chris, we all watched the debate last night. the first five minutes, the first question was about the interview with wife number would, marianne gingrich and here is how gingrich turned it to his advantage. >> she said that syou asked her sir to enter into an open marriage. would you like to respond to that? >> no, but i will. i think the vicious nature of the media makes it harder to run for office. the story was false. i'm tired of the elite media protecti protecting barack obama by attacking the republicans. >> what now can mitt romney do to try to slow newt's momentum,

there were other good moments, santorum had a couple of good moments. does santorum and ron paul help romney here if they can pick up some more votes and stop newt gingrich from coalescing the anti-romney vote? >> sure, absolutely. but, i would say the debate was two hours long last night. and that clip you played was all you needed to watch. gingrich was are ready for this. don't think that newt gingrich was mad, he knew this was going to be the first question asked. it was classic newt. if you watched any debate recolle, no but i will. turning the allegations made by his second wife about an open marriage, turning that into somehow the liberal media elite a president obama wanting to hurt the candidates. smart by newt gingrich. if you are a undecided

conservative, if you think you'll not be romney, that performance probably made you with gingrich. >> santorum zeroed in on one of the key issues that troubled a lot of republican party leaders around the country is that newt, you do not know where he is going. do you see him winning and then going to the florida and then having the organizational capacity to go the distance? >> the answer is not yet and newt was asked what one thing would he do differently in his campaign today and he said he would never have run a traditional campaign that let to the first problem when all his staff members left. a lot of people would cheer that, i would say it's a worry, the traditional campaigns tend to work, barack obama ran a traditional campaign and it

worked. newt cannot just go to debates and give speeches. he has to run money and have real debates. he just doesn't have that right now. >> chris, thank you so much for our daily fix, see you later and how can romney go this long in the campaign without figuring out an answer for the tax question, here with me now, romney supporter, former governor ron sununu. have you been a political figure for so long, a lot of people are trying figure out how mitt romney cannot have had a better answer for the tax question. i want to just play you a collection of all the versions as we have progressed over this last month. >> i'll provide all the financial information which is an extraordinary pile of documents that show investments and so forth. i do not intend to release tax

returns. i ran against ted kennedy and he ran for president and he would fwhot not release his tax returns. >> if i become president, then i'll consider it. >> rather than sort of is have multiple releases of tax returns, why, we will wait until that tax returns for the recent year are completed and then release them. i don't know how many years i'll release, i'll take a look at what our documents are. >> that basically gives you sort of the path. he still doesn't seem to have an answer. >> sure he does. he said when i get this year's tax returns done you'll get not only this year but previous years and compare that to the other answers you got last night. ron paul said he will not release his, and santorum said he will not release his until he finishes them and gingrich put on one year, so the guy putting out this year and previous years

is mitt rom. >> you said it in 20 seconds and it a strong answer, why can't mitt romney say, look, ron paul is not putting his out, and san tore um is not -- and santorum is not putting his out, i'll get mine out too. he is projecting something that could be untrue. >> the biggest news will be that he was a successful businessman and you already see that. >> but people like that. he has more money than romney and bloomburg pays the higher rate, he doesn't pay the 15% rate. he pays 31 -- 33. >> that is because he is not coming from investment as

income. he is getting regular income. the country has two kinds of income, if you get this kind of income you pay 31% to 35%. >> the boston globe is suggesting today that there's off shore money invested that could be paying -- >> this issue will be gone. >> but by then he could be gone, what if he does not get the nomination because of this issue? >> he will continue to talk about how he is the best man to replace obama and he will continue to talk about how he is the one to fix the country's problem? >> what the newt wins in south carolina carolina? >> he is prepared to go to florida then to the caucuses in nevada and super tuesday, he is ready for the long journey, i do not think you'll end quickly anywher anywhere. >> do you think it will weaken him, going through this bruising

battle, you are providing -- not you, republicans, they are laying out the road map for the obama campaign. >> the issue that the democrats are happy about are the files from the ethics committee against gingrich. nancy pelosi knows what is in there, if she knows what is in there, barack obama knows. if they know shouldn't the republican voters in the primaries know? >> why wouldn't gingrich be a stronger candidate than romney given his performance last night? >> the people know we are electing a president not a high school debate team member. he has to be respected by the people that he works with -- >> and gingrich doesn't? >> mr. gingrich was thrown out by his own leadership for

