weekend. what did they find? >> well, richard, so much has happened over the past week. there was another sexual harassment allegation against herman cain. this one coming publicly. and that very infamous debate flub that rick perry had on wednesday night. so what our pollsters did, they were able to recontact 102 out of the 248 republican primary voters that we polled a week ago. and among those 10 2, it showed that rick perry's support plummeted from 8% to 4%. you ended up having mitt romney and noous newt gingrich increase by 5% points. and herman cain went from 28% to 27%. it shows that there was a bit of a change after all these weeks' events. >> that's the nbc news/"wall street journal" poll. there were a couple earlier ones. did they show results in cain

going down? >> they were, richard. there's a new mcclachy marist poll and showed mitt romney in the national league and herman cain dipping just a little bit. newt gingrich on the rise. politico george washington university also had a poll. overall had cain in the national lead but what was interesting that cain's percentages were going down as the poll was in the field. by that last poll date his numbers had gone down. conversely, mitt romney's numbers have con up by the end of the that poll. the consistent trend lines are that romney, nut gingrich up, herman cain going down a little bit. but, boy, this has been a very volatile field and i think we're going to have a of twists and turns with 50 days before the iowa caucuses. >> what surprised you in the polls? i was watching story lines here. gingrich rise and what he can do with it right now. >> right, there is a big question on what gingrich can do. does he have the infrastructure. does he have the money to

capitalize on getting a second look from voters. richard, what i'm struck by is the collapse that we've seen from rick perry. this is actually going on -- >> single digits, right? >> right. it was going on well before that debate flub on wednesday night. our poll is show that people really just weren't giving him a second look. then we we reintroduced the so 2 republicans, boy, there is not a lot of love for rick perry right now and for him to be able to make a comeback, he certainly has to roll up his sleeves. >> that looks precipitous as we looked at that drop from 8% to 4%. mark murray, as always, thank you. >> thanks. the gods of ancient greece shind at the box office this weekend. 3-d sword and sand action flick took in $32 million. who looked at tinseltown's elite. but now it's championing showbiz related issues rather than just their own personal causes. ted johnson is the editor of "variety magazine." celebrities, they're feeling this pressure i just described to push industry issues, traditionally going for values and causes that they care about, why is this happening right now? >> well, there's a major piece of copyright legislation. it's pretty arcane, technical stuff, that chris dodd, he's the chairman of the show business lobby, the motion picture association, and he really would like these donors, which is a large pool of donors out here, to bring up some of these issues as these politicians come through town. after all, president obama, who had been in hollywood a number of times this year, when he goes to a fund-raiser he doesn't get asked by the likes of tom hanks

or ellen degeneres, you know, about such things of how to remove trade barriers on movies from china. >> why have they stayed away from that traditionally? why have all these stars not focused on issues important to their own industry? >> well, it's almost a source of pride. you do have a lot of good government types within the industry who see it as a little bit unseemly to bring up what they consider lobbyist issues. and, as well, you know, you have to consider the fact that there aren't a huge amount of pressing issues that actually come before congress that they're going to have a big impact on hollywood itself. so they naturally turn to their own causes. it also has to do with the break-up of the industry itself. we're not in the studio system anymore. it's very much a self-centered business where people are -- smaller businesses, contractors. >> corporations themselves. >> right. >> exactly. independent contractors. >> you don't have the big

behemoths that won't something done because it affects their larger business. hollywood has donated $17 million so far to federal candidates and committees, so far this year. how much do politicians rely on hollywood for campaign cash or is it really more than that, just to say i do have tom hanks who has donated to my campaign? >> yeah, it certainly is more than that. i think one thing politicians really do like about raising money out here is there is this concept that perhaps there is no strings attached. you won't have these business favors being asked immediately when they go back to washington. but certainly there is that cachet, the idea that tom hanks is going to be in the press and saying, i support this candidate. you know, elizabeth warren was just out here. she was raising money at the home of norman lear. and, while it may be a little bit controversial for her to go back 20 to massachusetts and say, hey, i -- i'm raising money from all these people out of

state, never the less, it does add to her own celebrity value when you consider all of the performers who are operating backing her and supporting her, by association, exactly. >> how does this breakdown here, ted? you said some 70% goes to m thes democrats but some organizations have given up to 40% to gop candidates or interests. is that surprising? >> yeah. what happens is showbiz lobby and a lot of the studios have their own political action committees. and they tend to equalize a little bit. you may call it hedging their bets. they give to both parties. >> that's not uncommon, right? >> especially this year. >> not too surprising, hedging your bets. how heavy do politicians court celebrities? how do they go about doing this? >> well, there are a few people in town, they would be political advisers to major figures within the entertainment community.
