barrel state. the restaurant will have a capacity to of 149 persons, currently the permitted hours of operation of the restaurant use is are 9 a.m. to 11 p.m. the proposal is to extend the permitted hours of the operation to 2:00 a.m.. >> the use will provide a limited amount of beer, brewing on the premises with an alcohol type of 75, the proposal will provide the commercial space and no ex-expansion of the building envelope. today the department has received e-mails asking for information and indicated that his support of the proposed projects and the department has received also two letters of opposition to the project because of concerns that the extended hours will cause an issue for the neighborhood residents. >> they have submitted 29 letters in approval and two out

reach meetings and engaged in efforts in which they will scribe in their presentation. and also received a letter of the north of the panhandle neighborhood association that requested the planning commission approve the proposed project with the following conditions, the conditional use is not attached to the property itself, but the brew house and the sponsors of the application, it is reviewed for feedback and comments and complaints related to the extended hours. the planning department staff is recommending that the proposed project be approved with conditions as indicated in the draft motion under exhibit a, that it is permitted hours between 6:00 a.m. and 2 a.m.. and this concludes the presentation and also available to answer any questions. >> thank you. >> project sponsor?

our project liaison with the neighborhood, and the project coordinator which we will talk more about. thank you. >> good evening, planning commissioners, my name is amy ellis and i am the community out reach liaison and i wanted to speak about how we will be a family friendly establishment. 700 block of fulton street has been blieted for many years and there are multiple vacancies on that block and we feel that right now is the perfect time to open a business such as ours and it will be an anchor business for the community and the block and as he mentioned we will super a local focus and all of the individuals involved are part of the neighborhood. the vacantcy has been ongoing for 9 years, so there is absolutely a need to have a business go in there and be a success. we really feel that there is a lack of establishment such as

hours on fulton street and in that neighborhood, that are opened to serve food later in the evening. we feel strongly that we need the extended hours of operation in order to be successful during our first year as you already know, many restaurants do not survive the first year and we would like for our business to be a success. we have conducted out reach in the community, for over a year and a half, we really feel there is a ground swell of neighborhood support as you will see evidenced in the 29 letters of support that were submitted by folks of all ages from properties surrounding where we will be going. we really feel that it is a necessary and desirable improvement for the neighborhood. as mrs. young has indicated in her report as well. i would like to take a moment to speak about the safety measure and how we will insure that there were no not disturbances to the neighborhood. all staff manage and hers owners will be working

diligently to insure that there are not any distar banses for area residents. the brew house is not a nightclub and will not have amplified sound and an all ages friendly establishment. >> per conversations with officer wu and sergeant from park station which began in 2012. it will be brightly lit and utilizing security cameras. we are working with the station and intend on taking on any and all recommendations that the sfpd may have for us. if one of the managers is not on site, there is a manager on duty who is specifically dedicated to handling the property at all hours of operation. >> when the time of closure approaches, that there are no crowds gathering in front of our business as they exit and we will have a point person at the door who will be monitoring

patrons as they exit at the time. and inside and outside to remind them as they exit and, and remind the patrons to keep the noise levels and not to disturb anyone otherwise of course we would not be able to they are approve and committed to doing as we say. >> the bar manager in the audience has a decade of experience previously managing the bar program. she has a record of having had no abc violations are issues of any kind under her watch and she plans to participate in lead training from the abc which is licensing education on alcohol and drugs. if issues should arise they will be addressed by the owner, rather than a staff person or a manager. and the owner is always easily reachable by cell, if he is not

on site, and this last year and a half we have given out his cell phone to many members of the community and it is currently listed on our page web. >> we have extensive conversations with the director of the university of san francisco to be sure that every precaution is taken to prevent the under aged drinking and anything on the part of usf students, we are well aware that they have occurred on the 17th block, during the operation of a nightclub which has since closed. and we understand the concerns and the history. and so we would like to take every possible measure to reassure our neighbors that we will be respectful and proactive when it comes to mitigating any issues that may arise. >> to that end, we ask to not be penalized to anything that previously occurred with the business that had a different focus from ours. >> the business that one of the letters of opposition mentions was a nightclub whereas we are