inability to stay focused on the agenda. he the not have the temperment or the stability to be president. i'm a believer in the ronald reagan formula, he was a good president because he was a good governor. and i think that mitt romney will be the same. >> john sununu, thank you very much, sir. >> thank you. >> and the republicans are not the only ones out campaigning, president obama released his first campaign, playing defense on the failed solar panel company support. playing defense in your first advertisement shows that the solyndra campaign against the president was beginning to take hold. it was actually hurting the campaign. >> i don't think so at all, i do

not think we were playing defense, anybody that has watched what we have done knows that we are on offense. this gave us an opportunity, the sponsors of this ad are billionaire oil investors and this gave us an opportunity to call them out and show what the president has done to lessen our dependence on foreign oil and so, it was a great opportunity. we are not going to respond to all of the attacks from super pacs but this gave us an opportunity to get out a positive message. >> what about hope and change, that is a far more positive message than trying to explain solyndra and connect to the oil and gas industry? >> if you look at the ad, we briefly mention who was behind the attacks. most of the advertisement is

about lessening our dependence on foreign oil. 28 seconds is about the president's record. i don't call it negative at all. there's a lot of hope that we can lessen our dependence on foreign oil if we poll the path that the president has taken and make the appropriate investments in the renew ables and so forth. >> why do you think that the obama super pac is being out raised by the republican super pacs, even by mitt rom michigans alone? >> you have to ask them, traditionally you see the bigger money to republican side. you look at the type of interests that are against the president and supporting someone like mitt romney who wants to go back for example to the same type of rules that led to the financial collapse, oil industry, insurance company's

last night, rick santorum went in for the kill, channelling the whole republican critics who say that newt gingrich is not reliable enough to be president. >> grandiostiy has never been a problem for newt gingrich, handle it very, very well. and that is one of the issues. newt is a friend and i love him but he goes to that worrying moment that something is going to pop and we cannot afford that in a nominee. >> rick tyler is in charge of newt's super pac and joins me now. first of all, what a night for newt gingrich -- >> it was a great day. >> -- everyone feels he scored by that response to the first question. what about the reactions from others in the republican party that believe, and certainly rick santorum on the stage, that his past shows that he is not steady

enough to be a nominee? >> i would not worry about getting the support of a congress that is polling at 9% approval. when he became speaker a lot of republicans had the idea that we will have earmarks and have all the things that the democrats had done and he did not do that. he bipassed the chairman and that made people angry. and so, yes, newt spent a lot of time saying no and maybe angered a lot of people in congress. >> what hailey barbour said and he is a former head of the governor's association and you served with him. what hailey barbour said is that if gingrich is the nominee at the top of the ticket, it would drag down the ticket and you would not have a republican house. >> really? well hailey barbour was there

when gingrich paid off debt and created 11.1 million jobs. i'll -- >> bill clinton was president as well. >> he signed welfare after twice vetoing it and he came to the conclusion that they can balance the budget. >> and there was not a single republican vote for the economic plan. >> and sununu orchestrated the plan for which his boss lost the job. that was mitt romney's senior adviser. he is in charleston, if you want another 1990 budget deal, then your guy is mitt romney not newt gingrich. >> question about the tax release, newt gingrich has released his tax returns and challenged mitt romney to release his, at the same time,

critics are looking at the tax returns and pointing out that a lot of his other income, book and other income comes from his s-corporation had is not listed therefore his real earnings are actually not disclosed by the income tax returns for 2010 that he released? >> i'm not aware of that, i do know that mitt romney who has been asked over and over again about releasing taxes cannot answer a simple is question in a debate, when he should be ready to answer the questions. why not release the taxes and get beyond it. all of his advisers tell him to release them. he cannot figure out to release the taxes. newt put his 10-40 up on the website. everyone can look at it. >> as the head of the super pac, your response to all of the criticisms of the film, about bain capital and washington post and others, they say there are

errors, we talked before about the fact that you have said, if there are errors, mitt romney should respond. but isn't your responsibility as the head of the super pac to make sure as gingrich said himself that everything in that film should be accurate? >> everything is accurate. and look, it's funny for the media to criticize us for being out of context but what is described in the film is a pattern of behavior by mitt romney and bain capital right here in south carolina, gsi steel, they ran up debt and shorted the pension funds that were the worker's property and the federal government bailed out the pension fund and yet, mitt romney and bain capital made a $17 billion profit, it's legal, but just because you can do it doesn't mean you should do it. and i know in business there's winners and losers but in bain capital, sometimes you win and sometimes you win.

