good to have you with us here now to today all researchers. coming up on our team u.s. intelligence has revealed some of its findings about the crash of malaysian airliner seventeen and who it believes could be responsible and update just ahead. on a human rights watch report finds a terrible trend in u.s. counterterrorism it highlights cases of alleged improper profiling extensive sting operations and conditions of confinement and more in the findings coming up. and hundreds of detroit residents have been without running water this summer that the city's water department will suspend the shut off for fifteen days more on their water woes i had.

good evening it's tuesday july twenty second eight pm here in washington d.c. i'm lindsey france you're watching our team america. with investigators on site beginning to sift through the evidence and the public demanding answers to determine what happened on the fateful day the malaysia airlines plane was brought down in eastern ukraine the u.s. intelligence community has finally made public some of its findings on how the crash may have been caused and who it believes ultimately was behind this tragedy artie's america david has more on this breaking story. senior u.s. intelligence officials reiterated early this evening that russia was responsible for creating the conditions that led to the demise of malaysia airlines flight seventeen however they made clear that they also have no evidence at this point of direct russian government involvement briefing reporters today intelligence officials said they believe the plane was likely shot down by and as

a eleven surface to air missile and that the missile was likely shot by separatists intelligence officials cited intercepts satellites photos and social media postings as evidence of that some of which they say has already been authenticated however that being said the u.s. says it currently has no direct evidence that the missile used to shoot down the passenger jet came from russia now before this latest information was released i did attend a state department briefing earlier this afternoon where i asked about separate claims coming from russia regarding a ukrainian fighter jet allegedly flying close to the airliner i also asked her about reports of escalated conflicts between ukrainian authorities and take he have separatists since the plane went down take a listen to that exchange russia has recently been questioning a ukrainian su twenty five fighter jet that was flying no more than three miles away from the boeing plane before it was shot down in

a sort of suggested that it may have been involved they don't know but they're questioning they've done more than what. what evidence does the u.s. have to rule out that possibility at this point because i've heard reports of the u.s. already sort of knocked that out of a couple points first as we've said when you look at the kind of markings on the plane and how it looks like it was brought down obviously that's consistent with an essay eleven which is fired from the ground i haven't seen any information that indicates a ukrainian jet we're still looking into it obviously the president of ukraine has said. there was not but again we like to independently verify things for matt before you asked the question and so i haven't seen information that would indicate that all of the you know the proponents of the information that we've laid out in that the intelligence to knew a way out was that this was an essay eleven fired from the ground from a separatist controlled area and there are also several ports that the ukrainian military has continued to issue attacks in eastern ukraine despite everything going

on with the investigation and what kind of information do you have on that and has the u.s. said anything whatsoever to kiev authorities about a cease fire while the president of ukraine is committed to a forty kilometer ceasefire around the crash site and i believe the fighting is outside of that forty kilometers i think he's held to it and look we very takes two sides right so where there are attacks against the ukrainian people ukrainian forces they obviously have a responsibility and obligation to protect their people but it's my understanding that they have held the cease fire around the crash site deputy spokeswoman marie harf was also asked about russian allegations that the u.s. had scant evidence of satellite imagery showing the plane shot down by a missile and here was her response to that we've seen a history throughout this conflict of the russian government putting out just sheer propaganda false about what's happening we have a great deal of open source evidence and intelligence to back it up that supports what we believe to be true and we'll talk about that more in the coming thank you

force instead of finding you know what can we agree on like said if you want peace you have to talk to enemies this is not talking to enemies this is make your enemies really untalkative. that was our to correspondent harry share with norwegian doctor and actress mark gilbert well the human cost of counter-terrorism practices used by the united states government has skyrocketed since september eleventh. thousand and one according to a new report from human rights watch it details the extent of allegedly improper profiling extensive sting operations and the conditions of confinement since september eleventh more than two thousand one that is more than five hundred individuals have been prosecuted in u.s. federal courts or for terrorism or related offenses which is about forty cases per year on average and nearly half of those convictions resulted from informant based cases and almost thirty percent of those cases were sting operations in which the informant played an active role in the underlying so-called plot on top of this new

information is emerge regarding terrorist watch lists in general according to the associated press around ninety nine percent of the names submitted are accepted which has led to more than one point five million names being added in the last five years alone the state department has responded to the human rights watch report by saying the report itself acknowledges that many of the decisions that the that the report criticizes are not only lawful but also specifically approved by federal judges just as the material support statute that they report criticizes was upheld as constitutional by the u.s. supreme court now to explain the human rights watch report i was joined earlier by andrea process the deputy washington director for human rights watch i first asked her to give me some examples of how the u.s. might be creating terrorists out of innocent people. we've documented cases where the f.b.i. will send an informant to say a mosque most parking lot and encourage that informant to strike up conversations

with people about subjects like jihad eventually to to find people who maybe are interested in a conversation and the informant might spend weeks or months because bella be in a relationship with these people discussing the idea of violent jihad discussing the idea of terrorist attacks sometimes showing people inflammatory photos of violence perpetrated by americans and encouraging them to plan terrorist attacks and then the f.b.i. of course provide the means to commit the attacks frequently they provide in weapons they have provided money to allow people to travel to locations to plan a terrorist attack so in some cases we've documented the f.b.i. essentially manufacturing the entire plot. so how does a defendant in one of these cases make a claim of entrapment because he's got to show that the government induced him to commit the crime that he wasn't predisposed to commit it but given some of these people's background it's very hard for them to make that case is not. right so the

