11:01 pm
with a whole new way to rip you off what you need to know about synthetic identity theft but 1st the usas welcome mat is getting smaller as the administration announces new immigration restrictions its classic trump on the stump material but is this new policy practical i'm holland cook in washington this is the big picture on our t.v. america. the trump administration recently announced more aggressive steps to restrict legal immigration beyond the human drama now playing out is there an economic impact away let's ask daniel prieto anchor of boom bust seen weekdays at 4 eastern here on r t america daniel welcome good to be here since this change was announced we've been
11:02 pm
hearing the buzz word public charge which is a policy that's been in effect for a century meaning that immigrants need to be self-sufficient and not a burden to the social system that can. date and president trump has railed against what's new in the administration's overhaul right now the very term public charge sort of has an archaic sort of dusty sound to it and if it does that's because that's sort of where they're taking us with this sort of conjures images maybe of poor houses or orphanages maybe around the turn of the century and that's because as you point out it's been the case has been the law for quite a while that if you are tempting to bring your spouse if you are a citizen who has a foreign born spouse in your attempting to bring them to united states it's always been the case that you have to show that it's likely that they will not become what's called a public charge and the original definition of this a public charge simply would have meant someone who is unable to provide for themselves. provide for them their own survival and so these spent ministrations
11:03 pm
essentially expanded this term a public charge which was was previously someone who could have called indigent or something like that and around the turn of the century but now this will apply the term of public charge will apply to anyone who has received certain non-cash benefits including medicaid housing assistance and snap formerly known as food stamps to take the 3 big categories and so when you look at that exchange will mostly affect u.s. families that have foreign nationals in them if you're attempting to bring your spouse who lives abroad to the united states and you're a u.s. citizen from now on you'll have to ask the spouses asking for the green card will now have to convince an immigration official that their spouse is not likely at any time in the future to use any of these cash benefits that i listed so that's an excess a very big expansion of this formerly narrow term for example medicaid when you
11:04 pm
talk about people who are using medicaid 59300000 u.s. born citizens or about one in 6 people in the united states are enrolled in medicaid so that gives you a sense of. the scale of the use of these programs and how broad this application could be when you put this likely standard as opposed to you know the previous standard on you know when you're going to be completely indigent in the hands of immigration immigration official when they understand the message coming from the top right now every cent adds up when uncle sam is 22 trillion in the hole but to qualify or disqualify from the green card as opposed to the h. one b. work visa what's the difference right so the key point here is that the h. one b. acts as a kind of international temp agency run through the immigration system that is you're granted a visa and contingent on a specific job offer and your boss actually is the legal sponsor one of the legal sponsors of your visa application and a green card by contrast is simply
11:05 pm
a status you are granted the status of a permanent resident alien you have the legal right to be here and your status is not tied to a job and so you see an interesting breakdown in the business class in the united states in terms of who advocates for either a comprehensive more comprehensive immigration reform as we used to call it or the more narrow h. one b. guest fees based on what sort of labor either skilled or so-called unskilled that particular sector business constituency might be interested in to take a crude example like are you a software company who may want a lot of coders to come over and work for a company or you a farmer that simply you know is interested in getting a lot of stupid labor and in that case keep the boss happy right now as you surveyed his or her pleasure right and we saw this you know it was in terms of the h one b. you know you're actually formally sponsored by your boss but even in cases of undocumented labor effectively they have the same option to send you back if
11:06 pm
they're on happy as we saw with this raid in a mostly agricultural worker run by ice in the past week well let's talk economic impact the dirty little secret is that our. anomie depends on immigrant labor agriculture is merely obvious there are dozens of service jobs that depend on the immigrant workforce and according to an associated press and alice's low income immigrants who are not citizens use medicaid food aid cash assistance and supplemental security income s.s.i. at a lower rate than comparable low income native born adults which is surprising to hear but those of the numbers is that the false economy to cut the immigrants out given how much they contribute and solely holland i mean the economic arguments on this are so trivial it's almost a waste of time to consider them when you know right off the top as you point out apples to apples lower income visa holders are less likely than people with similar
11:07 pm
