he's talking with his entire legal team today. civilian and military and in an interview earlier, attorney john henry brown expects the army will file really bad charges on thursday. staff sergeant bales is being held in iisolation. one military sfert predicts he will be tried in the u.s. afghan officials are demanding he be tried in their country. we know this meeting start add short time ago. what else are we hearing from the civilian attorney representing bales? >> he's been spoke to be associated press during a lunch break. they said they had a good chat

this norng. the day before the shootings, his client had seen a colleague lose a leg. he now says that incident took place two days before the incident and bales did not directly witness the incident but saw the aftermath. this is the first time the legal team is able to sit down with him and hear the full story, talk to him at length. other conversations before this had been quick ones on the phone. it's also a chance for the attorneys to sit down with him eye to eye, face-to-face and get an assessment of this guy. he's awaiting charges that could bring the death penalty. they want to prepare their defense. now, brown has never said, has never denied his client did what he's accused of doing. he has talked about other issues, other mitigating circumstances. he's talked about the fact that

bales was on his fourth tour of duty in the middle east, three tours in iraq, the fourth in afghanistan. he had been injured in iraq twice. once a traumatic head injury, another time lost a part of a foot in two separate incidents. he also stresses that traumatic brain injury and raises the question of whether he has undiagnoseddisorder. it sounds like he's putting the war itself on trial. he said he's not doing that, but the american people have done that. he said they think if the trial will affect the duration of the war and he says i hope so. tamron. >> thank you. the top commander in afghanistan john allen be testify in front

of congress tomorrow on recent events in afghanistan including the charges against sergeant bales and the koran burning. he returned from iraq in december after helping train the iraqi army. let he start off with what she just heard john yang report. people are asking if the case could impact the duration of the war. the white house says it's not moving up the withdrawal of troops from afghanistan. people are linking this one case to that possibility what's your response to that? >> definitely affecting the impact of the war. this in addition to the burning of the korans. this including when u.s. marines were seen urinating on dead taliban. these thing vs had tremendous affect on the ground in

afghanistan. our current strategy is to take u.s. troops, put them out into the village, train up the afghan army and transition the villages over providing the security blanket to give us peace. all of that stuff is over. the taliban won't speak to us and president karzai said no u.s. forces should be out in the village ps p that renders the president's strategy over whether they want to admit it or not. >> you have the captain who served with bales who said what he sid is not systemic. the media is paint thanksgiving as too many deployments. he broke too many orders. drinking and killing women and children. he was passed over for a promotion. like most people, there is the good of your life and what some might feel the hardships or the bad of your life. you have this captain saying it's not about the tours or the

amount of time the men and women are serving in this country. >> look, in regard to sergeant bales, he been in the army for 11 years. he got passed over for sergeant first class. not everybody makes sergeant first class in 11 years. i think he's got an excellent attorney. he understands these issues. it's a lot of smoke. i just came home from iraq for the second tour. the big question is how did you only go one time. this guy went three times. my brother served in iraq twice, afghanistan once. everyone is doing these types of tour tours. the attorney can call about ptsd, the fact remains that the soldier signed off that he had to pass all this predeployment training and he deployed. he isn't on any medication or he wouldn't be able to carry a rifle. we never had an american soldier or marine leave night and murder women and children and come back and turn themselves in.

i don't see them getting around that with a jury of his peers. the jury will have compassion. it doesn't mean that will put him to death. i don't see the jury who have had multiple tours in iraq and having sympathy for the that is correct he's doing something no bun else has done. >> just because it's happening does not mean it's the right environment. fewer than 1% of this country serve in our nation's armed services, but with that said, the situation exists because not enough people are fighting for this country. >> sure. the smallest percentage ever in the history of our country is serve ing in iraq and afghanist. look at the things we talk about in the daily press. it's always hollywood stuff or this and that. no one really pays attention. i went to put a thousands

dollars and said is this still your dress. i said i was in iraq. she said were you there on vacation. the public really isn't engaged. the war is like the weather report. if the public wants to take sympathy on his two or three or four tours, he's not being tried by the public. the military has strict rules about the geneva convention. we do not warm women, children and innocent men. >> john mccain was on "meet the press." he talked about succezkding. >> the relationship is wonderful. when these things happen it just really sets back everything a great deal. we have troop tons ground in afghanistan. we have control of key parts of the country. >> do you agree?

