requirements. and one of the goals of the school district is accountability. promises to the parents and the students. and i would have to say as a counselor and i feel like i know this area really well, that this was not met so far with the class of 2014. and to start now when they are juniors, the question is what was going on before? i knew what was going on before. i knew what was going on when they were freshmen. we would have conversations about it in our counseling department all the time. how did it get this way? so now we're scrambling. okay? and it's really -- the question to all of you is not the product -- not the end product, but how did we get there? if you don't fix the
7:31 pm
dynamic it's going to continue on. instead of having the public relations department have excuses about we don't have money for this and this kind of stuff, you know what you should be saying? i'm sorry, we didn't do it. we didn't have the support. we got to do better and we should do better. and you should be doing better with the sophomore class. there should be someone working on that right now, okay? so i'm tired of getting emails from assistant superintendent with lists about off-track, severely off-track. i know who those students are. i work with them every single day, i know them. and the classes that you are offering for night school, i don't know who decided those classes. i mean no one asked me. i would not choose those
7:32 pm
classes. >> thank you very much. >> good evening ladies and gentlemen. my name is barbara and i am a proud parent of who student. my youngest son is a straight a student at lowell and in his junior and senior year my older son received an award from the president of united states and graduated as valedictorian. first i did not really define what non-violent parenting. was in the scheme of things going from worst to better we have council parenting defined by law, we have corporal parenting and i have materials
7:33 pm
dealting the negative effects. all of which have in common of negative reinforcement being presented against negative parent. in non-violent parenting what we want to do is provide positive reinforcement for positive behavior following the attitude it's okay to make mistakes, but we don't want to practice making mistakes and to move forward with the concept and promote the idea of non-violent parenting. in particular i would like to bring your attention to what i have named the eight pillars of parenting and have i conferred with the department of social services for children's basic needs. and that they should be
7:34 pm
protected from physical, sexual and emotional abuse as defined on the front page. my idea is before graduating from junior high each child should name what the eight pillars of parenting are. and define what "physical abuse" is. >> time. >> thank you very much. >> next. >> >> superintendent carranza, president yee and commissioners. i am a former teacher at leadership high school and a former supervisor with the san francisco teacher residency program. i also sit on two non-profit boards in san francisco and the san francisco coalition of essential small schools. i am here tonight to urge you to take the co-location of gateway
7:35 pm
middle school and creative arts charter off the table. keative arts charter is an amazing community with very loyal teachers, staff, parents and students. we have a strong program that is in high demonstrate. we had over 175 applications last year for 44 kindergarten spots and had over 90 of those students on our wait list at the beginning of the school year. currently we have had over 195 parents come and tour our school for next year. and over 150 of those parents have submitted intent to enroll forms. next year we will have 360 students. with our growing population we have a growing need for classrooms. next year in order to maintain the program, we will need annex buildings. it's not feasible for gateway
7:36 pm
middle school to co-locate on our current campus and use the annex space when our program will need more of the space with each passing year. despite the uncertainty and challenges around facilities that have been presented to the creative arts community, it continues to be a strong and sustaining school. i urge you to make the commitment that the co-location of gateway and creative arts will be taken off the table. we are working forward to working with you to find an alternative solution for everyone involved. thank you for your time. >> good evening commissioners, superintendent. i am also a parent at creative arts. i am also here about the proposal to co-locate gateway middle school with its 300 students on our campus. and to ask you to direct your staff to take the proposal off the table. as i think you all know we have
7:37 pm
had some challenges recently, particularly with last year's fire, and the aftermath of that. but we have a really resilient community. and we have managed to weather the challenges pretty well and we're really looking forward to next year when the repairs from the fire and the construction will be over and things will settle down. but if an additional 300 students are shoehorned into that campus there will not be any settling down. when i try to contemplate 300 additional middle schoolchildren, all i can envision is pandemonium. i can't imagine any children would get enough time outside if there were an additional 300 children on the campus. part of the reason my family choose this particular school it's a small k-8 and my daughter thrives in the close knit community. and i am worried about the
7:38 pm
social impact of an additional 300 middle schoolers there in that space. some kids thrive in a huge middle school environment and some kids thrive in a small middle school environment. although my kid is older i really sympathize with kids of little kids who have to contemplate sending their kindergartner to a campus with 300 middle schoolers and aren't part of the community that we build between our older kids and younger kids. expecting kindergartners to share a compass campus like that is hard to imagine. our board has been working with your staff to try to figure something out for months and we're not really sure what to do right now. i'm almost done. a lost community is going to come to your next meeting and i hope when we do it is to thank you for taking this off the table.
