privacy see last week g.m.'s on star service sent out a new terms and conditions of use form to their customers one part of the new form people the wrong way and rightly so the on the second page it read unless the data connection to your vehicle is deactivated data about your vehicle will continue to be collected even if you do not have a plan it is important that you convey this to other drivers occupants or subsequent owners of your vehicle i know you might be thinking if you choose to be in on star customer are you signing up for this already well think of all the people who buy new cars and get that free one month trial period all those people who aren't planning on being in on star subscriber would still be monitored on the new policy that would monitor non on star subscribers was set to go into effect in december but it was met with significant public outcry the media started spreading word customers shared their anger and even some politicians from capitol hill frowned upon the move senators al franken and chris coons sent a letter to on star saying on starr's actions appear to violate basic principles of

a true glimmer of hope. and the erosion of our civil liberties in the ten years since nine eleven is a topic that we've covered often on this show especially the continuation of this the roshan under the obama administration the same with ministration the promise to uphold the rule of law while he was still campaigning to be president is an administration that's decided not to prosecute anybody from the bush administration for torture that hasn't closed guantanamo bay and instead signed a formal policy for indefinite detention and an imminent administration excuse me that placed an american citizen on an assassination list without any due process which has continually used the state secrets privilege in courtrooms their push for warrantless tracking with g.p.s. devices and the list can go on and on and on not but aside from continuing bush policies and damaging his own track record has this president actually killed the civil liberties movement that's a legal scholar jonathan turley argues and a new op ed that appeared in the l a times he says that obama may prove to be the quote most disastrous president in our history in terms of civil liberties so is he

right or discuss this with me is mike riggs associate editor at reason i can see mike thanks so much for being here and i thank you. like i said this is an we talk about all the time you and i was spoken about it there's no question that our civil liberties are being eroded but why do you think that it's missing from the general discussion that you see now just on t.v. when people are having debates or in presidential debates yeah i question i was sort of thinking about it on the right over here you could obviously like divide up who's responsible you could talk about the media who is sort of has this like soup of the day type thing when it comes to their coverage you could talk about the size of the federal bureaucracy and how difficult it is true all the stuff back and you can talk about both democrats and republicans not really a core group of sort of a large one who have made all of this about national security which is basically the most effective selling point any politician ever has on their own security

definitely seems to be a big one i mean you know i yeah i think that fear plays a large role because then people become more complacent if you if you scare them so much and tell them that this is for their own good but in that sense you know if we look back to the end of the bush administration there was a movement going on there was a lot of anger and it was yeah ordinated anger and so here came candidate obama who actually promised that this country where by by the rule of law again he played right into that civil liberties base and now he hasn't followed through with any of that if anything he's just made it worse and so did he actually you know kill the civil liberties movement like this professor is arguing i think turley's he doesn't specify this is l a times opinion piece but i think he's right about obama having done reparable full damage to this argument at the federal level and so far as i mean democrats won congressional democrats won in two thousand and six on arguing that not specifically civil liberties but the point on a movie was bad that the iraq war was bad all this stuff we still have all that congressional democrats are still basically supporting all that stuff so i think in

terms of saying like how are we going to roll this stuff back at the federal level i think that's really difficult i don't think the battle at the local level has been lost but then again the issues are totally separate i mean at the state and city level you're not. worrying about extraordinary rendition or torture you're worried more about you know whether or not you know farmers can sell on the pennsylvania maryland border can sell across state lines so on terms of the federal level i mean i don't want to be like too pessimistic but i also now i can't i don't want any instance i think of something that the federal government rolled back big of a huge overarching policy that was shown not to work after a cost benefit analysis show me one where they rolled it back well so we can finally we don't torture people anymore but you know there is that we have a lot going on very americans now we just use proxies now but yeah we are still sore is going to the only thing that yeah there's a suspended habeas corpus for a lot of people down at the base in cuba you know so i don't know and i think the reason this is going to change we have a if anybody was going to change it was going to be obama because he he ran his

