. >> i'm tamron hall and we are following the stark change in tone as both sides say the government shut down can be avoided in a reach reached before tomorrow night's deadline. harry reid and mitch mcconnell held talks to resolve remaining issues overheading off a shut down and extending payroll tax cuts and unemployment benefits. as the president announced new action to help america's health care workers and pressured congress to act quickly on the three major issues that need action. >> there is no reason why we shouldn't be able to extend these items, the payroll tax cut, before the holidays. no reason the government should shut down over this. i expect all of us to do what's necessary in order to do the people's business and make sure it's done before the end of the year. >> nbc's correspondent kelly

o'donnell, catch us up to speed. >> there is a change in tone. they have all gone quiet for a while as the people who were doing the negotiating on how to sort out the remaining issues are hard at work. we are told republicans will get together to talk about ways the next steps will coming to and we are getting a sense from both parties in both chambers that there has been a light at the end of the tunnel. no one wants to take the blame for causing a shut down or denying unemployment benefits. all of the issues are at stake and they reached a point where they made their political points. they called themselves all the names and you get a sense that they are getting the work done. you can really tell not only with reid and mcconnell, but the way speaker boehner handled it when he came before cameras earlier today. >> i think everyone needs to step become and take a deep

breath. there is an easy way to untangle all of this. we need to let the members do their jobs and we need to let the two institutions do their work. >> boehner also said he could make certain that the house would be present within 24 hours, no one going home for the holidays and not coming back. that's the pledge he made today. of course the president said he doesn't want anyone to go on vacation without these things being done. there appears to be progress and we don't know when, but people say they are getting there and it has to do with funding for the government as well as how you pay for using the payroll tax cut, again, into the new year as well as unemployment benefits. there things to work out, but they feel a more cooperative spirit with everyone we are talking to. >> thank you very much. let me bring in senator bob case at pennsylvania who introduced the tax cut act of 2011 to extend after republicans blocked the tax cut last week.

he introduced a compromise. thank you for your time. >> thanks. good to be with you. >>or cooler heads needed to prevail and you got from both sides. mitch mcconnell and harry reid saying that's what's happening. >> that's what i perceive talking to leader this morning and others, we have to come together. we have 160 million american workers that are depending upon us to coming to in a bipartisan way and make a deal and cut the payroll tax at a time when the workers bad low need the kind of help this kind of tax cut can provide. in pennsylvania when we did it last year, over 6.5 million pennsylvanians were benefitted. we need it to kick start the economy. we can get it done, but we have work to do. >> you heard speaker boehner saying there is an easy way to untangle this. if there is an easy way, i will

ask what the voters are asking. why wasn't it untangled. here we are yet again with a christmas crisis and we know at least in one poll congress i believe it was 1% of the people poled think this is a good congress. >> let me try to respond to that. tamron, one thing you mentioned in the opening was the two bills i introduced. the original payroll cut that had a cut for cutting it in half for workers and businesses. republicans didn't want that. they didn't like other features. i came up with a compromise working with our leadership and so far they haven't embraced that either. we have been trying to compromise. what republican senators need to do is consider the impact of not passing a payroll tax cut as we have been advocating for. in pennsylvania no payroll tax cut means in 2012 a job loss of at least 20,000 jobs in a state where we created over 50,000

this year. we want to create more than that next year. this is important to the people and cash in the take home pay and in the pockets of the speaker. we need it. >> what do you think the timeline will be as we wait on the tick tock of the clock? >> it will take a while. we have to do a couple of things. we have to reach an agreement on the payroll tax cut. we can doe that. that is progress made and not enough to reach a deal, but some progress. we need to extend unemployment insurance and a job creator. we know that from the bang for the buck analysis. you spend a buck and you get $1.90 back for the economy. you have to go through a list of tax extenders that have to be worked on as well as the appropriations done. a lot to do, but we have to stay here the rest of this week and next week or the week after and get it done. >> we are close to the end of this year. when you look back at the