7:39 pm
thank you for your time and thank you for your work. >> thank you. >> good evening commissioners. president yee, superintendent carranza. in my day job i'm a lawyer, who practices school law and i represent school districts. as such i have a great understanding and passion for the job that you do in making decisions surrounding charter schools. i'm here to advocate for my daughter and not for charter schools. the proposal to co-locate gateway middle school at the golden gate campus is not feasible. creative arts has been operating without these facilities for almost two years now. between the fire and construction our children have been rotating out lunchtime on the basketball court for 15 minutes. we have no place for school assembly or theater production
7:40 pm
and our library doubles as a [phao-ubgsz/] room and we do not have the space most middle school have such as a gym, science lab or computer lab. locating an additional 300 middles schoolers on the campus raises concerns for a variety of reasons, most importantly the safety of young children on campus. my daughter has always been weary of the big kids. and i'm sure she is not alone. the idea of having over 300 more big kids on campus that will already have 140 middle schoolers and 13-14 and 168 in 15-16 is frightening for parents and children. if you have been to the campus and i do invite you to visit, you know how compacted the shared space already is. we look forward to the time when the annex is operational and question begin to use the refurbished space. i would like to make a quick [kph-epbgs/] mention of the
7:41 pm
capacity issue. capacity cannot be viewed only in terms of numbers of students per classroom. the capacity analysis must take into account specialty uses for assembly, library -- one more second please -- library, dance and art and we don't believe there is enough yard space to safely support the population of both schools. we will do a facility analysis, if it comes to that, but we hope it doesn't. we understand that no decision needs to be made before february 1st, but we could encourage you to take the proposal off the table. think there are a lot of ways to solve it and there are co-locations that can work without impact to us. >> time. >> thank you for your time. >> i had called up some other people, are they here? if they are here, could you please step
7:42 pm
up? >> you began this meeting this evening by commemorating human rights and i would like to know why the issue of bullying hasn't been addressed. recently there was a press conference held and the superintendent said it was slander. there was no physical abuse and bullying of students at martin luther king. well, i would say there was a thorough investigation and the staff involved in that incident haven't been interviewed bit management at the school district. so what kind of thorough investigation was done by school district about the bullying of students at martin luther king school? furthermore we just heard about the charter school and want a music room bechtel and the
7:43 pm
program are involve in san francisco as are other privatization companis who want to privatize the schools and drive the schools towards core standards. i would argue that is for the destruction of education. it's not the advance of students of san francisco and the students of this country. core standards are being used not to provide more teaching, more education, but to drive more testing and to drive really the students out and further privatization of the school. another issue was a video done of this incident at the school. there was a video done of the physical abuse of the student at the school and apparently amos brown was able to see that video. who allowed him to see that video, since he is not a parent of the student? is this
7:44 pm
allowed? other people have asked to see the have and not been provided that opportunity. there are serious and systematic problems going on and it has to be addressed. if this is slander, it's absolutely untrue and i think the superintendent should apologize to the people, the parents and students at mlk. thank you. >> good evening everyone. my name was in the paper for -- i will just quote it, "she yelled at me in front of two classes of students," said linda cook a former english teacher who was removed from her job and i will use another [kwo-ets/] [tpra-erlt/], "there are procedures in place to evaluate personnel and we follow these procedures," said school superintendent richard carranza in a statement.
7:45 pm
slandser is when someone tells a lie about another. it is slander when the lie can damage another's reputation. a group of students wrote a letter about the principal's behavior when she came to the classroom and i will read a short portion of this to you guys. "i don't have time for this," in a rude way and in a very offensive way that upset the entire class and just walked out and slammed the door. this is your principal, slamming doors in the front of students. miss cooks was very hurt that she didn't say a thing and just packed her stuff and called miss nancy and asked for a sub for her class so she could leave we are shocked that our principal would act like that, especially in front of the whole class and we felt very, very sad and mad that our teacher left. we are not forced to write this letter. we wrote this because we love
7:46 pm
and care about miss cooks. this is from a group of students who wrote this. and you know -- you all know that there is a problem at mlk. why don't you do something? the naacp is there, why don't you pay a security guard instead of the naacp? what amount of money are they getting? that is not the purpose of the naacp and amos brown. why don't you do something? like i said before, why don't you do the right thing over this christmas holiday? remember jesus is the reason for the season and think about how you want your children? that is all you have to do -- how would you like it to your daughter or son came home and say the principal sat on me today? i wouldn't like it very much. >> thank you. >> thank you. >> that is your two minutes.
7:47 pm
>> yes, my name is karen and i work with severely impaired children. i would like everybody here to please take out a piece of paper and a pencil. and please write this down. go to the website tonight when you get home or tomorrow of the united public workers for action.
7:48 pm
their website is www.upwa.org. the reason i'm here is because i went to that website today, and i saw an incredible narrative about mlk junior middle school. i saw two press rallies where people who were employees of the school district, members of uesf and because of the incident at mlk back in february where the principal sat on the student and as a result of that, as a result of that event, 17 people were fired or dismissed or reorganized from counselor into social worker. right? now i want to know how the board, how you mr. carranza can put out a memo and say there
7:49 pm
was a complete investigation, when you didn't even interview the people would were involved? maybe you would get up and respond to me. i would really like that as a matter of fact. and i also would like to know how tobey, the great security guard who has worked for the district for 40 years and loves the kids. he really does. how the police report that was put in for him, that he did not sign said that a student attacked him, when tobey himself says that the principal fell on him. and she is not a light woman. >> thank you. >> thank you very much for your comments. mr. carranza, did you want to say anything? >> sure.
