california see correlator persons pulled over at a traffic stop or taken into custody anything of their carrying on their person is able to be searched by law enforcement wasn't such a huge issue until mobile devices became popular giving police the ability to search through everything on a person's cell phone or tablet as part of their routine search meaning without a warrant so that means that contacts text messages phone location data pictures all of it is fair game and it's a troubling trend i discussed with brian rattie of back in january. any time you are arrested by police for any reason which could include the parking tickets trying to get a seat belt reckless driving the police could take your from a rescue and once you're in custody under arrest behind bars they can spend hours trying to search your phone anything they find can be used to get to court to use for a search warrant. now earlier this year the california state supreme court upheld the right of law enforcement to search the mobile devices but the state legislature

clearly saw the lack of constitutionality and they decided to do something about it so they passed s.b. nine fourteen a bill that would require police to get a warrant before they go through an arrested person's mobile device and despite our pleading governor brown to sign that legislation last sunday brown decided to veto the bill and appease law enforcement instead of siding with privacy why reported back in september the governor was leaning that way on s.b. nine fourteen thanks in part to one hundred thousand dollars in efforts by law enforcement lobbyist to encourage them to veto and here's the real kicker the ground's veto he said the issue is too complicated for him to make a decision on so he thought it best to leave to the courts which already ruled five to two in favor of warrantless cellphone searches after giving for asking but what's too complicated to decide here constitutional protection versus appeasing the cops and governor brown has clearly sided with the cops here and critics have already spoken out against brown vetoes or in care well known fourth amendment advocate so the government should have sided with the legislature and i'm going to

bet that civil libertarians are going to remember this move when brown gears up for reelection by the way i see it governor brown made his stance very clear he's going to side with law enforcement and potential campaign donations over the constitution just like the rest of them. now today the justice department announced that an alleged plot to assassinate the saudi ambassador to the united states with help from a purported member of a mexican drug cartel had been foiled calling it an international murder for hire scheme u.s. attorney general eric holder said that you accuse our agents of the iranian government that the u.s. would hold the wrong accountable and in fact the white house state department and treasury department are all involved in developing new measures against iranian government although they haven't specified what those may be the two men are months or are bobsy are fifty six year old u.s. citizen who also holds an iranian passport angle i'm sure wealth already ses it cuts force member and holder said that a sting operation began in may the president was informed of it in june of this year and that the mexican government had aided in a month long investigation f.b.i.

a movie plot all right and we have to sit down and consider maybe it wasn't the iranians are the ones for a false flag operations that could be actually conducted by other were there who may have wanted to blame your audience right now so that need be one of the issues i just think need to be very very careful here but you know clearly the details are still coming out on this because they just broke this news a couple of hours ago today and i think that we're going to find out more as it goes along it could very well be real and it could be great if they just put all this terrorist plot but if you think about iran and what they're possible intentions might be why would they want to carry out an attack on u.s. soil. well the logic seems to be this and this is what we're really hearing out of the attorney general's office out of the bureau is that there's a long standing in a mostly between the iranians on one side and subs on the other and i think the logic behind this is with so many others in the middle east of course we can talk libya we can talk about egypt now potentially the idea if the so we asked the

united states we're. in some of this might cause instability in saudi arabia but it seems to be the argument but the problem with that logic is that it still does really a sterile is how whose benefits you grow up you see that's the only problem all of these arguments don't really of track with what we've seen you go means have been more than willing to commit various operations around the world and they've absolutely done this every time they have done this and have been very calculated and very cold about this but part of calculated in terms of why they were doing it and it was for absolute your bomb you benefit at this point i'm having a hard time finding that absolute benefit that i've seen in past operations now could you even argue that this might be that or mental for iran because on one side you can say that the relationship between the u.s. and saudi arabia since the arab spring has happened has been deteriorating somewhat and sell now this might bring the two closer together that oh i think you're

absolutely right you go there former national security adviser came about just a couple of weeks ago to the u.s. chamber of commerce and talked about how our willingness to drop our support for the president mubarak of egypt and some of this is made just much more difficult for the americans it would be a local guest of our friends including the saudi arabians that makes it sort of interesting when you turn around and you look at your own zip code this could actually make this harder for iran not easier for iran because not all the sudden we can have the closing of the groups between the americans and the saudis and just . so you agree he did the same to these really because no one you see the iranians as the devil as the absolute in figo if you will soon you're going to go in there these people deserve to be hit see that's the fear of the chatter that i'm hearing around of the wall right you know who's that what the iranians are