topping the headlines right now on "andrea mitchell reports," in afghanistan, six u.s. marines were killed in a helicopter accident yesterday, it's said that it was not hit by

enemy fire. france is suspending training operations after two of their soldiers were shot and killed. protests are being made to allow anonymous donors to spend unlimited money on political ads. and redistricting maps back to the drawing board, and it could be a big win for texas board -- the district maps needed to be redrawn, one was created by the ledge slay -- legislature, the judges said that they should not have drawn up their own maps. south carolina has had a

long and complex history of racial tensions, of course, and grievances that were an issue this week that many felt had racial over tones, this is your hometown. and you've been covering the race down here. first of all, the debate, earlier this week, not last night's debate. but the debate where juan williams tried to question newt begin rich about some of his comments about letting minority youth get jobs as janitors, what is your takeway from that in talking to people down here, because it's been argued both ways? >> we have spent a lot of time talking to folks about that issue in particular. interesting, when candidates in south carolina use that type of language, use phrases like that, it's red meat to the base. >> it's a dog whistle. >> yes, yes, and when newt gingrich said that, he is from georgia. he is familiar with south

carolina politics. he knows the types of lines and words that get applause and things like that were greeted with applause and that is what it is designed to do. a certain type of voter in south carolina, hears that and it appeals to them on a different level. >> but gingrich is saying that his daughter got a job as a young person in her church. he is trying to compare it to examples that are, no pun intended, have no racial over tones. >> people hear the explanation the sound bite from sunday. if the primary voters are 450,000 turn out will be a record. they expect the race will be close, things like that with a

certain section of voter, it could go a long way. especially in the up state, 40% of the primary voters will come from the upstate, even by south carolina standards those voters are even more conservative than your typical south carolina voter. >> certainly there's a lot of cross currents here but gingrich has momentum and it started with that debate. >> the momentum is undeniable. i talked to former governor, republican governor here in south carolina and he was talking about how surprised that he was that newt gingrich has not bottomed out just yet. just a month ago he was up 20% points more than right now. voters in south carolina are torn from folks that i'm hearing from on the ground, a lot of them have been around the republican party for a long time. on one hand you have a guy on his third wife and third faith and you have another candidate who does not necessarily align himself with a lot of the

political leanings that many south carolina voters have, speaking of mitt romney, of course, for voters in south carolina, it's you know, it's your heart and your head. >> tough call. great to have you on the team. thanks for being here. and the first issue on congress' agenda has hit a obstacle. harry reid is postponing a vote on his internet privacy act until there's wider agreement on a solution. joining me now, former senator chris dodd, 30 year veteran of the senate. i know where you stand on this issue, you were very much on the side of the industry believing that the internet issue has to be addressed. i know you could not lobby because there's a two-year limit. you just left the senate. but where did this whole issue fall apart? why was the, you know, google and facebook and industries such as our own owner, comcast and others, time warner and the

like, why were they able to, rather why were the internet companies able to run circles around the more traditional movie and television companies? >> well, i think a lot of misinformation, andrea, had a lot to do with the decision. i think that harry reid made the right call. it was a bipartisan bill in the house and senate, they made the right call. the question is now, where do we go from here and i think as long as people are thinking about these are very afluent people in the hollywood community that were on one side. it was more complicated than that. even to entertainment side, 98% people that lose their jobs when content is stolen, it's people making $55,000 a year. these are not the ones that walk on the red carpet on oscar

night, they are the ones that are laying the carpet. i do not think that people understood that the products that were counterfeit on websites around the world, if they understood that it would have had a different outcome. obviously this was a loss. no way else to describe it. but the problem doesn't go away. here is the good news, the most severe critics of the bill feel there's a legitimate problem with the theft of american products and jobs. my hope is that community, the technology community, and those whose productsjobs are being jeopardized can come together. i've been advocating that since i took this job, that you cannot have people making choices between content on one hand and technology on the other. they both need each other. content wants technology to make their content available to

