view hunters plan overall. that concludes my presentation >> project sponsor please. >> good afternoon. i'm steve with digital reality trust. i'm here today to request the commission adopt the final desolation. a little bit of background here a real estate trust and we specialize in facilities. their also known as as the internet services challenges. we are that founded here, no san francisco and were headquartered

here. a little bit of history about the site of paul avenue. in 1999 paul avenue was a vacant set of warehouses that was the northern california distribution but as we went through various approvals of the expansion we worked closely with the city at the time with the legislation so we're familiar with it. my involvement goes back i was there for 5 years prior to digital realty forming. what we do at 200 paul avenue we lease space to companies for you s c use we provide the complete

if i did out spaces which includes those telecommunication equipment or we'll lease some shelf space and put in the types of systems they need. those customers have routing and switching equipment for voice services and storage and things of that nature the digital economy that supports us today. a lot of the customers are t mobile. we provide the services to san francisco and the surrounding area. astound is innovate company they provide services for voice in san francisco. we have 12 major customers that support the residents in san

francisco. i think i mentioned that a robust power infrastructure with the cooling systems is necessary for those kind of facilities it assures the quality of work for them. we already been a good neighbor at paul avenue and try to meet the needs of the community. we worked with a number of the stakeholders in the community resulting in an m l u with the promise. most important the project will reduce emission at the site. some of the existing engines at the site don't have the filter but as we install the new ones their required to have the filters and we'll retrofit the
12:35 pm
balanced engines and it results in a reductions of emissions. we've worked out using the clean equipment not taking advantage of any of the laws or rules. the green screening from the east funding of street trees in front of paul avenue and an conspiratoror street and also working with the local y t d on work force initiatives. additionally we've tried to make sure that everyone knows they can reach out to us and chris is our manager and we wanted to make sure they had his number so we made sure we have that connection. in closing paul avenue is a key infrastructure for the
12:36 pm
surrounding bay area providing critical back up services, you know, >> bob: those services to provide 24 hour services. we asked the commission to adopt this and the equipment use for the yard and i'll turn to over to greg miller to touch on more. >> thank you. >> good afternoon president and fong and members of the commission. greg. first of all, i want to thank the staff (calling names) from the department for all they're hard work and also the staff from the mayor's office. my appreciate the attention to the project.
12:37 pm
commissioners today, i ask you grant the request use authorization for the expansion emergency use back up generator on paul. if i could have the overhead briefly. just to give you a little bit of context the location of the project is right here almost dead center in the site. this is paul avenue up here and this is the north end of the project up here. we're about 4 hundred feet from the paul avenue here and over 4 hundred feet from the north end of the property here. the cal train runs around here and it dips down 50 feet or more below grade. briefly commissioner the project involves the remove of the
12:38 pm
portion of the building to accommodate the generator generated. it's located morning in the middle of the project and would effect 21 thousand square feet which is a small piece of the site over 7 acres in total. the project has been used for 1 hundred years and the light industrial zoning was reaffirmed in 2008 arrest as corey noted under this zoning there are permitted conditional use because we're intensifying it by expanding the generate yard. we've asked for racked parking
12:39 pm
issues. we have 1 hundred and 25 page lengthy this covers the air and annoys reports that were conducted under the departments supervision. the project has no significant environmental impacts that can't be mitigated through certain measures. the project will ultimately result if in an overall reduction of emissions because of the clean technology of the new generators. the project is applicable to the site as the departments materials show the project essentialists the criteria for conditional use authorization including the other criteria.
12:40 pm
the policy is in code with the commerce and industry and community safety element to the plan. it will not have a significant impact on the environment. in connection with the safety element i want to emphasis that having redundancy those generators will help to insure with the city infrastructure remains operable following an emergency. quite a few of the of the facilities have the serves. therefore i ask you to granlt the use of the authorization in that regard, i. asking for one small change. the actual generators and some of the infrastructure will be installed over a 12 year period
12:41 pm
and we would like the conditions of approvals clarified to state we can continue to install the generators so long as we pull the site permit and within the 3 year time period. this is intended to help us out if five or six years small business asks us if we'll knighthood with the conditions >> opening it up for public comment. i have one speaker card. john >> good afternoon thank you very much for seeing me today. i'm an engineering manager for t mobile and i'm responsible for the area of my expertise is the power and space.