concerned about and others are also concerned about is the potential stroke but it is really it's and that seems to be one of the things that though i'm not saying that they're necessarily connected but i am so you know there are people out there wondering if there is a connection or now we're hearing for now is that the state department the justice department the treasury department the white house they're all coming out with some type of response to iran attorney general eric holder if that's where we have no idea about how you think it's going to take for the bomb iran war hawks that we know so well to lindsey graham john mccain the john bolton the bill crystal's of the world to come out and say we have to bomb iran right now we've seen john bolton say it before last time when he said that israel only had eight days to do it. yeah i actually lose absolutely i think back to conversations i've had with ambassador bolton about this and i remember him telling me the same thing that what it is that israelis need to do or the americans needed to do was to either replace the leadership of iran or both of them so i'm not shocked if you're going to see

a whole series of groups out there now say you know it's time to take out the your audience here taking me back to this question of well we didn't do that but he's released and so that is a real concern but i think what's really important is that what the bureau needs to do what justice department really needs to do is if these guys in fact are responsible i think it is a criminal defense attorney then following prosecute them but don't prosecute them in some sort of strange came report that brought these guys in in one ton of oh i'm talking about prosecuting them in federal courts where you said you know when you have federal rules of evidence and you actually prove that you guys did this rather than some strange masquerade what we say well we know we did it with the best country in the world if we're the strongest condition system in the world now let's stand up and prove it so i'd like to see that happen we'll see if it actually it's also part thousand like it's going out and they are being charged in a federal court now lastly as happy as we all can be if any of this plot was foiled

happening on wall street and well my own view is boy i understand how those people feel i believe that mitt romney just indorsed i could buy wall street protesters just days after calling that dangerous class warfare so looks like we have yet another mitt romney flip flop on our hands you know mitt romney is a lock in contradiction who changes my depending on the latest poll numbers from health care to abortion the second amendment education we've had various opinions on every single one of those subjects and texas governor rick perry tried to make a case in the last debate that romney was a serial flip flopper but of course you know he kind of blew that line. is it the mitt romney that was on the side of against the second amendment before he was for the second amendment was it was before he was before the social programs from the standpoint of he was for standing up for roe versus wade before he was against verse roe versus wade he was for race to the top

he watching glenn beck's online person who's conservative enough for that i mean you know it's one thing to come out and get a zinger god said i'm not backing down but then when you start making a bad argument and rethink your own words and saying someone else twisted your words even though you just said them directly on camera. kind of a lose lose for him so you can claim you know here and kind of a funny thing too he stole that song name from his daughter's song that she released two years ago and i well i mean i've heard it but you're not very popular song in fact and there's. some country music was nice to see like how they thought about the song and just that. lou destroyed our country dot com. it got half a star out of five and said it was more like a rough draft and somebody writing in their journal late at night was free so he's not going he knew it was a good go to an article that expect cracked music sorry america. ok so let's move on to we have a couple occupy wall street stories today but the first one is this was

a story on fox news and the headline was occupy wall street blasts banking industry college rises to its own banker and so basically what happened is the protesters they've received donations from people right this is how they buy their food keep the rallies going and everything and so obviously you have to use banks to process your donations and at some point the accounts it was frozen and so they thought that this was all a big conspiracy by the banks because they were getting scared to occupy wall street movement so they had to freeze the accounts and it turns out that was actually happening they were getting such a high volume of these donations that it actually just froze the account and so then they released an apology and like yeah did i make them look stupid or belittle big conspiratorial i don't think so but at the same time i'm really bothered by the people who are the total just partisan hacks here that think that this is some kind of in. the wall street protesters you know that every they're not saying we don't think we should have big spirit you know they're not saying that we can't be using

the banks are saying they're unhappy with the amount of influence of the banks the fact of the executives at the banks are the ones that committed so many of the crimes that brought our economy down and never were held accountable for it and so i just kind of resent this type of twisting as if they're not allowed to use banks anymore because they're occupying wall street i don't know if you've written here. i mean to be like somebody you know fighting against government getting a parking ticket and i mean like like you or somebody being poor don't have anybody party couldn't you know can't use anything of the government might ever provide yet so today there was actually new example of this it was a picture of a guy like and corporate evilness and he was holding. coke like a coca-cola and everyone's like oh my god she's supporting coca-cola of all being against corporations gotcha no actually what you want to all like go live on a farm somewhere and not have any products of any type because the corporations are taking advantage of us that's not feasible we need to figure out a way to regulate them not be naked without food well that is the this is the