congress and really the incredible headlines and the divide for a lack of a better description, how would you define this congress, what we witnessed as voters? >> it's hard to encapsulate, but we made progress on job growth and moving the economy forward. not nearly enough. when you have more than 13 million americans out of work, more than half a million in pennsylvania, obviously we have a lot more work to do and that's why the tax cut is so important. it's one action that the congress can take right now to give people a sense that we will kick start the economy and put dollars in the take home pay and do it before the holidays. >> senator bob casey, thank you very much for joining us and happy holidays to you. >> thanks and same to you. >> nearly nine years aftershock and awe ushered in the start of the iraq war, the conflict has drawn to a quiet close in a

there was a lot of talk about american accomplishments. it was a small ceremony considering it was the closing ceremony for a big war since vietnam. there were only a few hundred soldiers present there. the event lasted less than one hour. now there is one mission left even though the military command here is officially closed. that mission is to withdraw the remaining 4,000 or so troops from the country. most of them have made it to kuwait where they are outprocessed and on the way home to families. >> live for us in baghdad, thank you so much for your excellent reporting. developing now, a federal investigation found toughest sheriff in america committed serious civil rights violations against latinos in arizona. one justice department expert said it's the worst case of racial profiling he has ever seen. for the latest let's go to justice correspondent pete

williams. this is the result of a three-year investigation? >> right. it involves the maricopa county sheriff. the justice said joe arpaio and deputies engaged in racial profiling of latinos. retaliating against people who criticize the sheriff and punishing jail inmate who is can't speak english. latino drivers are at least four times more likely to be pulled over in traffic stops. about 1/5 of all the traffic stops that violated guarantees against unreasonable seizures and most of those involve latinos. you quoted from the expert, he's the who called it the most egregious he had seen or heard or read about. the justice department said the officers are not properly train and the action shows what the government calls a chronic culture ever disregard for basic legal and constitutional

came naturally from mitt romney? >> it was a word used in his question. jeff mentioned zany first. he mentioned other words that governor romney did not repeat. he took it and ran with it and said this is not what we independent a president. >> we had conflicting reports saying his campaign is shaken. when we saw the polls, the nbc news polls with newt gingrich surging at 35 points, more than 40. he's the first candidate to reach 40%. at least in that one poll. did he seem like a man who was shaken by what we were watching right now? >> no, it was interesting. the campaign is not panicked, but they are concerned. when we sat down with governor romney, he had five fund-raisers and money still coming in. we heard from people in the campaign that gingrich has been a way for the romney campaign to raise more money.

some republicans do not relish the prospect of the a gingrich candidacy. disciplined and calm and upbeat and did not seem shaken. >> it's interesting. we know what's happened in a few interviews in the past and what's infamously reported or talked about is the exchange between bret behr and romney. he seemed agitate and off his game of being a calm and cool kind of guy. did you see that from him when bringing up flip flop and his positions that have changed? >> when governor romney is uncomfortable, he does a fake laugh. we heard that a few times. >> when did you hear that mostly? >> you know we heard it one time although it seemed genuine when asking him about the book of mormon. he said he hadn't had time to see it, but he would love to. it's a tony-award winning play. we heard that a few other times,

and that constituency from michele bachmann to herman cain and breastly to rick perry and to newt, they want a street fighter. romney is this guy who computes competence and control. that's not necessarily what primary voters are looking for. the serious point is that zany doesn't help him. what he has to do tonight is it's the last debate for this calendar year. iowa voters are getting ready and he needs to make the pitch that he can win. it's one thing to express your frustration by voting for newt gingrich, but you are throwing that away because look at the data and nbc news two or three days ago. they show this growing discussion about how it's romney who can beat obama and not newt gingrich. >> a lot of people are talking about the gop establishment and

lining forces against newt gingrich. what i find interesting, you said these voters and at least the republican voters want a street fighter, a man who is a famous street fighter. he didn't do well at all when he ran. he defended newt gingrich this morning on "morning joe." let's play rudy giuliani, please. >> who makes the closer connection to the reagan democrats? mitt romney? he has an aura of elitism for better or worse, or newt who comes from them to a large extent. >> basically giuliani said newt is a man of the people. he is the guy here and not mitt romney. in fact during the "morning joe" appearance, he doesn't like mitt romney. >> my disagreement with mayor giuliani is to identify who holds the cards in this election. i don't think it's the reagan democrats, but moderates and independents.

