many places as you go online and you can see it with nbc as well. what are people saying to what we heard now? >> tamron, the people here on penn state campus are saying his comments are like salt to their wounds. they feel that this is extending the pain and shame they feel over the allegations already. in short, they are not buying his explanation buy and large from the people we spoke to here today. they are concerned this is going to go on and on and as you know this is going to continue because there more people coming forward and saying they too were molested by jerry sandusky. we also have heard from an e-mail where everyone has been talking about mike mcquery, the grad assistant who allegedly caught sandusky in the act of molesting the young boy. many people have been questioning why this 6'5" man did nothing and left.

i would never do anything like that. he attempts to mitigate by coming up with reasons like i have touched kids and horsed around with them in the shower, but any of those answers to a trained investigator, you have to say this guy has something to hide. >> let me bring you in on this. bob asked sandusky about the eyewitness in all of this who said he walked into the shower and saw a child being raped. let me play that line of questioning. this all could come dun to a trial where the men who were boys were dragged in and had to tell the story. let's play it. >> i would say that's false. >> what would be his motive to lie? >> you would have to ask him that. >> what did happen in the shower the night that mike query happened upon you and the young boy? >> okay, we were showering and horsing around and he actually

turned all of the showers on and was sliding across the floor and we were as i recall possibly snapping a towel and horse play. >> this could all come down to mcquery's word versus sandusky's. this is so rare and i read so much articles to say there was an eyewitness involved and it was incredibly rare. how could it play out in court? >> it is incredibly rare. it will bolster the credibility of the victim. nine times out of 10, the prosecutor is faced with the testimony of the victim and you have to prove it beyond a reasonable doubt. there is a jury instruction that said the testimony of the victim alone if believed in a sexual assault case is enough to prove guilt beyond a reasonable doubt. it's very rare. >> you have the attorney for san dusky and he is making the

rounds and claims they may have found the boy who was allegedly sexually assaulted in the shower and he said the boy tells a different story and denies this happened. what is also disturbing to a lot of people, sandusky's attorney is saying that people who come out or some of the people who come out in the future accusing this man of assaulting them could be in it for the money. y want to play what he said and get your take on this. >> what's happening now in my opinion is we have a bunch of people who have read the allegations and realized there is a large university involved and there may be a lot of money involved in lawsuits that will certainly come. >> that's a heck of a strategy. that's your take? >> now he is attacking my profession. i have been a civil litigator for more than a decade and there might be the case of somebody looking for a payday, but my response is someone secretaried to that conduct at the hands of sandusky, they are entitled to a

pay out and ought to come out of the woodwork and assert their claim. in response to the attorney, i cannot believe he allowed san dusk to do that interview with bob costas. as i go through and i look at the answers to those questions, there all sorts of incriminating statements that are just shy of an admission. he said yeah, that was me. yes, i was in the shower with a boy and i was naked. we were horsing around, there was touching. i think it's really done damage to him. >> you have sandusky detailing what he said happening with the boy that was misunderstood and the attorney said they think they found the boy. sandusky said the boy turned on the showers and he knows a lot of detail and they are not sure of the boy? i said how many boys did you do this with with the shenanigans happening in there?

>> what he was doing there was a classic defense move. he was mine myselfing the situation and putting himself in the opportunity because he knows that everyone already saw him there. he is admitting to it to make himself look trustworthy and gain the trust of the public, but pulling back just when it gets to the truth. it's classic defense minimizing. that is what i have interviewed hundreds of child molester suspects and that is the number one move that the suspect does. >> quickly i want you to get in here with the profile and the attorney insists she innocent and they have a case to unfold. profile wise, a pedophile most people don't say they did it, but do they try to minimize or justify the interactions? >> they do, but we find predators, child molesters who have done this for not only years, but decades. they have hundreds if not thousands and one individual in

california had 35,000 documented victims that he had. in this particular case, sometimes a person feels so bulletproof and so above the law, they have done it so long, they don't realize how damaging they have been to the victims and make statements like michael was talking about. it puts them right in the middle of this. one last thing, the victims coming forward, that's the way you remove yourself from a victim status is you stand up and you face your person who molested you and say i'm going to stop you right here. that's what anyone who is a victim needs to do in this case and any other case. >> thank you for your time. great conversation there. right now, hundreds of occupy wall street protester are watching in manhattan and holding photocopies of a court order they say gives them the right to be there after they were forced to leave early this morning. metal barricades are block them

