cases of child pornography eight iowa species to keep more data on their customers now nobody wants to stifle child pornography investigations but if passed this would affect all of us so what would it mean for privacy when you're discussing with music. and randy associate director of technology studies at the competitive enterprise institute brian thanks for being here but let's first start you know with why law enforcement considers this a problem i mean in the meantime every i.s.p. has their own policy right some keep this content for days some might keep it for months there's no formal rule that's correct right now internet providers vary dramatically in terms of how long they retain this data but by and large the data is retained for a period of several months law enforcement does use it from time to time not all providers do retain this data however which is what the law enforcement has urged congress to revisit now why would a nice piece want to retain this data to begin and i've heard a lot about that is just actually just too expensive to keep it forever it is

actually quite expensive especially for smaller providers remember the amount of data we're talking about here is things like what internet protocol address is affiliated with which customer also devolves into which websites you visit take that for every customer time six months you have to have a server back it up have available for law enforcement is not cheap and it's actually pretty good and some pieces which is why providers don't like the idea of a mandate of the federal level now if the government you know if they do go ahead and pass this legislation that they're calling for here do we know any of the details you know how long are they going to require i a species to keep this data what kind of data is it going to be you know is it only ip addresses or could it could it go further is it only going to be i s p's could it be other like e-mail services that's a gray area the department of justice official who testified this week talked about why don't you data retention but he didn't give any specifics as far as what do you want for some community wants congress to do that's troubling to me because if they

go too far they could really have a stifling effect on free speech you're talking about not just in applied but coffeeshops libraries even email providers social networking providers there's a lot of data that companies could be forced to retain and all that data sitting on a server it's right for identity. it's ripe for hackers it also makes americans uneasy about using the internet for things that are sensitive which a lot of people use not nowadays for all the nation things like that let's talk about the way that they're going about doing this too right i mean even the title the way they use it here is data retention as a tool for investigating internet child pornography and other crimes you know i mean i feel like that they use this a lot really we see in law enforcement you know protecting children or child pornography to pass a lot of measures that are incredibly and basic and who's going to want to look soft on child porn who's going to want to say no to protecting kids online i think that's exactly right politically speaking it's difficult to be against the children

and certainly there are in the crimes involving children that we should be concerned about where this data could come in handy but there are a lot of other internet crimes that the department just want foresman mention in their testimony things like drug trafficking hacking internet gambling so law enforcement wants this for a wide range of reasons of course they feel the most politically expedient reason is to protect the children which is why they're pushing this mandate that i think in other contexts lawmakers would view is far too intrusive well that's what i'm wondering this has been brought up before it was brought up during the bush administration but if it's only about keeping the children safe. and catching those who make child pornography doesn't actually have a chance of passing it's unclear but the fact that republicans now control the house doesn't bode well on this issue it is interesting to note that back when democrats controlled the house last term when they controlled the judiciary committee in the subcommittees they didn't have a hearing on this topic in fact the democrats on the house judiciary committee were focused on reforming privacy laws so americans have greater privacy now the

republicans are in control instead of trying to limit government intrusions into our private lives we're seeing them invite the department of justice here to discuss expanding the master valence to me the greater extent which is very troubling to me how might this. in fact also you know international business i mean do you think that her hopes foreign companies aren't going to want to work with american providers because i mean there's a lot of you know european countries that look at privacy in a much different way that aren't so easy to just give it all up as companies are here in america that's a serious concern wouldn't the united states over the last decade has passed laws like the patriot act and other bills that require more data retention more government access to data foreign companies are rightly concerned about doing business in the u.s. all with companies that have u.s. based servers so american businesses thriving american businesses like sales for stock comp for instance have heard their foreign customers and customers say we're a little worried about doing business we're not sure what the u.s.

government can have access to in fact the european government had a similar directive on data retention but it was actually struck down by the high court of germany which shows that there is some realization on both sides of the atlantic that data retention means people are not going to be as comfortable expressing themselves online which means companies are going to want to be using services where they know government has access to that data and at the moment like you mentioned earlier a lot of people are comfortable using services online and you know doing whatever they need so what kind of implications would it have you know if for you and me what i did what i wanted to do i'm a normal person i don't like a child porn you know on the internet that now i might worry the government might get their hands on it through the uncertainty involved here people use the internet of course for basic things their twitter their facebook but people store emails they store health information people use it to communicate with their doctors people google health related issues mental health related issues a lot of people do things on the internet that they perhaps don't want government having access to and when all this data that the department of justice is considering trying to get congress to require drivers to retain is sitting there on

the these servers the government can access with a court order that's not hard to get people just feel uneasy there's uncertainty about what information government can access and as we as we've discussed before with all the laws on the books and with the ever increasing eagerness. to get its hands on our private data i think is a good reason to be concerned that this data could end up in government sounds or as i said in the hands of hackers or identity thieves who can break into a provider's servers if the security is not perfect now i definitely don't like the sound of it definitely you know our minds are to what happens in this internet day and age when you do everything online ryan thanks so much for being here thank you . now still to come tonight for your safety the t.s.a. is banning another item that you can't bring on flights you know probably to roll your eyes and we'll tell you about this one then the defense department is trying to stop a bias when it comes to their intelligence analysts find out their latest plan to help train those analysts by using video games that system is richer.

