and be able to respond to people about concerns on whether it will be lost or not. commissioner borden: i notice there is a request for proposals for parklands, and one of the things i thought about when i walked by a residential hotel where there are a lot of people milling about, because they do not have an open space to hang out in. i was wondering if we might look at how we can work with the affordable housing providers about having sparklets at residential hotels. these are people that do not want to stay in their small room all day long, but they do not have anywhere else to be. and sometimes they are obstructing the sidewalk because that is the only place they can be. why not look at a pilot program of during park with ioing parklf these buildings to make sure
12:31 pm
that people who need open space have access to it. tomorrow i am talking to regroup from the lakeland economic development council. there is a group of executives better coming to not on the sentences go, but silicon valley to look the best practices. and they're looking to stretch their tech university from the ground up, and there really to come a look at mission bay in sales force -- and sales force and the campus. they are here to study best practices. i wanted you to know people do still think we have best practices. obviously they have a different economic situation. it is more of a smaller city, but they do are really pro- active job of looking at how they can create jobs for people by focusing a lot on education, which i think is a smart approach, and when we are having these conversations about
12:32 pm
housing and jobs and looking at how we can help facilitate that, working with city college or with state to figure out how we can work across ecosystems, because i think the key to people being able to afford housing is obviously having a good jobs. to the extent we can support those institutions in the city that do that work, i think it would be worthwhile. >> commissioner morore. commissioner moore: commissioners, does anyone else want to hold on to your packet? >> i am going to keep mine. ok, that is all. thank you, if we could move forward to directors reports. board of appeals and the

w. the other speakers expressed support for the project, and the committee recommended approval of both ordnances to the board of supervisors. we did hear from the clerk of the board yesterday. it looks like there was the sequel of appeal that has been filed on the project, but we have not on official word it is a valid appeal. we're waiting to hear more on that. right before thanksgiving the full board of supervisors heard an appeal of wireless antennas -- a conditional use authorization of wireless of tennis at noun -- 199 cleveland avenue. -- leeland avenue. the hearing departments that presented the material that had already been presented to you because the appellate raised no further information. you unanimously granted approval on october 6. this was a preferred site type

conditional use authorization. also at that hearing, there with three items introduced i want to share with you. one was introduced by supervisor mar. this would be along portions of gary boulevard. the second one is unfortunate -- ordnance introduced by supervisor cohen. this would be established to facilitate the continued operation of the california college of art and provide a regulatory scheme for future possible expansion of the campus. supervisor mar also introduced a hearing request which we expect will happen this coming monday on the growth of four miller retail ward chain stores within san francisco. we are preparing for that now. >> who was the one bvote against the wireless? supervisor mar?
12:39 pm
>> that is correct. supervisor antonini: could you go over the retail. who was the supervisor in the context -- >> the hearing request says they want to hear about the growth of retail formula stores in san francisco and the impact on small businesses and the economy. we have shared with them the report we provided to this commission earlier this summer. the department will be prepared to present that. we're creating with a small business commission to talk about the efforts we're trying to courtney between this commission and the small business commission to address the issue. >> informational at this point? to go that is correct. >> i wanted to mention most people have noticed this are ready better here for the beach item, but that will not start until 5:00. there is a special time for that

item to be heard today. >> there were no appeals last night. >> of the historic fort preservation committee did not meet this week. that takes you to your 15 minutes general public category. at this time members of the public may introduce you -- may talk to you about items with the exception of agenda items. they may only be approached at items on the calendar. with respect to this category from each member of the public may address you for up to three minutes. i do not have any speaker cards. president olague? : any comments at this time? >> linda chapman from nob hill. i want to raise the subject of people that negotiate conditions
12:41 pm
with the department of developers, conditions you approved without the knowledge of people in the neighborhood at all. i want to put this in perspective, because you will be have lied nation coming before you again before long. you received a letter from the nob hill association, which is a legitimate organization that was not involved in the negotiations last year. what they have tried to do is research and layout as best they could find what were the actual kinds of conditions that existed in the past four evens so that since the judge are rolled up the kind of use that was done in the past but they could show you the use. in contrast, the year before, a little group of people who were not at that time an organized group who had no meetings, no members, who had no way of
12:42 pm
receiving any kind of input, no way for anyone in the neighborhood to know what they were doing come down -- came down and negotiated with the department and with the mayor's office in supervisors. they call themselves the nob hill coalition. i discovered there were people that seem to be trying to protect nob hill out there, and i wanted to help, so i tried to find out who they were last year before they came to you. and i actually used all my investigative skills, and i managed investigations in the federal service for a three-star general spirit that i could not find out who they were, although i lived on nob hill and was once a community organizer. i checked with staff. i checked with newspaper reporters who were reporting on the events with people in the neighborhood. our executive director who knows
12:43 pm
people there. everyone i could find. it could not discover who they were. and finally told me -- finally someone told me to contact the manager and address. he gave me the name of mr. gomez. he sent me these emails. i now receive all the emails that everyone else in the neighborhood who communicated with you at that time got. they're still getting e-mail and communicating with you, because they believe they have an organization working for them here again that is what all of the evils that went out and the neighbor heard work. -- that went out in the neighborhood were. please send us your e-mail addresses. please sign as our petition. please communicate with the petition, and that is what people did i will assume that