but second there is a lot of activity on the ground. the sunnis are dissatisfied that they don't run the country anymore. the largest voting block in the parliament will have a great deal of influence. he spent the entire war inside iran. >> i wanted to talk about the soldiers and the troops there who are back home. what roles they may play later in politics and as lawmakers. how young these men and women were when they went over there and many of them were in middle school when 9/11 happened. later in life they decided this is what they wanted to do in life. we often hear that decisions like the iraq war were made because we don't have enough people who fought for the country and go on to the senate or house of representatives. what is your take? >> we have far too few veterans. an all volunteer service and as

a result of that, we have far too few veterans in congress. one of the reasons we might be less inclined to use the military is if we have veterans inside the decision making apparatus of the country. when i came back from vietnam, they said no more vietnams. now they say no more iraqs. we have to be clear about what we want to accomplish as youing the military instrument and how we are going to finish the job and we didn't do that in iraq and not doing that in afghanistan. >> you make the point and we have a lot of people tweet us or send e-mails saying this is supposed to be happy. there 15,000 who will still be there. >> the troops are coming home now. when i came home, absolutely elated. i wasn't in good shape, but elated that i was coming home and they are too. a national security standpoint, the adventure in iraq caused two

things to happen. we lost the momentum in afghanistan. seven years later we try to get it back again and we are not. second, the united states lost a great deal of influence in the region. we are not going to get that back either. >> thank you for sharing your thoughts on had to this day. >> we turn to a debate over aviation safety as airlines are starting to allow ipads in the cockpit. the faa approved the use for pilots in all stages of flights. they can use tablets instead of paper versions of flight charts and manuals. passengers say it's a double standard. tom costello joins us from washington, d.c. this is a heck of a debate. the pilots obviously want to become more technologically savvy here, but passengers are saying if they can do it, why can't i?

>> the debate is never as clear as the actual argument and what's going on. american airlines said they are equipping pilots with ipadss a high tech alternative to the brief cases we see them lugging through the airports. american airlines just made headlines for kicking a famous actor off the plane who refused to turn off his iphone. for pilots, the new ipad will replace the 45 pound brief cases stuffed with paper versions of flight manuals and charts and airport lay outs. >> frankfurt airport. >> these ipads and applications have been proven safe for the cockpit, but the faa demands that the wi-fi connection must remain off. >> we have been testing now for six months with literally no issue. >> it was just a week ago that american airlines kicked alec baldwin off for refusing to turn

off his iphone before take off, something he was playing up on "saturday night live." >> don't phones interfere with the plane's system? >> you don't believe that, do you? >> a lot of travelers have doubts. we asked the senior engineer. >> how can an ipad be used on the flight deck, but not in the cabin? >> it's a good question and i can understand why people ask it. the ipad or net book computer is in the control of the airline. they maintain it. they assure if something goes wrong it's fixed. >> the faa prohibits devices below 10,000 feet because those are the most critical moments for an aircraft, take off and landing. when the pilot has little time to react if interference were to disrupt the equipment. while a modern aircraft may tolerate a handful of electronics, what if dozens were left on or hundreds?

document was chartered, sanctioned or chapter-wide. someone else with the fraternity saying i was shock and we will not tolerate this behavior. tell me a bit about this fraterni fraternity. i understand there has been trouble in the past with this frat. >> it's one of the oldest and largest at the university of vermont. they have done a lot of good work through the years, but there also had been a lot of fraternities and incidents that came to the public's attention. probably the biggest one was 18 years ago where similar kinds of things where they asked pledges racist jokes or to make inappropriate comments. the video of that pledge was sent to the free press anonymously. the charter was revoked for four

years by the national office for inappropriate conduct. >> what's been the reaction from the women on campus? >> it goes beyond the campus. i think there is shock and outrage over the university of vermont throughout the community. they just think in today's society that they don't understand how that kind of question could be put on to a survey of potential pledges or potential members at a fraternity. as the statement from the national office says, it does not appear that this was fully sanctioned by the chapter or by the local fraternity or the national office. this was just conceivably maybe one or more students. >> all under investigation right now. thank you very much. we appreciate your time.
