hello this is our t.v. good to have you company we have data if you will on our top stories tonight from moscow gadhafi loyalists are keeping up the fight in libya but the country's interim leaders are struggling to form a cabinet this is the french president could face a legal battle at home over his country's actions in the war. the eaves calling for calm over the ethnic tension that erupted when kosovo seized two checkpoints on its northern border with serbia it led to service locating the approach roads meantime belgrade's top to go see it is urging all sides to seek a diplomatic solution. and the palestinians asserts take center stage in new york
12:31 pm
at this coming week to try and secure a statehood recognition for the wide support they're getting could clash with a veto will the u.s. the world's key financial institutions an independent palestine will be strong enough to cope. and more on that then the head of that u.n. vote we've been hearing from the people making that call the key palestinian politician explains next why four member status will finally hold israel to account over its actions and occupations. archie sitting down with award winning scholar and internationally recognized politician executive committee member of the palestine liberation organization dr hanan ashrawi thank you so much for joining us today thank you and it's my pleasure dr charlie let's start with one of the most highlighted issues this year's united nations general assembly gathering of course palestine's bid for recognized statehood we know that palestine is already recognized by over one hundred twenty countries why does this u.n.
12:32 pm
vote matter that's very important because this is a turning point in sort of palestinian history and in the history of peacemaking in the region we do have as you said bilateral recognitions from different countries we have right now one hundred twenty seven but at the same time we are we have been engaged in a peace process that has taken on over two decades of prolongation and stalling with creating cracks on the ground building settlements in the laterally acting from a position of power as an occupier and undermining the chances of peace and the objectives of the two state solution and so on so we are trying now to say that this is a new phase a new era let's say we are going to the international community to say that the palestinian question and the palestinian people have the right to certain premonition and should be placed within this international context as the essence of multilateralism as the source of international global legislation and the
12:33 pm
palestinian question must be resolved in accordance with international law now the united states has made it more than clear that a veto is really it's only possible reaction to a resolution of the security council so are there really there are plans reported to that palestine we consider going through just through the general assembly is that really in the works well we have many different options and on term clips and we studied all of them and we're keeping all options open frankly. thinking because if we go through the security council directly that means we want the different objectives and we certainly don't want to have a confrontation with the us but they're the ones who are choosing a confrontation over something that is actually part of their own policies and that on the lead in suppose we could also go to the assembly and ask for upgrading of our status or greater recognition and then ask for support put out to go to the security council so what we're saying is we can go straight to the security council
12:34 pm
and deal with the consequences and if the u.s. wants to isolate itself with israel on the wrong side of the law it could be its choice or we could go in directly to the security council and also fortified by. the dissolution and that's an assembly and then again in the present but as i said that many many options and we're keeping them all out open like going through the security council going through the general assembly would mean a nonmember state status for palestine why would that be important that's very important because although we are now we have observer status as the p.l.o. and we want to have. a nonmember state status which means there would be a recognition of statehood but it's our membership that is an observer member short but that opens the doors for us to become a member of all u.n. organizations institutions agencies and so on it would and powers that i listed
12:35 pm
means it would also declare our territory occupied territory not disputed territory and therefore up for grabs it would declare its truthfulness occupied not as the eternally unified capital of israel for ever and ever and it would lay the foundations of any the solution based on international law so it's very important and we can also hold israel accountable which is something. that is the having is the u.s. absolutely insane when talking about accountability because they don't want any kind of accountability whether through you and human rights organizations like the un council on human rights or where the international criminal court currently national court of justice but i just want to ensure that israel continues to act outside going above the law you have mentioned access you want to situations if we look for example at the international criminal court access to that what kind of really impact would that have for palestine relative
12:36 pm
a tremendous impact because that means that the international criminal court can act in accordance with their own convention and bear arms that you described settlement activities as a war crime because when you violate the first duty of a convention when you move populations of your own into occupied territory and you take other people's lands this is a war crime a collective crime against the palestinian people so aftermath actually we can start a suit and law cases against not just the government even all settlers and it will be seen as being part of this crime and that's right quite worried about the palestinians becoming a state or getting access to the instruments of accountability particularly of international criminal court while in an interview with archie we had aired previously palestinian politician a bill shot said to us that it's released must be changed to be taken to paradise. on their way to peace who is strong enough do you think to forge
