greetings and salutation. while growing up in this crazy world one of the most important lessons our parents mr rogers big bird and elmo ever taught us was responsibility we had a responsibility to do our chores on time take care of our baby brothers or sisters feed our pets it's a moral obligation responsibility to behave correctly and with respect to those around you and allowing yourself to be held accountable for your actions and duties responsibility is also defined as a thing or action one is required to do is part of a job a role or legal obligation and role responsibility plays a major role on sesame street and the mr rogers' neighborhood it doesn't appear to exist at all here in washington d.c. because fresh up the news of one of the worst contractions of the economy in u.s. history with me. millions upon millions upon millions of folks facing joblessness
6:02 pm
the victims of potential sickness or even death thanks to a global pandemic the united states congress the senate in particular has decided to take a 3 day weekend no i'm not making it up yes chucky schumer mitch mcconnell an arrest and decided to take friday the 31st of july off despite the fact that the coburg 19 emergency 600 dollar weekly federal unemployment benefits expires on you guessed it friday the 31st of july all but guaranteeing that tens of millions of americans will see their incomes drop by 50 to 75 percent with another rent payment due in just 24 hours so while mitch mcconnell is resting his corporate job on a mint julep in his old kentucky home reveling in the true art of irresponsibility the new york times is reporting 'd that almost 40000000 people do not expect to be
6:03 pm
able to make their next rent or mortgage payment almost 30000000 americans said they did not have enough to eat during the week ending of july 21st and that according to ernie to be she and an economist at every core i.s.i. failing to resume the federal unemployment payments would cause a drop in consumer spending large enough to eliminate about $1700000.00 jobs. that my friends are job losses on par with what we saw during the recessions of the early 1990 s. and the early 2000. so please enjoy that jewel of bought us mitch while the rest of us take responsibility seriously and start watching the hawks if you want to what's going on on a city street you want to. be so you'd like to see the rise as you always state i'll see you throw strikes mass graves displays systemic deception is the
6:04 pm
late show which i would be so but no joke as. well i'm going to watching the hawks i am. and i'm sure joining us today to discuss this week of irresponsibility in washington d.c. is a man who is responsible for bringing us the whole picture that is the host of the big picture mr holland cook always a pleasure oh and thank you. i miss you guys i know we're so far away and know holland you've been covering the antics of congress for quite some time now how you are responsible in their duties are senate majority leader mcconnell and the rest to take a 3 day weekend when 1000000 americans are facing are literally on the brink. you know as you pointed out the benefits run out the rent is due and i got a 3rd bullet point for you the even moratorium is over and there are protesters
6:05 pm
ringing the courthouse in new orleans blocking lawyers from coming in to file even actions so this is a hell of a moment to go on vacation and i am so struck by mitch mcconnell's hubris naive take this guy is up for reelection and has a formidable democratic opponent back home in kentucky and yet he's calling the extension a not yet urgent. the house dems passed this 10 weeks ago and these guys go on vacation. this must be potomac fever or something because it's just him politic of a swamp dweller like mitch mcconnell to be doing this when his job is on the line great poise yeah that was a very strong i think i'm thankful that you brought it out because mitch mcconnell
6:06 pm
just apparently feels really safe in a very interesting election cycle but holland do you think the senate can recover from this kind of dereliction of duty and could this backfire on the republicans in the upcoming elections in november it seems like some people have some really tight races. yeah i really think they're going to have trouble in the senate they're defending what 23 seats this time and take a snapshot of america we have record unemployment we've lost 150000 lives to this virus we've got race riots in the street donald trump is asking us for a 2nd term after saying he was going to make america great again and all along these republicans have become invertebrates nobody will question him so here they go off on vacation admittedly too much of the washington and cable news conversation is a blame game but i gotta say in this case it's clearly more dems right republicans
6:07 pm
wrong because this money as tyrrell mentioned feeds the economy every one of those dollars is going to bounce on main street usa these are not going to be buying mutual funds and that's a great point i think we often forget that the you know all of the money that you put in to help people when they're unemployed and things like that that money gets spent they don't just hoard it you know that's a great point you bring up holland and also remember we have already got word from the climate people but we got 20 some odd hurricanes and big storms coming this way on the east coast as well coming up coming in before november it's going to be. yes speaking of elections this week president trump tweeted out his desire to possibly belayer even postpone november's election stating quote with universal mail in voting not absentee voting which is good 2020 will be the most any accurate fraudulent election in history it will be a great embarrassment to the us de lay the election until people can properly
6:08 pm
secure and safely vote hollande now we all know the constitution prevents the president from moving or changing any elections in this country but hey this is 2020 a rather unique year should we be concerned that he might try to move the election this november. the constitution has been treated like a doormat for the last 3 years that's for sure but to trump's credit which i am loath to give he read the room it only took him a day to walk that one back because the republicans mcconnell and others of whom are up for reelection quickly made the point that this isn't going to happen but i feel like i'm watching a las vegas magic act you know this is obvious diversion watched the other hand just as these horrible g.d.p. numbers came in look at this 1430000 americans filed for unemployment last week
6:09 pm
alone 33000000 americans are collecting or in that application this is such an obvious distraction from the economy and from the mismanagement of the coronavirus pandemic that i think people are getting on to him because we always take the bait he says something outrageous and it consumes the news cycle but less so this time he just. 5 laughed off the front page hollande you always have your polls on the truth out here so you know that the president and his new. have been hollering over and over again that mail in voting is right with fraud and abuse even though the majority of his administration mail in vote including the president himself is there any truth to these claims of abuse or is this just smoke and mirrors being played by president. well meanwhile he's got his postmaster general who was a major campaign contributor cutting over time just as we're expecting
6:10 pm
a surge of mail in ballots i got to regis i just spotted this on facebook from our fellow broadcaster alan tolls in new hampshire and alan posts if it's safe to how do you put it. if it's come back allan if it's safe to mail tax refunds social security checks stimulus checks draft registrations prescription drugs passports your driver's license or the actual id you would use to vote then it's safe to vote by mail i couldn't say it better myself i've been driving your friendship the mail of the ad because that is what everyone is kind of saying look at the send kids back to school you keep the polls open i mean it's just absolutely ridiculous what we're hearing over and over again up think that you and amidships other right it's really
