one of the hundreds of guns that was allowed in mexico was sdovered at the scene where a u.s. border patrol agent terry was shot to death by members of a mexican drug cartel. at first, the complete was told guns were nod allowed to go across the border. they took action against some of the officials in arizona responsible for the operation. so this is what the fight is about now. congressional investigators say the justice department is withholding thousands of pages of documents about when the most senior officials found out about fast and furious and what they did in response, but just last week, attorney general holder said his department has given congress all of the relevant documents and is withholding materials that it can't turn over, such as evidence produced by grand jurys that is restricted by law or documents related to its own criminal investigation into agent terry's shooting. >> pete, if this makes it to the full house vote, and mr. holder

is found in contempt, what happens then? >> reporter: interestingly, then it's referred to the justice department for prosecution. it actually is referred to the u.s. attorney here in the district of columbia and then i'm not sure what would happen because in the past, u.s. attorneys have taken the position that they won't try to initiate a prosecution if the president is asserted executive privilege. that's no, sir the case here, but who knows what would happen if it's referred. obviously, the hope here is, i suppose on both sides, if they can work something out before it comes to that. >> swhat is the likelihood they would be able to pull something out. i don't want to pull out the crystal ball but let's look at the scenarios here. >> well, even today, darrell iss hopes they can work something out if the justice department produces more documents. in the past when congress has threatened against people in the

administration some of these things are eventually worked out and may be what happens here. i can't tell you what is going to happen because i really don't know. >> pete williams, thank you for the developing news out of washington, d.c. the news nation is following breaking news right now. a dramatic start to the child sex abuse trial against jerry san dusky. the 68-year-old arrived in court ready to fight the charges that he sexually abused ten boys over a 15-year span. during opening statements, prosecutors showed jurors boyhood photographs of eight of the alleged victims who are expected to testify against sandus sandusky. john is following the developments. what was the significance of showing the photographs of the now junk men when they were, obviously, young boys? >> reporter: it was clearly an attempt or apparently an attempt to personalize the victims or the alleged victims of only since been known as victim one,

two, three, and four, to personalize them as the young boys they were when this allegedly took place, rather than the young men who were testifying right now. i got to tell you for the past hour, an absolutely wrapped courtroom has been listening to a young man, a 27-year-old man who has been known in court documents as victim number four. he has identified himself in court in his nbc news policy not to identify victims of alleged sexual offenses unless they consent so we are not naming him. the past hour, he has been testifying how showers with jerry sandusky in the coaches' locker room in penn state went from what he called horsing around to hugging and caressing, to maneuvering him onto the floor where more intimate contact took place. he says that this over two years, there were at least 40 incidents like this. he also says that sandusky gave

him gifts of hockey sticks, golf clubs, a snowboard, penn state football jerseys, game balls, a spot on the sideline at penn state home games, all of these things, he says, were things he loved, things he wanted, things he was afraid he would lose if he spoke up and said something about what was going on. he said that all of this made him feel very uncomfortable. he talked about how when he rode in the car with sandusky, sandusky would put his hand on knee, basically like i was his girlfriend. he says that it made him -- it freaked me out extremely bad, he says. he would always try to maneuver away but it always returned. now, the prosecutors, as you say, there are seven others who are prepared to testify to this and that is going to be coming up in the coming days and weeks.

the judge says the trial could take as long as three weeks. the hearing is continuing right now. >> jerry sandusky was very involved in the process, telling his attorneys which jurors he felt would be, quote/unquote, fair to him. what was his demeanor as we are now hearing some of the first graphic allegations coming from an alleged victim? >> reporter: he was sitting taking it all in. he was looking at the witness. his eyes -- his head was turned toward the witness box. the witness was maintaining a lot of eye contact with the jury and the jury, by the way, was paying very close attention to the testimony. he was also the witness was watching the -- paying close attention to the prosecutor as he asked his questions. only a few times did he glance over at sandusky and very brief glances. as i left the courtroom, they were presenting him with exhibits, photographs of the young man when he was a boy taken with sandusky and a handwritten letter that sandusky