people where they want to see it, when they want to see it. so i'm optimistic that we can come up with a better answer to this in the coming weeks and months. most people don't want to see hard working americans to lose their jobs to thieves. we passed a bill to allow us to go after domestic thieves. >> how do you do it, briefly, without leading to censorship of the internet which you have learned is a nonstarter as far as the powerful force and the force for good that the internet has been and the force for productivity and economic growth? freedom of expression and all the other issues? >> and wonderful, and 14 years ago when the so-called domestic millennium copy right act was passed many of the same fears

were raised and that was 14 years alone and last year they shut down sites that were stealing content. illegal conduct is not protected by the first amendment. if you slander someone on the internet, it's against the law. and if you steal product on the internet, that too is against the law. and so the internet is a wonderful engine of opportunity and growth, but we need to respect the jobs and content that people are producing through copyright and it's not just the entertainment community. it's across the spectrum here. there are people producing products like shoes and pocket books, if you will, but defense products, pharmaceutical products, many of those products are being stolen on illegal websites well beyond the shores of the united states. this out not to be a choice of freedom of expression, that is

not the issue. >> it's clearly back to the drawing board. >> we agree. >> thanks for joining us. >> thank you andrea. >> and south carolina will be a turning point for this race, if mitt romney wins it will likely put him back on a fast track and if newt wins it could extend the race for weeks if not months. we have our guests with us. well, where are we the today? that debate was about eugene, as raucus a debate as we have seen from the very first minute. >> i'm still gdigesting yesterday. we had a whole different race yesterday than before we went to bed. >> rick perry is out. >> perry is out and romney is

flubbing the tax thing and gingrich is soaring, he had a smashing first five minutes of the debate and that is all he needed. so, you know, look, gingrich, i think is clearly surging ahead in south carolina, and the only, the only thing i put next to that, the prediction that he will probably win is that now everyone thinks he is going to win and so we all think we know what will happen in this campaign and something else happens. >> you scored an a plus on "morning joe" this morning and you do not grade on a curve, mark, does it matter if newt gingrich wins is there any way, given organization and staying power, to keep mitt romney from getting the nomination? >> it's possible. as the establishment rallied around mitt romney, that helps him in some ways but it allows gingrich to say to the

grassroots don't let senators and governors in congress beat this. i cannot find anyone right now that thinks romney will win it and even romney people -- >> here in south carolina. >> here in south carolina and they are laying the groundwork for that. they are clearly talking as if they are trying set up. remember, mitt romney said for weeks and months to donors when he was explaining his theory of how he would win, i can lose iowa and others and still win. if he wins here tomorrow, maybe even in the short-term, but newt can give him a fight sdwlm >> here is where the weakness is for romney. his selling point is electability. i'm the one that can beat barack obama and the flub after flub on the issue of taxes, the whole sort of ritchie rich imagie tha is being created around him and

his money. the report of the off shore accounts, all this raises questions about his electability and that is the main thing he has. >> but you have republican leaders not just the haley bar bure bar -- hailey barbours but saying that romney is going to stumble. where does that leave them? >> it leaves the establishment to really around mitt romney without question and they will. and if gingrich, just as the bain capital attacks drove some of the members of the establishment toward romney, if it does, there will be panic, they will say it was tough that he lost a couple states but it cannot be gingrich, we must really. but you'll see grass roots and grassroots money go to romney. romney's rivals under estimate

gingrich is really to rise and could win this thing. does that mean that gingrich now is the alternative to mitt romney and makes s it harder ron paul? >> no, gingrich does not have the down field organization or support. we and mitt are the only campaigns are organized do downstre downstream. mitt has hitched his entire wagon to south carolina, i think that he will do well, but he is not on the ballot in virginia, our 12th most popular state. he will not compete with romney or paul. >> why is he not releasing his tax returns? >> he has a detailed personal financial disclosure on file with the clerk of the house of representativ representatives, it's more detailed than a tax return. it can be pulled from the clerk by anybody and you can get a