6:11 pm
just the virgin mary tactics to try to keep the conversation elsewhere and not on the truly horrendous job that we're seeing by not just donald trump but numerous politicians across both files in the wake of this pandemic hollow and i got to say you know it's always great having you on anything coming up in the near future but we should be looking at as far as the big picture is concerned. yeah watch this post-office story we're going to talk about it on my next show which comes up after steve malzberg on friday night who comes up after you and will repeat the show obviously a bunch of times on our t.v. but this post office situation has been a long time coming and they're going to be closing post offices and wait till you hear this on that i cannot wait thank you as always for bringing us the big picture of the one and only mr holland cook always a pleasure sir. i miss seeing you guys in washington eager to get back when it's
6:12 pm

the operation when you have a tiny group of people who have all the power you have to have some means to make sure the rest of us don't get together and take it back. these are sacrificed. places that capitalism exploited and destroyed for profit and left behind misery. environmental devastation and so you see things like voter suppression building more prisons you see gerrymandering all sorts of undemocratic practices are well in the world are well into. question the.
6:15 pm
bill from everyone and give to the government some sketchy and it is civil asset forfeiture the term given when law enforcement takes cash jewelry cars and even homes from those suspected of being connected to criminal activity is a very popular practice and one of the prime targets for civil asset forfeiture is the airport a recent report by the institute of justice discovered that customs and border protection and other department of homeland security agents seized more than $2000000000.00 in cash from travelers and u.s. airports between $22162000000000.00 the report is the 1st to show the use of civil asset forfeiture by federal law enforcement in airports after multiple investigations show most of these passengers were never even charged with crimes people like reston because ozzie a u.s. citizen who attempted to board a flight in 2018 to return to his native albania because as he had roughly 58000.
6:16 pm
and cash in his luggage money he said was taking to repair a house he owned because as he was strip searched and had his entire life savings seized c.b.p. officials claimed the cash was involved in a smuggling and drug trafficking operation but had 0 proof of this and it gets worse and 2017 the justice department office of the inspector general found that the detainee sees more than $4000000000.00 in cash from people suspected of drug activity but that we point $2000000000.00 of bo's seizures were never even connected to a single criminal charge civil asset forfeiture laws are broad and allow for some pretty troubling and sadly legal property removal and in most cases that property whether it's cash cars homes or anything else of value is never returned joining us now to discuss this is director of cologne justice and civil liberties at the institute are their rights are welcome out there they give or have here thank you for having me appreciate it well so asset forfeiture has been
6:17 pm
a hot topic in libertarian circles for years now and it's steadily becoming a sticking point in criminal justice reform policy why do you think it's so widely used especially when as we just talked about many of the people who have their property seized are never actually found guilty of anything. well it's quite simply i mean i was a federal prosecutor in one of the easiest tools they use to put pressure on individuals it's not even a criminal case i mean if you look at some of these cases it's like the united states versus $58000.00 united states versus the way of the united states versus an airplane or whatever and when you make it a civil case what you actually end up doing is lowering the burden of proof you know everybody knows to convict someone you have to prove beyond a reasonable doubt that the individuals guilty when you're doing civil asset forfeiture on the civil side it's just that it's a civil case and so winds of happening you only have to prove beyond a preponderance of the evidence which is a much lower standard and it really is. designed in order to put pressure on
6:18 pm
individuals very often to plead guilty or they walk away i mean this happens immigrants all the time when they're deported they they have assets taken from them and then they have no standing in order to take these cases of to court because they're no longer in the country you know this is amazing it absolutely is one of those things that just really gets stuck in my teeth when i hear stuff like this because it's just it's a subsiding to hear this look law enforcement they always claim that civil last of this is absolutely necessary and we need it for the war on drugs. and subsequently then the war on gangs that you know that's always the biggest use is there any truth to this and then secondly i want to ask you what happens most of the time to these assets after they are seized. well goes into a civil suit for preacher fund that money is actually to congress is designed how that money is going to be split up it very often goes to victims that's a good thing i mean that's one good thing that does happen is it necessary well
6:19 pm
it's really hard or german it is it is it a powerful tool yeah it's a very powerful tool it is one of the most powerful tools that the federal government has because it's instant and you know when because it's instant and you are put on the the the other side of the government and you have to fight against the government or to get your money back and everything is against you you have the hired attorney and member is not a criminal case and attorney is not a point for you you have to do this yourself it is an incredibly powerful tool and you know it's hard to feel bad for the bad guys when that happens and that may go and a lot of assets are taken from crooks criminals and as such i do find it funny that it's a loss of corporate or something you don't see a lot of white collar crimes because that would actually be the most of back to use a bit but it's pretty rare so is it effective yeah it's effective but it's expected against both the guilty and the innocent and i think that is the major problem but that's a great point you brought up about not being used in whitehall. crimes without
6:20 pm
blows my mind because you'd think the you know what you're going after you know goons on wall street who are you know robbing people blowing their trust that would be the perfect opportunity to put the squeeze on i'm interested in. and out there i'm sure you know this but one of the big things that come up in police reform conversations all the time is the trust the issue of trust is the trust gap between law enforcement and the public because of civil asset forfeiture cases and if so what can be done to stop it. why i think it's yes it is incredibly. destructive to the community relations with police because it's unfair listen americans have a long history of being able to deal with harshness and toughness what we do not have a tolerance for is things that are unfair this is unfair it's unfair unfair on its face and i think that right there really screams to the problems we're seeing on the streets with things do not feel like the play out it would be. everybody.