had written to him, apparently after the young man tried to break off contact. during this period, the witness was getting a little more emotional and sort of casting a couple of more glances and looks over at sandusky. so far, sandusky has been sitting calmly and attentive to this testimony and taking it all in. >> john yang, thank you very much. john bryson is out of the hospital, back in washington today, after crashing his vehicle three times in the span of five minutes over the weekend. the department said earlier today secretary bryson had a seizure while driving in california. police cited him for hit and run but say drugs or alcohol were not a factor in these accidents. meanwhile, another example of how quickly sides will pounce on the other. the super pac founded by karl rove, american crossroads, posted a tweet this morning saying, quote how does commerce

secretary have three car crashes in five minutes and alcohol not be involved? #skills. after the commerce department announced that bryson suffered a seizure, earlier bryson tweeted with hash tag #skills and attempted levity before the facts known and failed miserably and we took it down and regret the tweet. what else do we know regarding the seizure if the commerce secretary was on medication and the accident happened? >> reporter: we have breaking news coming in. white house press secretary jay carney holding his daily briefing addressing this. saying president obama has not spoken with bryson at this point but jack lu has. he wouldn't give us an exact readout of that conversation except to say the entire administration is monitoring the situation and quite concerned about the secretary's health. here is more what jay carney had to say.

take a listen. >> we are, obviously, concerned about the incident, concerned about secretary bryson's health-related issues that played a role in this incident and we are still gathering information about it. >> reporter: so, just to recap according to authorities out in l.a., this whole thing unfolded on saturday. that is when they say, secretary of commerce bryson was driving in his lexus and was in the san gabrielle area. he got out and spoke to the driver of the car and wound up rear ending the car a second time and drove off. five minutes later, he had a second accident. when authorities found him, he was unconscious. they took him to the hospital. it has been determined that according to the commerce department, that he had a seizure and that is what is behind all of this. he was cited with a felony hit and run, but never taken to the police station, never booked because he was rushed to the hospital. authorities out in l.a. stress the fact that he was quite helpful. now, commerce department says

that he is back here. he is resting in d.c. he has no public events scheduled today. the administration, obviously, monitoring his condition and the investigation quite closely. >> with this investigation, is there any indication he had a preexisting situation, especially regarding seizures? >> reporter: great question there. potentially one incident a little while ago in which secretary bryson may have showed level of unsteadiness. when pressed about this jay carney wouldn't confirm that he had any preexisting condition but that is certainly one of the questions that is going to be asked as they continue this investigation. >> thank you very much. . governor mitch daniels has some advice for governor mitt romney. get a better message. >> the american people, i think, will rightly demand to know something more than he is not president obama. >> i'll talk with our political panel about romney's friendly

now to politics and campaign 2012. president obama and his re-election team woke up today to a new romney web video seizing on the president's comments that the private sector is doing fine. >> we have seen layoffs,

cut-backs. >> when it's all said and done, i'm making $200 a month. >> the private sector is doing fine. the private sector is doing fine. the private sector is doing fine. >> and meanwhile, obama senior adviser david axelrod spent another day, today, clarifying the president's remarks. >> he called a press conference to say -- to suggest urgent actions we should take to undergird the economy from the clouds that are rolling in from europe. he has said repeatedly we need to do more to accelerate job creations so i don't think there is -- in the minds of most americans there is no confusion about this. >> and, today, the obama campaign firing a new ad of its own. in fact, seizing on mitt romney's comments that president obama, quote, says we need more firemen, more policemen and more teachers. did he not get the message out of wisconsin? >> it's time for us to cut back on government and help the american people.