12:42 pm
we've been attending paul avenue over 10 years. the wireless industry has been a fast growing destroy and on 200 paul avenue we've grown organic storefronts and grown through accusations we want to update this to a more reliable through redundancy to switching over to 2 hundred paul. i hope that you will support us and look forward to working here in san francisco area going forward and i'm available for
12:43 pm
questions and any additional public comment? >> michael san francisco public and trades council. i know you've seen the letter i've sent but those machines you have sitting in front of you those have relied on 2 hundred paul and the shortening the cable between those facilities and the machines is critical to insuring there are fewer possibilities of the signals you all were depending upon on. we might all one of those days hope there's an alternative for diesel such 2 hundred paul but
12:44 pm
right now that's not the case it's diesel and that's why in hospitals it's an emergency back up as well. we could look at fuel cells one day but they're not there >> thank you. >> good afternoon. i'm the kenst i'm the chief financial office i believe you have a letter from me in our packet. i'm here to commend the project sponsor with their engagement in the community. clearly everybody does get what they want but they've gone beyond the preliminaries the department was putting before them and quite honestly do a
12:45 pm
great process. didn't walk away when we could have and this is to be commended and this is an example of how project sponsors do it right. i also want to commend heidi kline and jessica who come out to the bay view and a met with a lot of the people to explain the environmental process and raise the education level base for a lot of us being not educated in this the phrase accommodate active impact means this is going to have a huge impact on things not secret. so a great deal of effort was put in by the department to help the community understand. i do want to call out from the
12:46 pm
memory of understanding something steve doesn't mention. it calls for continuing engagement both in working with the community on the jobs area and exposing members of the community to opportunity in the future. and this is key to our needs and then their commitment to go beyond the requirements to tell you a reduction in pollution from the site and this a pollution hot spot of the city as you know from reading the environmental report. so i'm here to ask our support for the project >> any additional public comment? okay seeing none, public comment is closed commissioner anton all we often have conditional uses
12:47 pm
on projects that is a project that truly is necessary and desirable for many of the reasons already stated and, you know, the fact that it's actually putting in filters and it's go back net zero or less than net zero is going to be an improvement. 3450i7bd it's only 8 generators are tested once a month and usage is around 14 hours per year there will be less noise arrest the cable length from the transmission from the actual user to the back up site has to be fairly close you can't locate it 10 or many miles away.
12:48 pm
in fact, they have another site right across the new project next to infinity next to folsom so it's for those be located, you know, close to where their customers are but this is particularly good it's close to the source of pg&e. and if you go up the peninsula you'll notice the grounded wires are next to the airport and you want to be as cross to those because the diesel will be reinstate on some power. the very fact they're the back up they have to rely on them. it's good this is public works dr 2 it's a company located in san francisco and it serves as
12:49 pm
the emergency services where much of the information that comes into san francisco we're the first source from the many companies and it's essentially this information be able to be abbreviate 3 hundred and 65 days a year so i'm supportive >> it is good i'm glad to hear there's not as much objection this seems to be containing all the answers. perhaps the city attorney should talk about the suggested changes and the motions and the conditions the motions are the same but the conditions might
12:50 pm
change. the sponsor is asking for the conditions that might lead to the authorization be clarified or added to slightly. right now it basically says you commence the project within full permits to commence the project within 3 years then it remains valid so the permits are 3 years but they'll still be valid they're trying to make it clear that the installation of generators morning 3 years would be okay >> then the commencement of the industry is like the new generators would automately be updated after 12 years it will still be the old ones from 2013.