perhaps since they said there were 3000, there were. there were not 3000 people that were supporting the conditions that they were negotiating. they knew nothing about it. the coalition for san francisco neighborhoods entertained these people who said they were opposing the project and then gave their endorsements. in the name of the coalition, all those other groups were used to convince the people of nob hill but this was a legitimate group of people working for them. >> i am not sure -- there it is. it gets confusing with the bells sometimes. any additional public comment at this time? please come up to the microphone. this is on items that are not on today's agenda. >> hello. my name is savannah walcott.

i am an environmental study student from san francisco state university. i would like to express my concern today about the lack of composting and recycling bins with than the city of sanford says go. specifically at the golden gate bridge, which is a high-traffic locations. on a trip that my roommate and i took last week to the golden gate bridge, we noticed there were no places for me to properly dispose of an apple i was eating. coming from the sentences the state university campus, i am really expecting to see a three- been system. -- coming from the san francisco state university campus, i am really expecting to see a three- bin system. i feel that since the san francisco city is so progressive, i feel this is important that residents interests have easy access to places where they can easily
12:46 pm
dispose of their waste. high-traffic areas that attract residents and visitors should exemplify and promote such goals. and i am asking for your support today, and thank you for allowing me to speak and for your consideration. >> if i may before you leave the podium, the golden gate bridge district is a separate legal governmental agency with its own board of directors. it is the agency that would be in charge of that, not this one. >> i will look into that. thank you. >> hello my name is caitlin, and am also a student at the san diego state university. my concern is the buildings are
12:47 pm
the number one use of energy and climate change. in order for us to achieve the 20 percent said emissions decrease by 2012, commercial buildings must be strictly but they did -- regulated in regards to their energy consumption. we can transfer it every building into their own grain at my progenitor. i strongly believe the only way this can be achieved is by strict regulation when granting building permits. additionally we need to enforce the use of solar panels, efficient lighting system and water conservation techniques and all of these infrastructures. i have a concern for the lack of marketing and social media is that can get younker community members to get involved in these issues, and i think it is of very easy tool by the use of facebook, twitter that younger people do use every day. it is very easy, and it is hard
12:48 pm
to find meeting such as these and get people involved, because these are very interesting issues. thank you for your time. president olague: any additional public comment? seeing none, additional public comment is closed. >> we can start your regular calendar with item number 10. case no. 1 2011.0716c. >> this is a conditional use authorization to allow sure when williams, a form of the retail paint supply store to operate within the vacant senate space between california and sacramento streets in the poll street neighborhood commercial districts. the subject and the space has
12:49 pm
been vacant since 2008. with regard to conditional use authorization for retail use is, the planning commission is required to consider the following criteria in addition to the standard conditional use finding. one, the existing concentration of other formal we still uses. the ability of other similar retail uses, the compatibility of the proposed formula retail use with aesthetic character. the existing retail vacancy rates, and the existing mix of city-wide serving in neighbor wide city services. due to buildinthe length, they e previously used the subsection when of formulating the criteria. the subsection use for the department analysis bands from sacramento st. to polk street. within that section there are eight formula retail uses. they include two walgreens,

subway, gnc, and and out the door sthrift store. there is another simular business with in this portion that specializes in paek sales. the gnr pay sales. there are also to hardware stores that stock paint and paint supplies as part of their larger offering of products. this includes brownie's hardware and nob hill hardware. the project will be compatible with architectural and aesthetic character of the neighborhood. furthermore, the proposed conditions of approval would require the store front remained visually open and an apparent -- transparent through unobstructed windows. in addition to the subject and is based, there are approximately 12 other vacant commercial store fronts throughout this portion of polk

street. these are mapped on the exhibits in your packet. since your packet went out, the department has received three additional levellers opposition -- letters of opposition. this would allow a store front that has been vacant for the past three years to be occupied for an active retail use. due to the existing vacancy rate in the area, the proposed business would not preclude a locally-owned independent business from establishing their business in the area. sherman williams would provide paint supplies and services than any other retailer in the polk street corridor. -- sherwin williams. this concludes my presentation, and i am available for questions. thank you. >> good afternoon, commissioners. in virginia.

