a new policy when it comes to deportations of undocumented immigrants according to homeland security secretary janet napolitano the cases of three hundred thousand people currently in deportation proceedings will be reviewed on a case by case basis or the goal of providing relief to those who are in the country illegally but who pose no threat to national security or public safety and many expect young people those who were brought here as children and grew up and went to school in the country and who would who would have been helped excuse me by the dream act which failed to pass last year they are expecting those people to be at the top of this list see if we look at obama's record thus far last year almost four hundred thousand people were deported and while the claim is always been that they focus only on the worst of the worst the statistics prove otherwise only half of those reported were so-called criminals seven percent were based on traffic violations twenty three percent were drug violations fourteen percent drunk driving violations so this new move is a welcome one for those fighting against tough deportation policies but is it enough how many millions will still live in fear without comprehensive immigration

reform and joining me from our studio in new york is immigration attorney michael wildes managing partner at wiles and weinberg law offices mike i want to thank you for joining us tonight and for starters or you i'm good thank you let's start with the legal aspect here right so three hundred thousand cases which are already within this deportation process here are going to be reviewed on a case by case basis what does that actually mean are these people already in the system it's not like they've already been deported there in the court system. this is merely a band-aid on a cancer alone there better eleven million plus people here in the awfully there are seven thousand ice agents about two hundred something immigration judges not enough airplanes and coughs or beds to house and deport these individuals and this is merely a band-aid on a growing cancer it's an affront to law enforcement who worked very hard to get those three hundred people into the system to say we're going to be lenient and

it's really a lot of hogwash to believe that they're going to give this entitle me to the dream act candidates even one district director i think in atlanta said earlier today that they're going to ignore it as far as they're concerned it's business as usual in the going to deport people as handily as they need to four hundred thousand people were deported in the last two years the president does not have enough initiative officers or resources to remove the eleven million plus and we're going through in the extraordinarily excruciating economy where these individuals not only contribute billions of dollars on to the tax role in the treasury but help remind us of the very d.n.a. that made america special and that is our immigration heritage now why do you think it is that the obama administration announced this policy now i was just ranting the other day about the fact that there were protests across the u.s. protesting about his deportation policy protests in a secure communities program and nobody was covering it and the media but does this mean that the obama administration actually paid attention because they are

protesting in front of his campaign offices. i'm a i'm a former federal prosecutor a former mayor and a democrat and i'm disappointed democrat in this administration and particularly on this policy the government now says they want to clear the docket from the traffic resources and focus on getting hardened criminals and felons out of this country no this is not the right message to citizens and law enforcement with our homeland preparedness in jeopardy and our economy held in the bands were immigrants can contribute from the hospitality to the agricultural hubs this is the wrong way to cure the deafening silence in washington i'm about ready to teach immigration law in a law school where my father taught for thirty two years and i'm a second generation immigration lawyer we all know that the powers vested in congress and just because they can't get their act together for politics doesn't mean the president should be excused on the eve of an election to put

a band-aid on this issue certainly not when he goes to you know he goes to challenge governors and courts saying that they have no right to protect their financial treasuries and interests because it's a federal issue and then when given the authority does nothing again let's put the camera on the on the subject here we're talking about three hundred thousand people in the system the leniency that they're promising is nothing more than cosmetic and it's not going to address the porous borders we have the fact that we have a departure system that is broken and nonexistent and the fact that students clerics diplomats and others have guys themselves historically and have insidious terrorist cells in this country still a decade from these attacks where are we in this war on terrorism where are we on treating people you mainly they've removed people over traffic stops you have no idea how many times we get phone calls in the middle of the evening from a wife or a husband who's stopped at a red light is this what america is like these ice officers these customs border

patrol. are in jeopardy their lives are in jeopardy with drug cartels in the southern border and all sorts of other challenges that they have this is the wrong imperative for them to europe and the wrong cure to a broken system i'm just curious though so you mention of course of the power here lies within congress right we're still waiting for a comprehensive immigration reform to come from congress but the interesting thing is is that when the dream act was being debated last year in congress the president said that he had already used all the administrative powers that he had and yet here we have what seems to be an administrative power where the president just goes around congress and announces this new program how far could he actually take that if he wanted to i mean you call this a band-aid but how much could he do on his own. excellent question you know the president and congress have the capacity when. japan and haiti before it had all sorts of natural calamities to give authority to individuals the president and

congress each have authority in the immigration act with the operations instructions the foreign affairs manual through its agencies through u.s. c.i.s. through state department to issue all sorts of relief to the millions upon millions of people that are here i'm not advocating for amnesty we don't want to create the next generation of people that will ignore laws because we are a nation of laws but we have to remind ourselves that the tools that are available to our president to our congress should be used and right now there is a debate between the two of them where they're kind of not being each other in the eyes rather than doing the people's work and the reason they're not doing it is politics and that's the reason on the need of an election we're going to appear lenient but these officers these well intended law enforcement ice agents and otherwise are now getting mixed directions from their commander in chief and that again is a bad message when we have a war on terrorism afoot and economy that's fledgling and a great tool in our arsenal that would help us on both fronts and that is

