>> oh, yes! >> reporter: the obama health care was upheld. chief john roberts sided with court liberals to say the penalty in the obama law for not buying health insurance is a tax, because the constitution permits such a tax, roberts wrote, for the five-justice majority, it is not our role to fosh bit it. the court did linlt the federal government's power to force states to take more medicaid patients. the affordable care act goes forward. guaranteed coverage and every american ncluded, like it or not. >> i was hoping for the whole thing to come down. >> we have to unite and fight this. >> i am very happy with the decision that was made today. >> we have worked for this for a long time. >> president obama praised the high court's decision. >> with today's announcement, time for us to move forward. to implement and where necessary, improve on this law.

americans as a right, not a privilege. >> lean forward with the ed show at 8:00 eastern on msnbc. eric holder has become the first cabinet member to be held in contempt of congress. all but two republicans voted for the resolution in a dispute over access to documents for the gun tracking operation known as fast and furious. the house could try to go to court to force the attorney general to hand over the documents but that could become a long court fight. holder called the vote a politically motivated act in an election year. president obama is going to travel to colorado today to get a first-hand look at the areas devastated by these wildfires. the waldo canyon fire has destroyed some 346 homes in colorado springs, made it the most destructive fire in that state history. so far, the remains of one person have been found in one of theç destroyed homs.

jinah kim has more. >> reporter: after waiting in ago any for much of the week, hundreds of evacuated families in colorado springs learned they no longer have homes. >> we have preliminarily, 346 residents that have been destroyed. >> today, we are going to be incredibly aggressive on this fire. we have the first break in the weather that we've had since we've been here. >> reporter: fire crews now numbering near 1500. >> seven officers with crews ready to go. >> reporter: switched from defense to offense for the first time in four days. >> as far as what's happening up in the forest or the areas we can't get to, it is going to be difficult. it is going to take time. there is going to be smoke and fire for quite some time. >> reporter: for evacuees like stephanie kaufman, this has been an emotional and physical roller coaster. >> we evacuated a couple of days ago due to the smoke. we came back and had to mandatory evac again, came to monument and now monument is on preevacuation.

>> reporter: the waldo canyon fire is one of nine major wildfires burning throughout colorado. there are dozens of other fires burning in other western states. here is your first look at other stories making news. in new york city, police have released dramatic video of a gunman opening fire in what's being described as a random attack. investigators say the man walked up to two people and just started shooting. the victims are wounded but are now in the hospital recovering. the gunman is still on the loose. in texas, tragedy at a construction site where a worer was killed after becoming trapped in theç collapse of a crane north of houston. the crane was hoisting the wall of a new store when the accident happened. the cause is under investigation. finally, in ohio, it is okay to envy these kids. look at them. they were able to beat the heat and have fun doing it after the mayor of columbus ordered a small group of fire hydrants opened under supervision. something normally forbidden but

allowed under the city's operation cooldown. that guy is having fun. the hydrants will likely be turned on again today as the thermometer inches closer to the triple digit mark. i love it. now, for your national weather, we turn to nbc meteorologist, bill karins, not just heat making headlines thunderstorms rolling through populated, dense areas. if you are getting ready to leave your house from new jersey, greater new york city, connecticut, baltimore, philadelphia, thunderstorms are rolling through this morning. even a few in update new york. from syracuse, just got hit, now heading for albany and upstate. as far as we are going to deal with the worst of it appears to be down around philadelphia and baltimore. we see severe thunderstorm warnings all over the delaware valley. looks like the strongest of those storms is rolling through downtown philadelphia. they will roll through pretty quickly. it looks like baltimore, you have just avoided the worst of it in the downto area.

north of the city is where we are seeing a stronger storm. as far as the new york city area goes, we are not looking at severe storms. a pretty strong line of storms is going to roll through. it looks like it is intensifying as it is over stat continue island. if you are traveling anywhere from new york city north wards including çconnecticut, it loo like over the next half hour, these storms will roll through and the rest of the morning commute should be just fine. another line up here near utica, new york. those will head around interstate 88, albany area. the heat wave is the big story. yesterday, four major cities had their all-time hottest june temperatures, indianapolis, louisville, 103-104, st. louis, 108, little rock, 107. the heat wave is heading east. we are going to see the heat starting to peak in areas of the southeast. what's been different is it wasn't all that humid in areas of the midwt. the heat index is going to be

photograph of president obama in the oval office appearing relaxed and happy after the supreme court decision upholding the health care law. earlier, the president was worried because of first reports that said the court struck down the law. in official statements after misreporting the ruling from the justices, cnn apologized for the error and fox news channel said it reported the facts as they came in. an aide to republican candidate mitt romney told politico that within hours of the high court decision, the campaign raised more than $3 million from small donors that opposed the law. on cnn, rick santorum reacted to the ruling and said that the health care plan put in place by governor mitt romney, quote, hasn't worked in massachusetts, even though he sports romney for president politico reports that in congress yesterday for the announcement by the court, former speaker, nancy pelosi, was wearig)her lucky shoes. she wore the pointy toed

progress on europe's debt crisis could help stocks recover some of europe's losses. euro zone leaders agreed to take emergency action to bring down italy and spain's borrowing costs. they agreed on new bank supervision and okayed bailout funding for struggling banks. earlier, the supreme court health care ruling pushed hospital stocks higher. etna lost 3% as investigators ruled about the rulings impact on health insurers. blackberry plunged 15% after a big quarterlyç loss. news its new smart phone won't go ready until next year. after the bell, nike tumbled 13% on weaker than expected earnings. ford plflagged investors warnin europe's economic woes are taking a much bigger toll on the bottom line. jpmorgan fell after "new york times" reported losses could reach $9 billion, more than four
