conservative. he's never won any races as a conservative. hoping he can separate himself. i think they say these folks have become their best allies in this. the longer they split, the better off mitt romney is. romney had events hoping to build momentum. his only event of the day before heading to a fundraiser in new york city. they were hoping this would be a big event. they were planning to roll the bus in. for them there was only 100 people. there room was very sparsely filled. they didn't roll the bus in claiming the gas tank was full saying it would billion dangerous situation. it was sort of a buzz kill. >> let's bring in our sh"news nation" panel.

idea that he wants to wait to release the tax documents saying it was his own father who started this tradition in the '60s. is he hiding or is it truly about waiting? >> it's probably just about waiting or could be a bit of hiding. the problem is no matter what, it leaves him into a really uncomfortable conversation about income and equality which will become a huge issue with occupy wall street and with warren buffet with the tax issue. for most people in the tax system, the more you earn, the more in taxes you pay. the capital gains tax, which is 1 15%, which is why romney's rate is so low, that turns it on its head. people that are really wealthy are take advantage of this tax rate. you'll see a lot of -- >> the reality is, and as you pointed out today, mitt romney talked about he's probably in

but new audio has emerged indicating that he fled before all the passengers were off and resisted repeated orders to return. michelle, what else do we know that's been revealed from the audio tapes here? >> reporter: it's been a day full of activity. searchers were able to punch a hole using explosives, but it was no sign of life aboard. what's shocking people that at the same time the search was going on the captain was facing the criminal charges of manslaughter, causing the wreck and abandoning ship. most shocking to people is that audio tape. a recorded phone conversation between the captain and the port authority about three hours after he veered off course and hit the rocks. repeatedly the port authority orders him to get back on the

following some developing news on capitol hill are the house of representatives conv e convened less than half an hour ago after a three week break. the session just lasted minutes. they're back at work only for a few minutes. >> it's one of those things where they will be back later in the day. it's a travel day for the west coast members. they getgoing at 6:00 tonight and will work for a period of time this evening. they are getting going and it has been a holiday break where some were traveling to see other countries that are of important

u.s. interest and there are those that had chance to hear from constiutents. they have been looking at polls. part of what they have to do is get back at work. some of the issues will be contentious. president obama said he will ask congress for the next piece of increasing the death so the u.s. can borrow money and decrease default. many republicans will say it's an example of the president's failed leadership because the country is above $15 trillion. that's one of the big issues. they'll have to deal with the unemployment benefits for long-term out of work people as well as the payroll tax, which is the way we ended 2011.

i can't tell you how many times as of late we have done these students where students have been punished because of what they put on their facebook page. this is a hot one. >> right. in some cases when students attack other students they call it cyber bullying. they also attack teachers and principals and can have consequences for them too. students posted quite vicious, obscene rants about teachers and principals. saying the principal liked to have sex with students and their parents. another case that a teacher was a heavy abuser of drugs. those two from pennsylvania. another case from west virginia in which one student said another had herpes. the school punished the students and the parents sued. some courts have held, yes, the

schools can discipline the students. teachers can reach out. other courts have said you can't touch a student for speech that's entirely outside the school. all these were created at home computers or relatives competers, not on school grounds. thai say therefore the schools can't touch them. all over america school administrators were hoping the supreme court would take this case and give some clarity. there's still some uncertainty about when this happens, what the school can do. can it punish the students or not. >> thank you. i guess it's still left for a dilemma. thank you, pete. supporters of an effort to remove touve top republicans fr office have about 90 minutes to make the recall. scott walker is scheduled to be in new york when tacks of

petitions are unloaded at the state election board in madison, wisconsin. all of this reaction to the law the governor pushed last year that ended nearly all collective bargaining rights for most public workers in that state. organizers say they have more than the required signatures needed force recall. joining me now by phone, wisconsin democratic state senator, lena taylor. thank you for joining us. >> it's such an honor to be with you. >> the petition started in mid-november. more than 700,000 signatures were expected to be part. you have exceeded and may have gone beyond anything you expected here. >> this is true. we have exceeded the number of signatures that were needed. we don't have an exact count to provide you, but we know it weighs a ton, literally one ton. we had to get clearance that the

government accountability board would be able to hold the amount of paper, this weight of all of these signatures. it's truly an exciting moment. it's history for wisconsin. we are able to hold our governor accountable for trying to take our legacy of being progressive and being for the average person and helping our neighbor away. he has truly made the mistake of giving $2.3 billion away in tax cuts to big corporations and hundreds of thousands of wiscons wisconsinites say they don't like it. >> when i spoke to another in your state who was not really hopeful, but not confident you would be able to reach the petition numbers needed or the signatures needed for the petition because it's hard to

gauge people. the passions were very high. people were protesting in the cold and the rain, but there was concern you wouldn't reach it. what do you believe was the driving factor here that people turned it beyond anger at the dinner tape to reaction of signing the petitions? >> i think a few things. they continue to just lie to the people. they continue to say they want to raise taxes and then raise taxes on the poorest individuals in our state, the working poor and senior citizens. they did that as they gave away $2.3 billion in tax cuts to big corporations. it was things like that. individuals getting their paychecks and seeing the legislation and the governor did. the effect it would have on their family and their neighbor. those things, i think, really brought it home to people.

i'll tell you the thing that i think continues to do it is the governor continues to show his disregard for the average person and his complete commitment to big corporations over and over again. people are beginning to really understand that he does not have their best interest in mind. i have to admit, it was a question of whether or not after my colleagues and i left and did a driving filibuster to illinois, whether or not people would be able to continue a year later. i think the continue effort by this governor and the legislature to do more and more things, to show their lack of commitment to the people of wisconsin, the average person of wisconsin is the thing that kept putting fuel to the fire and put us in the place we are today. >> all right. lena taylor, thank you very much. we'll see those numbers for eastern time.