from getting inside where police and riot gear are standing lock. you can see in this video there literally throwing protesters out of the park over the barricades. the show of force follows a predawn raid when officers made dozens of arrests when forcing people to evacuate at the park owner's request. they removed sleeping bags and cleaned out for sanitation reasons to clean the area. >> they threw out everything. >> it's a smash and destroy everything. all my possessions i had on me. i had to get up and walk away. >> it's bigger than ever because all the police do is create this and made it bigger. they are foolish. >> a court order said protesters can return to the park. michael blam berg said they have the right to return, but cannot hold up camp there. what's the latest there? >> reporter: you are right.

at this point the legal argument seems to be prevailing to the protester side. we expect the judge to hear an appeal from the city around 3:00 this afternoon. it has been delayed for a couple of hours. the city is insisting letting them back in the park with their catching paraphernalia would be unand unsanitary. there have been complaints about them being here. the city even said they found evidence of stockpiles of weapons here, cardboard tubes with metal objects and hypodermic needles that are a threat to the authorities and the public safety here. at this moment it's a standoff. you can see behind me the situation is sort of calm now. again everyone is waiting for the ruling by this judge in an hour or so to see what will be the outcome. the police are surrounding the protesters and people who were camping out and hanging out and waiting to see what goes on. a lot more tension is these 200 people have been arrested.

welcome back. opponents of wisconsin's governor launched a grass roots effort to force a recall next year. more than 100 are planned across the state as supporters try to collect more than a half million signatures to unseat the republican after pushing a controversial measure to strip them of collective bargaining rights.

corporate cash. his party here has engaged in such dirty tricks, they are doing anything to stop it. >> i can't let you just say that. what do you mean by dirty tricks? >> they are threatening to recall workers and in the spring they ran phony democrats to extend the recall elections. he recalled himself and a supporter of his triggered the recall early to raise unregulated cash to hire felons to collect signatures against democrats in the spring. the government accountability board, the nonpartisan arm found hundreds if not thousands of instances on the republican side. scott walker himself was tape recorded admitting he would use dirty tricks and receive legislators to come and do what he wants. this is a guy who was kicked out of marquette's elections for dirty tricky and it starts at the top. we will force his recall.

all this stuff swirling around in my head. >> they asked about it and i guess he looked at andrew and said 9-9-9 and walked away. it's our gut check whether or not people believe he was sleep-deprive and what evidence is there that he does not have a grasp with foreign policy? >> there is a lot of evidence with that and there was just on policy with the debate held with the republican candidates. cain didn't come off all that well and performed better than that one video had. several times in other debates, he would rely on experts and foreign policy advisers when it comes to foreign policy. this has never been his strong suit. thing that has is a double-edged sword that you don't have the grasp or the material on a complicated issue that someone like a sitting united states senator and even a governor

top and apocalyptic. why shouldn't the military be looked at? >> it should be looked at. there a lot of line items that need to be cut, but if the committee can't reach agreement on what needs to be cut, the across the board cuts will adversely affect the line items that should not be cut as much as others. leon panetta's talk while apocalyptic is right on the money, agencies have been asked what the organizations will look like with across the board cuts. some of them are dangerous. >> the pentagon faces $500 billion in reductions over ten years if the panel does not make the deal here. in this letter he said the automatic cuts would at up to 23% reduction in the first year alone, 2013. that's a part of the terms he said. this is dooms day and the list goes on and on. you have obviously a divide.

republicans not wanting to see any cuts here. the president is saying he would not accept any legislation that tries to undo the automatic cuts. some lawmakers are looking for a way around this and the president is saying no go on this. >> the congress may have its own way. it's important they reach an agreement. it's the easiest thing to cut. personnel size was going to get small in any case. these automatic cuts because you can save money in this year, those are going to be deeper. i don't think that we can operate a country with 310 million people and all of our obligations worldwide with a force that is 1.5 million people. >> here's an easy thing then. we don't need the obligations around the world. >> that's true except for a lot of the obligations detectly affect their own security. it's very easy to get isolationists and to close in on