terrorism case when you were looking at whether the defendant was predisposed to commit terrorism what the government does is they introduce all sorts of evidence about what was say what was on the defendant's computer so if someone has gone to websites that have particularly violent images or discuss a violent ideology that's on the defendant's computer that's evidence that the prosecutors will introduce we also documented the use of types of expert testimony where experts talk about terrorism in a much broader context context so people in the u.s. are frequently charged with crimes like conspiracy or attempting to provide material support to terrorists the prosecution then can admit evidence totally unrelated to the defendants but about terrorism in general and that inflames the jury the jury is scared of terrorism so all these issues sort of bundled together making it very difficult for a defendant to show that he was entrapped with this report also find that speaking of these targets american muslims are unfairly targeted in f.b.i.

and department of justice can our terrorism operations how so sort of you know shine a light on the way this is actually done which talks about the idea of the f.b.i. and law enforcement in general treating american muslims as terrorists in waiting there is this theory the f.b.i. has used the so-called radicalization theory that suggests that people who say go to websites that talk about violent jihad or participate in discussion forums or maybe even talk about it themselves on the street or in their community centers the idea is that those people have a greater propensity towards violence but there isn't actually evidence that that's true and what we've seen is long forstmann targeting people at times based on ideas and thoughts and speech that should be protected by freedom of expression laws. policy changes and reforms disc human rights watch recommend for the department of justice to reign in these potential abuses during their terrorism investigations.

well the first thing is we think the use of informants needs to be curtailed and subject to robust oversight the case of the newburgh four for example is a very prominent one the informant offer the defendant two hundred fifty thousand dollars and the other defendants who were poor and one case one of them had a very sick brother who needed medical treatment the offer of two hundred fifty thousand dollars was very tempting now there is testimony in that case the f.b.i. didn't know the informant offered that much money they hadn't authorized this of course the person with the acting as an agent of the government but that's a great example of why the f.b.i. needs to conduct more robust oversight over their own informants and why congress needs to conduct robust oversight over the f.b.i. and the justice department. how many resources does the f.b.i. and the department of justice put towards the investigation of terrorism. since nine eleven the f.b.i. has actually diverted significant resources to counterterrorism diverted away from investigation of white collar crimes in particular but also non-parallel violent

and non violent crimes and in fact there is an inspector general report from the f.b.i. documenting this shift that certain f.b.i. field offices feel they have fewer resources to pursue other non terrorism related offenses and then you look at some of the cases that we documented in this report where the person likely would never have tried to commit a criminal act but for the involvement of law enforcement and think about how much better those readers that could be used to actually pursue the real criminals that's andrew apostles' the deputy washington director of human rights watch. the battle over running water in detroit has taken another turn the city says it has halted shutting off past due accounts for fifteen days in order to give residents time to set up a payment plan thousands in detroit are facing a water crisis has drawn the attention of the united nations are cheesemaking lopez has more. the trying residents who are struggling to keep their heads above their water bills are getting some temporary relief this week the city's water and sewer department announced that it will temporarily suspend water shut off for fifteen

days to allow residents a chance to work out a payment plan for past due bills since spring the city has aggressively gone after customers who are sixty days or more than one hundred fifty dollars late on their payments turns out that that is about half of the city's one hundred seventy thousand residents the average overdue water bill is about five hundred forty dollars now there are aggressive tactics included shutting off the water for seven thousand five hundred fifty six customers between april and may and another seven thousand two hundred in june alone drawing criticism from as high up as the un for violating human rights to water water was restored to more than half of those customers within twenty four hours of being shut off and most of the others were able to pay their bills within seventy two hours the water department says that it will use the two weeks to educate residents who are behind on their bills department spokesman bill johnson told the detroit free press they are doing this

quote and case we have missed someone who has legitimate affordability problems this will allow them to come to us to see if they can work out payments we've always maintained that what we were doing was a collection efforts not a shut off effort however once the fifteen day reprieve ens shut off will continue as the city tries to recoup eighty nine million dollars in overdue bills but activists and community leaders are fighting back this week a group of ten residents filed a lawsuit with the u.s. bankruptcy court accusing the city of violating their constitutional rights with water shut off the group is joining an effort to ask bankruptcy judge steven rhodes to grant them a temporary restraining order to stop all water shut off and to restore service at least until a hearing can be held in bankruptcy. the court part of the group's plan is implementing a water affordability plan with income based payments for residential customers meanwhile on friday over one thousand residents took to the streets of detroit to

there where she can skip out on paying taxes here but this is the craziest part her company makes generic drugs and those are the ones available from medicaid and medicare programs funded by our tax dollars so her company is getting our tax dollars right into its pockets while at the same time it's leaving the country to avoid paying their. taxes. companies moving out of the states to avoid paying taxes is nothing new it's happening all the time now to the point where it's practically an epidemic but this is the first time a patriot here is doing it he can't make this stuff up so now our patriots are people who move their companies out of the country to avoid paying taxes that's how american patriots now rigorously support their country by refusing to supported it .
