we have been working close to a year now on item 12, the rest from regulation. as you know, this started as a more modest version of arrest brought over all. this is actually -- the problem with the restaurant regulation were identified in a report that the planning department staff did. they realized it looked at 20 years of zoning and found these restaurant regulations are not -- they are pretty broken when this came before the commission you as a commission said we really want you to take this opportunity to overhaul the restaurant regulations.

we have been working with your staff to do so. we think they have an outstanding proposal. is it perfect? no, we're still working out bugs. it is incrediblis it currently n current regulation? absolutely. we hope that you will act on this in a timely manner. this is a section of the planning code that is really broken. as someone who works in government, i think we have an obligation to when we see something crooked, to fix it. if you are a private corporation, you go to a different company that has a good product. bart is the only regional transit opportunity. we hope the continuance will be as brief as possible. i think most of the issues that have been addressed substantively, and i say let's

thank commissioner snyder in particular because of a meeting that i had with our architects, and it was in regards to project candlestick cove, and i think under certain circumstances that when you have an untitled project that has been titled for signature in the past, and there has been a change, sometimes it is brought back to the commission for full review. others are brought forward with the understanding that they incur rich projects and architects to contact the commissioners. -- and they encourage projects and architects to contact the commissioners. another commissioner has spoken to them on this. i think this is a really good policy. in fact, i would encourage wherever possible that whenever projects are being planned, that

whenever possible we have really early input as to design on projects, because we have seen many projects, and we have one today that came out very successfully that we will discuss later, but it took time and redesigned before this finally came out. if we can intercept these things early, then i think it takes a lot of time and money and process. this was good, and i am glad we were able to do that in this particular instance and wherever possible, if there is a way that commissioners can get an early look. not all commissioners will agree on design, of course, but at least to get input and be able to address some of the concerns. thank you very much for doing that. commissioner olague: commissioners of guyasugaya. commissioner sugaya: on tuesday i attended a japan town on

public that was still upset about a project. they felt they did not see commissions that they would like to a scene. we talked about a hearing to delineate which hearings are enforceable by this commission and which are not come and i think we might want to look at having a hearing about that topic, because i know it is something the new -- never a network and others have brought up in the past because people come together with a laundry list of things they would like to see happen. sometimes we put them in, and sometimes we do not, but most the time we do not have the ability to enforce them, and they create a situation of tension because people do not understand we cannot enforce the conditions. maybe we could have a discussion around conditions of approval for different types of projects, and then general public education about what is the jurisdiction of the planning commission for some of the other bodies that interact on bodies we entitled.
