a fear and acute anxiety if required to ship prison, accommodation, and facilities with a transgender woman who has male genitalia. however, the subjective concerns of women prisoners are not the only concerns which the defendant had to consider in developing the policies. he also had to take into account the rights of transgender women in the prison system. by bringing this challenge, i did not seek to prevent trans women in prison from leaving indignity or to exclude old trans women from women's presence. however, i feel that trumps women have a history of violence and sexual offending against women. should not be in a situation where they can put our safety at risk. take coleman from the keep prison, single sex campaign group, believes the current regulations are making a mockery of the segregated prison system to our surprise, and frankly, shock. the judges rule. but this practice is lawful that extends to housing, male prisoners with fully functioning male genitalia. i find that quite

regard to the incidence of violence or sexual assault by trans business. female prison. it is very, very, very tiny. the vast majority of assault on women in prisons are not by trends or by other women. if my biological women, when all the biological women. so i think it's very wrong to single out trans people as a group, a somehow being a threat to a danger to women. i think we need to recognize there are some trends, prisoners that have done bad thing, and i condemned that. you know, women, safety is important. we cannot therefore generalize about or trans women prisoners because most pose no risk. they cause no harm. they get on well with other women in the prison, so they should not be penalize or treated any differently. i can say,

i think you're absolutely right peter, i don't think you can, you can use the whole one bad, a whole sports, a whole bunch idea here, and i think you're absolutely right. i think it's very positive that you say that the number of these transgender assaults have been relatively small and relatively few in various prisons. but i wanted to ask you that where should the line be drawn? because here on our team, we have been covering stories of pretty hard core abuse in various correctional facilities, whether it's the u. k or america also in canada as well. in the u. k. for example, it's enough to simply identify as a woman and have a gender recognition certificate, even if the prisoner has a functional male genitalia. and we've heard some female prisoners telling us that concerns about this. your thoughts, peter? well, absolutely, those concerns are totally valid. but initially the big boss, i mean, if a trends woman has a history of violence or sexual assault against women as

a male or as a trans omen, then that clearly has to be taken into account. and unless they have reformed, unless there is some clear evidence, they posed no risk, then there is a case they should not be able to freely mix in a woman's prison. so i think individual assessment is very important. i think this is one of the failings of the prison system. it does need to assess, indeed, all prisoners coming in to jails to assess their risk and danger they may pose to other inmates. and in cases where there is this history of sexual violence or physical violence. and i think that the probe has to be very of a deep and tara to make sure that those trans women are no longer a threat. and indeed we do need to hold out the prospect the people can change. it is true that someone as a man may have done bad things. but as a trans woman, they are totally changed and they pose nervous to anyone. we need to acknowledge

that as well. pete, i do think though, if we reverse the situation a trans man, a former woman being put into a male prison, is that appropriate? i think so. i don't see a problem. you know, i think that the big danger is if we say that trends woman cannot go into women's prisons. if we insist they must go into men's prisons than i think as a trans women. they would be at great danger of potential physical and sexual assault in a male prison. so we have to take that into account as well. there is, of course, an argument which some people say, well, perhaps the best solution is to have a special prisons for trans ruin. and i think that's an issue that is a matter of debate within the trans community. there are different pros and cons, but i think that's certainly an alternative option to try and ensure that trans