incomes who are citizens to use these benefits so right off the top there it's easily dismissed in terms of whether we see this show up in the aggregate. economic statistics or in any particular sector it's not clear that we will in that as i said this will mostly affect families would who have a non-citizen spouse in them it will mostly keep them from applying for benefits they may be eligible for out of an abundance of caution to not obviously want to do anything to endanger this very important process to bring your family member here so what we're probably won't see it in the aggregate economic statistics but will see this in families and human impact of people forgoing benefits that could make their lives better because they're scared this crackdown which is part of the intent here brito from boom bust week days of 4 here on our team america thank you for stepping into the big picture good to be here. since he became president donald
11:08 pm
trump has effects you waited 600 unilateral changes in immigration policy his administration has arrested multitude of undocumented immigrants taken away and caged and sometimes lost track of thousands of their children his campaign promised a muslim travel ban tried to add a citizenship question to the census form and his frightening immigrant communities with threats of mass raids the inscription on the base of the statue of liberty begins give me your tired your poor your huddled masses yearning to breathe free do those words still ring true let's ask the author of drones and targeted killing legal moral and geo political issues and the united states and torture interrogation incarceration and abuse marjorie cohn is professor emeritus at thomas
11:09 pm
jefferson school of law former president of the national lawyers guild deputy secretary general of the international association of democratic lawyers a member of the advisory board for veterans for peace hey like any issue immigration involves cause and effect most mainstream media coverage is in fact how the overwhelm system has become dysfunctional but there's little discussion of what causes those whom lady liberty calls the homeless tempest tossed to come to america marjorie when you and i spoke in april the usa was as it still is attempting to displace elected venezuelan president nicolas maduro with a puppet regime led by one goh i don't know is the southern border crisis chickens coming home to roost after decades of u.s. a regime change meddling in central america. well it is indeed holland the united states has
11:10 pm
a history of. and political interference in central america going back at least to the fifty's when the cia mounted a coup against a democratically elected president in guatemala then through the seventy's and eighty's supported the read the the death squads who were torturing people and locking them up and killing them without due process in el salvador and guatemala and then in 2009 the obama administration encouraged by secretary of state hillary clinton supported an illegal coup in honduras and the military forces that carried out the coup were trained at the united states what used to be called the school of the americas which for years trained terrorists and torturers in how to better control their people as part of the cold war and then the united states wanting stability in the in the in central america to make it
11:11 pm
safe for foreign investment and cooperation with us adventures these $600.00 plus people who busted in recent raids in mississippi. seem like pawns to me because if they're taking our jobs is really a problem why didn't we go after the employers. absolutely i mean the employer was just left alone when 686 people were rounded up and this also creates fear and terror among immigrant populations around the country if you really wanted to apprehend people who are undocumented you would think that tactically it would be smarter not to announce that you're going to have these raids but a couple of times the trump administration has boldly declared that they're going to conduct mass raids this is the 1st real mass raid that they've conduct. since
11:12 pm
the 1st announcement but again this is evidence of trump pandering to his racist anti immigrant xenophobe it base i want to recommend by the way an op ed you have recently written which our viewers can read at truth dot org if left unchecked trump will owe blitter rates the right to asylum marjorie please translate legally used a layman's terms about how asylum works or should and how the administration's interim final rule is attempting to stiff arm asylum seekers. yes well under u.s. and international law any person has a right to apply for asylum and they can be granted asylum or they would be granted asylum if they have a well founded fear of persecution in their home country on the count of race religion nationality political opinion or social group and for years people
11:13 pm
have been coming to this country and applying for asylum and now trump is effectively trying to end the right to asylum which is a human right his new rule would says that in order to apply for asylum you have to have already applied and been denied asylum in a country that you travel through on the way to the united states or you have to be a victim of trafficking or you have to have traveled only through countries that are not a party to the refugee convention or the convention against torture and mexico which central americans invariably travel through it unless they're coming by plane or boat and most of them don't come by plane or boat mexico is a party to these treaties now the only in alan the the ground for an eligibility for asylum is if the united states has an agreement with a safe 3rd country that. vides