6:21 pm
wants to fight back in the should fight back and i think there is the perfect. thing that we could do to change the right and the left both hate this so why not fix it and the simple things we can do one we can ensure that there's a conviction and even if you don't want to go to 4 and i hear a lot of prosecutors say that takes away their leverage i don't agree with them but ok but at least have a process where if you're not charged with it in so many ways but money is automatic we push that to you there are very simple things we can do and even states that have done the right thing like north carolina that a band civil asport which are they still get around it through something called equable sharing which means that all they have to do is be on a federal task force and they still are allowed to do this so they have bypassed the democratic process by their legislators saying hey we don't want to do this anymore and they still do it because do it the region ave and i find that to be to simply our. i couldn't agree with you more i love your take on this i want to ask
6:22 pm
you is there legislation you but as you said you bet on both sides of this fight is there legislation or a model policy that you've worked on to help open this process of civil asset forfeiture and how it's being abused and and how can this system truly be ended. yeah i mean i have written lots of pieces of legislation to different states and the federal government there is an appetite for it and i think right now there are individuals that are really looking for compromise when it comes to policing and anything related along law enforcement from a justice those types of pieces typically try to and equitable sharing because it's seen as an absolute affront to the will of the states and as a conservative mean armisen or right or that is outrageous that we're all for states' rights and tell we don't want to be more than we should be really for get that that is to as we would have our guiding principles lot of the reform efforts
6:23 pm
to simply talk about sharing they also talk about ensuring that there is some type of burden of proof that's beyond compliance of the evidence if you want to hold someone's money and if you don't i mean i believe it should be beyond a reasonable doubt i think it should be connected to the conviction but you don't want to go that far at least make it something higher than wanted to be evidence at least have something built into that there's not a conviction or there's not even a charge think about that a lot of people are never even charged and they never get their money back because what the government says is ok we couldn't prove the case beyond a reasonable doubt but we couldn't buy a part of the evidence to go ahead and fight a spin and the thousands of dollars that it's going to take to fight this and you know most people say i can't give up one of the big league gap is widening even further. well thank you so much authorizer it was great having you and thanks for enlightening our hot watch of yours. yeah for sure thank you for having me on.

the new york city police department has been making all of the wrong headlines this week my friends yes the over 10000000000 dollar behemoth that is the n.y.p.d. has not only been caught on camera snatching up peaceful protesters off the streets gestapo style and tossing them into the backs of one mark many bands all because of this transgender protester allegedly vandalized some security cameras i mean if that doesn't call for some hardcore iron fist and secret police tactics then then i don't know what does of course being sarcastic this is horrible but that wasn't the only fall smelling n.y.p.d. antics put on display for the world to see this week as the investigative journalist a pro publica published thousands of police discipline records of the city of new york has kept under wraps for decades are to america's trinity chavez has the story . i'm a little outcry against racial injustice the police brutality there been growing calls for greater transparency and accountability when it comes to long horsemen but after

told r.t. while we remain committed to increase transparency we are equally committed to due process while recent legislation repealed new york state civil rights law section 50 a federal judge issued a restraining order prohibiting the release of records of which allegations against our officers were found to be false unfounded or unsubstantiated we await the results of pending litigation meantime pro publica argues that it's not obligated to comply with the judge's pas order because it was not a party to a union lawsuit challenging the release of such records so even in the editor in chief of the outlet said in a statement we understand the arguments against releasing the state but we believe the public good it could do outweighs the potential harm the database gives the people of new york city a glimpse at how allegations involving police misconduct have been handled and allows journalists and ordinary citizens alike to look more deeply at the records of particular officers up until last month new york superhit of the release of
