seriously you're not certain whether that was discussed or not these lawmakers are asking you if you remember what eric holder had for breakfast yesterday they're asking you if the government says that it can kill u.s. citizens without ever letting them see a day in court even when they're on u.s. soil they're asking if you can be sitting on your couch one day eating some cheetos driving your car singing along to a little spring so you know the radio and have a drone strike like you and your family out without anyone ever telling you that that was a possibility we're giving you a chance to defend yourself in court first and also to seven others clear our director of the f.b.i. i can't answer whether that's cool or not he's got a lot of his play guys you can listen to some speech about the government assassinating their own and tearing the constitution into little shreds have you seen all the terrorist plots that he's helping his agency make up so they can get more federal funding in fancy toys and obviously i'm taking this a little far but it's a damn important questions ask i don't really believe that mueller is that oblivious i think that he just wants to avoid having to answer the question but the

against the national defense authorization act that was passed last year at least this provision for the attention of american citizens for a long time now you have certain colleagues of yours in congress that are trying to pass laws where you get the american part taken out of the language but while they pass this bill and the first place question in this climate of fear which our nation is still in and post nine eleven. it is ultimately destructive of our democracy because it has set us on the path through pass the patriot act pass the national defense authorization act which further erodes basic constitutional guarantees such as to process and creates a profoundly anti-democratic environment in america when when you have a government that has assumed for itself the right to execute american citizens then you have the government being policeman. prosecutor judge jury and

executioner due process destroyed our constitution shredded. this is not a democrat or republican issue this is a question of who are we as americans and whether we are going to speak out against what is obviously an abuse of power and in an attempt to gain for the state even you know the power of life and death over individuals without any legal process involved the fact that we don't hear some many people speaking out against it is that it's not the top story on every single news channel and we don't hear more voices from congress that there aren't protests on the street the constitution is just been destroyed in a sense what does that tell you because you ask who we are as americans what's going on and people are people have been logged into an acceptance of a status quo which sees the steady erosion of constitutional guarantees that shows a lack of civics. civic awareness of what our basic rights are and we should have

credit payments during trial modifications and intentionally misled homeowners about their eligibility for the program letting just enough modifications go through to avert the suspicion of the shady picture and it raises a lot of questions about all the new assistance that the of a supposed to provide for the recent fraud foreclosure settlement so joining me from our studio to discuss it in new york is matt stoler fellow at the roosevelt institute matt thanks so much for joining us tonight and i don't know i guess maybe we can't be all that shocked these days anymore when we hear the another bank or maybe specifically bank of america did something that was shady but you know lying to people i would say the government that's pretty bad. yeah i mean it what it what it is is it's evidence that there hasn't been a thorough investigation of the status of the mortgage market what's going on so this settlement the fact that there's a whistleblower complaint that's unsealed recently showing enormous problems in the

mortgage market shows that what we really need to do is be investigating what's happening instead of you know putting putting terms on what releases banks. but it's also isn't the first you know thing that we've heard from a whistleblower to there is something else earlier this year that had to do with countrywide which of course they now owns so if you had to guess other a lot more stories out there like this the things that just haven't been unsealed you know i mean the economy was you know it was some chunk of the economy a significant chunk was based on fraud there was a loss of five to seven trillion dollars of homeowner equity from two thousand and six to two thousand and ten and you know a lot of it was appraisal fraud and securitization fraud in the origination fraud etc etc there are hundreds of thousands of people who were involved in it obviously there are a lot more whistleblowers who could come forward probably will come forward and what's going to happen is going to become increasingly embarrassing to the attorney generals who signed on to the settlement to the administration should the d.o.j. etc etc the fact that they haven't actually fix the problem or even that they don't understand the scope of the problem let's start with what it is that bank of

america is going to have to do you with this settlement to write the embarrassment night comic as you can say in the long term or in the mid-term for the attorneys general here but in the meantime can you give us some more detail as to what exactly it is that bank of america is going to have to deal. well i i wish i could put these settlement documents are not public so so and there is apparently last i saw there is no term sheet there's a settlement in principle and what the banks are saying overall is on their on their f.c.c. document says well this settlement in principle does x.y.z. and the attorneys generals and the j. and shaun donovan of hud they're all talking about the settlement but that's actually a lie there is no settlement there is no set of documents that have been finalized so well while shaun donovan can get up and say well they have americal have to do this or that or the other thing we don't actually know what these banks are going to have to do and what we're giving up to get them to do that until we see the

documents i think it's absolutely outrageous that we are talking these are hidden from the public even as they have announced well actually we don't know if they exist but they have announced a settlement but it's not clear there is a settlement yet it's crazy i'm sorry it's there's really no other way to put it now don't apologize it makes perfect sense to me to do it it sounds outrageous to me but then you know what excuse is there are legal reasoning and they try to offer for that. you know i mean no one's putting pressure on obama around this i mean for iraq obama's policies on financial reform have been you know a series of dishonest extend and pretend schemes and anybody who's worked in financial services policy up close knows about this there's multiple trillions of dollars at stake and the fact is that the republicans are owned by the banks and the democrats are only maybe partially owned by the banks but they don't want to jeopardize barack obama's reelection so they're not talking about this if you notice in the election there are no housing finance issues being discussed even

though foreclosures are the main drag on the economy and this is a this is a political crisis at this point i mean it's not obvious right now but we saw occupy wall street we saw tea party we've seen wave election after wave elections since two thousand and six and it's not going to stop until you know there's some sort of new contract put in place between the american people in their government. well you know if you want to talk about but i was three is trying to push for this movement to break up and they banks especially to break up bank of america which seems kind of like wishful thinking at this point but if you had to envision a new contract between the people and the government would be a step in it. well that's a possibility i mean you know you could see a much more socially equitable set of arrangements but you know it's also just as likely that what you'll see is a far more militarized authoritarian state where you know where we're property rights don't exist unless you have political power and that's you know that's you