11:14 pm
a fair and open. process for asylum and guatemala is has been pressured by the trump administration and finally came up with this agreement but the guatemalan supreme court likely won't uphold that that agreement and in fact guatemala does not have a fair procedure for for applying for asylum so this is being litigated in the courts and it will eventually get to the supreme court of course the supreme court has been packed by trump with the right wingers although at times they have done the right thing particularly when john roberts is more concerned about the legacy of the court than pandering to the right wing's so stay tuned indeed author and professor marjorie cohen thank you again for your time here and for your context and perspective on this important story. thank you holland coming
11:15 pm
up scam stars of come up with a new way to rip you off and if they succeed you will be the last to know how to avoid synthetic to the theft next this is the big picture on our team america. why a paradise with some. turned into a round the experimentation feels that agricultural chemicals we know that these chemicals have consequences they are major here tell us there's no question otherwise why would the chemical company workers themselves be geared up that suited up locals attempt to combat the. they did experiments but also in day you
11:16 pm
have many of these people one foot into the biotech pharma and the other foot in the government regulatory bodies this kind of collusion is reprehensible while the battle goes on the chemicals continue to poison hawaii and its people so one has to ask the question whether there is a form of environmental research going on in hawaii whether these companies feel they can get away with this because the people have less political power. as if identity theft wasn't bad enough already wise guys are getting savvy with the information we are handing them on a silver platter via what's being called synthetic identity theft what is that
11:17 pm
let's ask attorney professor and ace scam buster steven j. j. wiseman and if you can read only one of the stack of books he's written make it identity theft alert 10 rules you must follow to protect yourself from america's number one crime and you should bookmark his website scam aside dot com which is updated daily steve i'm reading good news and bad news the good news year to year 2017 to 2018 fewer americans were victimized and chip unable to credit cards help the bad news is that 143000000 of us were exposed when equifax got hacked what's the latest on that equifax situation and now the capital one breach. yeah the equifax data breach really was a it was a prime example of what's wrong with protecting data and data security so when echo
11:18 pm
. a fax a couple years ago was breached it was breached because of their negligence the hackers the scam artists the only criminals we call artists they hacked into they exploited a vulnerability in equifax because of a vulnerability in the type of software they were using called apache however apache had issued a security update to solve that problem months before however equifax didn't get around to installing it in time and so 143000000 of us i do say us it included be had our names birthdates social security number all of this information that can lead to identity theft stolen now there was a major settlement a major settlement of charges brought by the federal trade commission and $48.00 of the 50 states attorneys general and about $170000000.00 if you mean about $700000000.00 was put aside to compensate some of it penalties others
11:19 pm
refunds and the big thing here is that people should be going to the equifax settlement web site and the best place to go is to go to scam aside dot com look up equifax settlement the reason i say go there is there are only equifax settlement web sites that are going to steal your information but you go there you can put in your name the last 6 digits of your social security and i know people have said well wait a minute i'm nervous there but if you go right web site you're ok it will tell you if you become a victim and if you were a victim it'll give you the information there as far as how you can apply apply for various benefits including free credit monitoring and perhaps even $125.00 of payment and they go now briefly what's up with this capital $1.00 breach. you don't the capital one breach again was really really huge interested. only enough the
11:20 pm
word any social security numbers that were a part of this breach that breach the equivalent of social security numbers in canada about 190000000 of those were taken the good news is much of the personal information there was not like social security numbers or personal information that could lead to immediate identity theft but it did give a lot of personal information that can be used to form what we call spear phishing emails these are specifically targeted and tailored phishing e-mails that lure you into clicking on links or providing information you download malware like ransomware sure you give away your information so the the big thing with the capital one is it isn't quite as bad as it may seem but it still shows once again we're only as safe as the places with the weakest security that have our
11:21 pm