>> sure on some aspects. we have done great work. this isn't about what happens when we're there. it happens when we leave. the time line of 2014, we can't rial achieve sustainable success in the timetable we have been set. not just the president's timetable but five years, ten years, who knows. sure american troops do a great job on the ground but senator john mccain misses the large points. we need to focus on missions our military can be success. it wasn't all these troops that went into pakistan and got bin laden. where we're at right now, i think the question senator john mccain sthould be asking is why should american troops die dying for a foreign democracy if they don't want them in the villages. we stay out of the afghan villages and on the bases and train their army until we complete this withdrawal. what we're seeing on the ground is the afghans upset. they want this u.s. soldier

tried in afghanistan. that's an immunity issue. that's what caused us to leave iraq. we will never allow u.s. forces to be tried under a foreign government. now we risk any mission in afghanistan because a lot have doubled down on a strategy that can't work. >> thank you for your time. now to the outrage that's reaching a boiling point in florida as more people join in protest over the handling of the murder of trayvon martin. >> justice, justice, justice. >> students from several florida universities protested outside of the seminole county courthouse today. a spokesperson told them it will take several weeks to review this case. 17-year-old trayvon martin was unarmed when he was killed last month in sanford by a neighborhood watch captain. he said he shot in self-defense.

his mother said she is certain her son did not provoke the attack. >> i'm pretty sure my son tried to get away. he didn't know who this guy was. he seen him as a stranger. he was trying to just get away from the situation. >> joining me now nbc analyst. just a short time ago at the white house briefing jay carney said the white house is aware of the incident and they understand that local fbi office has been contacted with local authorities monitoring the situation. carney went onto say the thoughts and prayers go out to his family but they're not going to weigh in to a local law enforcement matter. you've got local law enforcement saying they need more time to review. we're almost on a month since he was shot and killed. why would it be taking this long? >> this is case where it shouldn't. the facts seem to be pretty cut and dry. whether there's a stand your ground law or not, the shooter didn't stand his ground. he's carrying a gun.

he has a past history of assault on a police officer. number two, he's described as a self-appointed neighborhood watch person. number three, when he calls in to the police department to report he sees somebody he doesn't recognize in the neighborhood, the police say stay where you're at. stay in your car and don't follow this guy and he defies. he does exactly the opposite of what police do. there's a confrontation that takes place, a fight that take place. we ve a 17-year-old boy carrying candy and a grown man carrying a 9 millimeter pistol. a gun always trumps candy. >> the stand yo your ground law meets force with force if he or she believes it's necessary to do so to prevent death or great bodily harm. let me play the 911 phone that he made to authorities right before the confrontation. >> this guy looks like he's up

to no good or he's on drugs or something. he's got his hand in his waistbands. and he's a black male. >> are you following him? >> yep. >> we don't need you to do that. >> he's yelling help? >> yep. >> gunshots. >> you hear the gunshot there. you have the operator saying don't follow him and he says okay we don't need you to do that. we don't need you to follow this individual. there's so many questions. you're an fbi profiler. when you look at zimmerman's background, he's this neighborhood watch guy. i don't want to paint anyone as a bad person and that's not the issue. this is about justice and what the law says here. what does his profile say especially being a neighborhood captain where neighbors say he was the person that wanted to go out and confront. >> well, unfortunately, there's a lot of want to bes out there.

want to be police officers even though he assaulted a police officer seven years ago. what troubles me is he wasn't tested for drugs and alcohol right at the time of the shooting. this is something you would norally do in any type of situation. his voice on the phone sounds slurred like there's something going on. he may have been intoxicated. there's a lot of issues in this shooters background not with standing confrontational issues that says he shouldn't have been out there. number two, he shouldn't have con fronted this young man in this way. the last thing he should have done was pulled a gun. he should have stayed in his car with the door lock and waiting for the legitimate police to arrive. >> thank you so much. we'll keep our audience up to date as the pressure mounts for charges to be filed in this one. thank you. next, an romney calls on republicans to put an end to the

if i was commander in chief, we wouldn't have the policy we have in place right now which is to withdraw troops. when we did that was made it almost impossible for our men and women in uniform to be successful. >> i think it's plain to see the conditions there are not going very well. i lay part of the blame for that on the lack of leadership on the part of our president. >> politics now both san samric santorum and mitt romney blaming president obama for worsening conditions. both have refused to say whether they would speed up withdrawal. the two candidates are focusing on the republican prize in illinois tomorrow. 54 delegates are at stake. romney and santorum in a pretty tight race. joining me now to talk more about it "news nation" political panel, michael smerconish and