they were stopped by security they were ordered to remove the little guy the soldier was carrying because it's considered a weapon that three inch plastic a rifle the toy soldier was carrying is a threat because even though it's the size of a pinkie. and it doesn't do anything it is still classified as a firearm and firearms are banned on planes now there is a ray of sunshine in this otherwise ridiculous story the couple did get to keep the toy gun but they had to break it off have it mailed back to their home in ontario because they couldn't go on the plane with them because as i said this was classified as a threat to security just let that sink in for a second i don't think anybody can still be in doubt that airport security has gone overboard so it's just another example of the paranoia and outright stupidity that we have to endure to fly safely in the skies. now these days with

the military operations the us is waging all over the world intelligence is key but time and time again we've seen what happens with bad intel lives can be lost wars can be waged over the wrong information how about the negotiation with the senior taliban commander who turned out to be a fraud and of course who could forget that whole weapons of mass destruction myth that got us into iraq so now it turns out the department of defense is trying to deal with inherent bias in intelligence analysts that can lead them astray so they're depending on video games to fix this problem the intelligence advanced research projects agency announced this tuesday that they're looking to gather potential developers for a serious game initiative to create games that will help analysts study and learn their prejudice but how serious really is this bias problem joining caught up with jack rice former cia special agent and criminal defense attorney and i first asked him to tell us from his experience working with the cia how large

a role he thinks spies plates and analyzing intelligence. you know actually it's absolutely massive it's huge in every sense of the word if you look at the. new iraq with weapons of mass destruction you sort of almost anything that we do you need. more than anything else is objective understanding of analysis and if you have bias what happens is it drives you to have a certain path which may not be true and while you may want people to say this is what the american or if you will is we need to be able to understand everything so we come to the right conclusions if we fail of that effort then the intelligence community is failing overall that's the last thing we want to be doing but there are of course you know and there lies the irony in all of it too is that when the cia or the military wants a piece of intelligence gathered they're probably doing this with a certain mission and mind so if you really put objectivity into the picture then suddenly you know whatever you're trying to prove that mission might no longer be

valid. you know i think there's something called american exceptionalism which this idea that america is the best right and the problem that frequently comes with that is america is the best simply because it's america we've seen this again and again and again but what happens when you have that for you is that it simply doesn't understand the rest of the world very well it gives you a very narrow view and it gives you an incredibly strong bias the problem it is is frequently the intelligence community actually recruits people who have the american exceptionalism you point so they try to turn around and say ok we know you have bias but we're going to try to teach you to not have bias good luck with that . well so then do you think that you know this is an honest effort that they're making here with this new gaming initiative or is it also just not fair to the you know spend some money try some new games play with them new toys. you know i wouldn't be too cynical about it i actually believe they are trying to be less biased because let's face it this is

a fact they need to be they must be the failures of the parents have been obvious they must make changes so they have less bias they know that's true so i do think there is a legitimate effort the real problem again is that when you bring in certain kinds of people and the people who. already they are trying to figure out who the next group of people the next batch of people are coming in will be just like them that's part of their problem now and you try to change it right and say well we want your bias but we don't want your bias what do you or don't you i guess we'll wait and see just how successful they are i mean and you know let's talk about some of the bad intelligence or poor intelligence decisions that have been made in the past that really have you know altered the course of history could say that that started entire war as you mentioned you know the entire weapons of mass destruction match when it comes to iraq but what else is out there that you're aware of well i mean a perfect example is what's going on in afghanistan and we've you look at the bias one of the c.d.'s that we have is that we are the most powerful country on the face

of the planet in the history of man telling we can dictate we have the ability anyplace on the planet to control the lives of everybody else and they will fall into line on a slip that is a bias and so we decide well look at logically who would stand up to us when we know we can kill anybody that we want to jed we speak it well look at what happened in afghanistan and yet if we hold back for a second the romans would have the same arguments you know centuries ago the brits made the same arguments twice in afghanistan the russians made the same argument when it came to afghanistan alexander the great made the same argument so when we talk about bias it's a perfect example of how we see the world when sometimes it doesn't reflect the true reality and so what they're trying to do now to combat this bias is of course you know you kind of modern technology create games was that something that when you were in the cia did you have to play a lot of games and video games you know was that something that was normal. well

they didn't do it so much and i mean it's certainly more logical and it actually does make some sense i mean this was sometimes done on a face to face real life sort of way where you would be talking to be to try to get a better understanding and so this was always something that you tried to do and it is absolutely critical because if you're an analyst or whether or not you're a case officer or a field guy either way you need to have a true understanding but we have seen this failure now for decades when they simply don't get it if they don't figure it out now sadly we're going to spend millions know billions of dollars more there will be more lives lost and i guess in the ed we're not going to be any more or maybe even less stable than we are now and i don't think anybody at least in the u.s. wants it when it's really incredible you know i mean to put how much pressure i guess they're putting on these gaming devices to see if they can really fix all of our biases and it comes to intelligence out of our biases when it comes to war you know there are some other interesting developments too i know they're using the

game second life to help soldiers combat p.t.s.d. video games are something that we see almost in every industry now who knew that they could be therapeutic as well as educational tool if you think of this might change the the perception of videogames to give them a little boost you know it might it's actually pretty astounding is that i mean you realize this is also generational i mean this is change because there are so many of us who have actually grown up grown up gaming they started out very young my children have done the same thing and so for them it feels very familiar it's something they grew up with it's something that they understand this really as well as it will actually so the idea that you would use that now for a positive step is i think a really good idea and it may actually work i've had some experience talking with some soldiers i've been to a lot of war zones in my career both iraq and afghanistan and i've seen p.t.s. the very up close and personal if they can find a way to use that technology to help these hundreds of thousands no. billions of
