berry win a big battle. good morning, everyone, i'm betty nguyen. a showdown is set in the senate. democrat also try to avoid a government shutdown and keep president obama's signature health care law intact but senators ted cruz and mike lee are leading the charge against that effort giving you live pictures from the senate floor, the republicans are still speaking in an effort to prevent a vote. senator cruz started this just before 3:00 on tuesday afternoon and to tracie potts live in washington. what's expected to happen today. >> reporter: what was expected to happen was this vote about an hour after the senate goes into session. these two are trying to prevent that from happening. this all-night talk-a-thon could end up leading to a government shutdown. >> i intend to speak till i'm no longer able to stand. >> reporter: at 8:00 last night

paul spoke out against his filibusteresque tactic to defund obama care but what does this stay when you have a major tea party voice against a potential 2016 hopeful? >> it's a complete mess. senator cruz is wasting everyone's time doing this. it is not a filibuster. it is not going to get anything done. it is just grandstanding really at its worst and doesn't make our party look any better or stronger going into the mid-terps or the presidential coming up. it doesn't help his chances being president or the republican nominee any favors. ted cruz should stop this. and it's not constructive. we need constructive government. this isn't it. >> green eggs and ham aren't con truck tiff. >> i don't think so. >> senator paul is arguing they need more time. to do what? come up with a different strategy? speed up the clock? what are they needing the time

to do? >> ted cruz needs time to trach a nap or go to the bathroom. >> i'm not so sure. this is not a winning fight. this bill passed. i disagree with obama care. i'm against obama care but we just do not have the votes in the senate right now to stop this and to follow on what's done in the house. we have the majority in the house. we don't have the nesma majority in the snachlt that's the bottom line so you have to deal with the reality in life and that's one of them. let's move on to other issues. this country has absolute crawling gdp and high unemployment and these are things that the congress can deal with. this one is not. >> i want you to weigh in. hillary clinton is saying, "if they want to shut the government down" that is on their head and responsibility. she warned that we have's seen this movie before and is she right about that. >> she's wrong. she's talking about 1995 when the government was shut down and bill clinton went on to re-election. president obama is notal popular