steve who has endorsed newt gingrich. let me start with michael here and the gop problem, if you will, regarding this war in afghanistan. explosive moment on "morning show" let me play what joe had to say and get your thoughts on the other side. >> for all republicans and democrats that want to continue this fight this car, we won the war. it was an anti-terror campaign. we went in to get bin laden. we went in to break up al qaeda in afghanistan where they launched the 9/11 attacks. we killed them. we destroyed them. >> michael, how does romney and santorum counter that point from a con seservative op their own party? >> i think they will have a problem come the fall. it's the same old issue. i apologize if i'm repetitive on it when i say they are trying to out muscle flex one another in a beauty pageant for

conservatives, which will then put them out of mainstream in a general election. 57% of americans said they want us out of that country. they're trying to cultivate support among a small base. they are doing themselves harm in the long run. >> steve, let me bring you in. mitt romney says things are not going well on the ground. that's counter to what senator john mccain has processed to his thoughts. you also have romney saying he would still need to listen to the generals and what they had to say. kind of what we often hear. it seems he can't form a strong opinion if he wants to lead there country on this war. >> that's because what we're doing is circling the drain. the guest you had on previously, everything he said was 100% correct. we have lost the premise of this conflict. we are immersed in nation building.

i would slightly disagree with michael in i think the vast majority of conservatives are not in favor of nation building. this idea you can give someone democracy, whether they want it or not. i think we have to have a real conversation and get beyond the pandering on both sides and have a real conversation about what this is supposed to look like at the end and how do we get there. >> michael, are we going to have the real conversation from the gop candidates when they know very well what the polling shows out there and they know the situation on the ground. steve talks to conservatives all day long like you do, folks want out of that war. >> i think we're going to have that conversation, but not until the general election. the reason that we're going to have it, we all hope, is that the economy will continue to bet getter. it's only when the economy gets better that people will divert their attention from pocketbook issues to some of these foreign policy goals which might bode well for the president because

it will put the take down of bin laden back front and center. so long as the economy gets bett better, we'll talk about the other issues. >> michael, i know you have to get back to your radio program. steve, you're sticking around because you're on the hot seat with your support of newt gingrich. i laugh because i ask you repeatedly. newt gingrich is not campaigning in illinois. he has no vents planned. i believe he will try to pick up steam in louisiana for the weekend. is your guy running or not here, steve? does it matter at this point? let's be honest. >> i don't think it matters much at this point. i said last week i thought it was a two-man race. i think at this point newt's biggest goal is to deny mitt romney the nomination. i think there's a lot of conservatives that share that goal whether or not they want to support newt gingrich or not. >> let me play what rick santorum said yesterday regarding how high the stakes

are for him in illinois. he's behind in the polls but let's play his prediction. >> i guarantee that we will win this nomination. >> the audio is a little bad but he says if they're able to win in illinois, he guarantees he will win this nomination. is that a guarantee that would be faulty? >> no. i don't know if i'd go so far to pull it will joe nameth card, but i think he's close. what we haven't had in this race is a true road victory. we're seeing romney win places where moderate republicans reign and democrats usually win and we're seeing rick santorum and newt gingrich to a much lesser degree win in places where republicans win. what we have yet to see is a road victory. somebody put on the white jersey, go into somebody else's turf and win a big contest. if santorum would doll that in illinois, that would have a huge

jewish school. four people were killed. a rabbi, his two young sons and another child. be white house released a statement saying our thoughts and prayers go out to the families and friends of the victims and we stand with a community in grief. we join the government of france in condemning this unprovoked and outrageous act of violence in the strongest possible terms. this is the third attack in eight days where a man on a motorcycle has said to have opened fire. let's get the latest on this incident at the school. tell me how this is linked to those other incidents here. >> good afternoon. they now believe that the same weapon with the same cal barbibs used in sh shooting as the other two shootings. that is crucial. that is worrying officials that we may be dealing with a serial attacker possibly with racist

motivation or political. as you say opening fire outside this jewish school killing four people, including three children. an 8-year-old girl was killed stoet be the daughter of the school principal and this just the latest attack. two others involving members of the military. some of them wearing uniform shot dead by a shooter who was riding a motorcycle. some of them were wearing uniform and all of those victims were north african or caribbean origin. the theory could be this is politically motivated and a terrorist squad from paris is there investigating. another concern is this is somebody with some kind of far right motivation who is targeting people for racist reasons. >> what is the president saying today? >> he is saying this is not just an attack on jewish victims but an attack on the whole country.

