the occasion of the ninth anniversary of the printing of guantanamo bay connie bush thanks very much for talking to us now you've recently come back from guantanamo bay tell me a bit about what you saw there what the conditions were like unfortunately we no longer meet the prisoners in the camps so we don't see the conditions in the camps any longer what we do is meet them in a separate. holding camp whereby were brought in the detainees are brought in separately and we meet in trailers. so what we know is what we hear from them and what the conditions are like. unfortunately there is a lot of building work is going on in guantanamo right now which leads us to believe that it's nowhere near closing as obama would have promised back in two thousand and nine when he took office the fortunate. the men say that everything has improved conditions have definitely improved since two thousand and five which was probably the worst year for the men there and what reason are you

been subjected to in guantanamo bay it's been truly shocking i'm told that waterboarding and other forms of torture have you met people who was subjected to these forms of interrogation absolutely these these methods of interrogation the enhanced interrogation techniques as they're so referred are not are not the did not happen to the minority they happen to the majority so what happens is you get instructors who are interrogators and guards for the trained in these techniques that are actually used in military training. to help army men and women resist interrogation being used on these men in guantanamo bay so the majority of our clients have had at least one of these techniques used on them and. what do we know about the effectiveness of the reliability of the information that. well we

know about you can't rely on this information you can almost get a person say almost anything you want them to if you're torturing them and having them await forty eight hours seventy two hours. we know this from men and women who have undergone this training in the army we know this from men and men who have been held in camps in communist countries and say the vietnam war . you'll say almost anything under torture just to have the torture and what does reprise make of these methods of interrogation from a legal perspective while they're illegal under the geneva conventions the geneva conventions afford prisoners of war the right to be treated humanely and without degradation these treatments obviously do not do not. stand up to this standard of treatment. it is illegal but unfortunately in two thousand

and two after the prison first opened george bush declared that these men were not prisoners of war they were enemy combatants and therefore did not fall under the geneva conventions we still hold that this is a legal and if it's not illegal it's completely immoral anyways what's morale like among the prisoners that you've met recently the men who are still there are obviously tired they're depressed they're withdrawn. we try to give them as many updates as possible about men who have been released. but sometimes it's only serves to make them realize what they're missing a lot of the men feel that their lives are passing them by while they're stuck in this prison but at the same time do not want to return back to their home country because their. persecution airports are so they are kind of in this. limbo where they don't want to go home but they don't want to be in want ton of any more they've spent eighty. nine long years there that in that's their life and so

it's just passing them by the one hundred seventy three prisoners left in guantanamo bay what are the stories give me some examples of what some of the most opposed to. a lot of them are ridiculous charges so a lot of our clients are facing a charge that's listed on their combatant status review tribunals and their administrative review boards as as for instance running away from the incoming northern alliance well that's because the northern alliance is bombing the cities they're in so obviously they're running away from the bombings and the conflict that of course is now being held against them as a charge and holding that up to say that they're terrorists. you have people who have lost their passports or are on forged passports for asylum reasons . and this is being held as as proof as they're terrorists so it's

a lot of different charges you have associations which in in laws not supposed to convict you is not a sign of guilt but it is in their cases what's the purpose of your work there and do you feel that you are able to sort of progress towards your goal to make a difference our goal is obviously to find a safe home for every man and get them released from guantanamo. unfortunately we keep it we keep getting walls for instance. we've we've always held that people who won their hadiths cases about it is people who have been declared by the courts that they've been held illegally that they would not be returned forcibly teaching it to countries that will persecuted torture them that they have a better chance of being resettled in a third country that will offer them a good new home unfortunately on thursday a far far he who is a devious one or was just forcibly repatriated to algeria so that's just another

detainees brought into the united states but without that he's got nothing to do. as for the future of guantanamo it's looking less and less likely that it will be close in time in the future. on thursday he signed a he signed the national defense authorization act which is for the fiscal year two thousand and eleven which made it harder for detainees to group brought to the united states for civil order for criminal cases and that's just another roadblock in his closing the camp it is a tricky issue there isn't it because a lot of these prisoners have literally nowhere else to go they fear of persecution if they're sent to their home countries and any country is on willing to welcome them is that an issue that's moving forwards or backwards it's going backwards unfortunately. a lot of the men do fear persecution and torture in their in their

home countries a lot of the european countries have offered homes to at least one of the men usually many more so they feel like they've done their part it is a costly procedure to bring men to and to a new country and get them settled and give them language classes. without the united states doing so the european countries have decided that there have come to the realization that they have to be are all their responsibility the same national defense authorization act signed on thursday has made it. that much harder to resettle. resettle men in their countries because it made the loops much smaller to jump through for the for the government to send them to different countries we talk a lot about closing guantanamo but at the same time it is at least a detention facility that we know about isn't there a fear that if it was closed detention secret detention would just go underground that is a worry but that is a worry whether or not one tunnel remains open. united states has used underground

prisons for years and we know of these. to transfer men to and from before they go to guantanamo they're held in secret prisons. or only just finding out about some of these prison impacts that were used years and years ago. in the united states of course that's changing is it's m.-o. in secret detention it's doing proxy detention. instead of secret detention so you're always going to run into about whether or not kuantan a moe's open and we've been hearing more and more reports of secret cia facilities in europe do you do you know about that. there are ongoing investigations in many of the eastern europe countries for instance in lithuania last year there was a parliamentary inquiry which found that there were two secret prisons in the country. that held back the secret prisons were probably not used however there is now
