getting screwed by state by the deputy attorney general of the united states james cole read a combination of a.t.m. t. and t. mobile would result in tens of millions of consumers all across the united states facing higher prices fewer choices and lower quality products for mobile wireless services as lawsuit seeks to ensure that everyone can continue to receive the benefits of that competition. he was willing to drop thirty nine billion into the buyout and not too pleased with the department of justice is the city to file suit against it releasing a statement today saying we are surprised and disappointed by today's action particularly since we have met repeatedly with the of a justice and there was no indication from the d.o.j. that this action was being contemplated to d.o.j. has the burden of proving alleged anti-competitive effects and we intend to vigorously contest this matter in court so is the agency t. and t. mobile merger dead or is this just the beginning of the fight joining me now is some more insight into this issue as matt would say director of free press dot net net welcome back i thought i read i'm going to have you with us. why the lawsuit

what's the strategy here is the first order this track back to the sherman act of eighty one the sherman antitrust well it has its roots in the strawman act also the clayton act and this is a violation of section seven of the clayton act if you want to talk nickel that is the great act it's another any trust that you don't there's particularly one section that says that actions that would substantially less than competition in their state in an interstate market such as wireless telecommunications can be blocked by the department to whatever it was their claim back to pass i think it's nine hundred fourteen although i would want to be quoted on it it was back during the rest of her yeah basically a follow up to the sherman act that gave the o.j. and the stage more power than the term and i give them and made it worse because i mean the sherman act was like two paragraphs it was very very very big right and they've gotten progressively more detailed as time has gone along and businesses have taken the more sophisticated combinations that b.o.j. sometimes investigates and this case tries to block. will this ultimately be decided by the by the d.o.j. or apparently the f.c.c. has been sidelined of this one. i don't think that's quite fair the o.j.

has to not sue as they've done here they can sue to block the merger and yes he also has to approve the merger and there are the burden is in fact on a team t.v. so it's a little different from what he described for the department of justice situation the o.j. has the burden in an antitrust suit but he has the burden for the f.c.c. they haven't been sidelined but they can choose to approve or not kind of based on what the o.j. does are based on their own analysis and they're of course reviewing the deal as well as the as he sees the d.o.j. scripts here is what's best for competition what's best for the public good what's the f.c.c. scriptura the f.c.c. the criteria is even stronger and some sense it has a higher burden phrase you have to show that the deal is in the public interest and they've said all along that it is and organizations like mine at free press and others and frankly a lot of companies as well if said it's not in the public interest that it will do all those things that today the department of justice said it would do less in competition and raise prices the crease innovation hurt consumers and kill jobs well. any sense of which way this is going to go well i mean us in the beginning if

it is dead now because of the o.j. thing that's actually i think that's a bit premature but this is definitely not a good sign for a t.n.c. they can and they will fight this and they will go to court now the funny thing is the united states and now the plaintiff and entrust lawsuit and so they'll be suing to block this deal eighteenth he can defend against that but he has an uphill battle here and i wouldn't say it's dead but it certainly is a big blow to them i think the interesting thing is eighteen and he's saying we didn't expect this and that made it basically send a signal that the o.j. was not negotiating with or this was kind of in their mind a very open and shut case at some point and they decided to block to sue rather than negotiating with agency and with a mobile one of the more cynical. commentaries that i read today on this and there are a few in this day and age there's no shortage of these right on all sides on all the issues was that both the f.c.c. and d.o.j. work for the white house you know the executive branch is charged with very extreme laws created by congress and this is an election year and president obama needs a billion dollars and of these companies are big and they make big campaign

donations and therefore you know or against it might there be an element of politics in this and is it possible that the white house could settle this deal unfortunately there is no i'm not politics we think however in this case the facts have won out over politics d.o.j. it's not really cynical to say they work for the white house they do the partner justice because it is an executive branch agency the f.c.c. is an independent agency although they do have some discussions with the white house but they are not supposed to coordinate with the white house eighteen he has tried to make us about politics they've spent tons of money on capitol hill as they always do both in campaign contributions and in lobbying expenditures trying to get people who don't really have a final say here members of congress for example to say this might be a good deal we've seen some members of congress take the bait on that but fortunately most of them have not waited and now we think that what department of justice and this is anti-competitive those members of congress and state governors and those who have kind of get their toe in the water about the benefits of this field should be much more skeptical and say wait a minute you know we can now see that the emperor has no clothes hair and that this agency deal is bad for america we have just a minute left this morning and i started my day in las vegas ok and in the airport

