they also don't need to be catholic. and if we're getting really technical here there's nothing that says you can't nominate a dog if he can shoot hoops then he can interpret the constitution but it's perhaps most notable that nowhere in the constitution does it say that there needs to be 9 justices in fact the number fluctuated between 5 and 10 for almost a century until the late 860 s. when we settled on 9 under ulysses s. grant the 9 justice court has been an institutional norm ever since with a brief exception of 1970 when f.d.r. tried to pack the court with 6 new justices after they struck down parts of the new deal his effort failed with the court did become more conciliatory hold kooky anti-poverty agenda let's face it helping the poor is pretty un-american if barrett is confirmed but the democrats manage to win back the white house and the senate
