from everyone and give to the government some sketchy and it is a civil asset forfeiture the term given when law enforcement takes. cash jewelry cars and even homes from those suspected of being connected to criminal activity is a very popular practice and one of the prime targets for civil asset forfeiture is the airport a recent report by the institute of justice the severed that customs and border protection and other department of homeland security agents seize more than $2000000000.00 in cash from travelers and u.s. airports between $22062000000000.00 the report is the 1st to show the use of civil asset forfeiture by federal law enforcement in airports after multiple investigations showed most of these passengers were never even charged

now to discuss this is director of cool justice and civil liberties at our street institute arthur riser welcome other if you think you are having me appreciate it won't sell out the forfeiture has been a hot topic in libertarian circles for years now and it's steadily becoming a sticking point include justice reform policy why do you think it's so widely used especially when as we just. talked about many of the people who have their property seized are never actually found guilty of anything. well it's quite simply i mean i was a federal prosecutor in one of the easiest tools they use to put pressure on individuals it's not even a criminal case i mean if you look at some of these cases it's like the united states versus $58000.00 united states versus the way of the united states versus an airplane or whatever and when you make it a civil case what you actually end up doing is lowering the burden of proof you know everybody knows to convict someone you have to prove beyond a reasonable doubt that the individual is guilty when you're doing civil asset

forfeiture on the civil side it's just that it's a civil case and so winds of happening you only have to prove beyond a preponderance of the evidence which is a much lower standard and it really is designed in order to put pressure on individuals very often to plead guilty or they walk away i mean this happens immigrants all the time when they're deported they they have assets taken from them and then they have no standing in order to take these cases of to court because they're no longer in the country you know this is amazing and it absolutely is one of those things that just really gets stuck in my teeth when i hear stuff like this because it's just it's a subsiding to hear this look law enforcement they always claim that civil our support for tours this is absolutely necessary and we need it for the war on drugs . and subsequently then the war on gangs that you know that's always the biggest use is there any truth to this and then secondly i want to ask you what happens most of the time to these assets after they are seized. well goes into

a civil asset for preacher fund that money is actually to congress is designed how that money is going to be split up it very often goes to victims that's a good thing i mean that's one good thing that does happen is it necessary well it's really hard or german it is it is it a powerful tool yeah it's a very powerful tool it is one of the most powerful tools that the federal government has because it's in its instant. and you know because it's instant and you or put on the the the other side of the government and you have to fight against the government or to get your money back and everything is against you you have the hired attorney and members not a criminal case and attorneys not appointed for you you have to do this yourself it is an incredibly powerful tool and you know it's hard to feel bad for the bad guys when this happened so that may go and a lot of assets are taken from crooks criminals and as such i do find it funny that it's a loss of corporate or something you don't see a lot of white collar crimes because that would actually be the most of back to use

a bit but it's pretty rare so is it effective yeah it's effective but it's affected against both the guilty and the innocent and i think that is the major problem so it's a great point you brought up about not being used in white collar crimes without blows my mind because you think the you know if you're going after you know groups on wall street who are you know are robbing people blind trust that would be the perfect opportunity to put the squeeze on them interesting. and out there i'm sure you know this but one of the big things that come up in police reform conversations all the time is the trust the issue of trust is the trust gap between law enforcement and the public because of civil asset forfeiture cases and if so what can be done to stop it. why i think it's yes it is incredibly. destructive to the community relations with police because it's unfair listen americans have a long history of being able to deal with harshness and toughness what we do not have a tolerance for is things that are unfair this is unfair it's unfair unfair on its

face and i think that right there really screams to the problems we're seeing on the street when things do not feel like the play out it would be. everybody. who wants to fight back in the should fight back and i think there is the perfect. year old. thing that we could do to change the right and the left both hate this so why not fix it and the simple things we can do one we can ensure that there's a conviction and even if you don't want to go that far and i hear a lot of prosecutors say that takes away their leverage i don't agree with them but ok but at least have a process where if you're not charged within so many days but money is automatic we push that to you there are very simple things we can do and even states that have done the right thing like north carolina that a banned civil asport which are they still get around it through something called at the will sharing which means that all they have to do is be on a federal task force and they still are allowed to do this so they have bypassed

the democratic process by their legislators saying hey we don't want to do this anymore and they still do it they just do it through didn't ave and i find that to be to simply outrageous i couldn't agree with you more i love your take on this i want to ask you is there legislation you but as you said you bet on both sides of this fight is there legislation or a model policy that you've worked on the help of this process of civil asset forfeiture and how it's being abused and and how can this system truly be ended. yeah i mean i have written lots of pieces of legislation to different states and the federal government there is an appetite for it and i think right now there are individuals that are really looking for compromise when it comes to policing and anything related along law enforcement criminal justice those types of pieces typically try to an equitable sharing because it's seen as an absolute affront to the will of the states and as a conservative mean armisen or right or that is outrageous that we're all for

states' rights and tell we don't want to be more than we could be really for get that that is because we would have our guiding principles lot of the reform efforts to simply talk about sharing they also talk about ensuring that there is some type of burden of proof that's beyond compliance of the evidence if you want to hold some of the money and if you don't. i believe it should be beyond a reasonable doubt i think it should be connected to conviction but you don't want to go that for at least make it something higher didn't want to be evidence at least have something built into that there's not a conviction or there's not even a charge think about that a lot of people are never even charged and they never get their money back because what the government says is ok we couldn't prove the case beyond a reasonable doubt but we couldn't buy a part of the evidence to go ahead and buy this spin and the thousands of dollars that it's going to take to fight this and you know most people say i can't give up one of them the gap is widening even further. well thank you so much authorizer it

chavez has the story. and the global outcry against racial injustice and police brutality there been growing calls for greater transparency and accountability when it comes to law enforcement but after a federal judge paas the public release of disciplinary records of the n.y.p.d. one organization decided to take matters into its own hands. pro publica is making head. lines after publishing more than 12000 complaints against nearly 4000 active n.y.p.d. officers just days after judge katherine polk fail a pause the public release of the records amid a legal challenge by police fire and jail guard unions the database includes all allegations filed against cops spanning from september 1905 through january 2020 after further analysis that all that found that some 34 officers in the database have faced 40 or more allegations while 303 have had 5 or more substantiated allegations yet stayed on the job the publication drawing fierce criticism from

unions representing police and firefighters which argued that the release of the database could tarnish cops reputations and jeopardize their safety by including allegations that were ultimately unsubstantiated a spokesperson for the n.y.p.d. told r.t. while we remain committed to increase transparency we are equally committed to due process while recent legislation repealed new york state civil rights law section 50 a federal judge issued a restraining order prohibiting the release of records of which allegations against our officers were found to be false unfounded or unsubstantiated we await the results of pending litigation meantime pro publica argues that it's not obligated to comply with the judge's pas order because it was not a party to a union lawsuit challenging the release of such records so even the editor in chief of the outlet said in a statement we understand the arguments against releasing this data but we believe the public good it could do outweighs the potential harm the database gives the people of new york city a glimpse at how allegations involving police misconduct have been handled and