able to pay co-pays and they're not able to pay deductibles so they're not required getting the care that they need they're not going for procedures which means when we see them things that could have been preventable are not preventable and we finally said you know it's time instead of looking at cutting programs that basically support people in. time when they're desperately in need of help we need to look at someplace else and one of the strip places we need to look at is wall street and the fact that they're the ones that cause this we can't keep pointing the finger at each other we need to point in the place where it really started and it is wall street and looking at it came clear but you know went with a small tax to wall street we could basically be putting as much as three hundred fifty million billion dollars back into our programs to support the american people when we get people back on the feet and provide jobs you know you're one of the few groups is telling the truth on this it's it really and truly is astounding kevin phillips the go back in the sixty's i think of it really seventy's wrote the emerging republican majority all the republicans loved him he predicted they were

going to. wrote several books the most recent it was bad money about how we have gone from financial services in america being basically a nice boring business of how people buy houses and finance cars and made a nice predictable little two percent bankers were banking hours and you know had a nice home in the suburbs and that was it was we're going to thirty four percent of all the profits in america last year for american industry i mean that's that's what it used to be manufacturing may have actually done to eleven percent. they have wiped us out and they're continuing to wipe us out but one of the ways that they were so this was super high frequency trading zillion trades a second computers and if you put just a tenth of a penny tax on each one of those things that's like throwing sand in those gears is that the kind of thing you're talking about doing well actually they looked at as this is not a new thing this is not something we did this come from this forty other countries that are also doing this great britain has already is transaction takes place.

great britain has it there's other countries that have it in now we're looking at germany and france the european countries are now looking at this very closely as well it is a very minuscule when you think of the trading that is done in the money that exchanged hands it's point five percent would be just you know even now looking. and calculated again it would be somewhere around three hundred fifty billion dollars put back every year into our economy to be able to help keep these programs going get people back to work help with housing help with those that are you know have no jobs have no help here and support all these things how can this be wrong i mean you know again it was based we supported the wall street back up and running it's now time for wall street to get the russian people out here and this is exactly what. we're trying to trillion dollars in. care and the details of this exactly what you what are your clients who are coming days well tomorrow is going to be a great day and we call it a day of action basically what we're doing is we're visiting sixty representatives

that's right when pressed by constituents about his party's plan to privatized social security and handed over to the wall street banks traders grassley brushed it aside and said he only knows a one member just wanna lose candidate who he won't name who wants to privatize social security he doesn't want to name names because he's that one guy back in two thousand and five as chairman of the senate finance committee grassley spearheaded an effort to privatizing social security to thousand and five new york times article documented grassley efforts writing grassley chairman of the senate panel responsible for social security supports private social security. accounts grassley told reporters he would push for the private accounts even if a majority of the public does not appear on the idea and to quote george w.

bush who was present at the time support of grassroots efforts and later complained the failure of privatizing social security was one of the biggest regrets of his office. and six years later chuck grassley doesn't want to fess up to it but they did. but you know his constituents know that he was hustling the plan to sell off social security to wall street but you know you say oh there's one in oh no grassley isn't the only one as a think progress report on covered one hundred eighteen other republican members of congress like grassley gone on the record with their support for privatizing social security either through votes they've taken or statements they've made so when grassley said he knows of only one member who wants to privatizing social security he was either line forgetful or simply off by one hundred seventeen people but grassley is clumsy why speaks to a bigger picture here and that bigger picture is republicans are at it again since

coming out big in moving to midterm elections last year republicans took the gamble that they could destroy everything our nation has accomplished over the last century from the new deal programs like the minimum wage unemployment insurance and social security to the great society programs of medicare food assistance for hungry children and fema it's what bankers on wall street have been spending hundreds of millions of dollars on for years by and politicians like there's no tomorrow so those politicians will hand over social security and these other programs to them so the banks just can then skim billions off the top in profits but this is the first time social security has been under siege the worst thirty one nine hundred thirty five when you know when so security was first passed and republicans argued that the program would turn the united states into a soviet union. luckily the american people ignore the republican surtax scare tactics them and by the time republican dwight eisenhower was president the one

of florida who are resorting to creating wanted posters with pictures and personal details of people who dared to ask them about things like privatizing medicare and then passed out those wanted posters to other town hall attendees basically saying you know if you ask a question like that and i don't like you and i'll call the next poster and then there's people like chuck grassley who choose just a lot of their constituents a. he'd never private thoughts social security when he's been working to do that for almost a decade either way republicans are desperately trying to hide the truth about their plans to radically meet remake america by turning our commons and social safety net over to the bankers on wall street and the oil. and we can't let them get away with it so it's time to force those republicans who are hiding under their desks to listen and showing up to your congressman's district office call them son in law letters to the editor of the local newspaper emails talk to them on walker blogs get the message out that these right wingers want to undo the last hundred