12:37 pm
a chain like. look i think. it's a modern power more than anything else. seems to me that if you can use your powers of persuasion for humanity for the israelis to understand that the land grab their greed for the land for control for subjugating and other people is legally a strategic liability for it it's. russian political legal human decision you have to think about the consequences of your actions but you cannot for ever claim to be above the law and claim to be exempt from any accountability and claim really impunity and preferential treatment that there is a time in which all these things will end then you will be held accountable like any other country and you can continue in slab and slaving at people whatever and getting away with it so it's a question of persuasion and looking clearly at the reality and understanding that given also the context of the arab spring given the context of regional and even
12:38 pm
global changes and transformations israel has a unique chance to make peace quickly with the palestinians and to be accepted in the region rather than continue with its unilateral dangerous adventurous policies out of control and got pressure on the left of land and so on and then. with the ball which is going to be further confrontations violence and extremism now if we look a little bit at united states involvement in all of this we know that last year barack obama spoke at the general assembly saying that hopefully by this year two thousand and eleven palestine will be recognized as a member within the united nations now his administration is clearly opposed to this do you see this is a stab in the back i see this as a source of commander sled down in disappointment because he theys the expectations and every right of ways starting with ending all settlement activities to acting
12:39 pm
decisively in peacemaking to basing all peacemaking on international law and multilateralism and to building the palestinian state on the sixty seven numbers so having it in then going on most all these things he has created a sense of letdown among palestinians the arabs even there were people of good conscience who expected obama to live up to his promises and to his values and principles. for interest. right now. if he's seen as doing israel's bidding and trying to justify the occupation and trying to justify israeli policies and actually putting pressure on everybody starting with the palestinians who are of course the weakest part because we do not have any kind of. thing so he can be seen as sort of not just bullying that palestinians but he'll be seen as weighing in on the side of an illegal situation and he'll be undermining the
12:40 pm
standing and credibility of the u.s. in the region and throughout the world other brokers russia the european union united nations have really of. what they're trying to do is very dangerous because the u.s. in many ways has changed its policy to accommodate this extreme government and not only that but it was trying to put pressure on the quartet to accept this position on the you and to the gate by saying the statements from both of you on the e.u. by asking them to change their longstanding policy on the street solution and so on and jerusalem and the legality of it and of course that has taken a very clear stance on the basis of international law palestinian rights including terminations so by adopting the israeli position and then trying to salvage the throat of the quartet the u.s. is is leaving the door the system and as a political system and run as
12:41 pm
a human and. achieving. what do you think americans and some european countries have been willing to welcome the arab spring and yet palestine determination is seen as something pretty much an acceptable by the united states in particular it is ironic this notwithstanding. look at the arab spring as a way of vindication. i have coached democracy and freedom and human rights and human dignity and that when it comes to the palestinians we are decontextualized we are ignorant this is very selective this is actually because. our occupied israel. is that mr sharon. has enormous influence on because he has. many politicians through elections access to the media through the campaign funds and so on. and of course this is the key to long for people. like
12:42 pm
any other country is a constant example also because of the part of the holocaust history western guilt over what they would do so in a sense this has saved certain and which was given a month. i described earlier as a sense of exceptionalism and in fact the month of munich the end of course it has acted with impunity so the palestinians were deprived of the protection of the law was given this exceptional amount particularly because it has a powerful lobby holes in the us that is a growing movement of solidarity with the palestinians and i hope that that would own. countries accountable or systems of government and this is as we said of the arab spring where the other playing has moved and the relation to the social media and these global principles that do not apply just to the other world of palestine
12:43 pm
. like humanity as a whole and therefore the exemption of the palestinians from these values and the exemption from accountability for violating these values will no longer be tolerated and. the americans may succeed then having that all nighters. yes but on that goes on that principle was right not for long because they too would be held accountable by their own people so if you're not sure we thank you for your time with us today thank you very much and still sits next to me.
