5:30 am
social security, we're all sucking the glass of [ bleep ] of -- >> that's live. he's still talking. he read some dr. seuss too, i do not like green eggs and ham because it costs too much under obama care to deal with the indigestion. as the president's signature law remained under assault mr. obama was in new york and at the united nations, that historic handshake with the president of iran never happened. we'll take a look at what's going on with global leaders in the big apple. we all know joe scarborough did some pretty good clinton. what about bono, you be the judge in "the cooler." this is "way too early." >> uh-oh.
5:31 am
>> it feels like today is -- we have a hump to overcome for some reason. it is a wednesday. that -- i show it to my kid. they like that and the naked m&m commercial from the super bowl. brian shactman. in sports the oldest person ever to hit a walkoff home run and the martha stewart relationship may be ending. let's start with that dysfunctional business of d.c. politics. senator ted cruz part of a marathon speech in protest of funding the president's health care plan and took the floor at 2:41 p.m. eastern time. this is him right now live at 5:31 a.m. eastern time. i mean people are still wondering if he has a catheter. i think he's been taking turns up there at the dais declaring
5:32 am
he will talk until he can't stand anymore and with the help of his tea party friends, the debate continues of course, as we continue. it is not technically a filibuster because it has no chance of delaying today's senate vote. but apparently speaking about obama care for hours on end, not enough to pass the time. >> most americans could not give a flying flip about a bunch of politicians in washington. who cares? you know, almost all of us are in cheap suits with bad haircuts. who cares? you know, it's a little bit like the world wrestling federation. it's wrestling matches where it's all rigged. the outcome is predetermined. they know who is going to win. i'm a big fan of eating white castle burgers. obama care is a far less intimidating foe than those that i have discussed with the possible exception of the moon. do you like green eggs and ham?
5:33 am
i do not like them, sam, i am, i do not like grind eggs and ham. would you, could you in a car. eat them, eat them, here they are. could you would you with a goat. i do not like them here or there. i do not like them anywhere. i do not like green inc.s and ham. >> i think his pacing on that was a little slow. the communication director for senator harry reid tweeted out this so-called fun fact last night. "senator cruz prenegotiated the terms of his fake filibuster with senator reid yesterday. "not exactly a mr. smith moment, end quote. all right, joined now by nbc's political reporter casey hunt. i don't know how you keep it together. we appreciate you getting up with us. the front page of "the dallas morning news" he leads lonely attack on budget bill.
5:34 am
he is alone on this. why is he doing it? >> he has become a hero to the conservative grass roots over this and, brian, you have to remember what's going on here. these third party conservative groups like the club for growth, heritage action, those are the people who got him elected and other senators elected like mike lee and marco rubio as you heard him just talking about was actually the establishment basically rejected early on and they went on to win. so they don't feel beholden in any way to their party leaders and you're seeing that play out on the floor and cruz is being played out as a grassroots hero on right wing blogs as much as his critics say he deserves to be ridiculed because he can't actually change the process going forward and those critics would also say that he's painted himself into a corner and this is his attempt to prove that it's not fruitless. >> right, so he's following through to prove that he can follow through but in the bigger picture, kasie, especially for
5:35 am
the republican party, what does it mean that there are other prominent republicans against h him. >> at this point it is a gop bloodbath. they're trying to argue behind the scenes this is an argument over tactics and not strategy and says everybody wants to defund obama care but the reality is they're really split on this and even senator rand paul who stood on the floor earlier with cruz and who says that he plans to vote with cruz on these key procedural votes coming up this week, still stood up inside a private meeting and backed senator minority leader mitch mcconnell's proposal to do this a different way and rand is in a particularly difficult spot because he falls into this conservative grassroots tea party group on the one hand but on the other is one of the most vocal supporters of mcconnell's bid for re-election and mcconnell, rand's support for him is very important to him. and it could affect him in a primary against businessman matt bevin. >> kasie, get some rest.
5:36 am
good follow on twitter @kasie and live tweeted the thing as much as she could stay awake. president obama bringing in one of his most powerful supporters to help sell his signature health plan. former president bill clinton. hillary introduced the two former presidents at number 42 and number 44. setting off speculation that the moment may prove to be historic with number 45 there on stage, as well. maybe someday. a q&a about health care between the two commanders in chief quickly turned into a sales pitch for the affordable care act. >> what does this mean? how will people get involved? i'll give the president a chance to talk about the good stuff. in the last three years just since we started doing this inflation and health care cost has dropped to 4% for three years in a row for the first time in 50 years.
5:37 am
>> what you've this is an unprecedented effort you've seen ramp up over the last month or so in which those who have opposed the idea of universal health care in the first place and have fought this thing tooth and nail threw congress and the courts and so forth are -- have been trying to scare and discourage people from getting a good deal. what we're saying to people is, look, go to the website yourself. what we are confident about is when people look and see that they can get high quality, affordable health care for less than their cell phone bill, they're going to sign up. >> let's turn our attention overseas now. the tense four-day standoff at a mall in kenya appears to be over. today the first of three days of mile-per-houring for the victims after kenya's president declared victory. he announced five members of al shabaab were killed, 11 other members were captured.
5:38 am
>> we have ashamed and defeated our attackers. that part of our task has been completed by a multiagency security team. >> security forces are still at the mall searching for additional victims. now, the latest death toll at 61. government and six -- excuse me, civilians and six government troops on top of that officials fear they could find up to 60 more victims. take a look at some exclusive video that nbc obtained of the moments after gunmen stormed in terrorizing the shoppers. "the new york times" reports al shabaab hatched this plot weeks or months ago in somalia even studying the mall down to the vent lakes ducts on the blueprints and recruited english speaking fighters to be part of the attack and plant ed weapons inside with the help of an employee. an american survivor is back home this morning.