7:50 pm
thank you, president yee, and absolutely unequivocal that we take student safety -- in particular the no. 8, the no. 3, and the no. 38. you see the no. 8 represents the number of latino students proficient before the current principal took over at mlk. 8% were proficient in english language, and math. 3% or proficient in terms of african-american students before this principal took over. 3%. and if that is not enough, let's talk about 17 and 33.
7:51 pm
33% of the latino students being proficient in language arts and 17% proficient in math. how can we as adults in this community who have our high school diplomas and some cases have your bachelors degrees and master degrees and doctorates who have shown proficiency and gone to college, sit and purport to be for the kids when you have 3% of the african-american students proficient? how can we say that and not once have i heard what are you going do about that? we're going to do something about that and that is with a our strategic plan is about and you are with us or not and we welcome and join arms with the naacp, who have said, by the way, they are getting not one dime. not one penny and going out and
7:52 pm
raising their own funding to support our students at mlk and in the spirit of martin luther king jr., who went to jail because he wanted a better future, we're going to do whatever it takes to ensure that our kids have a better future at mlk. but as you think about this, i want you to think about 8, 3, 33, and 17. and when we start talking about those numbers being 100%, then we're talking about what the real work is about. [ applause ] >> so we're going to move on to -- >> president yee? superintendent, i am from martin luther king. >> i'm sorry, do you have a speaker card? >> i don't have a speaker card. >> i'm sorry. >> i am asking if i could say a few words, please?
7:53 pm
>> no. you don't have a speaker card. >> i just wanted to thank superintendent carranza for taking a stand and for those watching online, letting them know the reality of what is really going on. if he is bold enough to take a stand, i hope and a pray that everyone here in this room, on this board, all educators, parents, security, secretaries, whoever they may be, who are in charge of our children when they are not in our care, and they are at the school site that we have the utmost compassion and respect for our children. so i just wanted to say thank you because all of you know on this board know how many times that have i come forward and asked for help, but
7:54 pm
what i have gotten in return is removal. i would like for you to reach out to me, because i know what works in the bayview and in the southeast. i know the families and the communities in the bayview. i know the church leaders in the bayview and in the southeast sector of the city. i know that we need to close the achievement gap of the targeted population, which is the african-american, the latinos, the polynesians, and our chinese-american children, because we are having all of these problems at our school sites our chinese-american children have come to me and told me that they will not do well in the c s.a.t. and they are struggling and that should not be. thank you for allowing me this time president yee, thank you. >> thank you.
7:55 pm
advisory committee reports, appointments by board members? seeing none, item l. special order of business. i now call the public hearing and approval of the state testing apportionment waiver. is there a motion and second? >> i move. >> second. >> reading of recommendation by commissioner designee. mr. burke? >> superintendent, commissioners, my name is john burke, i'm the supervisor for the assessments office. requested action that the board of supervisors -- the board of education of the san francisco unified school district will hold a public hearing regarding the submission of a generwaiver request to the california department of education and support said waiver under the general waiver authority of
7:56 pm
education code 330 50-33053, the california code of regulations section to be waived. celdt ccr 1517-5b1a which requires that the california english language development test, california english language development test committee on higher education aparking lotionment request be sent to the california department of education postmarked no later than december 31 2012. a request for 88,790,000 dollars from the state, which if we submit this waiver we'll be able to receive.
7:57 pm
>> so i don't have any public comment cards for this. any comments from the board members. seeing none roll call. >> thank you, miss ly? >> yes. miss wong? >> yes. >> miss fewer? >> yes. >> miss maufas? >> yes. >> miss mendoza? >> aye. >> dr. maufas? murase. >> aye? >> miss wynns? >> aye. >> mr. yee? >> aye >> seven ayes. >> thank you. the second special order of business would be the recommendation that the board of education of the san francisco unified school district review and adopt the developer impact fee amount and five-year reports for the five year ending june 30, 2012. is there a motion and second? >> so moved.
7:58 pm
>> second. >> reading by commission designee. >> good evening, commissioners, it's that time for the most exciting report that you will hear. i thought i had the monoply until i heard the last item identified and i figured there was some competition for this report. there has been a lot of great news tonight, i guess in a funny sort of way buried in this rather droll report. for those of you who may remember that there were a couple of sections in the government code that require every school district in california, every year to provide the following information on what is called "developer impact fees," which are essentially the fees that a
7:59 pm
school district collects from developers that build within our cities and our counties, depending on whether it's a commercial or residential project and to report every year how much money we collected and how much interest we earned and what we spent the money with and to make sure that money was spent appropriately. and so also provide a certain projection of five years down the road, what we intend to spend the money on? and that is a requirement of the government code and so every year we hire a consultant to do an outside audit of our fees and provide the report. and so the requested action, i would ask of the board tonight is that the board of education of the san francisco unified school district review and adopt the developer impact fee annual and five-year reports for the fiscal year ending june 30, 2012. the attached report