information the new meaning to what's in your wallet in their case now about the sun phatic identity theft how does that work. this is fascinating and here's how it works instead of identity theft now is the biggest and fastest growing area of identity theft we're all familiar with identity theft someone takes our name our social security number or runs up debts in our name and we're left with a ruined credit report well synthetic identity theft takes your social security number or other information and forms a totally fake person they may have your social security number my address other pieces of information and they create this new person and they use that it's a gradual process because what happens is they'll apply for a big loan or actually even a small loan using this synthetic identity they go to the credit reporting agencies and there's no credit report so they get turned down. but just by applying that
11:22 pm
will open a new credit report and then gradually what they do is they get a small loan they may even pay it off it's a dedicated dennehy that often happens over years and eventually they hit for the big one now here's the problem with this and it's really interesting because let's say they have your social security number but not your name when the harmful credit report information comes it doesn't appear on your regular credit report or appears on a sub file that you don't see but all of a sudden your credit score which is so important for not just getting a loan but getting a job and getting insurance that goes down and so that's one of the indications that you may be a victim of synthetic identity that you go you don't see anything on your credit report but suddenly your credit score has dropped precipitously because the made
11:23 pm
a composite character so how do we lock it down and prevent that from happening. one of the best things you want to do is a credit freeze you should do it for yourself you should do it now for your kids your kids and kids are the biggest victims they are 51 times more likely to become victims of synthetic identity theft than adults so you want to freeze your credit and the other thing you want to do is you want to monitor your credit score regularly because the sooner you find out there's been a problem the easier it is to fix and you've got some shortcuts for that scam aside dot com right. yes we've got some good shortcuts both finding out if you're a victim of data breaches what to do how to get some credit monitoring this free credit monitoring the various services that do it so we provide all of that at scam aside dot com one of your recent scam of. day reports there was about the federal
11:24 pm
trade commission busting a credit repair service scam or if there are any explain how legitimate credit repair services operate and what these wise guys were up to. yeah the bad guys out there and they do this for all kinds you know a lot of people have have debt issues and so they want to get their credit report fixed so that they can be in a better position financially if they do need a loan but the problem is it can the kind of negative stuff can appear on your credit report for years so what they do is the the bad guys promise to remove it from your credit report and they may even give 100 percent guarantee so they guy that the f.t.c. recently brought charges against and and settled with the good way of finding out between a legitimate credit repair company and the phoneys is it is illegal
11:25 pm
for the any credit repair company to charge you in advance and so if they want an advance payment you know it's a scam otherwise there's a lot of things that you really can do for yourself in these companies often over promise but the biggest way to find the scammers is they want upfront money. here we are back to school time before you know what the holidays are going to be upon us what are some of the perennial scams the seasonal things to watch out for the surface this time of year. yeah you know there are a bunch of them and 1st of all we're talking about back to school so. one of the big things is child identity theft has become a huge thing and often the parents don't find out that their children and the children of find out that they've become victims until perhaps they're even 18 and maybe applying for a car loan or student. aid scholarships so one of the things you want to do
11:26 pm
is you do want to freeze your child's credit you can't do this online like you can for an adult has to be done by mail but it's chemist i dot com we show you you know how to do it it's free you can freeze and unfreeze as as you watch wish but there's also something called for and this is a federal law that protects the privacy of your child's information at school and allows you to stop schools from sharing this with 3rd parties and that's something that a lot of parents don't realize that schools are taking that information that they have on our personal information of children and they're sharing them with companies and when they start doing this that makes the kids much more vulnerable to identity theft and so what you want to do is every year the parents should exercise their rights by for a contact a school an opt out of information sharing yeah i read up on this and
11:27 pm
kiddos are in the crosshairs because their credit report is a blank slate. yet it's very easy there's nothing nothing bad there and so what the bad guys will do is they will take over that credit report this is the identity theft directly of the of the child then they'll do even things like call piggybacking they will get someone with good credit maybe it's a good credit from a credit card put me on your credit card and after a few months that good credit the history of that credit card gets reported as if it's years worth of history on that new stolen identity and so there are ways that the bad guys can take that clean credit report build it up quickly and then devastated so a lock down your kiddos every time you're here steve i learned something and i urge everybody to bookmark scam aside dot com thank you attorney author professor and