a restaurant and micro brewery. we feel our out reach effort and willingness to engage with the community signals that we are committed to being good neighbors and we will continue to do so. i would like to also previously touch upon the out reach that we have already conducted and we have engaged in public out reach with the san francisco police department, of course the park station, the university of san francisco, the north of han pannedle association, and the village of the place and lar kin services and zion church and the supervisor breed's office. we we have the letters of support from the panhandle of the association as well. i would like to briefly mention of the 29 letters supported there were letters submitted from neighbors, three neighbors that share a wall with our property and there were letters

speak on this item? >> good evening, my name is lee elson and i am here to express my support for the barrel head, restaurant and brewery, i live two steps away and share a backyard, and it has been closed for ten years now, the building has been deter ating and what happens with the buildings that are vacant and we have got a lot of trouble over there and negative attention, and homeless encampments and graffiti and broken glass and i have several instances where i am uncomfortable and fear for my own safety so much so that i don't approach that side of the block at night. i think that it would be

wonderful to open this, talking to my neighbors, we are blown away and can't believe that this is a possibility that it could happen and that this business could open and our community could just really try. and we have nothing like this in the neighborhood, except for a row of vacant buildings. and i am so excited for this to happen, i ask for your support, and making this happen, and the extending the hours so that this business has every potential in being thriving and doing well. and a corner stone of our neighborhood and the western edition nopa neighborhood. thank you. >> thank you. >> any further public comment? >> good evening. just quickly, my name is andrew kings dale and i also live around the corner from where the projector the restaurant is going to be, and i am the president of my home owner's association and i wanted to express my unbridled enthusiasm

for the project i think that it will be a asset to the neighborhood. everyone is, because it is vacant and there are very few place to eat or drink in the neighborhood to gather after 10. and so nobody has expressed any concerns about noise at least to me, i think that there should be concern and having the owners and managers and be cap able of keeping the noise down just like the many other establishments in the city that are opened to 2:00, thank you. >> thank you. >> further public comment? >> seeing none, public comment is closed. commission antonini? >> thank you. i would like this project a lot. and it has always been a little bit of a mystery to me why that particular part of fulton street never has seemed to do too well and this, i hope will help a lot in the regards to that portion of town.

and often you are at a usf basketball game and you are thinking about getting something to eat nearby and there are not a lot of choices. i mean the corner store that opened recently they are doing well. and i hope that this is along those same lines, a place where you can go a little later in the evening and get dinner and have a beer and very supportive and it sounds like there is a lot of support. >> commissioner hillis? >> yeah, i too am very supportive, i live in the neighborhood. and i have seen kind of the out reach that you have done or at least seen the fliers that you have put out for the out reach, it is a tough spot. but it is a great use for that building. and i know that it is the last, it was a bar ten years ago. that i used to go to and play pool which was nice, but it is good that it is finally being reused. i like what you are doing and i think that it fits well with the neighborhood and so i am supportive and i would actually move to approve.

for two actions regarding the proposed 162 unit residential project at 101 polk street. it is located at the northwest corner of polk and haze streets in the downtown civic neighborhood and the zoning district. >> the proposed building is 13 stories and 120 feet tall and will provide 19 on site affordable units that will be located on the site currently used by a surface parking lot. the building contains 51 subgrade parking spaces including one space and 52 bicycle parking spaces. the project sponsor will give a presentation regarding the design, but i would like to focus on the regular and policy issues. >> order to proceed it will need a change in 309, including the granting of several exceptions it allows it to seek

exception from strict compliance with only certain sections of code providing that the commission makes findings, the request requests exceptions regarding the rear yard, parking and the reduction of ground level wind currents. compliance with the criteria for each exception is described in the draft section 309 motions in your packets i am available to discuss any of these specific exceptions in detail if you have any questions, in short, they believe that the requested exceptions are warranted and the criteria that is established in the planning code. >> the project requires two separate uses, and to allow the additional for affordable dwelling units and second to allow for a greater density. i am available to discuss the specifics of this conditional use in detail, but the staff does believe that they are warranted and that it is the priority to create more housing

