can seize it. he could end this race quickly if he wins iowa and new hampshire. >> barney frank saying bye-bye and the president releasing a statement saying this country has never had a congressman like barney frank. the representatives will not be the same without him. house democrat saying america and the principals for which it stands have been well-served by congressman barney frank in his three decades of service. this man knows how to fight hard and loud. not afraid of a tv camera. what kind of void might there be for the progressives and liberals? >> an exceptional intellect and legislator and wit. he showed it in the news conference when he took on newt gingrich. he ought to be in jail because of how he approached the housing issue.

conservatives. some here and the state when he talks legality. people can debate all day long, but what's interesting is it appears to be a dig at mitt romney. they wrote we would rather back someone with whom we disagree than one who told us what he thinks. we want to hear. >> i would say that's a pretty difficult, probably difficult words for the romney campaign to have to swallow. mitt romney spent a lot of time in new hampshire and a lot of money in new hampshire. what this is telling conservatives in particular across the country is that we don't really like anyone, but newt gingrich is more palatable than mitt romney. that's a lot to be said given the fact that an argument could be made that gingrich has flip flopped himself on many issues.

>> the argument could be made and has been made in significant ways that if the word is flip flop, he has changed his stance on a number of issues. absolutely. as he goes further down in the electoral process, he is going to have to answer those questions. more than anything else, this is just a huge problem for mitt romney. the question he has to ask is if he should be the republican nominee, will he win it or is he going to achieve the status through the process of elimination? >> it's interesting that one of the articles said that mitt romney needs a knockout early. when you look at the calendar on january 3rd. south carolina where newt is focused, january 21st and florida. if he does not do something big and early, we could according to at least some see a long primary as we saw with barack obama and hillary clinton. speaking of clinton, i want to

play what the former president had to say and praised the new candidate. >> he tries to think of a conservative version of an idea that will solve a legitimate problem. for example, last night i watched the national security debate last night. newt said two things that would make an independent voter say well, i got to consider that. >> is this a jedi mind trick? what is this from the former president? >> as you know this far many, many times when clinton was in the white house and newt gingrich was speaker of the house and made over the budget and so forth, there was respect that he developed to romney. the bigger question was something he put his finger on. can newt gingrich and polls are showing that mitt romney would do better in the general election than the nomination of his own party. would mitt romney do well in the

general election, ie getting moderate and conservative independents. everyone knows the name of the game comes down to appealing to that segment of the population. ie the independents. at this point in time, the jury is way out. whether gingrich if he did in fact get the gop nomination could appeal despite what clinton said. polls are showing and surveys are showing and general sentiment is showing the same thing across the board. mitt romney is just about the only gop candidate that has a ghost of a chance dealing with and appealing with a broad segment of independents. the others have no chance. including newt gingrich. >> we know the dnc is out with this mitt versus mitt ad hitting him hard on the flip flops. you have bill clinton in the interview saying that newt gingrich is articulate and trying to think of a version that will solve legitimate

problems and saying he could appeal to independent voters and we know it's 100 days and we will be talking about independent voters. >> i give newt gingrich credit for having a practical solution and a practical response in the last debate on the issue of illegal immigration instead of just using the sound bytes and talking in terms of amnesty and so forth. i am very dubious as to whether he can cultivate support from the little. in the end he will be perceived. >> why do you think bill clinton would say this? >> tamron, i don't know. i think that bill clinton is brilliant when it comes to political matters. i disagree with him. i think it romney and still believe it's huntsman who could have appeal to cent rifts. not the rest of them. >> i want this dncad going after mitt romney, earl is saying it and michael smerconish is saying it despite this over newt

current military transitional government led up to today's voting. there only a few reports. they think in parliament, they will take a back seat to the military when it comes to running egypt. todayy vote is the first part of the process that will last into next year. the latest. give us perspective on those who boycott it. >> it started very early in the day. you really get a good cross section of society. this is not a nationwide vote. this is only nine governors. we are able to get a sense of who in the nine governs voted. and those that participated, we heard from a great deal of political viewpoints and strong showing for the muslim brotherhood. we heard from liberals and muslims. the legitimacy of egypt's future

fantastic every time we have something resembling a free election on the arab world to see how many people turn out. we saw it in lebanon and iraq and see it now in egypt and tunisia. i think that really shows how much of a hunger there is for democracy. >> you said what resembles a free election, but many others chose to protest. this could get complicated and we know the process goes until next year. at the core is whether the people can believe and what comes out of these elections here. >> you know it's not just a question of whether the military is the new dictatorship. the military is a respected institution in egypt. the military doesn't want the civilians telling it what to do. they have huge and pretty corrupt financial interests. they don't want to be investigated the way the president has been investigated and the way his cronies have been. they want to maintain the

nation." the attorney's office has taken the lead in the child sex abuse investigation of the former syracuse university assistant basketball coach. fine was fired sunday night after a third man accused him of molestation. the latest come after the release of a recorded phone conversation said to be between one of the alleged vehicles and fine's wife. during the call they discussed the alleged abuse. the man said he experienced as a ball boy. darren rovell has more. they are taking over and looking for any possible victims they can bring charges on fine this time around. i want to play the tape between bobby davis and fine's wife. let's take a listen. >> i don't know everything that went on. i know everything that went on with him. maybe canny are not aware of it, but he had issues.