please to be here representing sure when williams -- sherwin williams. we certainly hope we found a tenant that can go there and clean up this space. we do believe they offer a unique opportunity here and a unique product line that is not available. in the second i will turn it over to gary garcia, the district manager for this infants as go bay area. he has been with sure when williams for 38 years. -- sherwin williams. he can answer questions about their specific operating. i will turn it over to gary. >> thank you. sure wsherwin williams is an american company founded in 1877. our sole business is the manufacturing and distribution

of paint. we manufacture paint for very -- various business segments. however, the primary purpose of the polk street vacation is the do-it-yourself consumer. we find a professional painting contractors, the property maintenance painter, the painter who does regular maintenance on apartments and condos and the small commercial painters, those individuals who specialized in painting office buildings and health-care facilities. now, i have been asked several times why we would want a paint store on polk street when there are other suppliers there, the other suppliers as have been
12:54 pm
noted are all in that vicinity. however, we have done it research, market research, and what we have found is there is approximately a $36 million retail gap between the need for a building products and the supply of building products in that area. quite frankly, the paint department in the hardware stores are small. the existing stores will not take a big hit if we come to the neighborhood, because many of the consumers are making purchases outside the district. while many of you think paint as paint, we offer many products that are not available to current suppliers. several examples would be the brazilian it exterior product and decorative concrete finishes and sealers. it is an exterior coating that can be applied in 35 degrees and attaches and 30 minutes. this is a born to the professional painter because of
12:55 pm
the body and voice conditions in san francisco. this technology was developed in san francisco and not available to any other competitor. -- this is important to the professional painter because of the foggy and moist conditions in san francisco. besides paint we offer a wide variety of items including spray and repair parts, specialty primers, specialty calking, wallpaper tools, wood refinishing tools, respirator, ladders, and safety products. most of these products which is not available when i was visiting competitors. sherwin williams has the most stringent quality. this is a perfect product for schools, hospitals, and in the

occupied space. our pro mark 2000 is a complete system for the professional painter. both of these products carry the green seal designation providing reduce environmental impact and improved sustainability. besides selling paint, we offer a different services that many of our current competitors do not. we offer free delivery, in-store color is civilization, computer matching, and color rendering for the professional painting contractor. finally, i want to ensure you sure when williams remains committed to being a good corporate citizen in every community we serve. since 2004 we have completed 17 homework projects. that is a painting enrichment program developed it as a partnership trai. today we have trained over 350

residents from the housing authority, with a 65% and job placement rate. in 2006, gavin newsome declared november 8 sherwin williams dayl . finally, we have joined forces with the way to st. donation to donate 500 gallons of paint per year for the minutes of their facility. in closing, i would like to thank you for your time and hope that you approve our application. president olague: public comment at this time. stephen cornell, and nick bolan ey. i'm not sure. >> good afternoon, commissioners. i am rick harp.

we have four locations in san francisco. one of which is on polk. the polk street corridor is much longer than what staff has presented, as you know. in fact, there are about eight places where you can get paid, both hardware stores and professional paint stores. this is an issue about formula retail. this neighborhood when you stretch it in the upper freeway is filled with many local independent businesses, and also a share of formula retail folks. sherwin williams who's basically the slogan is cover the earth. there currently trying to cover the city. they have three stores right now. they're hoping to get seven or
12:59 pm
eight throughout the city. i am sure they will be here on other projects as they are protested for their development in the city. in essence, they are basically trying to take money out of san francisco, send it to corporate headquarters come and take it out of locally-owned businesses. when someone buys of a gallon of paint from brownie's hardware it cetera, money from that sale is recycling and recirculating in our community in doing well in sentences go, versus the money going outside. i think you need to consider that business like a formula one business that comes in and hurts the local young of businesses that contribute more to our community.