defend his energy policy. he's visit nevada and othklahom. if you're going to go after someone, you have to go after with what they said. >> he will continue to use the same message effectively that obama promised that energy prices would go up. there's several republican who is have said they believe that president obama and his entire administration want gas prices to remain so high that consumers can no longer consume as much gasoline as they have in the past. >> the president was asked about that and he flatly said i think what seems logical to anyone, what president would conspire or want the price of gas to go up. who would want that? that's a recipe for not being invited to the white house by the american people? >> that is right. that's why you see the president on the road trying to get on the

offense so he's not on the defense about gas prices. he knows what's coming. prices will go up this spring as they have begun to. they will get bad in the summer. it will be a huge republican talking point. energy prices, the price of food, the increase of prices in health care will be part of the narrative about what is worse in your life then it was in 2008. they will remind the voters it was a $1.90 a gallon when he took office. this is an issue. that's why he's talking about it several times a week. >> let me play what david axlerod said about the republican promising to lower gas prices. >> the notion that we can drill our way out of this or if somehow we say that that the gas price will go down now. that's not oil talk, that's snake oil talk. the american people know the difference. >> to the point specifically with newt gingrich. he was hoping that his speech on

gas prices or his promise would dig him out of hole and it's not worked for him. is that because the american people, the american public knows that the candidates will toss out the figures in hopes of seducing them in, but it's not a reality? >> it's a good republican talking point but they weren't voting for him when he promised $2.50 a gallon. no president can promise any number for a price of gasoline. you see in the last week's poll that 54% of those polled in that poll, which some consider an outlying poll the president does control prices and could be doing more. that's why because of that perception you see the president trying to take control of the republicans before republicans beat him up too much on how much

the president controls prices. >> there was a bloomberg poll that showed a different number in favor of the president. the bottom line is with this gas argument, you bring up the price of gas. some people say it's speculators. it's a back and forth. can any of these gop candidates really pick up real traction because in the end people want to hear that yes, you can bring it down to $2.50, but they know that's not possible in the immediate future for any of us. >> when president obama was running for president, both hillary clinton and john mccain were pitching a gas tax holiday. president obama was standing in opposition saying it's a gimmick and it's not going to work and not bring down prices. at the time the bush administration agreed with him. a spokesperson said the american people should not be led to believe there's a quick fix.

let's get the scoop from chris with witherspoon. five months. she gave her five months. apparently she personal lip ended this. >> she was not delivering. her show launched she was bringing in about 500,000 viewers. in a few days it went less to half of that. she was not delivering. there's a lot of speculation about what went on behind the scenes. we're hearing she was a bit of a t tyrant. she fired and rehooired her announcer. she tried to revamp the show and it wasn't working. she went from a an audience show in january to a nonaudience show it wasn't working for her. >> there was a quote from someone, the daily beast an employee said it was a hell hole. >> i heard. if you watched rosie on the view, she had this, she went from a queen of nice to a queen of ice persona.

time now for the "news nation gut check." should your loved one have access to your social media accounts in the event you pass away? karen williams said she wanted to look at her son's post after she died in a terrible motorcycle accident. she fought for two years after she was blocked from her son's page. karen joins me from portland, oregon.

thank you so much for your time. i saw your story on friday. i wanted to talk with you. obviously, this is one of the situations that comes about. it's all very new. from a mother's standpoint. tell me why you wanted to see your son's account. >> friends of his notified me to tell me of the wonderful postings people were making on his wall. you have to remember, this is back in 2006 before his friends gave me their own personal password so i could go on and my husband and i could see what was written about him and how much they missed him on his wall. i found out right then they were going to -- facebook was going to drop it in 30 days. my main reason was just to try to keep it up for at least a year so that it would be there on the anniversary of his death,

which would be very important to his friends and to me. i got ahold of facebook -- yes. >> i imagine that request from you to facebook, you would assume that would be easy enough. they would allow you to have that access for the year you requested, but that was not the case. >> no. they said the problem was that no one would be there to monitor the account. somebody could put something up that was inappropriate and so his roommate gave me his password and i said now are things fine. i can monitor the account and then within two hours they had changed the password. i couldn't get back on. what i was just worried about was preserving what he had put up and there was no way i could. they said finally, we will let you have access if you get a court order. we had to hire lawyers to get that court oerd, which we did.

>> how much -- this is two years before you were able to get facebook to allow you on. you hired a lawyer. i can't imagine that was free. you're already dealing with the grief of losing your child. this two year battle with facebook. the money that you had to spend to get the access. ultimately you prevailed. when you look back at this, was it worth it? >> yes, it was. i am right now just concerned about other families. they shouldn't have to go to such extent. there needs to be some legal provisions for people's accounts so that something can be done with them. will they take control. it should be dealt with almost like a digital estate. >> i know that attorneys in two states are considering proposals that would require facebook and