authority shutting down cell phone service proceeding a planned protest to supposedly keep commuters say this is all a sure sign of where things are going it's a very good indicator of how of the result react to what they consider public disturbances and it's a threat to freedom of speech to the freedom of assembly and of the ability to communicate what's most disturbing here as it is being done in the same countries which just months ago berated leaders in the arab world for doing the same thing what egypt or tunisia shut down social media as their people rising up it was considered an affront to democracy our secretary of state gave speeches launched initiatives worth millions of dollars to create programs for those dissidents to be able to circumvent the restrictions put in place by authority to leaders the freedom to communicate to organize on the internet those are spoken about as universal rights and yet when people use the exact same tools to either organize for riots in the u.k. or for peaceful protests like they did in san francisco suddenly the same tactics

those dictators used those became ok now the truth is yes technology can be used for both good and for bad for riots or for peaceful protest but it's become more reliant on these tools governments or law enforcement they're going to take it upon themselves to decide when it's good and when it's back forget about overarching principles this situation or that situation will be considered different they'll be an exception but exceptions dangerous precedents exceptions are the first steps to an erosion of civil liberties and we've already experienced this firsthand and here in america over the last ten years nine eleven has been used as an excuse by the government to systematically strip us of our rights and create. exceptions in emergency situations and the fear of our national security being at risk to pretend to make it all ok how about the patriot act how about the obama administration's continuous push to make warrants court orders i think the past they don't want them to be necessary when all thora to strap a g.p.s.

a that's not that kind of an answer for rick perry in the state of new hampshire in a republican primary this is a southern governor who has very conservative beliefs so i don't really see that as a gaffe he sort of laid it all out there and said you know we let people decide which is not saying i don't believe in evolution i mean i think he's pretty careful there in came out ok because you work on the campaign trail all decide if you were so cynical as sitting here in this studio and you're you're better at monitoring these things and how they're going to be perceived on the campaign trail i mean i have to say when i was in iowa a lot of people talking even though rick perry wasn't even there a lot of people saying they really perceive him as the front runner and he is playing to his base a whole lot of people you know believe that creationism is the right answer i think he was careful i think it's interesting too to see sort of what happened as a result with jon huntsman coming in thing i believe in evolution you know like well we actually have jon huntsman what he tweeted there and shoot i totally didn't

write it down but let's put it out on the screen to be clear i believe in evolution and trust scientists on global warming call me crazy and that to me is what really i understand all this playing to your base but it's actually scary to me that he's the crazy one of the bunch because he actually believes in evolution and believe scientists on global warming i mean look the world i mean it has been obvious though at the debate talked about how being in favor of civil unions obviously he is a voice that is not playing you know to the ultra right wing but it's an important voice i think nonetheless he says hold that jon huntsman is trying to be the grown up in the room when you will bachmann screaming you know rick perry saying these thing. he is trying to be the grown up republican the back and win the general election the problem is that is not what the base the people that give money and vote want to hear from their candidates they want to hear the most harsh red meat rhetoric that says we're going to take down obama so that's where you see john how about a two percent love how do we do it you know i do not agree with me here the fact

that people don't want somebody who believes in science to the president of their country i think that's a problem the fact that media organizations are describing john huntsman as the maverick maverick for believing in science that's been confirmed to be at least the last hundred years you can toggle evolution as being like a theory that the all scientists most scientists ninety nine percent except for maybe there are some random people that decide to mix evolution does that mean creationism that they ascribe to and that might be the problem but you might be right that that would be the problem republican party has if they nominate a candidate that is so far outside the mainstream of americans in the general election of matter how bad the economy is they'll go with obama let's really quick just play our last clip here this is something that was overheard being said to rick perry. thank. you. another problem you could say in politics there's just too much money involved here's a guy that goes from bank of america we've got your back we'll help you out i think

this is one of the most scathing examples that rick perry is going to have to deal with moving forward i know it seems crazy but both sides left and right keep saying you don't want somebody in the white house that's too friendly with large corporations and bank of america one of the most corrupt one of the largest corporations and here's evidence well you're going to call me a cynic on the campaign trail but i think this is very innocuous and not a big deal people get to sit here the one that's just like i would say you know when you realize they do more work for someone for a president or a bank or an interest group all of that we're going to help you out i mean there wasn't any promise of money if you read the whole statement the bank says we want to you know we're talking about policy is bank of america going to give to rick perry probably but they give everybody these banks you look at campaign cards you get are going to obama to do so to me that this was i think when you see i think i sorry but no but it's true they get to everybody and if you look at the new super committee republicans and democrats their biggest donors always have been the banks thanks for joining us and thanks for tuning in tonight and make sure to come back