most important trading partners, we spend a lot of time focussing on how we can continue to grow economies and create good jobs on both sides of the atlantic. a large part of the conversation revolved around the euro zone crisis and they have been actively engaged with the heads of government and heads of state in europe to try to resolve this prisz. i communicated to them that the united states stands ready to do our part to help them resolve this issue. this is of huge importance to our economy. if europe is contracting and having difficulties, it is great to create jobs here at home because we send to europe and it is such an important trading partner for us. we have a stake in their success and we will work to try to

and if they have a sense of a future for themselves where they work hard and use stills and talents to support their families, the likelihood of the successful transition will exist as well. of course these problems don't only exist in the mideast and north africa, we discussed for example the situation in belarus where we stand shoulder and shoulder and see a return to the rule of law. we agree we want ukraine to continue down a reform path and we want to do everything we can to encourage that. so both on security issues as well as on economic issues, we could not have a closer partner than the european union. there many issues that don't get a lot of attention.

pakistan were outraged that 24 soldiers were killed. one response was to close down two border crossings to nato convoys. it's a lifeline for nonlethal supplies that they bring in to land-locked afghanistan. 30% of the supplies come through these convoys, but the convoys are not allowed to come in or out. at the moment they were blocked off and shut down the use of an air ways. it is use to launch drone strikes in the past. pakistan is thinking of other ways to punish the u.s. and nato for doing this to their troops on their ground. on their land in pakistan and possibly withdrawing their offer to negotiate with the taliban and bring the taliban to the table to stop the 10-year war here in afghanistan.

another option is to boycott the bond conference in germany where countries around the world will gatherer to talk about afghanistan's future. pakistan is thinking about not attending that either. all of this being said, we talked about this all time low in the relationship among the u.s., nato, and pakistan. what we don't talk about is the fact that the u.s. and pakistan need each other and there is distrust, it's a necessary evil for all parties involved. many people involved say they will find a way to mend the relationship. right now the pakistanis obviously very angry at the fact that they lost 24 soldiers on saturday. >> live for us in pakistan. developing news out of los angeles. representatives from the occupy los angeles camp just held a news conference to announce legal action for clearing out protesters this morning. police told the occupiers to leave by midnight.

basketball may be back in time for the holidays. a tentative labor deal is reached between the nba and the players. if both say okay, they will open with three games on christmas day. >> on to another topic. an ohio mom is fighting to get her 8-year-old son back after officials took him into foster care last month because the child is overweight. the third grader weighs 200 pounds. if you were wondering, the weight for an average 8-year-old boy is around 50 pounds. this case was so extreme, they had to intervene. on the child's ninth birthday. they will decide if he will return to his mom. the professor of bioethics. thank you very much for joining us. at least eight other states have looked at cases or looked at cases similar where a parent is being accused of child abuse because the child is overweight.

>> 200 pounds in the third grade is a ticking time bomb. it's risk. it's not imminent harm. that's the usual standard you look for in removing the child. not of something down the road, but is something going happen immediately. that is not true in this case. the problem with an overweight child doesn't end with the child moving out of the house because he will come back. you will have to figure out ways to change bad habits with the family. i'm not sure moving him into foster care will fix the problem at home. >> the boy's mom said listen, he's on the honor roll and a great kid and you are taking my child from me. why not intervene in a way where you educate the parent or help them? what does this do to a family where you rip this child from his home, from his mom, the parent he knows. >> rip the child into a lousy foster care system. it's already overwhelmed.

they can't deal with kids getting beaten up and sexually assaulted already. >> this foster care race is say healthy environment, it's still not your home. is the government or county going too far when they say you can remove a child based on weight. we know what obese is, but what if the child is on the way to obesity? >> it's still a bad policy. moving kids out of the home is going to be emotionally wrenching with him going to live with strangers. you are creating turmoil. it's not good for the kid. this parent for whatever reason unless you monitor the kid 365 days a year every minute, who knows where they are getting their food. they may be getting the effort to have the kid be less obese, but you can't turn to foster care. we have too many overweight kids it would overwhelm the system. >> what i was thinking is you have to wonder about the income

of the family. you have food in poor areas where they don't have grocery stores and the luxury organic grocery store. will you see more minorities and poor people targeted by this as opposed to getting some kind of help? >> does anyone think a 200 pound kid in a rich family household out in the bushes will be put into foster care? i don't. i think you are right. it will fall mainly on the single mom and on the poor who don't have the resources to resist this. inherently unfair. we have no reason to think it's going to work. there is no study that shows taking kids out of the home and putting them somewhere else is going to make them skinny. >> some say they want to take the child out of a dangerous environment. let's assume that they are trying to do what's best for the child. how do we move it past taking the child? >> if we were going to be at our kindest, you are trying to draw attention. you have to fix what's wrong at