would say this. a guy riding high in the republican party pushing back on romney's comments saying that, quote, i know in my state our reforms allowed us to protect firefighters, police officers, and teachers. that's not what i think of when i think of big government. governor walker taking a very different stance from sununu and even romney there. >> right. this is a classic democratic/republican battle where the republicans try to paint the government establishment be it the federal government or the local government, as sort of a nameless, faceless bureaucracy and the democrats will come back and point out firefighters, police officers, teachers, that is isn't simply a bunch of people collecting a paycheck who are members of union but the teachers, maybe of your own kids. suddenly, people aren't that excited about the teachers that teach their kids being laid off. so this is a battle we have seen played out repeatedly and it is interesting that walker, having won the battle to some extent with the public employee unions, would choose nod to slap at them

again in this context. >> jen, let me bring you in and ask you, if possible, grade the curb correction from axelrod, the president giving his comments later in the day on friday, trying to clarify this private sector remark from the president. >> well, as david said, the president called the press conference on friday because he wanted to talk about the need to do more to help not just the public sector but the private sector. he went back very, very quickly on friday and made sure people understood exactly what he was trying to say in the morning. so that was a really quick move by the white house. >> it wasn't quick enough, jen, because in the middle of the president clarifying -- >> well, it was. >> -- but factually speaking in middle of that were instant attacks coming in from republicans. so in our world of where a minute used to matter or even a couple of hours you got twitter and facebook and we saw those attacks. our first team points out in context, of course, the president was noting that the

private sector is doing fine in comparison with the public sector, but, jen, again, in reality, between when the president made the comments in the press conference and when he came out later in the evening there was already a lot of rattling regarding those comments from republicans. >> well, that's true. and that is a friday afternoon where mitt romney tries to seize on the remark. but mitt romney's attempt to try to say the president is out of touch is just not -- simply not believable and in the same day, as you touched on a few minutes ago, you know, he made clear again that he was ready to slash and burn jobs for firefighters, teachers, and public sector workers and that is something he did as governor of massachusetts. the problem with the republican attempt to make the president's morning remark on friday more than it was is that it just doesn't reflect his record, it doesn't reflect what he is fig for and it makes it awkward and difficult to make that a big campaign issue for them. >> josh, let me play what mark

halpern said on ""morning joe" about the police officers and teachers and firefighters. let me play that. >> i think all of this is silly. i thought when john mccain said the fundamentals of the are strong is silly. i think this is what our politics has become. >> do you think that this boils down to something silly, or are we see i guess an achilles heel regarding big government, teachers, firefighters, people we know we all need. >> i don't think it's totally silly with all due respect to mark. anybody can make a mistake in the haste of a press conference. i'd say that is probably what the president did on friday but there a broader debate between the two parts. if you're talking about aus t austerity plan. it probably does mean laying off firefighters or teachers or police officers.

and so if people are laying economic plans on the table, it seems to me that it's totally legitimate to talk about what the impact of those jobs may well be. >> let me also switch you to this taung. the so-called friendly fire for mitt romney. scott walker, an indiana governor, mitch daniels, both coming out, josh, over the weekend saying, listen, governor romney has to put more on the table. it cannot be a campaign based on i am not president obama. let me play the remarks back-to-back, josh. >> i just hope he takes a page out of president reagan's playbook in 1q0e8 where it was not only a referendum on the failed policies of president carter at the time, it was something where president reagan laid out a clear plan. >> the american people need to know more than he is not president obama. he better have an affirmative and constructive message and one of hope. >> less about the words, josh, because they were pretty clear. what is the message behind the fact you have these popular republican governors saying this?

>> well, i think they are looking at the fact that we have heard a lot of comments from the obama campaign in recent weeks about the raising fears about what mitt romney may do as president. i saw an ad just today talking about that. and that the message has been one more fear than hope oriented and i think if they are thinking that if romney is going to win here, he actually has to present a more positive image and a projection for the future but i'll tell you i think both candidates have sort of come up short in terms of saying what they are going to do in the next four years as opposed to how the other guy would be worse. >> isn't that something that they could have told him behind the scenes here? i mean, you've got mitchell daniels, who it came off as criticism, and usually when someone is on your team, we talk about this with corey booker and when team obama seems to be going rogue with clinton. now you got these governors who are very popular right now on national television seemingly criticizing romney for being just not obama. >> well, i can only assume that

that means that their views are not being heard within the romney campaign and, therefore, they feel like they have to fire something across the bough. it seems similar to the cory booker situation and flying into the face of the candidate you're a surrogate for. >> thank you both. coming up, congresswoman gabby giffords stepping out to campaign for her former aide who is hoping to fill her house seat tomorrow. mark your calendar. arizona voters will decide gifford's successor. comedian don rickles stand by his joke. he thought it was funny to compare president obama to a janitor. what he is saying in defense of that joke is just one of those things we thought you should know.

