closure. america's most notorious prison so joining me now to discuss that secrecy that surrounds get now i'm joined by u.s. navy lieutenant commander kevin beaucoup thank you so much for coming on to help me get through on it over the last year there have been a handful of detainee transfers is this a positive sign that we should be expecting more of every let me start out by saying i represent along with various other excellent attorneys i represent three men who are currently detained at guantanamo bay and i will say this is a very positive sign in that last year eleven people were released from guantanamo bay. but eleven people per year even if we were to keep up that average you can see how long it would take to finally meet president obama's promise to close guantanamo bay we have to move much faster but the fact that the very first periodic review board came up with a result that mr mujahid no longer poses

a threat to the united states is a very positive sign it at least shows that this board is willing to look at the facts as they are and to make an appropriate decision sure but for those who don't understand really how the process works that now that doesn't necessarily mean much it could just mean that he's been transferred into the last security threat level of detainee and being transferred some are still definitely in another prison correct me that's exactly what it means in the case of mr majority that he essentially gets transferred from a category of individuals who are being indefinitely detained pending the end of the war on terror whenever that's going to happen to a group of now seventy seven individuals who are i should say a group of yemeni detainees who are being detained indefinitely until such time as the united states decides that its relations with yemen are such that we can trust them to accept the return of their own citizens however we trust them enough to carry out drone strikes unabated in the country without argument doesn't really

hold too much water to me let's talk about the periodic review board why did it take them three years to review this one case this is probably the biggest concern that we all have as you noted in march of two thousand and eleven by executive order president obama directed that these periodic review boards would take place in fact he said that they should take place within a year this was then codified in the national defense authorization act of two thousand and twelve so it became the law of the land and yet it took almost three years for the very first periodic review board to render its result. if this is the track record then we are never going to obtain significant results and let me note that the purpose of these periodic review boards is to identify the men who don't pose any threat to the united states and who are not going to be charged with any crime these men shouldn't be there in the first place these boards need to happen as quickly as possible because these men have been suffering now for upwards of

twelve years there are men they are wrongfully detained who have had no opportunity to prove their own innocence and we need to get these boards done so that at least they get one day before a panel and kevin another thing that you were telling me earlier is the limited access for trial observers journalists talk about that he has recently returned from vietnam this is an issue that definitely needs to be resolved in in the case of this very first periodic review board which was essentially litigated by a fine attorney named david remes there was no access by the press whatsoever and i think the media was surprised that something so significant would be held completely in secret i think the result has opened a lot of eyes and maybe future periodic review boards there will be greater transparency but honestly transparency is not something that we've come to expect at guantanamo it seems that they go to extreme measures to keep everything about

the system there and the abuses that take place a complete secret from the american people and from the rest of the world and you've established relationships of these men where you can better represent them and anyone else could yet they're per vanny and that from happening which is kind of screen over the people even more here again every it's the absurdity of guantanamo for five and a half years i've worked with these men i've established relationships with them i know their families i would love to represent these men at their periodic review boards and you know. an arbitrary decision was made that military attorneys cannot be part of this process even though we've established an attorney client relationship i can't be part of this process representing my men in the only hearing they will probably have for the many years they've been at guantanamo bay unbelievably frustrating. five years ago those three executive orders that i

a nation where human rights and the rule of law matter i don't know how you can say it any better than you give or you really can't have and you know the thing that irks me the most is that people kind of blame the republicans for all this you know barriers that he's had to close it isn't it true that today obama could use a national security waiver to actually start the process of every single release of every detainee there and if so why isn't that being done well certainly with the national defense authorization act of two thousand and fourteen which we're currently operating under the the restrictions have been greatly loose i mean it used to be that a secretary would have to have votes for the fact that if we were to release somebody they absolutely would not engage in any misconduct now the standard is much more reasonable and so i would say yes the power has now been given to the executive to close guantanamo bay and do what needs to be done but if we're to wait
