be open by easter they saw him you know tell businesses that everything will be fine they saw him tell the american public that this was not going to be a big deal and all of that fell flat on its face he doesn't want to admit his own wrong and definitely done our best but what about congress you know congress is the ones who they're the ones who decide what money goes where they're the ones who spent you know a trillion dollars on national security and clearly we're not that secure clearly our priorities were not you know our priorities were we got to build more you know warships and guns and tanks and bombs that virus doesn't care about that now people might say oh well that's hindsight 20 twentieth's well no it's not when you were at the pentagon telling you in 2017 saying hey this is a major issue that could be coming down the pipe to practice i mean they literally pointed right to the family that covert money team belongs to saying the most likely and significant threat is a nobel respiratory disease particularly a nobel influenza disease i mean they had it right there can be more plain than that what we know about congress is that they have a habit of writing

t rights and advocacy here to tell us more is preston mitchell writer an abject professor of law at georgetown law center welcome present. thank you for having me . it's really fascinating when you look at the history of the f.d.a. is treatment of gay men i mean originally they were banned from giving blood donations back in the 1980 s. and with the hiv aids epidemic we've come a long way since that era not only in our understanding of the virus but also prevention methods why did limits to why do limit still exist in blood donations from gay men and why is this the group that is most excluded when it comes to the issues like this. homophobia is that easy we're about to use here but i would like to start by setting it by painting a picture 1st so for more than 30 years sexually active gay bisexual and other men who have sex with men and trans people i should say have been prevented from donating blood so in the f.d.a. is guidance f.d.a.

has specifically noted and recommended that blood establishments indefinitely just for donors from donating blood since 1977 if they've had sex with another male so the regulations itself were put in place in 1903 in the wake of the each aids cases and the related panics that we've seen and that many people have experienced so while hardly anyone tests positive for things like blood our student test positive for h i b because of blood transfusions and blood is test that we now legally have 30 plus years of discrimination on the books again why i say that is is because of homophobia here's what we know we know that all blood is tested so even in the face of science in the advent of technology lot of some particular communities is automatically perceived as damaged damaged and dangerous and not worthy of save you know life. take a step back by saying in 2016 i wrote an article so the group called polls tragedy homophobic blood ban puts lives at risk the purpose of that article was to describe

the need to push the f.d.a. for overturning the entire ban not just issued temporary orders not just issued deferral periods in that piece i specifically said we cannot wait for another tragedy to realize just how important having more access to blood donations is now look we have a national strategy tragedy in the form of public health crisis and it's a shame that f.d.a. is just now deciding to rethink their already discriminatory ban. and president americans now have an outsize reliance on government from small business support to checks to stabilize working class families government has played more phone than print to the people historically what happens now. so i think what happens now is the government needs to continue having honest hard conversations with themselves with community members so part of the truth is you

know and to be clear as you stated already the f.d.a. issued their guidance to reissue the guidance in 2015 for a 12 month for a period now they reissued the guidance for 3 muffed appropriate so we need to honestly think about the role that stigma discrimination and criminalization has played for l.t. teach you communities especially black and brown elizabethan unities who really populate a lot of the southern states southern states who have not expanded medicaid i would at the government is to have an honest conversation around ice role in the harm that it's cost of the tea to people like me so we went into round the role of people and health disparities overseas you people have lacked in health insurance coverage we have asthma contrary to popular belief many of us live in poverty and many of us experience homelessness especially young people so cold it inherently impacts them so again the. government needs a saint how can actually invest in the lives of marginalized communities and system impact communities and eligible teach you the people of color are no different and

this is beyond the united states right even though the f.d.a. covers the united states the u.s. food and drug administration this is a global crisis this is a global pandemic and l g t 2 communities across the world have always caught attention to the harm that governments caused and they need to do a much better job to save our lives that they are certainly most do it's interesting because the algebra 2 q. community much like the african-american community has heightened vulnerability factors that make over 1000 a lot more dangerous and life threatening to their communities both here in the states and around the world what precautions can members of. the community take to protect themselves during this pandemic but you would recommend. until some of us it is that eligible teach you people can do of course is you know make sure that we are staying home and staying safe if we're able to do so right so of course you know i want to be honest around what it means to socially distance there are there are a lot of i would say dangerously untrue statements being made around black america

and around you folks and young people where there is a lot of shame and blame be in place on these particular communities why aren't they because it's easy to blame us because we've always been blamed for causing most havoc and harm in this entire country despite this country causing havoc and harming our lives right so if it is saved and it's possible to do so i'll be to you people should stay safe but the truth is many of us including many black and brown square transferrable are essential workers so we have to have more interaction many of us in gauging good economies which means that we are drivers religious robbers were m. a lot amazon delivery drivers and so i think we're honest i think we have to have an again an honest conversation with the role that only the local state and federal governments are having the people we also have to have almost honest conversation around the onus that is placed. on particular people when the rule issues are institutions that have not really preparing for a pandemic and poor it is that we're not put in place would have mitigated