campaign on a lot of ideas that don't bring in fundraiser money right so he sort of benefited from there some synergy with this bush hatred a lot of it around the war and national security stuff and then obama sort of stepped up to the plate and said like all these issues that don't bring in money i mean labor unions bring in money for the democratic party middle class people you know public sector employees those people bring in money that a libertarian anything there's a little money things don't bring in money for anybody it's not a coalition and this stuff is not going to come up for congress because unlike looking at environmental regulations or the health care bill there's a lot of players on both sides that with a ton of money they force this stuff and why that's why is this kind of the first thing to go you know just when it comes to people so i think if you think about our constitution everything in this country is supposed to uphold civil liberties play a really large role of that but like somebody like yourself for example i mean i think that the left here is doing a miserable job and i don't know if it's you know this worship of obama just as the person as turley's are going to be saying it's not about his policies anymore they

just worship the character of obama and so they model him wherever he goes but for libertarians and what's more important to you your. economic viewpoints are going to go from or somebody you know that goes on with it goes along with the policies you believe need to happen in order to fix the economy or just in general or through your civil liberties really matter i feel sometimes like it's a false choice i mean our government again from a libertarian perspective is really good at suppressing both of those things at the same time i mean they're really good at implementing regulations that theoretically are bad for jobs because they create create all these burdens for small businesses at the same time they are really good. you know using drones putting out you know like they can't they can do both at the same time i can object to both the same time i would say i think turley is selling obama supporters short their chief concern right now and going to november two thousand and twelve is making sure that he gets reelected because even if they hate him and some of them do by this point or dislike him

a lot he's still for them the lesser of two evils so i'm not sure that this is there's definitely a cult of personality on the left i think that cold like meats and somebody's stroller. you know in the florida panhandle it's not well probably not florida but it's not a big prize i think you would honestly be surprised but you know one thing that says what i think is true is the in the past we've always had this moment where we'll go through the dark days right and then there's this thing about as much as the other way and we win more right but it's not it's not going to happen this time around. or i hear it i never i don't know i don't think it will i mean also to be able to push that pendulum back i mean first of all doesn't swing back on its own it requires force prefer belief from citizens you can't push a pendulum you don't see you know there's you know the charlie savage the new york times came with a great story this week saying that you can find out if you're on the watch list the terror watch list for instance so because you can find out you can you also can petition to have your name removed from it and he also found out that people who

all right it's time for tonight's tool time awards night goes to g.o.p. lawmakers in michigan to the g.o.p. to control the state government in michigan last november they won the state house and the governor's race and they held on to the state senate so during their time in charge in lansing michigan republican lawmakers have had to make a drastic budget cuts to deal with the state's finances and one area that targeted is spending on education lawmakers and cut a billion dollars from school budgets which has caused a massive outcry from teachers unions state politicians voted to cut funding to local schools where schools would just close it even for a break from which. politicians love to treat school employees like punching bags

these days but they were ignoring teachers and school support staff are sharing in our state sacrificing so. now republican lawmakers weren't happy about the pushback in the efforts by teachers unions to recruit new members and this debate comes after another attempt by a conservative michigan activist he tried to use the freedom of information act to obtain the e-mails of teachers in the state and he claimed to be looking for e-mails that mentioned fund raising for teachers unions or lobbying on state computers but the court system stopped the freedom of information act requests so now the g.o.p. lawmakers have decide if you and run around the judge's ruling this week that they have moved vision house bill forty fifty two out of committee and listen to this the bill would prohibit a public employee from using their public e-mail for political campaigning union activities union recruitment and fund raising if you violate the law you could be fined up to a thousand dollars and spend up to a year in jail or both and organizations the violate the law could face

a ten thousand dollar fine so local newspapers in michigan point out the bill actually can't be enforced without modifying the state's freedom of information act which would be you know the way main the e-mails could be acquired through the law now a judge has already ruled that teachers e-mails were off limits to four requests but the bigger question that really remains here is how is the state going to police this new law are they going to hire people by computer programs to read everybody's e-mails you know that costs money and i thought michigan was broke maybe the encouraged public employees to tattle on each other that's going to go over really well and help improve morale i think this is another case of state lawmakers creating petty vindictive laws that completely overstepped their bounds this law is meant to scare the teachers' unions in the public employees into submission and the language is so broad that it would allow for a witch hunt against public sector employees who disagree with the government that's shameful scapegoating so let's hope the michigan house bill forty fifty two goes down in flames but since the g.o.p.