12:51 pm
>> that both be a different kind of condition. i believe what was authorizations under the mitigated desk for the generators if i wanted to apply another condition that would be another condition >> i don't know if we need to condition it because they require permits from back pedestrian so they will get a new permit and that will insure with the most appropriate equipment is in place. >> i have the idea that be cutting-edge at all times i want to raises the question so we at least have an understanding that we remain cutting-edge as the
12:52 pm
technology changes. i'm in support of the project and move to approve >> commissioner. >> yes. do you have a suggested language change in condition 3 or are we just invoicing here as an intent. >> the sponsor has requested the change we don't have any suggested language but if the commission wants to make that change go ahead. >> it's the commissions intention to support the sponsor. >> we can draft that with the commissions pd it will allow up to 12 years to install the back up generators but they still have to get the permit that will be allotted up to 12 years and in addition to the corrections that were noted during his
12:53 pm
presentation as well. >> is that - that's okay with the maker of the motion. >> gentlemen absolutely. >> and the secondary as well. >> commissioners there's a motion a second to approve the conditions and all the time it by the commissioner. on that motion (calling names) so moved commissioners that places you on item 12 for case 20110 z also known as pennsylvania avenue requester to an authorization >> good afternoon president fong corey. the project is a large project
12:54 pm
authorization to demolish the two believes and put up another believe. it will be 44 feet tall and have the vehicle parking spaces in a ground floor parking garage. it will be 40 stories for the other location and will have 8 vehicle parking spaces in a ground floor parking garbage. they have inner courtyards in the rear and there will contain sidewalks. this includes expectations for the composure planning code, however, the current proposal optional requires is rear yard proposal and that's reflected in our package.
12:55 pm
it's along 17 and pennsylvania avenue are to provide 10 foot set back and being slightly raised to provide the transmission space for the dwellings. the building on 171 has a lot area that's covered but the building. please note that the rear yard is only 2 thousand and 75 square feet but that's only for the open space component of the rear yard. the building on 140 pennsylvania avenue represents 25 percent of the lot area covered by the building. they have a second story courtyard, however, it's to be
12:56 pm
provided for a dwelling unit. it provides ground floor units on 17 street and pennsylvania avenue. the rear yard is to be open 25 percent of the lot and it includes building spaces 25 percent of the lot. therefore it requires an exception section 134 to allow the rear yard to gun at the second story instead of the ground floor. it's requested both building meet the composure developments of the planning code. the project is going to provide on site affordable units and it's a tier site within zoning district. and as such the project will provide 5 on site opt.
12:57 pm
please note that the draft notation references there are to be corrected in the final notation. the department received two calls of general inquiry about the project and one letter of opposition. in order for the construction that believe approved it must have an exception to the rear yard. and prudent to planning codes f and 329. the department recommendation the project be approved and it will add 5 affordable units that be transitioning toward more opts. the ground floors will be near pennsylvania avenue and otherwise actuate those uncles.
12:58 pm
it currently lacks streetscape features and the promise proposes a high quality design that is consistent with the design code and the general plan overall. that concludes my presentation >> project sponsor, please. >> good afternoon, commissioners i'm kidnap i'm with valleytion. i have a power point presentation i'm loading up right now.
12:59 pm
sow there's kind of a running joke in the development community in san francisco that can take a a lot of time to see a project to fruition and this is the poster child of that statement. just to give you an idea background of the project it was first submitted in the year 2000 clinton was pointing and willie brown was mayor and i couldn't legally drink alcohol. it was submitted in the beginning as a big 5 story commercial building at 68 thousand square feet and had 68
1:00 pm
thousand parker spaces and the desk was given in november 17th of 2000 but, of course, since 13 then e then there was the.com bubble and 9-1-1 happened to the project was on hold. so 2378 in 2005 it was resubmitted this time as a two building residential with 48 units and it was 52 thousand square feet 5 stories and zero bicycle spaces and the final negative desk was issued in 2005. but, of course, right now right after that in february 2006 had a moratorium so the project was again on hold. and in 2008 we had an