especially affordable housing. >> the department has received a number of letters from neighbors and community groups in support of the project and one e-mail expressing concerns, i have additional letters of support for your review as well as a response from the project sponsor. in conclusion, the department supports the project because it meets the goals and the objective of the plan to create new housing, affordable housing and close the jobs in the downtown with access to public transit and a walkable urban context. the project is necessary and desirable and compatible with the surrounding neighborhood and meets all applicable requirements of the code aside from the exceptions in the 309 application. staff recommends that the commission approve the project with conditions. lastly, as an administrative item there are two small directions to the seconds 309 motion, although the staff reports that there are 8 walk up units there are actually only four. and also in the conditions of approval, the public condition has been updated to include the

option to pay the public art fee kh, is the standard allowance. should the commission approve the project, the final motions will reflect these changes. thank you and that concludes my presentation and i am available for questions. >> thank you. >> project sponsor? >> hi, my name is oz erickson and would you get that? if you could get that. trying to get a picture up on the computer. i will talk a little bit about the project and what we are did he go there, it is a currently a surface parking lot at 63 parking spaces right now. it was a former gas station. it is as the planner noted it is in the c3 g area and it is general downtown zoning, we are right next to the civic center

and right next to the market plan and in fact we border it and our project has been designed entirely within the confines and the approach of the plan. dense housing, replacing surface parking lots. i would note that since we started this thing two years ago and since we started the area just ratically changed, you have krisnights coming on and we are doing 100 vaness, and most importantly the zone is vast and twitter building alone there are 7,000 jobs and that is just walking distance from our project. that would be the equivalent of 3500 units of housing and this is a start th. is 162 units combined with our 100 vaness. one of the areas that are... this is the probably the west of chicago, it is probably the best served public transit area in the western part of the united states and there are 37

transit lines running there and four lines and 700 metro and 16 muni buses, vaness and brt, it is incredible transportation, easy access to the south bay highways and google etc.. and haze valley is just two blocks away. and this project, and with the knights and our other project 100 and, this is going to change this is really important right now it is a dangerous area to walk at night. so the project. there is a picture of it. >> there is the picture of the project. and it is a nice building. you look at the design now and that is our 6th design. and i don't have time to tell you a story, maybe i will tell you it any ways. we went through the planning and we made presentation after presentation, and i really liked when jackson and we kept getting shot down and shot down

and finally we want up this one and we will show you how it goes to the historical neighborhood. and you know this took forever, but finally we get the staff support. two weeks ago, i go meet with tom masenbrado of the hud. and tom says i swear to god in the first five minutes you know that is a historical district and if that building does not go with the historical, the nature of the building of the area we can't get involved. and it is just, like my thought was john, ram saved my ass. it is really really funny. and any way, we have... let me back up. >> there is the picture. >> pardon me? >> it should come on. >> any way, we have open space, we have salariums and we have a

yeah, we picked up the different elements and the base and the balconies and the whole massing is basically driven by what is around, or by what is around there. i am sorry it does not show so clearly, but we made a major effort with the city planned to do that. finally, we have reached out to everybody in the neighborhood. we have in total, eleven formal letters of support to the best of our knowledge there was no one who was opposed there was someone who questioned it and took a neutral position and we actually formally answered the responses. there was no, we were actually doing everything that they

beautifully, and it fits in with the painstakingly fits in with the neighborhood. it fits in with what is now, three rapidly evolving neighborhood. and we are watching mid mark debt and the civic center exploding and this is absolutely wonderful how this fits in with the direction that these neighbors are going. and finally, the only remark that i would make is that would i have to have been to several dozen planning commission meetings over the years leaving at night and walk down polk street and go right to get to west portal. the best that you could say about that neighborhood at night is that it is uninviting. this project is going to change that. i hope that you will not hesitate