voters head to the polls tomorrow to decide who will take over congresswoman gabrielle giffords seat in arizona. ron barber hors former aide is running against jesse kelly for that seat. while it is a local election, some believe it's a reflection of the political drama playing out we are watching nationwide. the "national journal" calls it, quote, a national dress rehearsal saying the campaign has focused on social security and medicare and the same hallmarks of partisan skirmishes across the country. joining me now is joshua cartel. he has an article up on the politics of this election. thank you so much for your time, joshua. you talk about highly negative and personal this campaign has been. >> it's amazing.

when we were thinking about the election to replace gabby giffords, everyone on both sides of the political aisle thought it would be a respectful and polite and not many negative ads in this race but it's turned out to be one of the most negative campaigns in the country so far with hack ards from democrats accusing the republican noom knee of wanting to sut social security and medicare and republicans pretty much trying to attack the democratic nominee ron barber being a pawn of president obama. almost every ad you've seen, especially the ones coming from outside groups, have been negative and nasty and race to the bottom. >> outside groups are watching this because, as you pointed out, a kelly victory would be a sign that 2012 could very well be another wave election for republicans. so like with wisconsin, when these outside groups start getting involved, you know the stakes are high. >> yeah, absolutely. and wisconsin election is make willinging this election a special election in arizona a little more significant.

what we saw in wisconsin was that a lot of the conservative groups, a lot of republican groups showed intense get out the vote efforts. the turnout in the republican parts of wisconsin were high and in arizona, this is a conservative district. >> right. >> the key is for the republicans, if they can turn out their base, if their base is so jacked up to vote for the republican nominee, it's a sign that they are going to continue to be motivated and have a strong base headed into the november elections. >> you talked about the highly negative personal nature of it. i want to play an exchange with chuck todd on his show with democrat ron barber on this anti-kelly ad that was put up by one of his supporters. let's play it. >> i want to play for you this ad that is being done by an outside group on your behalf using congresswoman giffords in a different way. here is the ad. >> two years ago, kelly said this about gabby giffords. >> now she stands there with that smile and pretends tob to

be some kind of hometown hero. she a hero of nothing. >> do you really want jesse kelly representing you? >> is that ad appropriate, considering his words when he said this, it implies that it's about gabby giffords after the shooting when, of course, he said this during the 10:2010 campaign. is that fair? >> first of all, the video or ad has nothing to do by my group and it's by an outside group and we have no control over what they say. i believe it shows clearly it was 2010. >> joshua, that is an example of what is going on here. you have an article with "the washington post" talking about a sympathy vote. gabrielle giffords, her role in this and legacy playing a big part in what we might see tomorrow. >> yeah. as chuck noted that footage from giffords was from before the 2010 election, before the shooting. so it's been very controversial but it's also been very effective.

because there are a lot of independent voters the less hard-core voters in the district that supported giffords. giffords defeated the republican who was on the ballot back in 2010 even though it was a good year for the republicans and the reason why was because a lot of independent voters, moderate republicans in that district, thought he was a little too far to the right. so that's the kind of baggage he is facing in the special election and these ads haare effective pointing him as outside the mainstream. >> thank you, joshua, for your time. people check out the article on this one. we will be talking about it tomorrow. a recent virginia high school graduate was brought to the u.s. as a child is now facing deportation. according to "the washington post," 18-year-old heidi mahea had planned to attend college until immigration officers ordered her and her mother to buy a one-way ticket back to gaud m guatemala. illegal immigrants brought to this country and educated here

and want to remain. the so-called dream act would grant permanent residency to top students has so far to fail the support to become law. that issue underscores the frustration among many latino voters and the massive way to get their vote. president obama's supporters have teamed up on a new ad targeting hispanic voters in the battleground states. you see the map there. nevada, colorado, and nevada. >> to tell my story, i'm also unemployed. [ speaking in foreign language ] >> and the $4 million ad bite comes one week after the romney campaign launched a spanish language ad highlighting unemployment in the hispanic communities. let's bring in mark murray to talk about this. it's interesting. you got this article in "the new york times" about the latino growth not fully felt at the voting booth and it says that hispanic leaders are frustrated and democrat leaders are worried

