communication and this is a great model of what i've been trying to articulate. i call it within the concepts of actual contents this provides information to teach to folks in the corridors so they can improve their neighborhoods. if we can build the capacity in those neighborhoods it will carry on. so really appreciate that and want to see the department do more of that. and along the lines of captive commissioner talked about providing accessibility to the data. i think that could help neighborhoods also. they've already participated in some of the collecting of it. so thank you >> commissioner moore. >> following up on capacity building. i think in the idea of

nothing further we can move on to item 7 formula retail controls recommendations to the board of supervisors that the issue of formula retail rail be looked to understand the issue. >> good afternoon amy rogers of the planning department staff where we're here at the request of commission president fong and would like to note an error on the first sentence in 2011 i believe when the board asked for revisions and earlier this summer in review of the multiple frldz - we've been looking at this and his request was in june. as the report before you outlines there are currently 7

active proposals that would change the way the city formula - multiple supervisors are looking at the issue and we think it's timely you asked for this presentation. if i were to characterize those the first would be changes to the geography areas. that includes moving the controls such as argue downtown 3 district and supervisor kim's to the changes by supervisor cowen for the bay view areas. and other changes that are a foot are structural changes. this includes definition

changes. and what should we look at when reformulaing rail. those structural changes are best done at the citywide level and we would like them defined across the city and where's there's a demonstrate need but generally we find feel that overall it should be consistent across the city. and in addition to the proposals outlined in your packet that supervisor mar plans on introducing another ordinance. his ordinance would look at changing the definition of formula rail and increasing the geographic areas it does apply

and we're interested in learning. so in the of the ideas our primary goals today we would like to have time to look at the proposals which we feel is desperately needsed the report before you is a good start and we've - amy cowen joins us here to discuss the issue today. so let's jump into our presentation we have different colleagues to decide the parts and i'm happy to introduce our intermediate and we'll do a review of some of the case laws

in other cities. then my colleague will talk about the particular issues and how we're going to explore the issues and prepare a draft outline for those structural changes. so let us begin. good afternoon, commissioners planning staff. i wanted to start by highlighting a view moments. the first formula retails were adopted in on a 4 and they required 212 notification in c districts. they abandon formula daily and now it's renamed. and they did require a conditional ice authorization on

specific rocks and lots on coals streets. i will note that at that time the department did not support those and the legislation was forwarded onto the board. at that time when the legislation was first introduced by supervisors gonzalez the definition of retail was 4 or morality establishments and by the time the second and third legislation formula come up it ended up being the 12 edition. there were incremental changes including a ban on the north beach neighborhoods and in the japan special use district.

and in 2007 the voters passed a formula retail and that requirement is still in place. we can't change the remit, however, the definition of formula retail maybe alternated through the typical legislation e legislative process. and again, there were changes but the basic structure is still in place. so the definition of formula retail is a type of activity with 11 other retail establishments maintenance two or more of the following features a standard listed facade a standard listed decore and standard listed sicken.

in most areas the formula retail applies the c u criteria are the same regardless or the size and regardless of the number of retail outlets where 12 or 1 thousand. before i move on regarding the retail formulas i'll turn to over to my colleagues for controls about formula retail >> good afternoon, commissioners i'm jenny planning department intermediate. first i'll present non-formula retail and formula usage and second i'll talk about that

cross the nation. first, it's important to note that most of the existing research is on big box impacts not on smaller storewide. we found one study in san francisco. month studies were done by a nonprofit who promotes local stores. so for those rations the city wants to conduct its own study. and most studies look at less immense studies. those studies tend to describe the local increased spending by non-chain stores. and at the same time the formula retailers provided goods and services and serve as

neighborhood anchors. in 2007 a study was done and found that independent routines do have the most growth. the money is kept and recycled in the local economy and this generates more income for the local services. zoning across the nation. recently many small california cities driven their laws like san francisco. but they seek to prevent a formula retail establishments. also the concerned is disruption of the culture of the

neighborhood. and discouragement of some services. so they have limited the number of the establishments permitted and some have abandon. our second example a neighborhood in new york city has the same concerns but they already have limited commercial space speaker at that time, 69 banks had opened for retail in the upper side. and the city adopted the upper west side which provided stricter controls for the regional hub. the controls while not the recreational - the intent felt

control is to prevent and keep a safe neighborhood while protecting neighborhoods for services >> now i'll turn is back over to my colleague >> so the long-term goal is a set of consistent citywide controls that can be refined if necessary and needed for specific areas. but we're addressing a number of topics sincerely o e w d is working on and our study will address. those include the definition and implementation of the controls. specifically does our definition capture the appropriate uses. currently the definition is only

local specifics but if they have fewer than 12 in the u.s. wouldn't be countered formula retail. there are nationally known use not - not stores but brands. gas stations are not considered formula retail. we're looking at our criteria for evaluation. is 11 or other establishments should formula retail business with 12 exciting outlets be evaluated like a large chain like sub by the way. should our criteria reflect

whether or not a proposed business has outlets in the bay area like pet food express or should we consider separately a national chain like starbuck's. and i'm thinking about pharmacies that provided retail that's not provided by depict operators or are there areas we should look at human resources and when considering new applications what are the guidelines. what are the guidelines working in the upper area. we would like to look at visual impacts by definition formula retails have sicken or color scheme and can that standard

standardization respond to the san francisco neighborhood. we're looking vacancies and the affordability of jobs and other services. we would like to look at the geography broundz and they apply in the dnc district but two proposals are the intermediate controls by supervisor kim extend the controls into neighborhood that have not been subjected to them. so today before you is a draft recommend to the board of supervisors that the formulas by looking at extensively. and the board can then look at

the policy going forward. our timeline is short. we hope to select a consultant immediately and to return to this commission in the fall with a mid report and complete the study by the end of the fail. that includes my presentation. i have a handout on one side is a chart that summarizes the zoning district and also specific formula retails and on the other side it's the criteria we use for physical retail and those are available for the public as well. and the second i have the information won a letter with suggestions for modifications to the draft ordinance as well as

report and we want to commend the staff setting forgot the issues from board members of what's the future of retail in san francisco. so i want to share with you the committee at belmount is wholeheartedly in support. the points and the scope of work that the staff sets forward is wonderful. this process is good and the staff has outlined that in the report. it will simplify the staff retail citywide and and belmount in particular c-3 districts have not be regulated and the vast majority of our members are from

achieve that balance. i really like the example in the study of europe west side and the study of coronado in california. the analysis has been point out in order - what's the right balance of national and local. what's the right balance for businesses of all sizes. and it's very mind-boggling and i sometimes look around the neighborhood and we have so many neighborhoods and in each neighborhoods there are corridors of different density and i look forward to hearing the analysis and conclusions from the staff as what are some of the uniform policies that can be applied across the city by