bendita mallika was tearful and she's still coming to grips with what she went through. >> you would hear the feet and then you would hear some talking, some other languages, sometimes you would hear like ran democrat things like muslim, christian and hear like random things, and, you know, people would respond or scream don't shoot and then you hair some walk and some get shot. >> incredible. to the united nations where president obama says the u.s. will begin high-level negotiations with iran on its nuclear program this week. he voiced optimism over their new tone for a diplomatic solution but did admit possible roadblocks may be too great. >> i don't believe this difficult history can be overcome overnight. the suspicions run too deep. we should be able to achieve a resolution that respects the

rights of the iranian people while giving the world confidence that the iranian program is peaceful. but to succeed conciliatory words will have to be matched by actions that are transparent and verifiable. >> later in the afternoon, it was president rowhani of iran who took his turn staying talks were possible on equal footing but that his country would insist on its right to enriched uranium. >> translator: i listened carefully to the statement made by president obama today hoping that they will refrain from following the short-sighted interests of warmongering pressure groups. we can arrive at a framework to manage our differences. let me say loud and clear that peace is within us. >> a lot were seeing whether the two would shake hand, speak to each other or do anything to

the s&p 500 dipping below 1700. the concerns about the fed and a possible government shutdown in d.c. all continuing although the nasdaq was slightly higher. steve sedgwick live for us. >> there was one big deal. $29 billion merger between applied materials and a japanese company as well. very important for the semiconductor sector. everyone is worried about that debt ceiling breach. amazon keeping the pressure on apple and ipads. jeff bezos' group got a whole host of new devices. and an 8.9-inch kindle for $379 and get an 8 megapixel camera on that and mayday support system, as well. so jeff keeping pressure on apple saying it's not the money they make out of the devices but selling services they're after which is the key for amazon. elsewhere, incredible comments from robert benmarsh.

he's saying some of the criticism labeled at the bonuses paid to the financial industry post the collapse of aig and indeed the broader sector. he said this was intended to stir public anger and get everybody out there with their pitchforks and hangman nooses. i think it was bad and it was just as bad then as it is now, as well. he apparently has regretted some of the phrasing after criticism from social media and regulators, as well. >> yeah, and merited by the way. quickly, martha stewart, jcpenney, is that over? >> it appears so. not only is macy's in the courts with jp penny about whether they can even use the name, the deal struck by the previous ceo ron johnson, this ten-year deal virtually being scrapped it looks like because the martha stewart bath and bed linens have been replaced by liz claiborne brands and other in-house