as they increase efforts to rally latino support. >> it's one of the biggest challenges for the obama campaign is turning these people out. you look at any poll out there including the most recent poll that shows that latinos are overwhelmi overwhelmingly breaking for president obama but the question is will the people turn out to votes? "the new york times" on sunday wondered how many of these latinos will vote that their registration numbers are down vis-a-vis other ethnic groups. so it is going to be one of the biggest stories, one of the reasons why the obama campaign is putting so much money registering people to vote. >> the numbers according to "the new york times" more than 21 million latinos will be eligible to vote this november. over 10 million of them are registered and even fewer turn out to vote. is this why mitt romney's campaign, despite his comments during the debate over self-deportation and despite not

supporting the dream act saying he would consider something from senator rubio, is this why they believe perhaps there is an opening, not necessarily can you pull that vote but you can bank on maybe without enthusiasm there could be a problem for the president and democrats? >> their strategy is to have the economy be the single driving issue and as you mention inside that tv ad that the romney campaign ad has going their message isup the economy. president obama is advertising his campaign is trying to target latino voters and speaking almost more to them than talking about the economy per se. so those are the two different strategies going on. i would note, tamron, it's just been four years ago since our last presidential election and there were still some reservations on whether latinos would turn out in the 2008 election. four years later, there are more latinos and more latinos of voting population. the question is whether they are going to come out to vote. that question and how it's answered could very well decide this presidential contest. >> mark murray, great pleasure

having you on and starting the week off with you. thank you, mark. >> thank you. a disturbing new trend in the nation's high schools. an investigation by "the new york times" shows a growing number of students are actually using prescription drugs as a study aide. the drugs are adderol and ritalin and normally pretty bad for people with adhd but also known to increase focus and provide energy for those all-night study sessions that many of you might remember. a number of prescriptions for these types of drugs given to teenagers and preteens. it's gone up according to the report by 26% in just the last five years. totaling almost 21 million prescriptions a year. many students who don't have prescription, well, they are getting them from their classmates. doctors warn that the drugs can have a dangerous effect on kids and that they can be highly addictive. for more on this we are joined by "the new york times" national education correspondent allen schwartz. thanks for your time here.

>> my pleasure. >> this article caught my attention and the attention of a lot of people because it is one of those things that you read and you really can't believe it's happening but we know the pressure that a lot of students are under to excel to get into the right college and to get those scores up. >> well, yeah. you're right. this wasn't a story about drugs in schools. this was a story about pressure and what some kids in some communities feel they have to do to deal with it. it's not a particularly new phenomenon. there was a famous episode of "family ties" where michael j. fox's role got strung out on his friend's diet pills. something we have known about a long time but no one seems to be talking to the parents and particularly the doctors and particularly even more so the young people who feel they have -- some of whom feel they have to do this in order to compete for college applications. >> alan, the big thing when i was in college taking a no doze or maybe gatorade and hype

yourself up on some sugar. obviously, to your point, this is not necessarily new. people might use something over the counter or as you pointed out an episode of a tv show, a diet pill. but the numbers, as presented in your piece, are stunning and, to your point, it's being ignored. why do you believe that is the case or when what is the research showing the case? parents saying do what you need to do to get into harvard? >> exactly. i think what we need to do probably is to educate parents, to lock their medicine cabinets, to make sure that if a kid has a prescription, that he, in fact, has the disorder and hasn't just fooled a psychiatrist, which happens a lot. >> isn't that all common sense? it seems like there is something under all of this. we have seen the ads. psas for example on the number of kids now addicted to prescription drugs that they are finding in their parents medicine cabinet or the neighbor's medicine cabinet. what you're saying sens quite common sense. the intriguing part with all of that information, this is still hang and the kids are still under this pressure. >> let me ask you this. is your medicine cabinet locked
